Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. [22 U.S.C. 7101 note]SHORT TITLE; TABLE OF CONTENTS. (a) Short Title.—This Act may be cited as the “Trafficking Victims Protection Reauthorization Act of 2005”.(b) Table of Contents.—The table of contents for this Act is as follows:Sec. 1.Sec. 2.TITLE I—Sec. 101.Sec. 102.Sec. 103.Sec. 104.Sec. 105.TITLE II—Sec. 201.Sec. 202.Sec. 203.Sec. 204.Sec. 204A.Sec. 205.Sec. 206.Sec. 207.TITLE III—Sec. 301.SEC. 2. [22 U.S.C. 7101 note]FINDINGS. Congress finds the following:(1) The United States has demonstrated international leadership in combating human trafficking and slavery through the enactment of the Trafficking Victims Protection Act of 2000 (division A of Public Law 106–386; 22 U.S.C. 7101 et seq.) and the Trafficking Victims Protection Reauthorization Act of 2003 (Public Law 108–193).(2) The United States Government currently estimates that 600,000 to 800,000 individuals are trafficked across international borders each year and exploited through forced labor and commercial sex exploitation. An estimated 80 percent of such individuals are women and girls.(3) Since the enactment of the Trafficking Victims Protection Act of 2000, United States efforts to combat trafficking in persons have focused primarily on the international trafficking in persons, including the trafficking of foreign citizens into the United States.(4) Trafficking in persons also occurs within the borders of a country, including the United States.(5) No known studies exist that quantify the problem of trafficking in children for the purpose of commercial sexual exploitation in the United States. According to a report issued by researchers at the University of Pennsylvania in 2001, as many as 300,000 children in the United States are at risk for commercial sexual exploitation, including trafficking, at any given time.(6) Runaway and homeless children in the United States are highly susceptible to being domestically trafficked for commercial sexual exploitation. According to the National Runaway Switchboard, every day in the United States, between 1,300,000 and 2,800,000 runaway and homeless youth live on the streets. One out of every seven children will run away from home before the age of 18.(7) Following armed conflicts and during humanitarian emergencies, indigenous populations face increased security challenges and vulnerabilities which result in myriad forms of violence, including trafficking for sexual and labor exploitation. Foreign policy and foreign aid professionals increasingly recognize the increased activity of human traffickers in post-conflict settings and during humanitarian emergencies.(8) There is a need to protect populations in post-conflict settings and humanitarian emergencies from being trafficked for sexual or labor exploitation. The efforts of aid agencies to address the protection needs of, among others, internally displaced persons and refugees are useful in this regard. Nonetheless, there is a need for further integrated programs and strategies at the United States Agency for International Development, the Department of State, and the Department of Defense to combat human trafficking, including through protection and prevention methodologies, in post-conflict environments and during humanitarian emergencies.(9) International and human rights organizations have documented a correlation between international deployments of military and civilian peacekeepers and aid workers and a resulting increase in the number of women and girls trafficked into prostitution in post-conflict regions.(10) The involvement of employees and contractors of the United States Government and members of the Armed Forces in trafficking in persons, facilitating the trafficking in persons, or exploiting the victims of trafficking in persons is inconsistent with United States laws and policies and undermines the credibility and mission of United States Government programs in post-conflict regions.(11) Further measures are needed to ensure that United States Government personnel and contractors are held accountable for involvement with acts of trafficking in persons, including by expanding United States criminal jurisdiction to all United States Government contractors abroad.
<num style="-uslm-dtd:enum" value="I">TITLE I—</num><heading style="-uslm-dtd:header">COMBATTING INTERNATIONAL TRAFFICKING IN PERSONS </heading>
<section identifier="/us/sComp/109/164/tI/s101" style="-uslm-dtd:section" styleType="OLC">
<num style="-uslm-dtd:enum" value="101">SEC. 101. </num><heading style="-uslm-dtd:header">PREVENTION OF TRAFFICKING IN CONJUNCTION WITH POST-CONFLICT AND HUMANITARIAN EMERGENCY ASSISTANCE. </heading><editorialNote style="-uslm-dtd:legis-comment"><b>[</b>Subsection (a) provides for an amendment to the Trafficking Victims Protection Act of 2000.<b>]</b> </editorialNote>

<num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Study and Report.—</heading>
<paragraph identifier="/us/sComp/109/164/tI/s101/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Study.—</heading>
<subparagraph identifier="/us/sComp/109/164/tI/s101/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Secretary of State and the Administrator of the United States Agency for International Development, in consultation with the Secretary of Defense, shall conduct a study regarding the threat and practice of trafficking in persons generated by post-conflict and humanitarian emergencies in foreign countries.</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tI/s101/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Factors.—</heading><chapeau style="-uslm-dtd:text">In carrying out the study, the Secretary of State and the Administrator of the United States Agency for International Development shall examine—</chapeau>
<clause identifier="/us/sComp/109/164/tI/s101/b/1/B/i" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the vulnerabilities to human trafficking of commonly affected populations, particularly women and children, generated by post-conflict and humanitarian emergencies;</content>
</clause>
<clause identifier="/us/sComp/109/164/tI/s101/b/1/B/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the various forms of trafficking in persons, both internal and trans-border, including both sexual and labor exploitation;</content>
</clause>
<clause identifier="/us/sComp/109/164/tI/s101/b/1/B/iii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">a collection of best practices implemented to date to combat human trafficking in such areas; and</content>
</clause>
<clause identifier="/us/sComp/109/164/tI/s101/b/1/B/iv" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">proposed recommendations to better combat trafficking in persons in conjunction with post-conflict reconstruction and humanitarian emergencies assistance.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tI/s101/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Report.—</heading><content style="-uslm-dtd:text">Not later than 180 days after the date of the enactment of this Act, the Secretary of State and the Administrator of the United States Agency for International Development, with the concurrence of the Secretary of Defense, shall transmit to the Committee on International Relations and the Committee on Armed Services of the House of Representatives and the Committee on Foreign Relations and the Committee on Armed Services of the Senate a report that contains the results of the study conducted pursuant to paragraph (1).</content>

<num style="-uslm-dtd:enum" value="102">SEC. 102. </num><heading style="-uslm-dtd:header">PROTECTION OF VICTIMS OF TRAFFICKING IN PERSONS. </heading><editorialNote style="-uslm-dtd:legis-comment"><b>[</b>Subsection (a) provides for an amendment to the Trafficking Victims Protection Act of 2000.<b>]</b> </editorialNote>
<subsection identifier="/us/sComp/109/164/tI/s102/b" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="b">(b) </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t22/s7105">22 U.S.C. 7105 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Establishment of Pilot Program for Residential Rehabilitative Facilities for Victims of Trafficking.—</heading>
<paragraph identifier="/us/sComp/109/164/tI/s102/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Study.—</heading>
<subparagraph identifier="/us/sComp/109/164/tI/s102/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Not later than 180 days after the date of the enactment of this Act, the Administrator of the United States Agency for International Development shall carry out a study to identify best practices for the rehabilitation of victims of trafficking in group residential facilities in foreign countries.</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tI/s102/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Factors.—</heading><chapeau style="-uslm-dtd:text">In carrying out the study under subparagraph (A), the Administrator shall—</chapeau>
<clause identifier="/us/sComp/109/164/tI/s102/b/1/B/i" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">investigate factors relating to the rehabilitation of victims of trafficking in group residential facilities, such as the appropriate size of such facilities, services to be provided, length of stay, and cost; and</content>
</clause>
<clause identifier="/us/sComp/109/164/tI/s102/b/1/B/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">give consideration to ensure the safety and security of victims of trafficking, provide alternative sources of income for such victims, assess and provide for the educational needs of such victims, including literacy, and assess the psychological needs of such victims and provide professional counseling, as appropriate.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tI/s102/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Pilot program.—</heading><content style="-uslm-dtd:text">Upon completion of the study carried out pursuant to paragraph (1), the Administrator of the United States Agency for International Development shall establish and carry out a pilot program to establish residential treatment facilities in foreign countries for victims of trafficking based upon the best practices identified in the study.</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tI/s102/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Purposes.—</heading><chapeau style="-uslm-dtd:text">The purposes of the pilot program established pursuant to paragraph (2) are to—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tI/s102/b/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">provide benefits and services to victims of trafficking, including shelter, psychological counseling, and assistance in developing independent living skills;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tI/s102/b/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">assess the benefits of providing residential treatment facilities for victims of trafficking, as well as the most efficient and cost-effective means of providing such facilities; and</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tI/s102/b/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">assess the need for and feasibility of establishing additional residential treatment facilities for victims of trafficking.</content>
</subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tI/s102/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Selection of sites.—</heading><content style="-uslm-dtd:text">The Administrator of the United States Agency for International Development shall select 2 sites at which to operate the pilot program established pursuant to paragraph (2).</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tI/s102/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Form of assistance.—</heading><content style="-uslm-dtd:text">In order to carry out the responsibilities of this subsection, the Administrator of the United States Agency for International Development shall enter into contracts with, or make grants to, organizations with relevant expertise in the delivery of services to victims of trafficking.</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tI/s102/b/6" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="6">(6) </num><heading style="-uslm-dtd:header">Report.—</heading><content style="-uslm-dtd:text">Not later than one year after the date on which the first pilot program is established pursuant to paragraph (2), the Administrator of the United States Agency for International Development shall submit to the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate a report on the implementation of this subsection.</content>
</paragraph>

<num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Not later than one year after the date of the enactment of this Act, the Human Smuggling and Trafficking Center (established pursuant to section 7202 of the Intelligence Reform and Terrorism Prevention Act of 2004 (Public Law 108–458)) shall submit to the appropriate congressional committees a report on the results of the research initiatives carried out pursuant to section 112A(4) of the Trafficking Victims Protection Act of 2000 (as added by paragraph (1)(C) of this subsection).</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tI/s104/c/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Definition.—</heading><chapeau style="-uslm-dtd:text">In this paragraph, the term “<term style="-uslm-dtd:term">appropriate congressional committees</term>” means—</chapeau>

<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the Committee on Foreign Affairs and the Committee on the Judiciary of the House of Representatives; and</content>

