SA 3159. Mr. TUBERVILLE submitted an amendment intended to be
proposed by him to the bill S. 2296, to authorize appropriations for
fiscal year 2026 for military activities of the Department of Defense,
for military construction, and for defense activities of the Department
of Energy, to prescribe military personnel strengths for such fiscal
year, and for other purposes; which was ordered to lie on the table; as
follows:
At the appropriate place in title XI, insert the following:
SEC. __. CIVILIAN PERSONNEL MANAGEMENT REPEAL.
(a) In General.--Section 129 of title 10, United States
Code, is repealed.
(b) Clerical Amendment.--The table of sections at the
beginning of chapter 3 of such title is amended by striking
the item relating to section 129.
(c) Conforming Amendments to Title 10.--
(1) Section 115.--Section 115(d) of such title is amended
by striking ``This subsection applies without regard to
section 129 of this title.''.
(2) Section 129a.--Section 129a(g)(1)(B)(ii) of such title
is amended by striking ``and section 129 of this title''.
(3) Section 1597.--Section 1597(b) of such title is
amended, in the matter preceding paragraph (1), by striking
``the requirements of section 129 of this title or''.
(4) Section 2476.--Section 2476(c) of such title is amended
by striking ``sections 129 and 129a'' and inserting ``section
129a''.
SEC. __. MODIFICATIONS TO GENERAL POLICY FOR TOTAL FORCE
MANAGEMENT.
Section 129a of title 10, United States Code, is amended--
(1) in subsection (b), by striking ``The Secretary may not
reduce'' and all that follows through ``burdened costs.'';
(2) by striking subsections (c) through (f);
(3) by redesignating subsection (g) as subsection (c); and
(4) in subsection (c), as so redesignated, in paragraph
(1)--
(A) by striking ``except'' and all that follows through
``determines in writing'' and inserting ``except if the
Secretary of the military department concerned determines'';
(B) by striking ``; or'' and inserting a period; and
(C) by striking subparagraph (B).
