SA 1107. Mrs. FISCHER submitted an amendment intended to be proposed
by her to the bill H.R. 3823, to amend title 49, United States Code, to
extend authorizations for the airport improvement program, to amend the
Internal Revenue Code of 1986 to extend the funding and expenditure
authority of the Airport and Airway Trust Fund, to provide disaster tax
relief, and for other purposes; which was ordered to lie on the table;
as follows:

At the appropriate place, insert the following:
SEC. __. FEDERAL AUTHORITY OVER INTERSTATE TRANSPORTATION.
(a) In General.--Section 14501(c) of title 49, United
States Code, is amended--
(1) in paragraph (2), by striking ``Paragraph (1)'' and
inserting ``Paragraphs (1) and (6)'';
(2) in paragraph (3)(A), by striking ``Paragraph (1)'' and
inserting ``Paragraphs (1) and (6)''; and
(3) by adding at the end the following:
``(6) Additional limitations.--
``(A) In general.--A State, a political subdivision of a
State, or a political authority composed of 2 or more States
may not enact or enforce a law, regulation, or other
provision having the force and effect of law relating to meal
or rest breaks applicable to employees whose hours of service
are subject to regulation by the Secretary under section
31502.
``(B) Savings provision.--Nothing in this paragraph may be
construed to limit the provisions under paragraph (1).''.
(b) Effective Date.--The amendments made by this section
shall have the force and effect as if enacted on the date of
the enactment of the Federal Aviation Administration
Authorization Act of 1994 (Public Law 103-305).
