    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">Making appropriations for the Departments of Commerce, Justice, and State, the Judiciary, and related agencies for the fiscal year ending September 30, 1990, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
</enactingFormula><section class="inline" role="undesignated-level" style="-uslm-dtd:section" styleType="OLC"><content style="-uslm-dtd:text">That the following sums are appropriated, out of any money in the Treasury not otherwise appropriated, for the Departments of Commerce, Justice, and State, the Judiciary, and related agencies for the fiscal year ending September 30, 1990, and for other purposes, namely:</content>

            <num style="-uslm-dtd:enum" value="IV">TITLE IV—</num><heading style="-uslm-dtd:header">THE JUDICIARY<ref class="footnoteRef" idref="IDC56D706DBB7C4B49B731E5612174F873" style="-uslm-dtd:footnote-ref">1</ref> </heading><footnote id="IDC56D706DBB7C4B49B731E5612174F873" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">Title IV of Public Law 101–162 may be cited as the “<quotedText style="-uslm-dtd:quote">Judiciary Appropriations Act, 1990</quotedText>” (see 103 Stat. 1016).</p></footnote>

</compsdtd:text></compsdtd:subsection><compsdtd:subsection commented="no" display-inline="no-display-inline" id="IDAFE3C67915B6489F8E569F38A1690ED9" in-effect="yes" style="OLC" type="subsequent"><compsdtd:enum>(b)</compsdtd:enum><compsdtd:text cross-reference-style="no" display-inline="yes-display-inline">
<compsdtd:usc-reference>28 U.S.C. 1931 note</compsdtd:usc-reference>All fees as shall be hereafter collected for any service not of a kind described in any of the items enumerated as items 1 through 7 and as items 9 through 18, as in effect on November 21, 1989, of the bankruptcy miscellaneous fee schedule prescribed by the Judicial Conference of the United States under section 1930(b) of title 28, United States Code, 28.87 percent of the fees collected under section 1930(a)(1)(A) of that title, 35.00 percent of the fees collected under section 1930(a)(1)(B) of that title, and 33.33 percent of the fees collected under section 1930(a)(3) of that title shall be deposited as offsetting receipts to the fund established under section 1931 of that title and shall remain available to the Judiciary until expended to reimburse any appropriation for the amount paid out of such appropriation for expenses of the Courts of Appeals, District Courts, and other Judicial Services and the Administrative Office of the United States Courts. The Judicial Conference shall report to the Committees on Appropriations of the House of Representatives and the Senate on a quarterly basis beginning on the first day of each fiscal year regarding the sums deposited in said fund.</compsdtd:text><compsdtd:omitted-text type="7"/></compsdtd:subsection></compsdtd:section></compsdtd:account></foreign>
        </title>
        <title identifier="/us/sComp/101/162/tVI" style="-uslm-dtd:title" styleType="traditional">
            <num style="-uslm-dtd:enum" value="VI">TITLE VI—</num><heading style="-uslm-dtd:header">GENERAL PROVISIONS </heading>
            <elided style="-uslm-dtd:omitted-text">* * * * * * *</elided>
            <section identifier="/us/sComp/101/162/tVI/s605" style="-uslm-dtd:section" styleType="traditional-inline">
                <num style="-uslm-dtd:enum" value="605">Sec. 605. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t15/s18a">15 U.S.C. 18a note</ref><b>]</b> </editorialNote><subsection class="inline" identifier="/us/sComp/101/162/tVI/s605/a" style="-uslm-dtd:subsection" styleType="OLC"><num style="-uslm-dtd:enum" value="a">(a) </num><content style="-uslm-dtd:text">Five working days after enactment of this Act and thereafter, the Federal Trade Commission shall assess and collect filing fees established in subsection (b) which shall be paid by persons acquiring voting securities or assets who are required to file premerger notifications by the section 7A of the Clayton Act (15 U.S.C. 18a) and the regulations promulgated thereunder. For purposes of said Act, no notification shall be considered filed until payment of the fee required by this section. Fees collected pursuant to this section shall be divided evenly between and credited to the appropriations, Federal Trade Commission, “<quotedText style="-uslm-dtd:quote">Salaries and Expenses</quotedText>” and Department of Justice, “<quotedText style="-uslm-dtd:quote">Salaries and Expenses, Antitrust Division</quotedText>”: <i style="-uslm-dtd:italic">Provided,</i> That fees in excess of $40,000,000 in fiscal year 1990 shall be deposited to the credit of the Treasury of the United States: <i style="-uslm-dtd:italic">Provided further,</i> That fees made available to the Federal Trade Commission and the Antitrust Division herein shall remain available until expended.</content></subsection>
