    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To require the Secretary of the Interior to establish a program to provide assistance in the conservation of neotropical migratory birds.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
</enactingFormula>
        <section identifier="/us/sComp/106/247/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6101">16 U.S.C. 6101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Neotropical Migratory Bird Conservation Act</inline></shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/106/247/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6101">16 U.S.C. 6101</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">FINDINGS. </heading>
            <chapeau class="block" style="-uslm-dtd:text">Congress finds that—</chapeau>
            <paragraph identifier="/us/sComp/106/247/s2/1" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">of the nearly 800 bird species known to occur in the United States, approximately 500 migrate among countries, and the large majority of those species, the neotropical migrants, winter in Latin America and the Caribbean but breed in Canada and the United States;</content>
            </paragraph>
            <paragraph identifier="/us/sComp/106/247/s2/2" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">neotropical migratory bird species provide invaluable environmental, economic, recreational, and aesthetic benefits to the United States, as well as to the Western Hemisphere;</content>
            </paragraph>
            <paragraph identifier="/us/sComp/106/247/s2/3" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3)</num><subparagraph class="inline" identifier="/us/sComp/106/247/s2/3/A" style="-uslm-dtd:subparagraph" styleType="OLC"><num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">many neotropical migratory bird populations, once considered common, are in decline, and some have declined to the point that their long-term survival in the wild is in jeopardy; and</content></subparagraph>
                <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/106/247/s2/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the primary reason for the decline in the populations of those species is habitat loss and degradation (including pollution and contamination) across the species’ range; and</content>
                </subparagraph>
            </paragraph>
            <paragraph identifier="/us/sComp/106/247/s2/4" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="4">(4)</num><subparagraph class="inline" identifier="/us/sComp/106/247/s2/4/A" style="-uslm-dtd:subparagraph" styleType="OLC"><num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">because neotropical migratory birds range across numerous international borders each year, their conservation requires the commitment and effort of all countries along their migration routes; and</content></subparagraph>
                <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/106/247/s2/4/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">although numerous initiatives exist to conserve migratory birds and their habitat, those initiatives can be significantly strengthened and enhanced by increased coordination.</content>
                </subparagraph>
            </paragraph>
        </section>
        <section identifier="/us/sComp/106/247/s3" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6102">16 U.S.C. 6102</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PURPOSES. </heading>
            <chapeau class="block" style="-uslm-dtd:text">The purposes of this Act are—</chapeau>
            <paragraph identifier="/us/sComp/106/247/s3/1" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">to perpetuate healthy populations of neotropical migratory birds;</content>
            </paragraph>
            <paragraph identifier="/us/sComp/106/247/s3/2" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to assist in the conservation of neotropical migratory birds by supporting conservation initiatives in the United States, Canada, Latin America, and the Caribbean; and</content>
            </paragraph>
            <paragraph identifier="/us/sComp/106/247/s3/3" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">to provide financial resources and to foster international cooperation for those initiatives.</content>
            </paragraph>
        </section>
        <section identifier="/us/sComp/106/247/s4" role="definitions" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6103">16 U.S.C. 6103</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
            <chapeau class="block" style="-uslm-dtd:text">In this Act:</chapeau>
            <paragraph identifier="/us/sComp/106/247/s4/1" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Caribbean.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Caribbean</term>” includes Puerto Rico and the United States Virgin Islands.</content>
            </paragraph>
            <paragraph identifier="/us/sComp/106/247/s4/2" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Conservation.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">conservation</term>” means the use of methods and procedures necessary to bring a species of neotropical migratory bird to the point at which there are sufficient populations in the wild to ensure the long-term viability of the species, including—</chapeau>
                <subparagraph identifier="/us/sComp/106/247/s4/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">protection and management of neotropical migratory bird populations;</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/106/247/s4/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">maintenance, management, protection, and restoration of neotropical migratory bird habitat;</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/106/247/s4/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">research and monitoring;</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/106/247/s4/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">law enforcement; and</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/106/247/s4/2/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">community outreach and education.</content>
                </subparagraph>
            </paragraph>
            <paragraph identifier="/us/sComp/106/247/s4/3" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Fund.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Fund</term>” means the Neotropical Migratory Bird Conservation Fund established by section 9(a).</content>
            </paragraph>
            <paragraph identifier="/us/sComp/106/247/s4/4" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Secretary.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Secretary</term>” means the Secretary of the Interior.</content>
            </paragraph>
        </section>
        <section identifier="/us/sComp/106/247/s5" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6104">16 U.S.C. 6104</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">FINANCIAL ASSISTANCE. </heading>
            <subsection identifier="/us/sComp/106/247/s5/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The Secretary shall establish a program to provide financial assistance for projects to promote the conservation of neotropical migratory birds.</content>
            </subsection>
            <subsection identifier="/us/sComp/106/247/s5/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Project Applicants.—</heading><chapeau style="-uslm-dtd:text">A project proposal may be submitted by—</chapeau>
