    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To prevent the termination of the temporary office of bankruptcy judges in certain judicial districts.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/112/121/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t28/s1">28 U.S.C. 1 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Temporary Bankruptcy Judgeships Extension Act of 2012</inline></shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/112/121/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t28/s152">28 U.S.C. 152 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">EXTENSION OF TEMPORARY OFFICE OF BANKRUPTCY JUDGES IN CERTAIN JUDICIAL DISTRICTS. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/121/s2/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Temporary Office of Bankruptcy Judges Authorized by Public Law 109-8.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/121/s2/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Extensions.—</heading><chapeau style="-uslm-dtd:text">The temporary office of bankruptcy judges authorized for the following districts by section 1223(b) of Public Law 109-8 (28 U.S.C. 152 note) are extended until the applicable vacancy specified in paragraph (2) in the office of a bankruptcy judge for the respective district occurs:</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">The central district of California.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">The eastern district of California.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/1/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">The district of Delaware.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/1/D" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">The southern district of Florida.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/1/E" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">The southern district of Georgia.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/1/F" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">The district of Maryland.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/1/G" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">The eastern district of Michigan.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/1/H" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="H">(H) </num><content style="-uslm-dtd:text">The district of New Jersey.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/1/I" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">The northern district of New York.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/1/J" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="J">(J) </num><content style="-uslm-dtd:text">The eastern district of North Carolina.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/1/K" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="K">(K) </num><content style="-uslm-dtd:text">The eastern district of Pennsylvania.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/1/L" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="L">(L) </num><content style="-uslm-dtd:text">The middle district of Pennsylvania.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/1/M" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="M">(M) </num><content style="-uslm-dtd:text">The district of Puerto Rico.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/1/N" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="N">(N) </num><content style="-uslm-dtd:text">The district of South Carolina.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/1/O" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="O">(O) </num><content style="-uslm-dtd:text">The western district of Tennessee.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/1/P" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="P">(P) </num><content style="-uslm-dtd:text">The eastern district of Virginia.</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/1/Q" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="Q">(Q) </num><content style="-uslm-dtd:text">The district of Nevada.</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/121/s2/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Vacancies.—</heading>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Single vacancies.—</heading><chapeau style="-uslm-dtd:text">Except as provided in subparagraphs (B), (C), (D), (E), (F), (G), and (H), the 1st vacancy in the office of a bankruptcy judge for each district specified in paragraph (1)—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/a/2/A/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">occurring more than 5 years after the date of the enactment of this Act, and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/a/2/A/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</content>
                        </clause><continuation style="-uslm-dtd:continuation-text" role="subparagraph">shall not be filled.</continuation>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Central district of california.—</heading><chapeau style="-uslm-dtd:text">The 1st, 2d, and 3d vacancies in the office of a bankruptcy judge for the central district of California—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/a/2/B/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">occurring 5 years or more after the date of the enactment of this Act, and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/a/2/B/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</content>
                        </clause><continuation style="-uslm-dtd:continuation-text" role="subparagraph">shall not be filled.</continuation>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/2/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">District of delaware.—</heading><chapeau style="-uslm-dtd:text">The 1st, 2d, 3d, and 4th vacancies in the office of a bankruptcy judge for the district of Delaware—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/a/2/C/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">in the case of the 1st and 2d vacancies, occurring more than 6 years after the date of the enactment of this Act,</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/a/2/C/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">in the case of the 3d and 4th vacancies, occurring more than 5 years after the date of the enactment of this Act, and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/a/2/C/iii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</content>