                <subsection identifier="/us/sComp/101/162/tVI/s605/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><chapeau style="-uslm-dtd:text">The filing fees referred to in subsection (a) are—</chapeau>
                    <paragraph identifier="/us/sComp/101/162/tVI/s605/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">$30,000 if the aggregate total amount determined under section 7A(a)(2) of the Clayton Act (15 U.S.C. 18a(a)(2)) is less than $161,500,000 (as adjusted and published for each fiscal year beginning after September 30, 2023, in the same manner as provided in section 8(a)(5) of the Clayton Act (15 U.S.C. 19(a)(5)) to reflect the percentage change in the gross national product for such fiscal year compared to the gross national product for the year ending September 30, 2022);</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/162/tVI/s605/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">$100,000 if the aggregate total amount determined under section 7A(a)(2) of the Clayton Act (15 U.S.C. 18a(a)(2)) is not less than $161,500,000 (as so adjusted and published) but is less than $500,000,000 (as so adjusted and published); </content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/162/tVI/s605/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">$250,000 if the aggregate total amount determined under section 7A(a)(2) of the Clayton Act (15 U.S.C. 18a(a)(2)) is not less than $500,000,000 (as so adjusted and published) but is less than $1,000,000,000 (as so adjusted and published);</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/162/tVI/s605/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">$400,000 if the aggregate total amount determined under section 7A(a)(2) of the Clayton Act (15 U.S.C. 18a(a)(2)) is not less than $1,000,000,000 (as so adjusted and published) but is less than $2,000,000,000 (as so adjusted and published);</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/162/tVI/s605/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">$800,000 if the aggregate total amount determined under section 7A(a)(2) of the Clayton Act (15 U.S.C. 18a(a)(2)) is not less than $2,000,000,000 (as so adjusted and published) but is less than $5,000,000,000 (as so adjusted and published); and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/162/tVI/s605/b/6" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">$2,250,000 if the aggregate total amount determined under section 7A(a)(2) of the Clayton Act (15 U.S.C. 18a(a)(2)) is not less than $5,000,000,000 (as so adjusted and published).</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/101/162/tVI/s605/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c)</num><paragraph class="inline" identifier="/us/sComp/101/162/tVI/s605/c/1" style="-uslm-dtd:paragraph" styleType="OLC"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">For each fiscal year commencing after September 30, 2023, the filing fees in this section shall be increased by an amount equal to the percentage increase, if any, in the Consumer Price Index, as determined by the Department of Labor or its successor, for the year then ended over the level so established for the year ending September 30, 2022.</content></paragraph>
                    <paragraph class="leftIndentDecrease1" identifier="/us/sComp/101/162/tVI/s605/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">As soon as practicable, but not later than January 31 of each year, the Federal Trade Commission shall publish the adjusted amounts required by paragraph (1).</content>
                    </paragraph>
                    <paragraph class="leftIndentDecrease1" identifier="/us/sComp/101/162/tVI/s605/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">The Federal Trade Commission shall not adjust amounts required by paragraph (1) if the percentage increase described in paragraph (1) is less than 1 percent.</content>
                    </paragraph>
                    <paragraph class="leftIndentDecrease1" identifier="/us/sComp/101/162/tVI/s605/c/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">An amount adjusted under this section shall be rounded to the nearest multiple of $5,000.</content>
                    </paragraph>
                    <elided style="-uslm-dtd:omitted-text">* * * * * * *</elided>
                    <paragraph class="leftIndentDecrease1" role="undesignated-level" style="-uslm-dtd:paragraph" styleType="OLC"><content style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Departments of Commerce, Justice, and State, the Judiciary, and Related Agencies Appropriations Act, 1990</shortTitle>”.</content>
                    </paragraph>
                </subsection>