<num style="-uslm-dtd:enum" value="2">(2) </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t22/s7111">22 U.S.C. 7111</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Report by secretary of state.—</heading><chapeau style="-uslm-dtd:text">At least 15 days prior to voting for a new or reauthorized peacekeeping mission under the auspices of the United Nations, the North Atlantic Treaty Organization, or any other multilateral organization in which the United States participates (or in an emergency, as far in advance as is practicable), the Secretary of State shall submit to the Committee on Foreign Affairs of the House of Representatives, the Committee on Foreign Relations of the Senate, and any other appropriate congressional committee a report that contains—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tI/s104/e/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">a description of measures taken by the organization to prevent the organization's employees, contractor personnel, and peacekeeping forces serving in the peacekeeping mission from trafficking in persons, exploiting victims of trafficking, or committing acts of sexual exploitation or abuse, and the measures in place to hold accountable any such individuals who engage in any such acts while participating in the peacekeeping mission; and</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tI/s104/e/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">an analysis of the effectiveness of each of the measures referred to in subparagraph (A).</content>

<num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Activities of the Department of State.—</heading>

<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Finding.—</heading><content style="-uslm-dtd:text">Congress finds that in the report submitted to Congress by the Secretary of State in June 2005 pursuant to section 110(b) of the Trafficking Victims Protection Act of 2000 (22 U.S.C. 7107(b)), the list of countries whose governments do not comply with the minimum standards for the elimination of trafficking and are not making significant efforts to bring themselves into compliance was composed of a large number of countries in which the trafficking involved forced labor, including the trafficking of women into domestic servitude.</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tI/s105/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Sense of congress.—</heading><content style="-uslm-dtd:text">It is the sense of Congress that the Director of the Office to Monitor and Combat Trafficking of the Department of State should intensify the focus of the Office on forced labor in the countries described in paragraph (1) and other countries in which forced labor continues to be a serious human rights concern.</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tI/s105/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3)<ref class="footnoteRef" idref="IDA0A8778F22B349FE833F0E9AE85035AA" style="-uslm-dtd:footnote-ref">1</ref> </num><heading style="-uslm-dtd:header">Information sharing.—</heading><content style="-uslm-dtd:text">The Secretary of State shall, on a regular basis, provide information relating to child labor and forced labor in the production of goods in violation of international standards to the Department of Labor to be used in developing the list described in subsection (b)(2)(C).</content><footnote id="IDA0A8778F22B349FE833F0E9AE85035AA" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">Paragraph (3) was added by section 1233 of Public Law 113–4. <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Activities of the Department of Labor.—</heading>
<paragraph identifier="/us/sComp/109/164/tI/s105/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Secretary of Labor, acting through the head of the Bureau of International Labor Affairs of the Department of Labor, shall carry out additional activities to monitor and combat forced labor and child labor in foreign countries as described in paragraph (2).</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tI/s105/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Additional activities described.—</heading><chapeau style="-uslm-dtd:text">The additional activities referred to in paragraph (1) are—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tI/s105/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">to monitor the use of forced labor and child labor in violation of international standards;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tI/s105/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">to provide information regarding trafficking in persons for the purpose of forced labor to the Office to Monitor and Combat Trafficking of the Department of State for inclusion in trafficking in persons report required by section 110(b) of the Trafficking Victims Protection Act of 2000 (22 U.S.C. 7107(b));</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tI/s105/b/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">to develop and make available to the public a list of goods from countries that the Bureau of International Labor Affairs has reason to believe are produced by forced labor or child labor in violation of international standards, including, to the extent practicable, goods that are produced with inputs that are produced with forced labor or child labor;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tI/s105/b/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">to work with persons who are involved in the production of goods on the list described in subparagraph (C) to create a standard set of practices that will reduce the likelihood that such persons will produce goods using the labor described in such subparagraph; and</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tI/s105/b/2/E" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">to consult with other departments and agencies of the United States Government to reduce forced and child labor internationally and ensure that products made by forced labor and child labor in violation of international standards are not imported into the United States.</content>
</subparagraph>
</paragraph>

<num style="-uslm-dtd:enum" value="II">TITLE II—</num><heading style="-uslm-dtd:header">COMBATTING DOMESTIC TRAFFICKING IN PERSONS </heading>
<section identifier="/us/sComp/109/164/tII/s201" style="-uslm-dtd:section" styleType="OLC">
<num style="-uslm-dtd:enum" value="201">SEC. 201. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t34/s20701">34 U.S.C. 20701</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PREVENTION OF DOMESTIC TRAFFICKING IN PERSONS. </heading>
<subsection identifier="/us/sComp/109/164/tII/s201/a" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Program to Reduce Trafficking in Persons and Demand for Commercial Sex Acts in the United States.—</heading>
<paragraph identifier="/us/sComp/109/164/tII/s201/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Comprehensive research and statistical review and analysis of incidents of trafficking in persons and commercial sex acts.—</heading>
<subparagraph identifier="/us/sComp/109/164/tII/s201/a/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Attorney General shall use available data from State and local authorities as well as research data to carry out a biennial comprehensive research and statistical review and analysis of severe forms of trafficking in persons, and a biennial comprehensive research and statistical review and analysis of sex trafficking and unlawful commercial sex acts in the United States, and shall submit to Congress separate biennial reports on the findings.</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s201/a/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Contents.—</heading><chapeau style="-uslm-dtd:text">The research and statistical review and analysis under this paragraph shall consist of two separate studies, utilizing the same statistical data where appropriate, as follows:</chapeau>
<clause identifier="/us/sComp/109/164/tII/s201/a/1/B/i" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><chapeau style="-uslm-dtd:text">The first study shall address severe forms of trafficking in persons in the United States and shall include, but need not be limited to—</chapeau>
<subclause identifier="/us/sComp/109/164/tII/s201/a/1/B/i/I" style="-uslm-dtd:subclause" styleType="OLC">
<num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">the estimated number and demographic characteristics of persons engaged in acts of severe forms of trafficking in persons; and</content>
</subclause>
<subclause identifier="/us/sComp/109/164/tII/s201/a/1/B/i/II" style="-uslm-dtd:subclause" styleType="OLC">
<num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">the number of investigations, arrests, prosecutions, and incarcerations of persons engaged in acts of severe forms of trafficking in persons by States and their political subdivisions.</content>
</subclause>
</clause>
<clause identifier="/us/sComp/109/164/tII/s201/a/1/B/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><chapeau style="-uslm-dtd:text">The second study shall address sex trafficking and unlawful commercial sex acts in the United States and shall include, but need not be limited to—</chapeau>
<subclause identifier="/us/sComp/109/164/tII/s201/a/1/B/ii/I" style="-uslm-dtd:subclause" styleType="OLC">
<num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">the estimated number and demographic characteristics of persons engaged in sex trafficking and commercial sex acts, including purchasers of commercial sex acts;</content>
</subclause>
<subclause identifier="/us/sComp/109/164/tII/s201/a/1/B/ii/II" style="-uslm-dtd:subclause" styleType="OLC">
<num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">the estimated value in dollars of the commercial sex economy, including the estimated average annual personal income derived from acts of sex trafficking;</content>
</subclause>
<subclause identifier="/us/sComp/109/164/tII/s201/a/1/B/ii/III" style="-uslm-dtd:subclause" styleType="OLC">
<num style="-uslm-dtd:enum" value="III">(III) </num><content style="-uslm-dtd:text">the number of investigations, arrests, prosecutions, and incarcerations of persons engaged in sex trafficking and unlawful commercial sex acts, including purchasers of commercial sex acts, by States and their political subdivisions; and</content>
</subclause>
<subclause identifier="/us/sComp/109/164/tII/s201/a/1/B/ii/IV" style="-uslm-dtd:subclause" styleType="OLC">
<num style="-uslm-dtd:enum" value="IV">(IV) </num><content style="-uslm-dtd:text">a description of the differences in the enforcement of laws relating to unlawful commercial sex acts across the United States.</content>
</subclause>
</clause>
</subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s201/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Trafficking conference.—</heading>
<subparagraph identifier="/us/sComp/109/164/tII/s201/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The Attorney General, in consultation and cooperation with the Secretary of Health and Human Services, shall conduct an annual conference in each of the fiscal years 2006, 2007, and 2008, and thereafter conduct a biennial conference, addressing severe forms of trafficking in persons and commercial sex acts that occur, in whole or in part, within the territorial jurisdiction of the United States. At each such conference, the Attorney General, or his designee, shall—</chapeau>
<clause identifier="/us/sComp/109/164/tII/s201/a/2/A/i" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">announce and evaluate the findings contained in the research and statistical reviews carried out under paragraph (1);</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s201/a/2/A/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">disseminate best methods and practices for enforcement of laws prohibiting acts of severe forms of trafficking in persons and other laws related to acts of trafficking in persons, including, but not limited to, best methods and practices for training State and local law enforcement personnel on the enforcement of such laws;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s201/a/2/A/iii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">disseminate best methods and practices for training State and local law enforcement personnel on the enforcement of laws prohibiting sex trafficking and commercial sex acts, including, but not limited to, best methods for investigating and prosecuting exploiters and persons who solicit or purchase an unlawful commercial sex act; and</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s201/a/2/A/iv" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">disseminate best methods and practices for training State and local law enforcement personnel on collaborating with social service providers and relevant nongovernmental organizations and establishing trust of persons subjected to commercial sex acts or severe forms of trafficking in persons.</content>
</clause>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s201/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Participation.—</heading><chapeau style="-uslm-dtd:text">Each annual conference conducted under this paragraph shall involve the participation of persons with expertise or professional responsibilities with relevance to trafficking in persons, including, but not limited to—</chapeau>
<clause identifier="/us/sComp/109/164/tII/s201/a/2/B/i" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">Federal Government officials, including law enforcement and prosecutorial officials;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s201/a/2/B/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">State and local government officials, including law enforcement and prosecutorial officials;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s201/a/2/B/iii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">persons who have been subjected to severe forms of trafficking in persons or commercial sex acts;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s201/a/2/B/iv" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">medical personnel;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s201/a/2/B/v" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">social service providers and relevant nongovernmental organizations; and</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s201/a/2/B/vi" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="vi">(vi) </num><content style="-uslm-dtd:text">academic experts.</content>
</clause>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s201/a/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Reports.—</heading><content style="-uslm-dtd:text">The Attorney General and the Secretary of Health and Human Services shall prepare and post on the respective Internet Web sites of the Department of Justice and the Department of Health and Human Services reports on the findings and best practices identified and disseminated at the conference described in this paragraph.</content>
</subparagraph>
</paragraph>
</subsection><editorialNote style="-uslm-dtd:legis-comment"><b>[</b>Subsection (b) provides for an amendment to the Trafficking Victims Protection Act of 2000.<b>]</b> </editorialNote>
<subsection identifier="/us/sComp/109/164/tII/s201/c" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading><chapeau style="-uslm-dtd:text">There are authorized to be appropriated—</chapeau>
<paragraph identifier="/us/sComp/109/164/tII/s201/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">$1,500,000 for each of the fiscal years 2008 through 2011 to carry out the activities described in subsection (a)(1)(B)(i) and $1,500,000 for each of the fiscal years 2008 through 2011 to carry out the activities described in subsection (a)(1)(B)(ii); and</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s201/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">$250,000 for each of the fiscal years 2014 through 2021 to carry out the activities described in subsection (a)(2).</content>
</paragraph>
</subsection>

