  SA 1201. Mr. KENNEDY (for himself, Mr. Moran, Mr. Braun, Mr. Daines, 
Mr. Cramer, and Mr. Rounds) submitted an amendment intended to be 
proposed to amendment SA 1092 proposed by Mrs. Murray (for herself and 
Ms. Collins) to the bill H.R. 4366, making appropriations for military 
construction, the Department of Veterans Affairs, and related agencies 
for the fiscal year ending September 30, 2024, and for other purposes; 
which was ordered to lie on the table; as follows:

        At the appropriate place in division A, insert the 
     following:

     SEC. ___. PROHIBITION ON AVAILABILITY OF FUNDS FOR SECRETARY 
                   OF VETERANS AFFAIRS TO REPORT CERTAIN 
                   INFORMATION TO NATIONAL INSTANT CRIMINAL 
                   BACKGROUND CHECK SYSTEM.

       None of the funds made available by this Act for the 
     Department of Veterans Affairs may be obligated or expended 
     for the Secretary of Veterans Affairs to report a 
     determination under section 5502 of title 38, United States 
     Code, and section 3.353 of title 38, Code of Federal 
     Regulations, to the Department of Justice for use by the 
     national instant criminal background check system established 
     pursuant to section 103 of the Brady Handgun Violence 
     Prevention Act (34 U.S.C. 40901).
