PROTOCOL AMENDING TAX CONVENTION WITH NEW ZEALAND
Mr. DORGAN. Mr. President, I ask unanimous consent that the Senate
proceed to executive session to consider Calendar Nos. 3 and 4, treaty
documents 111-1 and 111-3; that the treaties be considered as having
advanced through the various parliamentary stages up to and including
the presentation of the resolution of ratification; that any committee
reservations and declarations be agreed to as applicable; that any
statements be printed in the Record; further, that when the votes on
the resolutions of ratification are taken, the motions to reconsider be
considered made and laid upon the table en bloc; that the President be
immediately notified of the Senate's action, and the Senate then resume
legislative session.

Mr. DORGAN. Mr. President, I ask for a division vote on each of the
resolutions of ratification.
The PRESIDING OFFICER. A division vote has been requested. On treaty
document 111-1, all those in favor stand and be counted.
All those opposed stand and be counted.
On a division, two-thirds of the Senators present having voted in the
affirmative, the resolution of ratification on treaty document 111-1 is
agreed to.
The question is now on treaty document 111-3. All those in favor
stand and be counted.

Two-thirds of the Senators present having voted in the affirmative,
the resolution of ratification is agreed to.
Under the previous order, the motions to reconsider are considered

The Senate advises and consents to the ratification of the
Convention Between the Government of the United States of
America and the Government of Malta for the Avoidance of
Double Taxation and the Prevention of Fiscal Evasion with
Respect to Taxes on Income, signed on August 8, 2008, at
Valletta (the ``Convention'') (Treaty Doc. 111-1), subject to
the declaration of section 2.
SECTION 2. DECLARATION
The advice and consent of the Senate under section 1 is
subject to the following declaration:
The Convention is self-executing.

Text of Resolution of Advice and Consent to Ratification
SECTION 1. SENATE ADVICE AND CONSENT SUBJECT TO A
DECLARATION
The Senate advises and consents to the ratification of the
Protocol Amending the Convention between the United States of
America and New Zealand for the Avoidance of Double Taxation
and the Prevention of Fiscal Evasion with Respect to Taxes on
Income, signed on December 1, 2008, at Washington (the
``Protocol'') (Treaty Doc. 111-3), subject to the declaration
of section 2.
SECTION 2. DECLARATION
The advice and consent of the Senate under section 1 is
subject to the following declaration:
The Protocol is self-executing.
