SA 50. Mr. BRAUN submitted an amendment intended to be proposed by
him to the concurrent resolution S. Con. Res. 5, setting forth the
congressional budget for the United States Government for fiscal year
2021 and setting forth the appropriate budgetary levels for fiscal
years 2022 through 2030; which was ordered to lie on the table; as
follows:
At the end of title III, add the following:
SEC. 3___. DEFICIT-NEUTRAL RESERVE FUND RELATING TO DETERRING
THE ELIMINATION OF THE TIP CREDIT UNDER THE
FAIR LABOR STANDARDS ACT OF 1938 DURING A
FEDERALLY DECLARED EMERGENCY WITH RESPECT TO
COVID-19.
(a) In General.--The Chairman of the Committee on the
Budget of the Senate may revise the allocations of a
committee or committees, aggregates, and other appropriate
levels in this resolution, and make adjustments to the pay-
as-you-go ledger, for one or more bills, joint resolutions,
amendments, amendments between the Houses, motions, or
conference reports relating to deterring the elimination of
the tip credit under section 3(m) of the Fair Labor Standards
Act of 1938 (29 U.S.C. 203(m)) during a federally declared
emergency with respect to COVID-19 by the amounts provided in
such legislation for those purposes, provided that such
legislation would not increase the deficit over either the
period of the total of fiscal years 2021 through 2025 or the
period of the total of fiscal years 2021 through 2030.
(b) Definition of Federally Declared Emergency With Respect
to COVID-19.--In this section, the term ``federally declared
emergency with respect to COVID-19'' means any of the
following:
(1) The emergency involving Federal primary responsibility
determined to exist by the President under section 501(b) of
the Robert T. Stafford Disaster Relief and Emergency
Assistance Act (42 U.S.C. 5191(b)) with respect to the
Coronavirus Disease 2019 (COVID-19).
(2) The national emergency declared by the President under
the National Emergencies Act (50 U.S.C. 1601 et seq.) with
respect to the Coronavirus Disease 2019 (COVID-19).
(3) The public health emergency declared by the Secretary
of Health and Human Services under section 319 of the Public
Health Service Act (42 U.S.C. 247d) on January 31, 2020, with
respect to COVID-19.