<num style="-uslm-dtd:enum" value="202">SEC. 202. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t34/s20702">34 U.S.C. 20702</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ESTABLISHMENT OF A GRANT PROGRAM TO DEVELOP, EXPAND, AND STRENGTHEN ASSISTANCE PROGRAMS FOR CERTAIN PERSONS SUBJECT TO TRAFFICKING. </heading>
<subsection identifier="/us/sComp/109/164/tII/s202/a" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">In this section:</chapeau>
<paragraph identifier="/us/sComp/109/164/tII/s202/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Assistant secretary.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Assistant Secretary</term>” means the Assistant Secretary for Children and Families of the Department of Health and Human Services.</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s202/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Assistant attorney general.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Assistant Attorney General</term>” means the Assistant Attorney General for the Office of Justice Programs of the Department of Justice.</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s202/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Eligible entity.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">eligible entity</term>” means a State or unit of local government that—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tII/s202/a/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">has significant criminal activity involving sex trafficking of minors;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s202/a/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">has demonstrated cooperation between Federal, State, local, and, where applicable, tribal law enforcement agencies, prosecutors, and social service providers in addressing sex trafficking of minors;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s202/a/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><chapeau style="-uslm-dtd:text">has developed a workable, multi-disciplinary plan to combat sex trafficking of minors, including—</chapeau>
<clause identifier="/us/sComp/109/164/tII/s202/a/3/C/i" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">building or establishing a residential care facility for minor victims of sex trafficking;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/a/3/C/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the provision of rehabilitative care to minor victims of sex trafficking;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/a/3/C/iii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">the provision of specialized training for law enforcement officers and social service providers for all forms of sex trafficking, with a focus on sex trafficking of minors;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/a/3/C/iv" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">prevention, deterrence, and prosecution of offenses involving sex trafficking of minors;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/a/3/C/v" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">cooperation or referral agreements with organizations providing outreach or other related services to runaway and homeless youth; and</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/a/3/C/vi" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="vi">(vi) </num><content style="-uslm-dtd:text">law enforcement protocols or procedures to screen all individuals arrested for prostitution, whether adult or minor, for victimization by sex trafficking and by other crimes, such as sexual assault and domestic violence; and</content>
</clause>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s202/a/3/D" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">provides assurance that a minor victim of sex trafficking shall not be required to collaborate with law enforcement to have access to residential care or services provided with a grant under this section.</content>
</subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s202/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Minor victim of sex trafficking.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">minor victim of sex trafficking</term>” means an individual who—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tII/s202/a/4/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">is younger than 18 years of age, and is a victim of an offense described in section 1591(a) of title 18, United States Code, or a comparable State law; or</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s202/a/4/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B)</num><clause class="inline" identifier="/us/sComp/109/164/tII/s202/a/4/B/i" style="-uslm-dtd:clause" styleType="OLC"><num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">is not younger than 18 years of age nor older than 20 years of age;</content></clause>
<clause class="leftIndentDecrease1" identifier="/us/sComp/109/164/tII/s202/a/4/B/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">before the individual reached 18 years of age, was described in subparagraph (A); and</content>
</clause>
<clause class="leftIndentDecrease1" identifier="/us/sComp/109/164/tII/s202/a/4/B/iii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">was receiving shelter or services as a minor victim of sex trafficking.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s202/a/5" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Qualified nongovernmental organization.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">qualified nongovernmental organization</term>” means an organization that—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tII/s202/a/5/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">is not a State or unit of local government, or an agency of a State or unit of local government;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s202/a/5/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">has demonstrated experience providing services to victims of sex trafficking or related populations (such as runaway and homeless youth), or employs staff specialized in the treatment of sex trafficking victims; and</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s202/a/5/C" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">demonstrates a plan to sustain the provision of services beyond the period of a grant awarded under this section.</content>
</subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s202/a/6" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="6">(6) </num><heading style="-uslm-dtd:header">Sex trafficking of a minor.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">sex trafficking of a minor</term>” means an offense described in section 1591(a) of title 18, United States Code, or a comparable State law, against a minor.</content>
</paragraph>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s202/b" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Sex Trafficking Block Grants.—</heading>
<paragraph identifier="/us/sComp/109/164/tII/s202/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Grants authorized.—</heading>
<subparagraph identifier="/us/sComp/109/164/tII/s202/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Assistant Attorney General, in consultation with the Assistant Secretary, may make block grants to 4 eligible entities located in different regions of the United States to combat sex trafficking of minors.</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s202/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Requirement.—</heading><content style="-uslm-dtd:text">Not fewer than 1 of the block grants made under subparagraph (A) shall be awarded to an eligible entity with a State population of less than 5,000,000.</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s202/b/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Grant amount.—</heading><content style="-uslm-dtd:text">Subject to the availability of appropriations under subsection (g) to carry out this section, each grant made under this section shall be for an amount not less than $1,500,000 and not greater than $2,000,000.</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s202/b/1/D" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">Duration.—</heading>
<clause identifier="/us/sComp/109/164/tII/s202/b/1/D/i" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">A grant made under this section shall be for a period of 1 year.</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/1/D/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">Renewal.—</heading>
<subclause identifier="/us/sComp/109/164/tII/s202/b/1/D/ii/I" style="-uslm-dtd:subclause" styleType="OLC">
<num style="-uslm-dtd:enum" value="I">(I) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Assistant Attorney General may renew a grant under this section for up to 3 1-year periods.</content>
</subclause>
<subclause identifier="/us/sComp/109/164/tII/s202/b/1/D/ii/II" style="-uslm-dtd:subclause" styleType="OLC">
<num style="-uslm-dtd:enum" value="II">(II) </num><heading style="-uslm-dtd:header">Priority.—</heading><content style="-uslm-dtd:text">In making grants in any fiscal year after the first fiscal year in which grants are made under this section, the Assistant Attorney General shall give priority to an eligible entity that received a grant in the preceding fiscal year and is eligible for renewal under this subparagraph, taking into account any evaluation of the eligible entity conducted under paragraph (4), if available.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s202/b/1/E" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="E">(E) </num><heading style="-uslm-dtd:header">Consultation.—</heading><chapeau style="-uslm-dtd:text">In carrying out this section, the Assistant Attorney General shall consult with the Assistant Secretary with respect to—</chapeau>
<clause identifier="/us/sComp/109/164/tII/s202/b/1/E/i" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">evaluations of grant recipients under paragraph (4);</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/1/E/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">avoiding unintentional duplication of grants; and</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/1/E/iii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">any other areas of shared concern.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s202/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Use of funds.—</heading>
<subparagraph identifier="/us/sComp/109/164/tII/s202/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Allocation.—</heading><content style="-uslm-dtd:text">Not less than 67 percent of each grant made under paragraph (1) shall be used by the eligible entity to provide residential care and services (as described in clauses (i) through (iv) of subparagraph (B)) to minor victims of sex trafficking through qualified nongovernmental organizations.</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s202/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Authorized activities.—</heading><chapeau style="-uslm-dtd:text">Grants awarded pursuant to paragraph (2) may be used for—</chapeau>
<clause identifier="/us/sComp/109/164/tII/s202/b/2/B/i" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">providing residential care to minor victims of sex trafficking, including temporary or long-term placement as appropriate;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/2/B/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">providing 24-hour emergency social services response for minor victims of sex trafficking;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/2/B/iii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">providing minor victims of sex trafficking with clothing and other daily necessities needed to keep such victims from returning to living on the street;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/2/B/iv" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">case management services for minor victims of sex trafficking;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/2/B/v" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">mental health counseling for minor victims of sex trafficking, including specialized counseling and substance abuse treatment;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/2/B/vi" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="vi">(vi) </num><content style="-uslm-dtd:text">legal services for minor victims of sex trafficking;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/2/B/vii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="vii">(vii) </num><content style="-uslm-dtd:text">specialized training for social service providers, public sector personnel, and private sector personnel likely to encounter sex trafficking victims on issues related to the sex trafficking of minors and severe forms of trafficking in persons;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/2/B/viii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="viii">(viii) </num><content style="-uslm-dtd:text">outreach and education programs to provide information about deterrence and prevention of sex trafficking of minors;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/2/B/ix" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ix">(ix) </num><chapeau style="-uslm-dtd:text">programs to provide treatment to individuals charged or cited with purchasing or attempting to purchase sex acts in cases where—</chapeau>
<subclause identifier="/us/sComp/109/164/tII/s202/b/2/B/ix/I" style="-uslm-dtd:subclause" styleType="OLC">
<num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">a treatment program can be mandated as a condition of a sentence, fine, suspended sentence, or probation, or is an appropriate alternative to criminal prosecution; and</content>
</subclause>
<subclause identifier="/us/sComp/109/164/tII/s202/b/2/B/ix/II" style="-uslm-dtd:subclause" styleType="OLC">
<num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">the individual was not charged with purchasing or attempting to purchase sex acts with a minor; and</content>
</subclause>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/2/B/x" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="x">(x) </num><content style="-uslm-dtd:text">screening and referral of minor victims of severe forms of trafficking in persons.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s202/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Application.—</heading>
<subparagraph identifier="/us/sComp/109/164/tII/s202/b/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Each eligible entity desiring a grant under this section shall submit an application to the Assistant Attorney General at such time, in such manner, and accompanied by such information as the Assistant Attorney General may reasonably require.</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s202/b/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Contents.—</heading><chapeau style="-uslm-dtd:text">Each application submitted pursuant to subparagraph (A) shall—</chapeau>
<clause identifier="/us/sComp/109/164/tII/s202/b/3/B/i" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">describe the activities for which assistance under this section is sought; and</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/3/B/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">provide such additional assurances as the Assistant Attorney General determines to be essential to ensure compliance with the requirements of this section.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s202/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Evaluation.—</heading><content style="-uslm-dtd:text">The Assistant Attorney General shall enter into a contract with an academic or non-profit organization that has experience in issues related to sex trafficking of minors and evaluation of grant programs to conduct an annual evaluation of each grant made under this section to determine the impact and effectiveness of programs funded with the grant.</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s202/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Pilot demonstration program.—</heading>
<subparagraph identifier="/us/sComp/109/164/tII/s202/b/5/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Establishment.—</heading><content style="-uslm-dtd:text">The Assistant Attorney General, in consultation with the Assistant Secretary, shall establish a pilot demonstration program, through which community-based organizations in underserved communities, prioritizing rural communities, in the United States may apply for funding to develop, implement, and build replicable treatment models, based on the type of housing unit that the individual being treated lives in, with supportive services and innovative care, treatment, and services.</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s202/b/5/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Population to be served.—</heading><chapeau style="-uslm-dtd:text">The program established pursuant to subparagraph (A) shall primarily serve adolescents and youth who—</chapeau>
<clause identifier="/us/sComp/109/164/tII/s202/b/5/B/i" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">are transitioning out of foster care;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/5/B/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">struggle with substance use disorder;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/5/B/iii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">are pregnant or parenting; or</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/5/B/iv" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">have experienced foster care involvement or involvement in the child welfare system, child poverty, child abuse or neglect, human trafficking, juvenile justice involvement, gang involvement, or homelessness.</content>
</clause>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s202/b/5/C" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Authorized activities.—</heading><chapeau style="-uslm-dtd:text">Funding provided under subparagraph (A) may be used for—</chapeau>
<clause identifier="/us/sComp/109/164/tII/s202/b/5/C/i" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">providing residential care, including temporary or long-term placement as appropriate;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/5/C/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">providing 24-hour emergency social services response;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/5/C/iii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">providing clothing and other daily necessities needed to keep individuals from returning to living on the street;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/5/C/iv" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">case management services;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/5/C/v" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">mental health counseling, including specialized counseling and substance abuse treatment;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/5/C/vi" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="vi">(vi) </num><content style="-uslm-dtd:text">legal services;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/5/C/vii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="vii">(vii) </num><content style="-uslm-dtd:text">specialized training for social service providers, public sector personnel, and private sector personnel likely to encounter sex trafficking and labor trafficking victims on issues related to the sex trafficking and labor trafficking of minors; and</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s202/b/5/C/viii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="viii">(viii) </num><content style="-uslm-dtd:text">outreach and education programs to provide information about deterrence and prevention of sex trafficking and labor trafficking of minors.</content>
</clause>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s202/b/5/D" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">Funding priority.—</heading><content style="-uslm-dtd:text">The Assistant Attorney General shall give funding priority to community-based programs that provide crisis stabilization, emergency shelter, and addiction treatment for adolescents and transitional age residential programs that have reputable outcomes.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s202/c" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Mandatory Exclusion.—</heading><content style="-uslm-dtd:text">An eligible entity that receives a grant under this section that is found to have utilized grant funds for any unauthorized expenditure or otherwise unallowable cost shall not be eligible for any grant funds awarded under the grant for 2 fiscal years following the year in which the unauthorized expenditure or unallowable cost is reported.</content>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s202/d" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Compliance Requirement.—</heading><content style="-uslm-dtd:text">An eligible entity shall not be eligible to receive a grant under this section if, during the 5 fiscal years before the eligible entity submits an application for the grant, the eligible entity has been found to have violated the terms or conditions of a Government grant program by utilizing grant funds for unauthorized expenditures or otherwise unallowable costs.</content>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s202/e" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Administrative Cap.—</heading><content style="-uslm-dtd:text">The cost of administering the grants authorized by this section shall not exceed 3 percent of the total amount appropriated to carry out this section.</content>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s202/f" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Audit Requirement.—</heading><content style="-uslm-dtd:text">For fiscal years 2016 and 2017, the Inspector General of the Department of Justice shall conduct an audit of all 4 eligible entities that receive block grants under this section.</content>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s202/g" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Match Requirement.—</heading><chapeau style="-uslm-dtd:text">An eligible entity that receives a grant under this section shall provide a non-Federal match in an amount equal to not less than—</chapeau>
<paragraph identifier="/us/sComp/109/164/tII/s202/g/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">15 percent of the grant during the first year;</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s202/g/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">25 percent of the grant during the first renewal period;</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s202/g/3" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">40 percent of the grant during the second renewal period; and</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s202/g/4" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">50 percent of the grant during the third renewal period.</content>
</paragraph>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s202/h" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="h">(h) </num><heading style="-uslm-dtd:header">No Limitation on Section 204 Grants.—</heading><content style="-uslm-dtd:text">An entity that applies for a grant under section 204 is not prohibited from also applying for a grant under this section.</content>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s202/i" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading><content style="-uslm-dtd:text">There are authorized to be appropriated $8,000,000 to the Attorney General for each of the fiscal years 2018 through 2021 to carry out this section.</content>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s202/j" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="j">(j) </num><heading style="-uslm-dtd:header">GAO Evaluation.—</heading><chapeau style="-uslm-dtd:text">Not later than 30 months after the date of the enactment of this Act, the Comptroller General of the United States shall submit a report to Congress that contains—</chapeau>
<paragraph identifier="/us/sComp/109/164/tII/s202/j/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">an evaluation of the impact of this section in aiding minor victims of sex trafficking in the jurisdiction of the entity receiving the grant; and</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s202/j/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">recommendations, if any, regarding any legislative or administrative action the Comptroller General determines appropriate.</content>
</paragraph>
</subsection>

