AMENDING TITLE 35, UNITED STATES CODE, TO PROVIDE A GOOD FAITH
EXCEPTION TO THE IMPOSITION OF FINES FOR FALSE ASSERTIONS AND
CERTIFICATIONS
Ms. CANTWELL. Madam President, I ask unanimous consent that the
Committee on the Judiciary be discharged from further consideration of
S. 3960 and the Senate proceed to its immediate consideration.

The senior assistant legislative clerk read as follows:
A bill (S. 3960) to amend title 35, United States Code, to
provide a good faith exception to the imposition of fines for
false assertions and certifications, and for other purposes.
There being no objection, the committee was discharged, and the
Senate proceeded to consider the bill.

read a third time and passed and that the motion to reconsider be
considered made and laid upon the table.

Be it enacted by the Senate and House of Representatives of
the United States of America in Congress assembled,
SECTION 1. GOOD FAITH EXCEPTION TO THE IMPOSITION OF CERTAIN
FINES.
Title 35, United States Code, is amended--
(1) in section 41(j), by inserting ``, unless the entity
shows that the assertion was made in good faith,'' before
``be subject''; and
(2) in section 123(f), by inserting ``, unless the entity
shows that the certification was made in good faith,'' before
``be subject''.
