  SA 93. Mr. REED submitted an amendment intended to be proposed to 
amendment SA 75 submitted by Mr. Schmitt and intended to be proposed to 
the bill S. 5, to require the Secretary of Homeland Security to take 
into custody aliens who have been charged in the United States with 
theft, and for other purposes; which was ordered to lie on the table; 
as follows:

       In lieu of the matter proposed to be added, add the 
     following:

     SEC. 4. PROHIBITION ON UNFUNDED MANDATES.

       This Act, and the amendments made by this Act, shall not 
     impose any unfunded mandate on any State or local government 
     relating to the detention of aliens under section 
     236(c)(1)(E) of the Immigration and National Act, as added by 
     section 2.
