SA 2816. Mr. PORTMAN (for himself and Mr. Brown) submitted an
amendment intended to be proposed to amendment SA 2282 proposed by Mr.
Inhofe (for himself and Mr. McCain) to the bill H.R. 5515, to authorize
appropriations for fiscal year 2019 for military activities of the
Department of Defense, for military construction, and for defense
activities of the Department of Energy, to prescribe military personnel
strengths for such fiscal year, and for other purposes; which was
ordered to lie on the table; as follows:
Strike section 893 and insert the following:
SEC. 893. PERMANENT SBIR AND STTR AUTHORITY FOR THE
DEPARTMENT OF DEFENSE AND PILOT PROGRAM
EXTENSION.
Section 9 of the Small Business Act (15 U.S.C. 638) is
amended--
(1) in subsection (f)--
(A) in paragraph (2), by striking ``shall not'' and all
that follows through ``make available'' and inserting ``shall
not make available''; and
(B) by adding at the end the following:
``(5) Administrative costs.--A Federal agency may use up to
3 percent of its SBIR budget established pursuant to
paragraph (1) for the purpose of funding administrative costs
of the program.'';
(2) in subsection (m), by inserting ``, except with respect
to the Department of Defense'' after ``September 30, 2022'';
(3) in subsection (n)--
(A) in paragraph (1)(A)--
(i) by inserting ``(or, with respect to the Department of
Defense, any fiscal year)'' after ``2022''; and
(ii) by inserting ``(or, with respect to the Department of
Defense, for any fiscal year)'' after ``for that fiscal
year'';
(B) in paragraph (2), by striking ``shall not'' and all
that follows through ``make available'' and inserting ``shall
not make available''; and
(C) by adding at the end the following:

``(4) Administrative costs.--A Federal agency may use up to
3 percent of its SBIR budget established pursuant to
paragraph (1) for the purpose of funding administrative costs
of the program.''; and
(4) in subsection (cc), by striking ``During fiscal years''
and all that follows through ``may each provide'' and
inserting ``During fiscal years 2018 through 2022, each
Federal agency participating in the SBIR program may
provide''.