                        </clause><continuation style="-uslm-dtd:continuation-text" role="subparagraph">shall not be filled.</continuation>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/2/D" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">Southern district of florida.—</heading><chapeau style="-uslm-dtd:text">The 1st and 2d vacancies in the office of a bankruptcy judge for the southern district of Florida—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/a/2/D/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">occurring more than 6 years after the date of the enactment of this Act, and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/a/2/D/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</content>
                        </clause><continuation style="-uslm-dtd:continuation-text" role="subparagraph">shall not be filled.</continuation>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/2/E" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><heading style="-uslm-dtd:header">District of maryland.—</heading><chapeau style="-uslm-dtd:text">The 1st, 2d, and 3d vacancies in the office of a bankruptcy judge for the district of Maryland—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/a/2/E/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">occurring more than 5 years after the date of the enactment of this Act, and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/a/2/E/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</content>
                        </clause><continuation style="-uslm-dtd:continuation-text" role="subparagraph">shall not be filled.</continuation>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/2/F" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="F">(F) </num><heading style="-uslm-dtd:header">Eastern district of michigan.—</heading><chapeau style="-uslm-dtd:text">The 1st vacancy in the office of a bankruptcy judge for the eastern district of Michigan—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/a/2/F/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">occurring 6 years or more after the date of the enactment of this Act, and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/a/2/F/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">resulting from the death, retirement, resignation, or removal of a bankruptcy judge, shall not be filled.</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/2/G" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="G">(G) </num><heading style="-uslm-dtd:header">District of puerto rico.—</heading><chapeau style="-uslm-dtd:text">The 1st vacancy in the office of a bankruptcy judge for the district of Puerto Rico—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/a/2/G/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">occurring 6 years or more after the date of the enactment of this Act, and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/a/2/G/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">resulting from the death, retirement, resignation, or removal of a bankruptcy judge, shall not be filled.</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/a/2/H" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="H">(H) </num><heading style="-uslm-dtd:header">Eastern district of virginia.—</heading><chapeau style="-uslm-dtd:text">The 1st vacancy in the office of a bankruptcy judge for the eastern district of Virginia—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/a/2/H/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">occurring 6 years or more after the date of the enactment of this Act, and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/a/2/H/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">resulting from the death, retirement, resignation, or removal of a bankruptcy judge, shall not be filled.</content>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/121/s2/a/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Applicability of other provisions.—</heading><content style="-uslm-dtd:text">Except as provided in paragraphs (1) and (2), all other provisions of section 1223(b) of Public Law 109-8 (28 U.S.C. 152 note) remain applicable to the temporary office of bankruptcy judges referred to in paragraph (1).</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/121/s2/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Temporary Office of Bankruptcy Judges Extended by Public Law 109-8.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/121/s2/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Extensions.—</heading><content style="-uslm-dtd:text">The temporary office of bankruptcy judges authorized by section 3 of the Bankruptcy Judgeship Act of 1992 (28 U.S.C. 152 note) and extended by section 1223(c) of Public Law 109-8 (28 U.S.C. 152 note) for the district of Delaware, the district of Puerto Rico, and the eastern district of Tennessee are extended until the applicable vacancy specified in paragraph (2) in the office of a bankruptcy judge for the respective district occurs.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/121/s2/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Vacancies.—</heading>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/b/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">District of delaware.—</heading><chapeau style="-uslm-dtd:text">The 5th vacancy in the office of a bankruptcy judge for the district of Delaware—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/b/2/A/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">occurring more than 5 years after the date of the enactment of this Act, and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/b/2/A/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</content>
                        </clause><continuation style="-uslm-dtd:continuation-text" role="subparagraph">shall not be filled.</continuation>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/b/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">District of puerto rico.—</heading><chapeau style="-uslm-dtd:text">The 2d vacancy in the office of a bankruptcy judge for the district of Puerto Rico—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/b/2/B/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">occurring more than 5 years after the date of the enactment of this Act, and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/b/2/B/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</content>
