  SA 2581. Mr. SCHATZ submitted an amendment intended to be proposed to 
amendment SA 2360 proposed by Mr. Thune (for Mr. Graham) to the bill 
H.R. 1, to provide for reconciliation pursuant to title II of H. Con. 
Res. 14; which was ordered to lie on the table; as follows:

        At the appropriate place, insert the following:

     SEC. __. EXEMPTION FOR MEDICINE AND MEDICAL PRODUCTS FROM 
                   DUTIES IMPOSED PURSUANT TO NATIONAL EMERGENCY 
                   DECLARATION.

       (a) In General.--Duties imposed pursuant to the national 
     emergency declared in Executive Order 14257 (90 Fed. Reg. 
     15041; relating to regulating imports with a reciprocal 
     tariff to rectify trade practices that contribute to large 
     and persistent annual United States goods trade deficits) 
     shall not apply with respect to medicine and medical 
     products.
       (b) Definitions.--In this section:
       (1) Medical product.--The term ``medical product'' means--
       (A) personal protective equipment, as defined by the 
     Commissioner of Food and Drugs, which may include protective 
     clothing, helmets, gloves, face shields, goggles, facemasks 
     or respirators, or other equipment designed to protect the 
     wearer from injury or the spread of infection or illness; or
       (B) a device, as defined in section 201 of the Federal 
     Food, Drug, and Cosmetic Act (21 U.S.C. 321).
       (2) Medicine.--The term ``medicine'' has the meaning given 
     the term ``drug'' in section 201 of the Federal Food, Drug, 
     and Cosmetic Act (21 U.S.C. 321).
