  SA 1234. Mr. BOOKER submitted an amendment intended to be proposed by 
him to the bill S. 331, to amend the Controlled Substances Act with 
respect to the scheduling of fentanyl-related substances, and for other 
purposes; which was ordered to lie on the table; as follows:

       In subsection (e) of section 202(c) of the Controlled 
     Substances Act (21 U.S.C. 812(c)), as added by section 2, 
     strike paragraph (2) and insert the following:
       ``(2) For purposes of paragraph (1), except as provided in 
     paragraph (3), the term `fentanyl-related substance' means 
     any substance that--
       ``(A) is an opioid mu receptor agonist with potential for 
     misuse or abuse, as demonstrated by binding studies and 
     functional assays; and
       ``(B) is structurally related to fentanyl by 1 or more of 
     the following modifications:
       ``(i) By replacement of the phenyl portion of the phenethyl 
     group by any monocycle,

     whether or not further substituted in or on the monocycle.
       ``(ii) By substitution in or on the phenethyl group with 
     alkyl, alkenyl, alkoxyl, hydroxyl, halo, haloalkyl, amino, or 
     nitro groups.
       ``(iii) By substitution in or on the piperidine ring with 
     alkyl, alkenyl, alkoxyl, ester, ether, hydroxyl, halo, 
     haloalkyl, amino, or nitro groups.
       ``(iv) By replacement of the aniline ring with any aromatic 
     monocycle whether or not further substituted in or on the 
     aromatic monocycle.
       ``(v) By replacement of the N-propionyl group with another 
     acyl group.
