  SA 1654. Mr. BUDD submitted an amendment intended to be proposed by 
him to the bill H.R. 4366, making appropriations for military 
construction, the Department of Veterans Affairs, and related agencies 
for the fiscal year ending September 30, 2024, and for other purposes; 
which was ordered to lie on the table; as follows:

       At the appropriate place, insert the following:
       Sec. __.  Notwithstanding any other provision of law, none 
     of the amounts appropriated or otherwise made available by 
     any division of this Act may be obligated or expended to 
     issue an interim or final rule that amends or replaces the 
     rule on speed restrictions to protect North Atlantic Right 
     Whales under section 224.105 of title 50, Code of Federal 
     Regulations, as in effect on January 3, 2023, until the date 
     on which--
       (1) the mitigation protocols required under section 
     11303(e) of the Don Young Coast Guard Authorization Act of 
     2022 (16 U.S.C. 1391(e)) have been fully developed and 
     deployed; and
       (2) the Secretary of Commerce has submitted a report on how 
     the mitigation protocols will inform any proposed changes to 
     section 224.105 of title 50, Code of Federal Regulations, 
     to--
       (A) the Committee on Appropriations and the Committee on 
     Commerce, Science, and Transportation of the Senate; and
       (B) the Committee on Appropriations and the Committee on 
     Natural Resources of the House of Representatives.