<num style="-uslm-dtd:enum" value="203">SEC. 203. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t34/s20703">34 U.S.C. 20703</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">VICTIM-CENTERED CHILD HUMAN TRAFFICKING DETERRENCE BLOCK GRANT PROGRAM. </heading>
<subsection identifier="/us/sComp/109/164/tII/s203/a" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Grants Authorized.—</heading><content style="-uslm-dtd:text">The Attorney General may award block grants to an eligible entity to develop, improve, or expand domestic child human trafficking deterrence programs that assist law enforcement officers, prosecutors, judicial officials, and qualified victims' services organizations in collaborating to rescue and restore the lives of victims, while investigating and prosecuting offenses involving child human trafficking.</content>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s203/b" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Authorized Activities.—</heading><chapeau style="-uslm-dtd:text">Grants awarded under subsection (a) may be used for—</chapeau>
<paragraph identifier="/us/sComp/109/164/tII/s203/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">the establishment or enhancement of specialized training programs for law enforcement officers, first responders, health care officials, child welfare officials, juvenile justice personnel, prosecutors, and judicial personnel to—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tII/s203/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">identify victims and acts of child human trafficking;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s203/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">address the unique needs of child victims of human trafficking;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s203/b/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">facilitate the rescue of child victims of human trafficking;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s203/b/1/D" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">investigate and prosecute acts of human trafficking, including the soliciting, patronizing, or purchasing of commercial sex acts from children, as well as training to build cases against complex criminal networks involved in child human trafficking; and</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s203/b/1/E" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">utilize, implement, and provide education on safe harbor laws enacted by States, aimed at preventing the criminalization and prosecution of child sex trafficking victims for prostitution offenses, and other laws aimed at the investigation and prosecution of child human trafficking;</content>
</subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s203/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">the establishment or enhancement of dedicated anti-trafficking law enforcement units and task forces to investigate child human trafficking offenses and to rescue victims, including—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tII/s203/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">funding salaries, in whole or in part, for law enforcement officers, including patrol officers, detectives, and investigators, except that the percentage of the salary of the law enforcement officer paid for by funds from a grant awarded under this section shall not be more than the percentage of the officer’s time on duty that is dedicated to working on cases involving child human trafficking;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s203/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">investigation expenses for cases involving child human trafficking, including—</chapeau>
<clause identifier="/us/sComp/109/164/tII/s203/b/2/B/i" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">wire taps;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s203/b/2/B/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">consultants with expertise specific to cases involving child human trafficking;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s203/b/2/B/iii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">travel; and</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s203/b/2/B/iv" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">other technical assistance expenditures;</content>
</clause>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s203/b/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">dedicated anti-trafficking prosecution units, including the funding of salaries for State and local prosecutors, including assisting in paying trial expenses for prosecution of child human trafficking offenders, except that the percentage of the total salary of a State or local prosecutor that is paid using an award under this section shall be not more than the percentage of the total number of hours worked by the prosecutor that is spent working on cases involving child human trafficking;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s203/b/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="D">(D) </num><chapeau style="-uslm-dtd:text">the establishment of child human trafficking victim witness safety, assistance, and relocation programs that encourage cooperation with law enforcement investigations of crimes of child human trafficking by leveraging existing resources and delivering child human trafficking victims’ services through coordination with—</chapeau>
<clause identifier="/us/sComp/109/164/tII/s203/b/2/D/i" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">child advocacy centers;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s203/b/2/D/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">social service agencies;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s203/b/2/D/iii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">State governmental health service agencies;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s203/b/2/D/iv" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">housing agencies;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s203/b/2/D/v" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">legal services agencies; and</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s203/b/2/D/vi" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="vi">(vi) </num><content style="-uslm-dtd:text">nongovernmental organizations and shelter service providers with substantial experience in delivering wrap-around services to victims of child human trafficking; and</content>
</clause>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s203/b/2/E" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">the establishment or enhancement of other necessary victim assistance programs or personnel, such as victim or child advocates, child-protective services, child forensic interviews, or other necessary service providers;</content>
</subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s203/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">activities of law enforcement agencies to find homeless and runaway youth, including salaries and associated expenses for retired Federal law enforcement officers assisting the law enforcement agencies in finding homeless and runaway youth; and</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s203/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="4">(4) </num><chapeau style="-uslm-dtd:text">the establishment or enhancement of problem solving court programs for trafficking victims that include—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tII/s203/b/4/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">mandatory and regular training requirements for judicial officials involved in the administration or operation of the court program described under this paragraph;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s203/b/4/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">continuing judicial supervision of victims of child human trafficking, including case worker or child welfare supervision in collaboration with judicial officers, who have been identified by a law enforcement or judicial officer as a potential victim of child human trafficking, regardless of whether the victim has been charged with a crime related to human trafficking;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s203/b/4/C" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><chapeau style="-uslm-dtd:text">the development of a specialized and individualized, court-ordered treatment program for identified victims of child human trafficking, including—</chapeau>
<clause identifier="/us/sComp/109/164/tII/s203/b/4/C/i" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">State-administered outpatient treatment;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s203/b/4/C/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">life skills training;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s203/b/4/C/iii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">housing placement;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s203/b/4/C/iv" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">vocational training;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s203/b/4/C/v" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">education;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s203/b/4/C/vi" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="vi">(vi) </num><content style="-uslm-dtd:text">family support services; and</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s203/b/4/C/vii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="vii">(vii) </num><content style="-uslm-dtd:text">job placement;</content>
</clause>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s203/b/4/D" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">centralized case management involving the consolidation of all of each child human trafficking victim’s cases and offenses, and the coordination of all trafficking victim treatment programs and social services;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s203/b/4/E" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">regular and mandatory court appearances by the victim during the duration of the treatment program for purposes of ensuring compliance and effectiveness;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s203/b/4/F" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">the ultimate dismissal of relevant non-violent criminal charges against the victim, where such victim successfully complies with the terms of the court-ordered treatment program; and</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s203/b/4/G" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">collaborative efforts with child advocacy centers, child welfare agencies, shelters, and nongovernmental organizations with substantial experience in delivering wrap-around services to victims of child human trafficking to provide services to victims and encourage cooperation with law enforcement.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s203/c" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Application.—</heading>
<paragraph identifier="/us/sComp/109/164/tII/s203/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">An eligible entity shall submit an application to the Attorney General for a grant under this section in such form and manner as the Attorney General may require.</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s203/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Required information.—</heading><chapeau style="-uslm-dtd:text">An application submitted under this subsection shall—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tII/s203/c/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">describe the activities for which assistance under this section is sought;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s203/c/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">include a detailed plan for the use of funds awarded under the grant;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s203/c/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">provide such additional information and assurances as the Attorney General determines to be necessary to ensure compliance with the requirements of this section; and</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s203/c/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="D">(D) </num><chapeau style="-uslm-dtd:text">disclose—</chapeau>
<clause identifier="/us/sComp/109/164/tII/s203/c/2/D/i" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">any other grant funding from the Department of Justice or from any other Federal department or agency for purposes similar to those described in subsection (b) for which the eligible entity has applied, and which application is pending on the date of the submission of an application under this section; and</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s203/c/2/D/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">any other such grant funding that the eligible entity has received during the 5-year period ending on the date of the submission of an application under this section.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s203/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Preference.—</heading><chapeau style="-uslm-dtd:text">In reviewing applications submitted in accordance with paragraphs (1) and (2), the Attorney General shall give preference to grant applications if—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tII/s203/c/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the application includes a plan to use awarded funds to engage in all activities described under paragraphs (1) through (3) of subsection (b); or</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s203/c/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the application includes a plan by the State or unit of local government to continue funding of all activities funded by the award after the expiration of the award.</content>
</subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s203/c/4" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Eligible entities soliciting data on child human trafficking.—</heading><content style="-uslm-dtd:text">No eligible entity shall be disadvantaged in being awarded a grant under subsection (a) on the grounds that the eligible entity has only recently begun soliciting data on child human trafficking.</content>
</paragraph>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s203/d" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Duration and Renewal of Award.—</heading>
<paragraph identifier="/us/sComp/109/164/tII/s203/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">A grant under this section shall expire 3 years after the date of award of the grant.</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s203/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Renewal.—</heading><content style="-uslm-dtd:text">A grant under this section shall be renewable not more than 2 times and for a period of not greater than 2 years.</content>
</paragraph>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s203/e" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Evaluation.—</heading><chapeau style="-uslm-dtd:text">The Attorney General shall—</chapeau>
<paragraph identifier="/us/sComp/109/164/tII/s203/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">enter into a contract with a nongovernmental organization, including an academic or nonprofit organization, that has experience with issues related to child human trafficking and evaluation of grant programs to conduct periodic evaluations of grants made under this section to determine the impact and effectiveness of programs funded with grants awarded under this section;</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s203/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">instruct the Inspector General of the Department of Justice to review evaluations issued under paragraph (1) to determine the methodological and statistical validity of the evaluations; and</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s203/e/3" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">submit the results of any evaluation conducted pursuant to paragraph (1) to—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tII/s203/e/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the <foreign id="warning-d178011e1290" note="processing mode: unknown" role="passthroughContent"><compsdtd:committee-name xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" committee-id="SSJU00">Committee on the Judiciary of the Senate</compsdtd:committee-name></foreign>; and</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s203/e/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the <foreign id="warning-d178011e1297" note="processing mode: unknown" role="passthroughContent"><compsdtd:committee-name xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" committee-id="">Committee on the Judiciary of the House of Representatives</compsdtd:committee-name></foreign>.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s203/f" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Mandatory Exclusion.—</heading><content style="-uslm-dtd:text">An eligible entity awarded funds under this section that is found to have used grant funds for any unauthorized expenditure or otherwise unallowable cost shall not be eligible for any grant funds awarded under the block grant for 2 fiscal years following the year in which the unauthorized expenditure or unallowable cost is reported.</content>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s203/g" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Compliance Requirement.—</heading><content style="-uslm-dtd:text">An eligible entity shall not be eligible to receive a grant under this section if within the 5 fiscal years before submitting an application for a grant under this section, the grantee has been found to have violated the terms or conditions of a Government grant program by utilizing grant funds for unauthorized expenditures or otherwise unallowable costs.</content>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s203/h" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="h">(h) </num><heading style="-uslm-dtd:header">Administrative Cap.—</heading><content style="-uslm-dtd:text">The cost of administering the grants authorized by this section shall not exceed 5 percent of the total amount expended to carry out this section.</content>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s203/i" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Federal Share.—</heading><chapeau style="-uslm-dtd:text">The Federal share of the cost of a program funded by a grant awarded under this section shall be—</chapeau>
<paragraph identifier="/us/sComp/109/164/tII/s203/i/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">70 percent in the first year;</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s203/i/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">60 percent in the second year; and</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s203/i/3" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">50 percent in the third year, and in all subsequent years.</content>
</paragraph>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s203/j" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="j">(j) </num><heading style="-uslm-dtd:header">Authorization of Funding; Fully Offset.—</heading><content style="-uslm-dtd:text">For purposes of carrying out this section, the Attorney General, in consultation with the Secretary of Health and Human Services, is authorized to award not more than $7,000,000 of the funds available in the Domestic Trafficking Victims’ Fund, established under section 3014 of title 18, United States Code, for each of fiscal years 2016 through 2020.</content>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s203/k" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="k">(k) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">In this section—</chapeau>
<paragraph identifier="/us/sComp/109/164/tII/s203/k/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">child</term>” means a person under the age of 18;</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s203/k/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">child advocacy center</term>” means a center created under subtitle A of the Victims of Child Abuse Act of 1990 (42 U.S.C. 13001 et seq.);</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s203/k/3" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">child human trafficking</term>” means 1 or more severe forms of trafficking in persons (as defined in section 103 of the Trafficking Victims Protection Act of 2000 (22 U.S.C. 7102)) involving a victim who is a child; and</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s203/k/4" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="4">(4) </num><chapeau style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">eligible entity</term>” means a State or unit of local government that—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tII/s203/k/4/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">has significant criminal activity involving child human trafficking;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s203/k/4/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">has demonstrated cooperation between Federal, State, local, and, where applicable, tribal law enforcement agencies, prosecutors, and social service providers in addressing child human trafficking;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s203/k/4/C" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><chapeau style="-uslm-dtd:text">has developed a workable, multi-disciplinary plan to combat child human trafficking, including—</chapeau>
<clause identifier="/us/sComp/109/164/tII/s203/k/4/C/i" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the establishment of a shelter for victims of child human trafficking, through existing or new facilities;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s203/k/4/C/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the provision of trauma-informed, gender-responsive rehabilitative care to victims of child human trafficking;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s203/k/4/C/iii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">the provision of specialized training for law enforcement officers and social service providers for all forms of human trafficking, with a focus on domestic child human trafficking;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s203/k/4/C/iv" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">prevention, deterrence, and prosecution of offenses involving child human trafficking, including soliciting, patronizing, or purchasing human acts with children;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s203/k/4/C/v" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">cooperation or referral agreements with organizations providing outreach or other related services to runaway and homeless youth;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s203/k/4/C/vi" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="vi">(vi) </num><content style="-uslm-dtd:text">law enforcement protocols or procedures to screen all individuals arrested for prostitution, whether adult or child, for victimization by sex trafficking and by other crimes, such as sexual assault and domestic violence; and</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s203/k/4/C/vii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="vii">(vii) </num><content style="-uslm-dtd:text">cooperation or referral agreements with State child welfare agencies and child advocacy centers; and</content>
</clause>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s203/k/4/D" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">provides an assurance that, under the plan under subparagraph (C), a victim of child human trafficking shall not be required to collaborate with law enforcement officers to have access to any shelter or services provided with a grant under this section.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s203/l" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="l">(l) </num><heading style="-uslm-dtd:header">Grant Accountability; Specialized Victims’ Service Requirement.—</heading><content style="-uslm-dtd:text">No grant funds under this section may be awarded or transferred to any entity unless such entity has demonstrated substantial experience providing services to victims of human trafficking or related populations (such as runaway and homeless youth), or employs staff specialized in the treatment of human trafficking victims.</content>
</subsection>