                        </clause><continuation style="-uslm-dtd:continuation-text" role="subparagraph">shall not be filled.</continuation>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/b/2/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Eastern district of tennessee.—</heading><chapeau style="-uslm-dtd:text">The 1st vacancy in the office of a bankruptcy judge for the eastern district of Tennessee—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/b/2/C/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">occurring more than 9 years after the date of the enactment of this Act, and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/112/121/s2/b/2/C/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</content>
                        </clause><continuation style="-uslm-dtd:continuation-text" role="subparagraph">shall not be filled.</continuation>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/121/s2/b/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Applicability of other provisions.—</heading><content style="-uslm-dtd:text">Except as provided in paragraphs (1) and (2), all other provisions of section 3 of the Bankruptcy Judgeship Act of 1992 (28 U.S.C. 152 note) and section 1223(c) of Public Law 109-8 (28 U.S.C. 152 note) remain applicable to the temporary office of bankruptcy judges referred to in paragraph (1).</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/121/s2/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Temporary Office of the Bankruptcy Judge Authorized by Public Law 102-361 for the Middle District of North Carolina.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/121/s2/c/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Extension.—</heading><content style="-uslm-dtd:text">The temporary office of the bankruptcy judge authorized by section 3 of the Bankruptcy Judgeship Act of 1992 (28 U.S.C. 152 note) for the middle district of North Carolina is extended until the vacancy specified in paragraph (2) occurs.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/121/s2/c/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Vacancy.—</heading><chapeau style="-uslm-dtd:text">The 1st vacancy in the office of a bankruptcy judge for the middle district of North Carolina—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/c/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">occurring more than 5 years after the date of the enactment of this Act, and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/121/s2/c/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">resulting from the death, retirement, resignation, or removal of a bankruptcy judge,</content>
                    </subparagraph><continuation style="-uslm-dtd:continuation-text" role="paragraph">shall not be filled.</continuation>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/121/s2/c/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Applicability of other provisions.—</heading><content style="-uslm-dtd:text">Except as provided in paragraphs (1) and (2), all other provisions of section 3 of the Bankruptcy Judgeship Act of 1992 (28 U.S.C. 152 note) remain applicable to the temporary office of the bankruptcy judge referred to in paragraph (1).</content>
                </paragraph>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/112/121/s3" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">BANKRUPTCY FILING FEE INCREASE. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/121/s3/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Bankruptcy Filing Fees.—</heading><content style="-uslm-dtd:text">Section 1930(a)(3) of title 28, United States Code, is amended by striking “<quotedText style="-uslm-dtd:quote">$1,000</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">$1,167</quotedText>”.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/121/s3/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">United States Trustee System Fund.—</heading><content style="-uslm-dtd:text">Section 589a(b)(2) of title 28, United States Code, is amended by striking “<quotedText style="-uslm-dtd:quote">55</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">48.89</quotedText>”.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/121/s3/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Collection and Deposit of Miscellaneous Bankruptcy Fees.—</heading><content style="-uslm-dtd:text">Section 406(b) of the Judiciary Appropriations Act, 1990 (28 U.S.C. 1931 note) is amended by striking “<quotedText style="-uslm-dtd:quote">25</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">33.33</quotedText>”.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/121/s3/d" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t28/s1931">28 U.S.C. 1931 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Paygo Offset Expenditure Limitation.—</heading><content style="-uslm-dtd:text">$42 of the incremental amounts collected by reason of the enactment of subsection (a) shall be deposited in a special fund in the Treasury to be established after the date of enactment of this Act. Such amounts    shall be available for the purposes specified in section 1931(a) of title 28, United States Code, but only to the extent specifically appropriated by an Act of Congress enacted after the date of enactment of this Act.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/121/s3/e" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t28/s589a">28 U.S.C. 589a note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Effective Date.—</heading><content style="-uslm-dtd:text">This section and the amendments made by this section shall take effect 180 days after the date of enactment of this Act.</content>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/112/121/s4" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t28/s152">28 U.S.C. 152 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SUBSEQUENT REAUTHORIZATION. </heading>
            <content style="-uslm-dtd:text" class="block">Prior to further reauthorization of any judgeship authorized by this Act, the Committee on the Judiciary of the Senate and House of Representatives shall conduct a review of the bankruptcy judgeships authorized by this Act to determine the need, if any, for continued reauthorization of each judgeship, to evaluate any changes in all bankruptcy case filings and their effect, if any, on filing fee revenue, and to require the Administrative Office of the Courts to submit a report to the Committee on the Judiciary of the Senate and House of Representatives on bankruptcy case workload, bankruptcy judgeship costs, and filing fee revenue.</content>
