INTRODUCTORY NOTE
The Committee on Transportation and Infrastructure is
pleased to publish the Safe, Accountable, Flexible, Efficient
Transportation Equity Act: A Legacy for Users ("SAFETEA-LU")
Technical Corrections Act of 2008.
It is my hope that this Committee Print and the
accompanying joint explanatory materials will be useful in
interpreting this legislation. These materials were printed
contemporaneously with the passage of the SAFETEA-LU Technical
Corrections Act of 2008 in the Congressional Record on April
30, 2008. This legislation amends the Safe, Accountable,
Flexible, Efficient Transportation Equity Act: A Legacy for
Users (Public Law 109-59) to make technical corrections
addressing drafting, technical, and funding errors identified
in SAFETEA-LU.
This law is the result of an almost two-year bipartisan
effort to rectify these errors so that Federal surface
transportation programs, policies and projects are consistent
with the agreements that were reached in SAFETEA-LU and can be
implemented as intended by Congress.
During the 109th Congress, on June 27, 2006, the
bipartisan leadership of the Committee on Transportation and
Infrastructure introduced H.R. 5689, a bill to make technical
corrections to SAFETEA-LU, which passed the House by voice vote
on June 28, 2006. On September 14, 2006, the Senate Committee
on Environment and Public Works reported H.R. 5689 with an
amendment in the nature of a substitute, unfortunately the full
Senate never considered the legislation.
On September 29, 2006, the bipartisan leadership of the
Committee on Transportation and Infrastructure introduced H.R.
6233. The legislation included provisions from the previously
passed House bill (H.R. 5689), as well a number of provisions
included at the request of the Senate. On September 29, 2006,
the House passed H.R. 6233 by voice vote. This measure was not
addressed by the Senate.
In the 110th Congress, on February 27, 2007, the
bipartisan leadership of the Committee on Transportation and
Infrastructure introduced H.R. 1195, a bill to make technical
corrections to SAFETEA-LU and based upon H.R. 6233 from the
109th Congress. H.R. 1195 passed the House by voice vote on
March 26, 2007.
The Senate Committee on Environment and Public Works
approved H.R. 1195 with an amendment in the nature of a
substitute on June 6, 2007. The Senate Committee on Banking,
Housing, and Urban Affairs reported S. 1611, a bill to make
technical corrections to the public transportation provisions
of SAFETEA-LU on June 13, 2007.
On July 31, 2007, the bipartisan leadership of the
Committee on Transportation and Infrastructure introduced H.R.
3248, the "SAFETEA-LU Technical Corrections Act of 2007". H.R.
3248 represented a bipartisan, bicameral agreement on these
issues among the bipartisan leaderships of the Committee on
Transportation and Infrastructure of the House of
Representatives and the Committees on Environment and Public
Works, Banking, Housing, and Urban Affairs, and Commerce,
Science, and Transportation of the Senate. H.R. 3248 passed the
House by a vote of 422-1 on August 1, 2007.
On March 7, 2008, the Senate Committee on Environment
and Public Works met again to consider H.R. 1195, the "SAFETEA-
LU Technical Corrections Act of 2008", and reported the bill
with an amendment in the nature of a substitute, which included
the agreements that were part of H.R. 3248.
The Senate passed H.R. 1195, as amended, by a vote of
88-2 on April 17, 2008. The House voted to suspend the rules
and agree to the Senate amendment by a vote of 358-51 on April
30, 2008.
On June 6, 2008, H.R.1195, as amended, was signed by
the President and became Public Law 110-244.
SAFETEA-LU has been very successful and effective.
Building on previous surface transportation acts, SAFETEA-LU
provides the programmatic framework and investments necessary
to begin addressing the nation's growing surface transportation
needs. However, as with any legislation of this magnitude,
there were inadvertent drafting errors. The changes in Public
Law 110-244 will ensure that all policies, programs, and
projects embodied in the authorization act reflect the
agreements reached in the development of SAFETEA-LU, and are
implemented as intended by Congress.