<num style="-uslm-dtd:enum" value="204">SEC. 204. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t34/s20705">34 U.S.C. 20705</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ENHANCING STATE AND LOCAL EFFORTS TO COMBAT TRAFFICKING IN PERSONS. </heading>
<subsection identifier="/us/sComp/109/164/tII/s204/a" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Establishment of Grant Program for Law Enforcement.—</heading>
<paragraph identifier="/us/sComp/109/164/tII/s204/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The Attorney General may make grants to States and local law enforcement agencies to establish, develop, expand, or strengthen programs—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tII/s204/a/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">to investigate and prosecute acts of severe forms of trafficking in persons, and related offenses that occur, in whole or in part, within the territorial jurisdiction of the United States;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s204/a/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">to train law enforcement personnel how to identify victims of severe forms of trafficking in persons and related offenses;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s204/a/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">to investigate and prosecute persons who engage in the purchase of commercial sex acts and prioritize the investigations and prosecutions of those cases involving minor victims;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s204/a/1/D" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">to educate persons charged with, or convicted of, purchasing or attempting to purchase commercial sex acts; </content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s204/a/1/E" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">to educate and train law enforcement personnel in how to establish trust of persons subjected to trafficking and encourage cooperation with prosecution efforts; and</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s204/a/1/F" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">as appropriate, to designate at least 1 prosecutor for cases of severe forms of trafficking in persons (as such term is defined in section 103(9) of the Trafficking Victims Protection Act of 2000 (22 U.S.C. 7102(9))<ref class="footnoteRef" idref="IDC8880123E8DD4C73974C8162AB2E5417" style="-uslm-dtd:footnote-ref">3</ref>.</content><footnote id="IDC8880123E8DD4C73974C8162AB2E5417" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">3</sup><p style="-uslm-dtd:para; margin-left:1em">So in law. </subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s204/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Definition.—</heading><content style="-uslm-dtd:text">In this subsection, the term “<term style="-uslm-dtd:term">related offenses</term>” includes violations of tax laws, transacting in illegally derived proceeds, money laundering, racketeering, and other violations of criminal laws committed in connection with an act of sex trafficking or a severe form of trafficking in persons.</content>
</paragraph>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s204/b" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Multi-Disciplinary Approach Required.—</heading><content style="-uslm-dtd:text">Grants under subsection (a) may be made only for programs in which the State or local law enforcement agency works collaboratively with social service providers and relevant nongovernmental organizations, including organizations with experience in the delivery of services to persons who are the subject of trafficking in persons.</content>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s204/c" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Limitation on Federal Share.—</heading><content style="-uslm-dtd:text">The Federal share of a grant made under this section may not exceed 75 percent of the total costs of the projects described in the application submitted.</content>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s204/d" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">No Limitation on Section 202 Grant Applications.—</heading><content style="-uslm-dtd:text">An entity that applies for a grant under section 202 is not prohibited from also applying for a grant under this section.</content>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s204/e" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading><content style="-uslm-dtd:text">There are authorized to be appropriated to the Attorney General to carry out this section $10,000,000 for each of the fiscal years 2014 through 2021.</content>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s204/f" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">GAO Evaluation and Report.—</heading><chapeau style="-uslm-dtd:text">Not later than 30 months after the date of enactment of this Act, the Comptroller General of the United States shall conduct a study of and submit to Congress a report evaluating the impact of this section on—</chapeau>
<paragraph identifier="/us/sComp/109/164/tII/s204/f/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the ability of law enforcement personnel to identify victims of severe forms of trafficking in persons and investigate and prosecute cases against offenders, including offenders who engage in the purchasing of commercial sex acts with a minor; and</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s204/f/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">recommendations, if any, regarding any legislative or administrative action the Comptroller General determines appropriate to improve the ability described in paragraph (1).</content>
</paragraph>
</subsection>

