  SA 1231. Mr. WELCH (for himself, Mr. Padilla, Ms. Hirono, Mr. Booker, 
Mr. Markey, Mr. Blumenthal, Mr. Schiff, and Mr. Wyden) submitted an 
amendment intended to be proposed by him to the bill S. 331, to amend 
the Controlled Substances Act with respect to the scheduling of 
fentanyl-related substances, and for other purposes; which was ordered 
to lie on the table; as follows:

       At the appropriate place, insert the following:

     SEC. ____. ACCESS TO DRUG TESTING TECHNOLOGIES.

       (a) Definitions.--In this section:
       (1) Life-saving drug testing technologies.--The term 
     ``life-saving drug testing technologies'' means devices, 
     including test strips, that can detect the presence of 
     fentanyl, xylazine, or other adulterants in drug samples 
     prior to use.
       (2) State.--The term ``State'' means a State of the United 
     States, the District of Columbia, and any commonwealth, 
     territory, or possession of the United States.
       (b) Access to Drug Testing Technologies.--A State--
       (1) shall not prohibit an individual from obtaining, 
     possessing, distributing, or using life-saving drug testing 
     technologies; and
       (2) shall not prosecute an individual solely for obtaining, 
     possessing, distributing, or using life-saving drug testing 
     technologies.
