  SA 23. Mr. LEE submitted an amendment intended to be proposed to 
amendment SA 5 proposed by Mr. McConnell (for Mr. Shelby) to the bill 
H.R. 268, making supplemental appropriations for the fiscal year ending 
September 30, 2019, and for other purposes; which was ordered to lie on 
the table; as follows:

       At the appropriate place, insert the following:
       Sec. 2__.  Notwithstanding any other provision of this Act, 
     nothing in this Act may be construed to preclude U.S. Customs 
     and Border Protection from using amounts appropriated for 
     border fencing under this Act--
       (1) for the procurement, construction, or improvement of 
     border barriers, fencing, or security technology based on 
     designs deployed before the date of the enactment of the 
     Department of Homeland Security Appropriations Act, 2017 
     (division F of Public Law 115-31), or on designs deployed 
     after such date; or
       (2) for the construction of border barriers, fencing, or 
     security technology in the Santa Ana National Wildlife 
     Refuge.