<num style="-uslm-dtd:enum" value="204A">SEC. 204A. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t34/s20705a">34 U.S.C. 20705a</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ENHANCING THE ABILITY OF STATE, LOCAL, AND TRIBAL CHILD WELFARE AGENCIES TO IDENTIFY AND RESPOND TO CHILDREN WHO ARE, OR ARE AT RISK OF BEING, VICTIMS OF TRAFFICKING. </heading>
<subsection identifier="/us/sComp/109/164/tII/s204A/a" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Grants To Enhance Child Welfare Services.—</heading><chapeau style="-uslm-dtd:text">The Secretary of Health and Human Services may make grants to eligible States to develop, improve, or expand programs that assist State, local, or Tribal child welfare agencies with identifying and responding to— </chapeau>
<paragraph identifier="/us/sComp/109/164/tII/s204A/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">children considered victims of “<quotedText style="-uslm-dtd:quote">child abuse and neglect</quotedText>” and of “<quotedText style="-uslm-dtd:quote">sexual abuse</quotedText>” under the application of section 111(b)(1) of the Child Abuse Prevention and Treatment Act (42 U.S.C. 5106g(b)(1)) because of being identified as being a victim or at risk of being a victim of a severe form of trafficking in persons; and</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s204A/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">children over whom such agencies have responsibility for placement, care, or supervision and for whom there is reasonable cause to believe are, or are at risk of being a victim of 1 or more severe forms of trafficking in persons. </content>
</paragraph>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s204A/b" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">In this section:</chapeau>
<paragraph identifier="/us/sComp/109/164/tII/s204A/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Child.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">child</term>” means an individual who has not attained 18 years of age or such older age as the State has elected under section 475(8) of the Social Security Act (42 U.S.C. 675(8)). At the option of an eligible State, such term may include an individual who has not attained 26 years of age. </content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s204A/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Eligible state.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">eligible State</term>” means a State that has not received more than 3 grants under this section and meets 1 or more of the following criteria:</chapeau>
<subparagraph identifier="/us/sComp/109/164/tII/s204A/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Elimination of third party control requirement.—</heading><content style="-uslm-dtd:text">The State has eliminated or will eliminate any requirement relating to identification of a controlling third party who causes a child to engage in a commercial sex act in order for the child to be considered a victim of trafficking or a victim of 1 or more severe forms of trafficking in persons for purposes of accessing child welfare services and care.</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s204A/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Application of standard for human trafficking.—</heading><content style="-uslm-dtd:text">The State considers a child to be a victim of trafficking if the individual is a victim of a severe form of trafficking in persons, as described in subparagraph (A) of section 103(11) of the Trafficking Victims Protection Act of 2000 (22 U.S.C. 7102(11)).</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s204A/b/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Development and implementation of State child welfare plan protocols.—</heading><chapeau style="-uslm-dtd:text">The State agency responsible for administering the State plan for foster care and adoption assistance under part E of title IV of the Social Security Act (42 U.S.C. 670 et seq.) has developed and is implementing or will develop and implement protocols that meet the following reporting requirements:</chapeau>
<clause identifier="/us/sComp/109/164/tII/s204A/b/2/C/i" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">The requirement to report immediately, and in no case later than 24 hours after receiving, information on children who have been identified as being a victim of a severe form of trafficking in persons to law enforcement authorities under paragraph (34)(A) of section 471(a) of the Social Security Act (42 U.S.C. 671(a)).</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s204A/b/2/C/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">The requirement to report immediately, and in no case later than 24 hours after receiving, information on missing or abducted children to law enforcement authorities, including children classified as “<quotedText style="-uslm-dtd:quote">runaways</quotedText>”, for entry into the National Crime Information Center (NCIC) database of the Federal Bureau of Investigation, and to the National Center for Missing and Exploited Children, under paragraph (35)(B) of such section. </content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s204A/b/2/C/iii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">The requirement to report to the Secretary of Health and Human Services the total number of children who are victims of child human trafficking under paragraph (34)(B) of such section. </content>
</clause>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s204A/b/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">Trafficking-specific protocol.—</heading><content style="-uslm-dtd:text">The State has developed and implemented or will develop and implement a specialized protocol for responding to a child who is, or is at risk of being, a trafficking victim to ensure the response focuses on the child’s specific safety needs as a victim of trafficking, and that includes the development and use of an alternative mechanism for investigating and responding to cases of child human trafficking in which the alleged offender is not the child’s parent or caregiver without utilizing existing processes for investigating and responding to other forms of child abuse or neglect that require the filing of an abuse or neglect petition. </content>
</subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s204A/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Indian tribe; tribal organization.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Indian tribe</term>” and “<term style="-uslm-dtd:term">tribal organization</term>” have the meanings given those terms in section 4 of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 5304). </content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s204A/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">State.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">State</term>” means each of the 50 States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands. Such term includes an Indian tribe, tribal organization, or tribal consortium with a plan approved under section 479B of the Social Security Act (42 U.S.C. 679c), or which is receiving funding to provide foster care under part E of title IV of such Act pursuant to a cooperative agreement or contract with a State.</content>
</paragraph>

<content class="block" style="-uslm-dtd:text">Each Federal department or agency involved in grant activities related to combatting trafficking or providing services to persons subjected to trafficking inside the United States shall apprise the Senior Policy Operating Group established by section 105(f) of the Victims of Trafficking and Violence Protection Act of 2000 (22 U.S.C. 7103(f)), under the procedures established by the Senior Policy Operating Group, of such activities of the department or agency to ensure that the activities are consistent with the purposes of the Trafficking Victims Protection Act of 2000 (22 U.S.C. 7101 et seq.).</content>

<num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Commercial sex act.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">commercial sex act</term>” has the meaning given the term in section 103(4) of the Trafficking Victims Protection Act of 2000 (22 U.S.C. 7102(3)).</content>
</paragraph>

<num style="-uslm-dtd:enum" value="208">SEC. 208. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t34/s20708">34 U.S.C. 20708</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">GRANTS FOR SPECIALIZED HUMAN TRAFFICKING TRAINING AND TECHNICAL ASSISTANCE FOR SERVICE PROVIDERS. </heading>

<num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">In this section:</chapeau>
<paragraph identifier="/us/sComp/109/164/tII/s208/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Act of trafficking.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">act of trafficking</term>” means an act or practice described in paragraph (9) of section 103 of the Trafficking Victims Protection Act of 2000 (22 U.S.C. 7102).</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s208/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Eligible entity.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">eligible entity</term>” means—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tII/s208/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">a State or unit of local government;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s208/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">a federally recognized Indian tribal government, as determined by the Secretary of the Interior;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s208/a/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">a victim service provider;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s208/a/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">a nonprofit or for-profit organization (including a tribal nonprofit or for-profit organization);</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s208/a/2/E" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">a national organization; or</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s208/a/2/F" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">an institution of higher education (including tribal institutions of higher education).</content>
</subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s208/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">State.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">State</term>” means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, the United States Virgin Islands, the Commonwealth of the Northern Mariana Islands, American Samoa, and any other territory or possession of the United States.</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s208/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Victim of trafficking.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">victim of trafficking</term>” means a person subjected to an act of trafficking.</content>
</paragraph>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s208/b" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Grants Authorized.—</heading><chapeau style="-uslm-dtd:text">The Attorney General may award grants to eligible entities to—</chapeau>
<paragraph identifier="/us/sComp/109/164/tII/s208/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">provide training to identify and protect victims of trafficking;</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s208/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">improve the quality and quantity of services offered to trafficking survivors; and</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s208/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">improve victim service providers’ partnerships with Federal, State, tribal, and local law enforcement agencies and other relevant entities.</content>
</paragraph>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s208/c" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Use of Funds.—</heading><chapeau style="-uslm-dtd:text">A grant awarded under this section shall be used to—</chapeau>
<paragraph identifier="/us/sComp/109/164/tII/s208/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">train law enforcement personnel to identify and protect victims of trafficking, including training such personnel to utilize Federal, State, or local resources to assist victims of trafficking, which may include programs to build law enforcement capacity to identify and respond to human trafficking that are funded through the Office of Community Oriented Policing Services of the Department of Justice, such as the Interdiction for the Protection of Children Program;</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s208/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">train law enforcement or State or local prosecutors to identify, investigate, or prosecute acts of trafficking;</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s208/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">train law enforcement or State or local prosecutors to utilize laws that prohibit acts of trafficking and to assist in the development of State and local laws to prohibit acts of trafficking;</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s208/c/4" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">provide technical assistance on the range of services available to victim service providers who serve trafficking victims;</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s208/c/5" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">develop and distribute materials, including materials identifying best practices in accordance with Federal law and policies, to support victim service providers working with human trafficking victims;</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s208/c/6" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">identify and disseminate other publicly available materials in accordance with Federal law to help build capacity of service providers;</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s208/c/7" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">provide training at relevant conferences, through webinars, or through other mechanisms in accordance with Federal law; or</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s208/c/8" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">assist service providers in developing additional resources such as partnerships with Federal, State, tribal, and local law enforcement agencies and other relevant entities in order to access a range of available services in accordance with Federal law.</content>
</paragraph>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s208/d" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Restrictions.—</heading>
<paragraph identifier="/us/sComp/109/164/tII/s208/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Administrative expenses.—</heading><content style="-uslm-dtd:text">An eligible entity that receives a grant under this section may use not more than 5 percent of the total amount of such grant for administrative expenses.</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s208/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Nonexclusivity.—</heading><content style="-uslm-dtd:text">Nothing in this section may be construed to restrict the ability of an eligible entity to apply for or obtain funding from any other source to carry out the training described in subsection (c).</content>
</paragraph>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s208/e" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading><content style="-uslm-dtd:text">There are authorized to be appropriated $10,000,000 for each of the fiscal years 2007 through 2011 to carry out the provisions of this section.</content>

