  SA 5027. Mr. DAINES submitted an amendment intended to be proposed to 
amendment SA 4979 proposed by Mr. McConnell (for Mr. Inhofe (for 
himself and Mrs. Boxer)) to the bill S. 2848, to provide for the 
conservation and development of water and related resources, to 
authorize the Secretary of the Army to construct various projects for 
improvements to rivers and harbors of the United States, and for other 
purposes; which was ordered to lie on the table; as follows:

       At the end of title I, add the following:

     SEC. 10__. ENVIRONMENTAL REVIEW OF ENERGY EXPORT FACILITIES.

       To the extent that the National Environmental Policy Act of 
     1969 (42 U.S.C. 4321 et seq.) applies to the issuance of a 
     permit for the construction, operation, or maintenance of a 
     facility for the export of bulk commodities (including any 
     permit denied by the Corps of Engineers in a letter dated May 
     9, 2016), the permit shall not be considered denied until 
     each applicable Federal agency has completed all reviews 
     required for the facility under that Act.
