Mrs. HARTZLER changed her vote from ``nay'' to ``yea.''
So (two-thirds being in the affirmative) the rules were suspended and
the bill was passed.
The result of the vote was announced as above recorded.
A motion to reconsider was laid on the table.
  Stated for:
Mrs. NAPOLITANO. Mr. Speaker, on Monday, April 16, 2012, I was absent
during rollcall vote No. 153 due to a family health emergency. Had I
been present, I would have voted ``yea'' on suspending the rules and
agreeing to H.R. 4040--To provide for the award of a gold medal on
behalf of Congress

to Jack Nicklaus in recognition of his service to the Nation in
promoting excellence and good sportsmanship in golf.
Mr. FILNER. Mr. Speaker, on rollcall 153, I was away from the Capitol
due to prior commitments to my constituents. Had I been present, I
would have voted ``yea.''
Mr. JOHNSON of Illinois. Mr. Speaker, on Monday, April 16, 2012 I had
a previously scheduled meeting with constituents in Ogden, Illinois. As
a result, I am unable to attend votes this evening. Had I been present,
I would have voted ``yea'' on H.R. 3001, the Raoul Wallenberg
Centennial Celebration Act; and ``yea'' on H.R. 4040, to provide for
the award of a gold medal on behalf of Congress to Jack Nicklaus in
recognition of his service to the Nation in promoting excellence and
good sportsmanship in golf.

                          personal explanation

Mr. GUTIERREZ. Mr. Speaker, I was unavoidably absent for votes in the
House chamber today. Had I been present, I would have voted ``yea'' on
rollcall votes 152 and 153.