</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s209/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Covered offender.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">covered offender</quotedText>” means an individual who obtains, patronizes, or solicits a commercial sex act involving a person subject to severe forms of trafficking in persons.</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s209/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Covered offense.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">covered offense</quotedText>” means the provision, obtaining, patronizing, or soliciting of a commercial sex act involving a person subject to severe forms of trafficking in persons.</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s209/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Federal law enforcement officer.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">Federal law enforcement officer</quotedText>” has the meaning given the term in section 115 of title 18, United States Code.</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s209/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Local law enforcement officer.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">local law enforcement officer</quotedText>” means any officer, agent, or employee of a unit of local government authorized by law or by a local government agency to engage in or supervise the prevention, detection, investigation, or prosecution of any violation of criminal law.</content>
</paragraph>

<num style="-uslm-dtd:enum" value="6">(6) </num><heading style="-uslm-dtd:header">State law enforcement officer.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">State law enforcement officer</quotedText>” means any officer, agent, or employee of a State authorized by law or by a State government agency to engage in or supervise the prevention, detection, investigation, or prosecution of any violation of criminal law.</content>
</paragraph>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s209/c" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Department of Justice Training and Policy for Law Enforcement Officers, Prosecutors, and Judges.—</heading>
<paragraph identifier="/us/sComp/109/164/tII/s209/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Training.—</heading>
<subparagraph identifier="/us/sComp/109/164/tII/s209/c/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Law enforcement officers.—</heading><chapeau style="-uslm-dtd:text">The Attorney General shall ensure that each anti-human trafficking program operated by the Department of Justice, including each anti-human trafficking training program for Federal, State, or local law enforcement officers, includes technical training on—</chapeau>
<clause identifier="/us/sComp/109/164/tII/s209/c/1/A/i" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">effective methods for investigating and prosecuting covered offenders; </content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s209/c/1/A/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">facilitating the provision of physical and mental health services by health care providers to persons subject to severe forms of trafficking in persons;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s209/c/1/A/iii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">individually screening all adults and children who are suspected of engaging in commercial sex acts or who are subject to labor exploitation that may be in violation of child labor laws to determine whether each individual screened is a victim of human trafficking; and</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s209/c/1/A/iv" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iv">(iv) </num><chapeau style="-uslm-dtd:text">how—</chapeau>
<subclause identifier="/us/sComp/109/164/tII/s209/c/1/A/iv/I" style="-uslm-dtd:subclause" styleType="OLC">
<num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">victims of sex or labor trafficking often engage in criminal acts as a direct result of severe trafficking in persons; and</content>
</subclause>
<subclause identifier="/us/sComp/109/164/tII/s209/c/1/A/iv/II" style="-uslm-dtd:subclause" styleType="OLC">
<num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">such individuals are victims of a crime and affirmative measures should be taken to avoid arresting, charging, or prosecuting such individuals for any offense that is the direct result of their victimization.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s209/c/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Federal prosecutors.—</heading><content style="-uslm-dtd:text">The Attorney General shall ensure that each anti-human trafficking program operated by the Department of Justice for United States attorneys or other Federal prosecutors includes training on seeking restitution for offenses under chapter 77 of title 18, United States Code, to ensure that each United States attorney or other Federal prosecutor, upon obtaining a conviction for such an offense, requests a specific amount of restitution for each victim of the offense without regard to whether the victim requests restitution.</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s209/c/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Judges.—</heading><content style="-uslm-dtd:text">The Federal Judicial Center shall provide training to judges relating to the application of section 1593 of title 18, United States Code, with respect to ordering restitution for victims of offenses under chapter 77 of such title.</content>
</subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s209/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Policy for federal law enforcement officers.—</heading><content style="-uslm-dtd:text">The Attorney General shall ensure that Federal law enforcement officers are engaged in activities, programs, or operations involving the detection, investigation, and prosecution of covered offenders.</content>
</paragraph>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s209/d" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Minimum Period of Supervised Release for Conspiracy To Commit Commercial Child Sex Trafficking.—</heading><content style="-uslm-dtd:text">Section 3583(k) of title 18, United States Code, is amended by inserting “<quotedText style="-uslm-dtd:quote">1594(c),</quotedText>” after “<quotedText style="-uslm-dtd:quote">1591,</quotedText>”.</content>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s209/e" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Bureau of Justice Statistics Report on State Enforcement of Human Trafficking Prohibitions.—</heading><chapeau style="-uslm-dtd:text">The Director of the Bureau of Justice Statistics shall—</chapeau>
<paragraph identifier="/us/sComp/109/164/tII/s209/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">prepare an annual report on—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tII/s209/e/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">the number of—</chapeau>
<clause identifier="/us/sComp/109/164/tII/s209/e/1/A/i" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">arrests of individuals by State law enforcement officers for a covered offense, noting the number of covered offenders;</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s209/e/1/A/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">prosecutions (including specific charges) of individuals in State court systems for a covered offense, noting the number of covered offenders; and</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s209/e/1/A/iii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">convictions of individuals in State court systems for a covered offense, noting the number of covered offenders; and</content>
</clause>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s209/e/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">sentences imposed on individuals convicted in State court systems for a covered offense; and</content>
</subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s209/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">submit the annual report prepared under paragraph (1) to—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tII/s209/e/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the Committee on the Judiciary of the House of Representatives;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s209/e/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the Committee on the Judiciary of the Senate;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s209/e/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the Task Force;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s209/e/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">the Senior Policy Operating Group established under section 105(g) of the Trafficking Victims Protection Act of 2000 (22 U.S.C. 7103(g)); and</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s209/e/2/E" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">the Attorney General.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s209/f" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Department of Justice Victim Screening Protocol.—</heading>
<paragraph identifier="/us/sComp/109/164/tII/s209/f/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Not later than 180 days after the date of enactment of this subsection, the Attorney General shall issue a screening protocol for use during all anti-trafficking law enforcement operations in which the Department of Justice is involved.</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s209/f/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Requirements.—</heading><chapeau style="-uslm-dtd:text">The protocol required to be issued under paragraph (1) shall—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tII/s209/f/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">require the individual screening of all adults and children who are suspected of engaging in commercial sex acts or who are subject to labor exploitation that may be in violation of child labor laws to determine whether each individual screened is a victim of human trafficking;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s209/f/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">require affirmative measures to avoid arresting, charging, or prosecuting human trafficking victims for any offense that is the direct result of their victimization;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s209/f/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">require all Federal law enforcement officers and relevant department personnel who participate in human trafficking investigations to receive training on enforcement of the protocol;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s209/f/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">be developed in consultation with State and local law enforcement agencies, the Department of Health and Human Services, survivors of human trafficking, and nongovernmental organizations that specialize in the identification, prevention, and restoration of victims of human trafficking; and</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s209/f/2/E" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="E">(E) </num><chapeau style="-uslm-dtd:text">include—</chapeau>
<clause identifier="/us/sComp/109/164/tII/s209/f/2/E/i" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">procedures and practices to ensure that the screening process minimizes trauma or revictimization of the person being screened; and</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s209/f/2/E/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">guidelines on assisting victims of human trafficking in identifying and receiving victim services.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
</section>
<section identifier="/us/sComp/109/164/tII/s210" style="-uslm-dtd:section" styleType="OLC">
<num style="-uslm-dtd:enum" value="210">SEC. 210. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t34/s20710">34 U.S.C. 20710</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">EDUCATION AND OUTREACH TO TRAFFICKING SURVIVORS. </heading>
<chapeau class="block" style="-uslm-dtd:text">The Attorney General shall make available, on the website of the Office of Juvenile Justice and Delinquency Prevention, a database for trafficking victim advocates, crisis hotline personnel, foster parents, law enforcement personnel, and crime survivors that contains information on—</chapeau>
<paragraph identifier="/us/sComp/109/164/tII/s210/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">counseling and hotline resources;</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s210/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">housing resources;</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s210/3" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">legal assistance; and</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s210/4" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">other services for trafficking survivors.</content>
</paragraph>
</section>
<section identifier="/us/sComp/109/164/tII/s211" style="-uslm-dtd:section" styleType="OLC">
<num style="-uslm-dtd:enum" value="211">SEC. 211. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t34/s20711">34 U.S.C. 20711</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ESTABLISHING A NATIONAL STRATEGY TO COMBAT HUMAN TRAFFICKING. </heading>
<subsection identifier="/us/sComp/109/164/tII/s211/a" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Attorney General shall implement and maintain a National Strategy for Combating Human Trafficking (referred to in this section as the “<quotedText style="-uslm-dtd:quote">National Strategy</quotedText>”) in accordance with this section.</content>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s211/b" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Required Contents of National Strategy.—</heading><chapeau style="-uslm-dtd:text">The National Strategy shall include the following:</chapeau>
<paragraph identifier="/us/sComp/109/164/tII/s211/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">Integrated Federal, State, local, and tribal efforts to investigate and prosecute human trafficking cases, including—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tII/s211/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the development by each United States attorney, in consultation with State, local, and tribal government agencies, of a district-specific strategic plan to coordinate the identification of victims and the investigation and prosecution of human trafficking crimes;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s211/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the participation in any Federal, State, local, or tribal human trafficking task force operating in the district of the United States attorney; and</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s211/b/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">any other efforts intended to enhance the level of coordination and cooperation, as determined by the Attorney General.</content>
</subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s211/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Case coordination within the Department of Justice, including specific integration, coordination, and collaboration, as appropriate, on human trafficking investigations between and among the United States attorneys, the Human Trafficking Prosecution Unit, the Child Exploitation and Obscenity Section, and the Federal Bureau of Investigation.</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s211/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">Annual budget priorities and Federal efforts dedicated to preventing and combating human trafficking, including resources dedicated to the Human Trafficking Prosecution Unit, the Child Exploitation and Obscenity Section, the Federal Bureau of Investigation, and all other entities that receive Federal support that have a goal or mission to combat the exploitation of adults and children.</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s211/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">An ongoing assessment of the future trends, challenges, and opportunities, including new investigative strategies, techniques, and technologies, that will enhance Federal, State, local, and tribal efforts to combat human trafficking.</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s211/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">Encouragement of cooperation, coordination, and mutual support between private sector and other entities and organizations and Federal agencies to combat human trafficking, including the involvement of State, local, and tribal government agencies to the extent Federal programs are involved.</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s211/b/6" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">A national strategy to prevent human trafficking and reduce demand for human trafficking victims.</content>
</paragraph>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s211/c" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Human Trafficking Justice Coordinators.—</heading><chapeau style="-uslm-dtd:text">The Attorney General shall designate in each Federal judicial district not less than 1 assistant
United States attorney to serve as the Human Trafficking Coordinator for
the district who, in addition to any other responsibilities, works with a
human trafficking victim-witness specialist and shall be responsible for—</chapeau>
<paragraph identifier="/us/sComp/109/164/tII/s211/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">implementing the National Strategy with respect to all forms of human trafficking, including labor
trafficking and sex trafficking;</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s211/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">prosecuting, or assisting in the prosecution of, human trafficking cases;</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s211/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">conducting public outreach and awareness activities relating to human trafficking;</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s211/c/4" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">ensuring the collection of data required to be collected under clause (viii) of section
105(d)(7)(Q) of the Trafficking Victims Protection Act of 2000 (22 U.S.C.
7103(d)(7)(Q)), as added by section 17 of the <inline style="-uslm-dtd:short-title">Abolish Human Trafficking Act of 2017</inline>, is sought;</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s211/c/5" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">coordinating with other Federal agencies, State, tribal, and local law enforcement agencies, victim
service providers, and other relevant non-governmental organizations to
build partnerships on activities relating to human trafficking; and</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s211/c/6" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">ensuring the collection of restitution for victims is sought as required to be ordered under
section 1593 of title 18, United States Code, and section 2429 of such
title, as added by section 3 of the <inline style="-uslm-dtd:short-title">Abolish Human Trafficking Act of 2017</inline>.</content>
</paragraph>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s211/d" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Department of Justice Coordinator.—</heading><chapeau style="-uslm-dtd:text">Not later than 60 days after the date of enactment of the <inline style="-uslm-dtd:short-title">Abolish Human Trafficking Act of 2017</inline>, the Attorney General shall designate an official who shall coordinate human trafficking efforts
within the Department of Justice who, in addition to any other
responsibilities, shall be responsible for—</chapeau>
<paragraph identifier="/us/sComp/109/164/tII/s211/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">coordinating, promoting, and supporting the work of the Department of Justice relating to human
trafficking, including investigation, prosecution, training, outreach,
victim support, grant-making, and policy activities;</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s211/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">in consultation with survivors of human trafficking, or anti-human trafficking organizations,
producing and disseminating, including making publicly available when
appropriate, replication guides and training materials for law enforcement
officers, prosecutors, judges, emergency responders, individuals working
in victim services, adult and child protective services, social services,
and public safety, medical personnel, mental health personnel, financial
services personnel, and any other individuals whose work may bring them in
contact with human trafficking regarding how to—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tII/s211/d/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">identify signs of human trafficking;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s211/d/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">conduct investigations in human trafficking cases;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s211/d/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">address evidentiary issues and other legal issues; and</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s211/d/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">appropriately assess, respond to, and interact with victims and witnesses in human trafficking
cases, including in administrative, civil, and criminal judicial
proceedings; and</content>
</subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s211/d/3" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">carrying out such other duties as the Attorney General determines necessary in connection with
enhancing the understanding, prevention, and detection of, and response
to, human trafficking.</content>

