    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To provide for the exchange of certain land located in the Arapaho-Roosevelt National Forests in the State of Colorado, and for other purposes</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/112/79/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Sugar Loaf Fire Protection District Land Exchange Act of 2011</inline></shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/112/79/s2" styleType="OLC" role="definitions">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
            <chapeau style="-uslm-dtd:text" class="block">In this Act:</chapeau>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/79/s2/1" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">District.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">District</term>” means the Sugar Loaf Fire Protection District of Boulder, Colorado.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/79/s2/2" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Federal land.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Federal land</term>” means—</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/79/s2/2/A" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the parcel of approximately 1.52 acres of land in the National Forest that is generally depicted on the map numbered 1, entitled “<term style="-uslm-dtd:quote">Sugarloaf Fire Protection District Proposed Land Exchange</term>”, and dated November 12, 2009; and</content>
                </subparagraph>
                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/79/s2/2/B" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the parcel of approximately 3.56 acres of land in the National Forest that is generally depicted on the map numbered 2, entitled “<term style="-uslm-dtd:quote">Sugarloaf Fire Protection District Proposed Land Exchange</term>”, and dated November 12, 2009.</content>
                </subparagraph>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/79/s2/3" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">National forest.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">National Forest</term>” means the Arapaho-Roosevelt National Forests located in the State of Colorado.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/79/s2/4" styleType="OLC">
                <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Non-federal land.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">non-Federal land</term>” means the parcel of approximately 5.17 acres of non-Federal land in unincorporated Boulder County, Colorado, that is generally depicted on the map numbered 3, entitled “<term style="-uslm-dtd:quote">Sugarloaf Fire Protection District Proposed Land Exchange</term>”, and dated November 12, 2009.</content>
            </paragraph>
            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/79/s2/5" styleType="OLC">
                <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Secretary.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Secretary</term>” means the Secretary of Agriculture.</content>
            </paragraph>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/112/79/s3" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">LAND EXCHANGE. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/79/s3/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">Subject to the provisions of this Act, if the District offers to convey to the Secretary all right, title, and interest of the District in and to the non-Federal land, and the offer is acceptable to the Secretary—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/79/s3/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the Secretary shall accept the offer; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/79/s3/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">on receipt of acceptable title to the non-Federal land, the Secretary shall convey to the District all right, title, and interest of the United States in and to the Federal land.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/79/s3/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Applicable Law.—</heading><chapeau style="-uslm-dtd:text">Section 206 of the Federal Land Policy and Management Act of 1976 (43 U.S.C. 1716) shall apply to the land exchange authorized under subsection (a), except that—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/79/s3/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the Secretary may accept a cash equalization payment in excess of 25 percent of the value of the Federal land; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/79/s3/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">as a condition of the land exchange under subsection (a), the District shall—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/79/s3/b/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">pay each cost relating to any land surveys and appraisals of the Federal land and non-Federal land; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/79/s3/b/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">enter into an agreement with the Secretary that allocates any other administrative costs between the Secretary and the District.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/79/s3/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Additional Terms and Conditions.—</heading><chapeau style="-uslm-dtd:text">The land exchange under subsection (a) shall be subject to—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/79/s3/c/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">valid existing rights; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/79/s3/c/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">any terms and conditions that the Secretary may require.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/79/s3/d" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Time for Completion of Land Exchange.—</heading><content style="-uslm-dtd:text">It is the intent of Congress that the land exchange under subsection (a) shall be completed not later than 1 year after the date of enactment of this Act.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/79/s3/e" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Authority of Secretary To Conduct Sale of Federal Land.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/79/s3/e/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">In accordance with paragraph (2), if the land exchange under subsection (a) is not completed by the date that is 1 year after the date of enactment of this Act, the Secretary may offer to sell to the District the Federal land.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/79/s3/e/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Value of federal land.—</heading><content style="-uslm-dtd:text">The Secretary may offer to sell to the District the Federal land for the fair market value of the Federal land.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/79/s3/f" styleType="OLC">
                <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Disposition of Proceeds.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/79/s3/f/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The Secretary shall deposit in the fund established under Public Law 90-171 (commonly known as the “<quotedText style="-uslm-dtd:quote">Sisk Act</quotedText>”) (16 U.S.C. 484a) any amount received by the Secretary as the result of—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/79/s3/f/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">any cash equalization payment made under subsection (b); and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/79/s3/f/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">any sale carried out under subsection (e).</content>
                    </subparagraph>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/79/s3/f/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Use of proceeds.—</heading><content style="-uslm-dtd:text">Amounts deposited under paragraph (1) shall be available to the Secretary, without further appropriation and until expended, for the acquisition of land or interests in land in the National Forest System.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/79/s3/g" styleType="OLC">
                <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Management and Status of Acquired Land.—</heading><chapeau style="-uslm-dtd:text">The non-Federal land acquired by the Secretary under this section shall be—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/79/s3/g/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">added to, and administered as part of, the National Forest; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/79/s3/g/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">managed by the Secretary in accordance with—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/79/s3/g/2/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the Act of March 1, 1911 (commonly known as the “<quotedText style="-uslm-dtd:quote">Weeks Law</quotedText>”) (16 U.S.C. 480 et seq.); and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/112/79/s3/g/2/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">any laws (including regulations) applicable to the National Forest.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/112/79/s3/h" styleType="OLC">
                <num style="-uslm-dtd:enum" value="h">(h) </num><heading style="-uslm-dtd:header">Revocation of Orders; Withdrawal.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/79/s3/h/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Revocation of orders.—</heading><content style="-uslm-dtd:text">Any public order withdrawing the Federal land from entry, appropriation, or disposal under  the public land laws is revoked to the extent necessary to permit the conveyance of the Federal land to the District.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/112/79/s3/h/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Withdrawal.—</heading><content style="-uslm-dtd:text">On the date of enactment of this Act, if not already withdrawn or segregated from entry and appropriation under the public land laws (including the mining and mineral leasing laws) and the Geothermal Steam Act of 1970 (30 U.S.C. 1001 et seq.), the Federal land is withdrawn until the date of the conveyance of the Federal land to the District.</content>
                </paragraph>
            </subsection>
