            <num style="-uslm-dtd:enum" value="312">Sec. 312. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t2/s2062">2 U.S.C. 2062</ref><b>]</b> </editorialNote><subsection class="inline" identifier="/us/sComp/102/90/s312/a" style="-uslm-dtd:subsection" styleType="OLC"><num style="-uslm-dtd:enum" value="a">(a)</num><paragraph class="inline" identifier="/us/sComp/102/90/s312/a/1" style="-uslm-dtd:paragraph" styleType="OLC"><num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">The Chief Administrative Officer of the House of Representatives shall maintain and operate a child care center (to be known as the “<quotedText style="-uslm-dtd:quote">House of Representatives Child Care Center</quotedText>”) to furnish pre-school child care and (subject to the approval of regulations by the Committee on House Administration) child care for school age children other than during the course of the ordinary school day—</chapeau>
            <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/102/90/s312/a/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">for children of individuals whose pay is disbursed by the Chief Administrative Officer of the House of Representatives and children of support personnel of the House of Representatives;</content>
            </subparagraph>
            <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/102/90/s312/a/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">if places are available after admission of all children who are eligible under subparagraph (A), for children of individuals whose pay is disbursed by the Secretary of the Senate and children of employees of agencies of the legislative branch; and</content>
            </subparagraph>
            <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/102/90/s312/a/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">if places are available after admission of all children who are eligible under subparagraph (A) or (B), for children of employees of other offices, departments, and agencies of the Federal Government.</content>
            </subparagraph></paragraph>
            <paragraph class="leftIndentDecrease1" identifier="/us/sComp/102/90/s312/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Children shall be admitted to the center on a nondiscriminatory basis and without regard to any office or position held by their parents.</content>
            </paragraph></subsection>
            <subsection identifier="/us/sComp/102/90/s312/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b)</num><paragraph class="inline" identifier="/us/sComp/102/90/s312/b/1" style="-uslm-dtd:paragraph" styleType="OLC"><num style="-uslm-dtd:enum" value="1">(1)</num><subparagraph class="inline" identifier="/us/sComp/102/90/s312/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC"><num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">The Speaker of the House of Representatives shall appoint 15 individuals (of whom 7 shall be upon recommendation of the minority leader of the House of Representatives), to serve without pay, as members of an advisory board for the center. The board shall—</chapeau>
                <clause class="leftIndentDecrease2" identifier="/us/sComp/102/90/s312/b/1/A/i" style="-uslm-dtd:clause" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">provide advice to the Chief Administrative Officer on matters of policy relating to the administration and operation of the center (including the selection of the director of the center);</content>
                </clause>
                <clause class="leftIndentDecrease2" identifier="/us/sComp/102/90/s312/b/1/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">be chosen from among Members of the House of Representatives, spouses of Members, parents of children enrolled in the center, and other individuals with expertise in child care or interest in the center; and</content>
                </clause>
                <clause class="leftIndentDecrease2" identifier="/us/sComp/102/90/s312/b/1/A/iii" style="-uslm-dtd:clause" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">serve during the Congress in which they are appointed, except that a member of the board may continue to serve after the expiration of a term until a successor is appointed.</content>
                </clause></subparagraph>
                <subparagraph class="leftIndentDecrease2" identifier="/us/sComp/102/90/s312/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">The director of the center shall serve as an additional member of the board, ex officio and without the right to vote.</content>
                </subparagraph></paragraph>
                <paragraph class="leftIndentDecrease1" identifier="/us/sComp/102/90/s312/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">A vacancy on the board shall be filled in the manner in which the original appointment is made.</content>
                </paragraph>
                <paragraph class="leftIndentDecrease1" identifier="/us/sComp/102/90/s312/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">The chairman of the board shall be elected by the members of the board.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/102/90/s312/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><chapeau style="-uslm-dtd:text">In carrying out subsection (a), the Chief Administrative Officer is authorized—</chapeau>
                <paragraph identifier="/us/sComp/102/90/s312/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">to collect fees for child care services;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/102/90/s312/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to accept such gifts of money and property as may be approved by the Chairman and the ranking minority party member of the Committee on House Oversight of the House of Representatives, acting jointly; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/102/90/s312/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">to employ a director and other employees for the center.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/102/90/s312/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d)</num><paragraph class="inline" identifier="/us/sComp/102/90/s312/d/1" style="-uslm-dtd:paragraph" styleType="OLC"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">There is established in the Treasury of the United States a revolving fund for the House of Representatives to be known as the “<quotedText style="-uslm-dtd:quote">House Child Care Center Revolving Fund</quotedText>” (hereafter in this section referred to as the “<quotedText style="-uslm-dtd:quote">Fund</quotedText>”), consisting of the amounts received under subsection (c) and any other funds deposited by the Chief Administrative Officer of the House of Representatives from amounts received by the House of Representatives with respect to the operation of the center. Except as provided in paragraphs (2) and (3), the Fund shall be the exclusive source for all salaries and expenses for activities carried out under this section.</content></paragraph>