<num style="-uslm-dtd:enum" value="212">SEC. 212. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t34/s20712">34 U.S.C. 20712</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">HOLISTIC TRAINING FOR FEDERAL LAW ENFORCEMENT OFFICERS AND PROSECUTORS. </heading>
<chapeau class="block" style="-uslm-dtd:text">All training required under the Combat Human Trafficking Act of 2015 (34 U.S.C. 20709) and section 105(c)(4) of the Trafficking Victims Protection Act of 2000 (22 U.S.C. 7105(c)(4)) shall—</chapeau>
<paragraph identifier="/us/sComp/109/164/tII/s212/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">emphasize that an individual who knowingly solicits or patronizes a commercial sex act from a person who was a minor (consistent with section 1591(c) of title 18, United States Code) or was subject to force, fraud, or coercion is guilty of an offense under chapter 77 of title 18, United States Code, and is a party to a human trafficking offense;</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s212/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">develop specific curriculum for—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tII/s212/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">under appropriate circumstances, arresting and prosecuting buyers of commercial sex, child labor that is a violation of law, or forced labor as a form of primary prevention; and</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s212/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">investigating and prosecuting individuals who knowingly benefit financially from participation in a venture that has engaged in any act of human trafficking; and</content>
</subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s212/3" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">specify that any comprehensive approach to eliminating human trafficking shall include a demand reduction component.</content>

<num style="-uslm-dtd:enum" value="213">SEC. 213. </num><heading style="-uslm-dtd:header">ENCOURAGING A VICTIM-CENTERED APPROACH TO TRAINING OF FEDERAL LAW ENFORCEMENT PERSONNEL. </heading>
<subsection identifier="/us/sComp/109/164/tII/s213/a" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="a">(a) </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t34/s20713">34 U.S.C. 20713</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Training Curriculum Improvements.—</heading><content style="-uslm-dtd:text">The Attorney General, Secretary of Homeland Security, and Secretary of Labor shall periodically, but not less frequently than once every 2 years, implement improvements to the training programs on human trafficking for employees of the Department of Justice, Department of Homeland Security, and Department of Labor, respectively, after consultation with survivors of human trafficking, or trafficking victims service providers, and Federal law enforcement agencies responsible for the prevention, deterrence, and prosecution of offenses involving human trafficking (such as individuals serving as, or who have served as, investigators in a Federal agency and who have expertise in identifying human trafficking victims and investigating human trafficking cases).</content>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s213/b" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="b">(b) </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t34/s20713">34 U.S.C. 20713</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Advanced Training Curriculum.—</heading>
<paragraph identifier="/us/sComp/109/164/tII/s213/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">Not later than 1 year after the date of enactment of this Act, the Attorney General and the Secretary of Homeland Security shall develop an advanced training curriculum, to supplement the basic curriculum for investigative personnel of the Department of Justice and the Department of Homeland Security, respectively, that—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tII/s213/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">emphasizes a multidisciplinary, collaborative effort by law enforcement officers who provide a broad range of investigation and prosecution options in response to perpetrators, and victim service providers, who offer services and resources for victims;</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s213/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">provides guidance about the recruitment techniques employed by human traffickers to clarify that an individual who knowingly solicits or patronizes a commercial sex act from a person who was a minor (consistent with section 1591(c) of title 18, United States Code) or was subject to force, fraud, or coercion is guilty of an offense under chapter 77 of title 18, United States Code, and is a party to a human trafficking offense; and</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s213/b/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="C">(C) </num><chapeau style="-uslm-dtd:text">explains that—</chapeau>
<clause identifier="/us/sComp/109/164/tII/s213/b/1/C/i" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">victims of sex or labor trafficking often engage in criminal acts as a direct result of severe trafficking in persons and such individuals are victims of a crime and affirmative measures should be taken to avoid arresting, charging, or prosecuting such individuals for any offense that is the direct result of their victimization; and</content>
</clause>
<clause identifier="/us/sComp/109/164/tII/s213/b/1/C/ii" style="-uslm-dtd:clause" styleType="OLC">
<num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">a comprehensive approach to eliminating human trafficking should include demand reduction as a component.</content>

</subparagraph>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s213/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Use of curriculum.—</heading><chapeau style="-uslm-dtd:text">The Attorney General and the Secretary of Homeland Security shall provide training using the curriculum developed under paragraph (1) to—</chapeau>
<subparagraph identifier="/us/sComp/109/164/tII/s213/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">all law enforcement officers employed by the Department of Justice and the Department of Homeland Security, respectively, who may be involved in the investigation of human trafficking offenses; and</content>
</subparagraph>
<subparagraph identifier="/us/sComp/109/164/tII/s213/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">members of task forces that participate in the investigation of human trafficking offenses.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection identifier="/us/sComp/109/164/tII/s213/c" style="-uslm-dtd:subsection" styleType="OLC">
<num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Training Components.—</heading><chapeau style="-uslm-dtd:text">Section 107(c)(4)(B) of the Trafficking Victims Protection Act of 2000 (22 U.S.C. 7105(c)(4)(B)) is amended—</chapeau>
<paragraph identifier="/us/sComp/109/164/tII/s213/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in clause (ii), by striking “<quotedText style="-uslm-dtd:quote">and</quotedText>” at the end;</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s213/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in clause (iii), by striking the period at the end and inserting “<quotedText style="-uslm-dtd:quote">; and</quotedText>”; and</content>
</paragraph>
<paragraph identifier="/us/sComp/109/164/tII/s213/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
<num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">

<num style="-uslm-dtd:enum" value="iv">“(iv) </num><content style="-uslm-dtd:text">a discussion clarifying that an individual who knowingly solicits or patronizes a commercial sex act from a person who was a minor (consistent with section 1591(c) of title 18, United States Code) or was subject to force, fraud, or coercion is guilty of an offense under chapter 77 of title 18, United States Code, and is a party to a human trafficking offense.”</content>

<num style="-uslm-dtd:enum" value="214">SEC. 214. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t34/s20714">34 U.S.C. 20714</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">TRAINING OF TRIBAL LAW ENFORCEMENT AND PROSECUTORIAL PERSONNEL. </heading><content style="-uslm-dtd:text">The Attorney General, in consultation with the Director of the Office of Tribal Justice, shall carry out a program under which
tribal law enforcement officials may receive technical assistance and training to pursue a victim-centered approach to investigating and prosecuting severe forms of trafficking in persons (as defined in section 103 of the Trafficking Victims Protection Act of 2000 (22 U.S.C. 7102)).</content>
