  SA 2969. Mr. WELCH (for himself, Mr. Tillis, Ms. Klobuchar, and Mrs. 
Gillibrand) submitted an amendment intended to be proposed by him to 
the bill S. 2296, to authorize appropriations for fiscal year 2026 for 
military activities of the Department of Defense, for military 
construction, and for defense activities of the Department of Energy, 
to prescribe military personnel strengths for such fiscal year, and for 
other purposes; which was ordered to lie on the table; as follows:

        Strike section 313 and insert the following:

     SEC. 313. USE OF SOLID WASTE DISPOSAL SYSTEMS BY DEPARTMENT 
                   OF DEFENSE.

       (a) Expeditionary Solid Waste Disposal Systems.--
       (1) In general.--The Secretary of Defense may use 
     expeditionary solid waste disposal systems for the 
     destruction of illicit contraband, including seized 
     counterfeit materials, unauthorized military gear, and 
     classified materials.
       (2) Availability of systems.--The expeditionary solid waste 
     disposal systems units deployed under subsection (a) shall 
     be--
       (A) equipped to support operations related to border 
     security and the elimination of contraband; and
       (B) made available to military installations, forward 
     operating bases, and partner security forces as needed to 
     assist in countering infiltration and unauthorized use of 
     military assets of the United States.
       (b) Prohibition on Use of Open-air Burn Pits to Dispose of 
     Certain Material.--The Secretary of Defense may not use open-
     air burn pits for the disposal of illicit contraband, 
     classified military equipment, or hazardous waste materials.
       (c) Funding.--

       (1) In general.--The amount authorized to be appropriated 
     by section 101 for Other Procurement, Army, for Modification 
     of In-Svc Equipment, as specified in the funding table in 
     section 4101, is hereby increased by $8,950,000, with the 
     amount of the increase to be available for solid waste 
     disposal systems, including expeditionary solid waste 
     disposal systems capable of destroying not only traditional 
     waste but also seized contraband, including illicit drugs, 
     counterfeit United States currency and documents, 
     unauthorized military equipment, and classified materials 
     that pose a security threat.
       (2) Offset.--The amount authorized to be appropriated by 
     section 301 for Operations and Maintenance, Army, for 
     Additional Activities, as specified in the funding table in 
     section 4301, is hereby reduced by $8,950,000, with the 
     amount of the reduction to be derived from amounts for the 
     use of open-air burn pits in contingency operations.