                <paragraph class="leftIndentDecrease1" identifier="/us/sComp/102/90/s312/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">With respect to employees of the center, the House of Representatives shall make Government contributions and payments for health insurance, retirement, employment taxes, and similar benefits and programs (including the subsidies provided on behalf of employees of the center as a result of reductions in the amount of tuition otherwise charged with respect to children of such employees under paragraph (4)) in the same manner as such contributions and payments are made for other employees of the House of Representatives.</content>
                </paragraph>
                <paragraph class="leftIndentDecrease1" identifier="/us/sComp/102/90/s312/d/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">The House of Representatives shall make payments from amounts provided in appropriations acts for salaries and expenses of the Office of the Chief Administrative Officer for the following activities carried out under this section:</chapeau>
                    <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/102/90/s312/d/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">The payment of the salary of the director and assistant directors of the center, and, at the option of the Chief Administrative Officer during an emergency situation, the payment of the salary of other employees of the Center.</content>
                    </subparagraph>
                    <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/102/90/s312/d/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">The cost of training classes and conferences for individuals employed by the center in connection with the provision of child care services, together with the cost of travel (including transportation and subsistence) incurred in connection with such classes and conferences.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/102/90/s312/d/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C)<ref class="footnoteRef" idref="ID958FDC18AE974D7FBAFE7BB2D39E7DD8" style="-uslm-dtd:footnote-ref">1</ref> </num><content style="-uslm-dtd:text">The payment of telecommunications expenses for the Center, to include voicemail boxes, land lines, and cell phones for Center employees, in connection with the provision of child care services and as needed for critical and emergent communications.</content><footnote id="ID958FDC18AE974D7FBAFE7BB2D39E7DD8" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">The margins of subparagraphs (C) and (D) are so in law.</p></footnote>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/102/90/s312/d/3/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D)<ref class="footnoteRef" style="-uslm-dtd:dangling-footnote-ref">1</ref> </num><content style="-uslm-dtd:text">During an emergency situation, the payment of such other expenses for activities carried out under this section as the Chief Administrative Officer determines appropriate. <ref class="footnoteRef" idref="IDE9CFFF08C8F94B259375CA2798E66770" style="-uslm-dtd:footnote-ref">2</ref></content><footnote id="IDE9CFFF08C8F94B259375CA2798E66770" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">2</sup><content><p style="-uslm-dtd:para; margin-left:1em">Section 19002(a)(2) of Public Law 116–136, which directed that subparagraph (C) be added “<quotedText style="-uslm-dtd:quote">at the end</quotedText>” of subsection (d)(3)(A), was executed by adding subparagraph (C) at the end of subsection (d)(3), to reflect the probable intent of Congress.</p>
                        <p style="-uslm-dtd:para">Such subparagraph (C) was subsequently redesignated as subparagraph (D) by section 114(a)(1) of division C of Public Law 119–37.</p></content></footnote>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/102/90/s312/d/4" style="-uslm-dtd:paragraph" styleType="appropriations">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><chapeau style="-uslm-dtd:text">In the case of a child of an employee of the center who is furnished care at the center, the Chief Administrative Officer shall reduce the amount of tuition otherwise charged with respect to such child during a month by the greater of—</chapeau>
                    <subparagraph identifier="/us/sComp/102/90/s312/d/4/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">50 percent; or</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/102/90/s312/d/4/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">such percentage as may be necessary to ensure that the total amount of tuition paid by the employee with respect to all children of the employee who are furnished care at the center during the month does not exceed $1,000.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/102/90/s312/e" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><content style="-uslm-dtd:text">The Fund shall be treated as a category of allowances and expenses for purposes of section 101(a) of the Legislative Branch Appropriations Act, 1993 (2 U.S.C. 95b(a)).</content>
            </subsection>
            <subsection identifier="/us/sComp/102/90/s312/f" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="f">(f)<ref class="footnoteRef" idref="ID3B7A1BB9997F4E448D61724B246D19CE" style="-uslm-dtd:footnote-ref">3</ref> </num><chapeau style="-uslm-dtd:text">As used in this section—</chapeau>
                <paragraph identifier="/us/sComp/102/90/s312/f/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">Member of the House of Representatives</term>” means a Representative in, or a Delegate or Resident Commissioner to, the Congress;</content><footnote id="ID3B7A1BB9997F4E448D61724B246D19CE" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">3</sup><p style="-uslm-dtd:para; margin-left:1em">There are two subsection (f)s’ in section 312.</p></footnote>
                </paragraph>
                <paragraph identifier="/us/sComp/102/90/s312/f/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">agency of the legislative branch</term>” means the Office of the Architect of the Capitol, the Botanic Garden, the General Accounting Office<ref class="footnoteRef" idref="ID73443D003707411F9C54A2B410521431" style="-uslm-dtd:footnote-ref">4</ref>, the Government Printing Office, the Library of Congress, the Office of Technology Assessment, the Congressional Budget Office, and the Copyright Royalty Tribunal; and</content><footnote id="ID73443D003707411F9C54A2B410521431" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">4</sup><p style="-uslm-dtd:para; margin-left:1em">The entity called the General Accounting Office was redesignated as the Government Accountability Office by section 8 of Public Law 108–271 (118 Stat. 814).</p></footnote>
                </paragraph>
                <paragraph identifier="/us/sComp/102/90/s312/f/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">support personnel</term>” means, with respect to the House of Representatives, any employee of a credit union or of the Architect of the Capitol, whose principal duties are to support the functions of the House of Representatives.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/102/90/s312/f" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="f">(f)<ref class="footnoteRef" style="-uslm-dtd:dangling-footnote-ref">3</ref> </num><content style="-uslm-dtd:text">House Resolution 21, Ninety-ninth Congress, agreed to December 11, 1985, enacted into permanent law by section 103 of the Legislative Branch Appropriations Act, 1987 (as incorporated by reference in section 101(j) of Public Law 99–500 and Public Law 99–591) (40 U.S.C. 184b–184f) is repealed.</content>
            </subsection>
