SA 5031. Mr. CORNYN submitted an amendment intended to be proposed to
amendment SA 4979 proposed by Mr. McConnell (for Mr. Inhofe (for
himself and Mrs. Boxer)) to the bill S. 2848, to provide for the
conservation and development of water and related resources, to
authorize the Secretary of the Army to construct various projects for
improvements to rivers and harbors of the United States, and for other
purposes; which was ordered to lie on the table; as follows:
At the end of title I, add the following:
SEC. 10__. CONVERSION OF SURPLUS WATER AGREEMENTS.
Section 6 of the Act of December 22, 1944 (33 U.S.C. 708),
is amended--
(1) by striking ``sec. 6. That the Secretary'' and
inserting the following:
``SEC. 6. SALE OF SURPLUS WATERS FOR DOMESTIC AND INDUSTRIAL
USES.
``(a) In General.--The Secretary''; and
(2) by adding at the end the following:
``(b) Permanent Storage Agreements.--In any case in which a
water supply agreement with a duration of 30 years or longer
was predicated on water that was surplus to a purpose and
provided for the complete payment of the actual investment
costs of storage to be used, and that purpose is no longer
authorized, the Secretary of the Army shall provide to the
non-Federal entity an opportunity to convert the agreement to
a permanent storage agreement in accordance with section 301
of the Water Supply Act of 1958 (43 U.S.C. 390b), with the
same payment terms incorporated in the agreement.''.
