  SA 2765. Mr. MARKEY submitted an amendment intended to be proposed to 
amendment SA 2360 proposed by Mr. Thune (for Mr. Graham) to the bill 
H.R. 1, to provide for reconciliation pursuant to title II of H. Con. 
Res. 14; which was ordered to lie on the table; as follows:

        At the appropriate place, insert the following:

     SEC. ___. HOSPITAL CLOSURES.

       Beginning on the date that is 1 year after the date of 
     enactment of this Act, any provision that modifies the 
     Medicare program under title XVIII of the Social Security Act 
     (42 U.S.C. 1395 et seq.), modifies the Medicaid program under 
     title XIX of such Act (42 U.S.C. 1396 et seq.), or affects 
     eligibility or payments to States under the Patient 
     Protection and Affordable Care Act shall be repealed and the 
     Social Security Act and the Patient Protection and Affordable 
     Care Act shall be applied as if such amendments had not been 
     enacted if the following occurs:
       (1) A hospital closes, as determined by such hospital 
     submitting a voluntary termination of participation in the 
     Medicare program to the Centers for Medicare & Medicaid 
     Services.
       (2) A hospital converts to a rural emergency hospital (as 
     defined by section 1861(kkk)(2) of the Social Security Act 
     (42 U.S.C. 1395x(kkk)(2))), as detailed in the report 
     submitted by the Medicare Payment Advisory Commission under 
     section 1805(b)(1)(C) of such Act (42 U.S.C. 1395b-
     6(b)(1)(C)).
       (3) There is an increase in emergency Medicaid payments 
     compared to the year prior to the date of enactment of this 
     Act.
       (4) There is an increase in disproportionate share hospital 
     payments compared to the year prior to the date of enactment 
     of this Act.
