                  FOURTH AMENDMENT IS NOT FOR SALE ACT

  The SPEAKER pro tempore. Pursuant to House Resolution 1149 and rule 
XVIII, the Chair declares the House in the Committee of the Whole House 
on the state of the Union for the further consideration of the bill, 
H.R. 4639.

  Accordingly, the House resolved itself into the Committee of the 
Whole House on the state of the Union for the further consideration of 
the bill (H.R. 4639) to amend section 2702 of title 18, United States 
Code, to prevent law enforcement and intelligence agencies from 
obtaining subscriber or customer records in exchange for anything of 
value, to address communications and records in the possession of 
intermediary internet service providers, and for other purposes, with 
Mr. Ellzey in the chair.
  The Clerk read the title of the bill.
  The Acting CHAIR. When the Committee of the Whole House rose earlier 
today, a request for a recorded vote on amendment No. 3 printed in 
House Report 118-464 offered by the gentleman of New York (Mr. LaLota) 
had been postponed.