                <paragraph identifier="/us/sComp/106/247/s5/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">an individual, corporation, partnership, trust, association, or other private entity;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/247/s5/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">an officer, employee, agent, department, or instrumentality of the Federal Government, of any State, municipality, or political subdivision of a State, or of any foreign government;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/247/s5/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">a State, municipality, or political subdivision of a State;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/247/s5/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">any other entity subject to the jurisdiction of the United States or of any foreign country; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/247/s5/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">an international organization (as defined in section 1 of the International Organizations Immunities Act (22 U.S.C. 288)).</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/106/247/s5/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Project Proposals.—</heading><chapeau style="-uslm-dtd:text">To be considered for financial assistance for a project under this Act, an applicant shall submit a project proposal that—</chapeau>
                <paragraph identifier="/us/sComp/106/247/s5/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">includes—</chapeau>
                    <subparagraph identifier="/us/sComp/106/247/s5/c/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the name of the individual responsible for the project;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/247/s5/c/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">a succinct statement of the purposes of the project;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/247/s5/c/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">a description of the qualifications of individuals conducting the project; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/247/s5/c/1/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">an estimate of the funds and time necessary to complete the project, including sources and amounts of matching funds;</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/106/247/s5/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">demonstrates that the project will enhance the conservation of neotropical migratory bird species in the United States, Canada, Latin America, or the Caribbean;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/247/s5/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">includes mechanisms to ensure adequate local public participation in project development and implementation;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/247/s5/c/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">contains assurances that the project will be implemented in consultation with relevant wildlife management authorities and other appropriate government officials with jurisdiction over the resources addressed by the project;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/247/s5/c/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">demonstrates sensitivity to local historic and cultural resources and complies with applicable laws;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/247/s5/c/6" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">describes how the project will promote sustainable, effective, long-term programs to conserve neotropical migratory birds; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/247/s5/c/7" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">provides any other information that the Secretary considers to be necessary for evaluating the proposal.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/106/247/s5/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Project Reporting.—</heading><content style="-uslm-dtd:text">Each recipient of assistance for a project under this Act shall submit to the Secretary such periodic reports as the Secretary considers to be necessary. Each report shall include all information required by the Secretary for evaluating the progress and outcome of the project.</content>
            </subsection>
            <subsection identifier="/us/sComp/106/247/s5/e" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Cost Sharing.—</heading>
                <paragraph identifier="/us/sComp/106/247/s5/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Federal share.—</heading><content style="-uslm-dtd:text">The Federal share of the cost of each project shall be not greater than 33.3 percent.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/247/s5/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Non-federal share.—</heading>
                    <subparagraph identifier="/us/sComp/106/247/s5/e/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Source.—</heading><content style="-uslm-dtd:text">The non-Federal share required to be paid for a project shall not be derived from any Federal grant program.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/247/s5/e/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Form of payment.—</heading>
                        <clause identifier="/us/sComp/106/247/s5/e/2/B/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Projects in the united states and canada.—</heading><content style="-uslm-dtd:text">The non-Federal share required to be paid for a project carried out in the United States or Canada shall be paid in cash.</content>
                        </clause>
                        <clause identifier="/us/sComp/106/247/s5/e/2/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">Projects in latin america and the caribbean.—</heading><content style="-uslm-dtd:text">The non-Federal share required to be paid for a project carried out in Latin America or the Caribbean may be paid in cash or in kind.</content>
                        </clause>
                    </subparagraph>
                </paragraph>
            </subsection>
        </section>
        <section identifier="/us/sComp/106/247/s6" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="6">SEC. 6. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6105">16 U.S.C. 6105</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DUTIES OF THE SECRETARY. </heading>
            <chapeau class="block" style="-uslm-dtd:text">In carrying out this Act, the Secretary shall—</chapeau>
            <paragraph identifier="/us/sComp/106/247/s6/1" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">develop guidelines for the solicitation of proposals for projects eligible for financial assistance under section 5;</content>
            </paragraph>
            <paragraph identifier="/us/sComp/106/247/s6/2" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">encourage submission of proposals for projects eligible for financial assistance under section 5, particularly proposals from relevant wildlife management authorities;</content>
            </paragraph>
            <paragraph identifier="/us/sComp/106/247/s6/3" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">select proposals for financial assistance that satisfy the requirements of section 5, giving preference to proposals that address conservation needs not adequately addressed by existing efforts and that are supported by relevant wildlife management authorities; and</content>
            </paragraph>
            <paragraph identifier="/us/sComp/106/247/s6/4" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">generally implement this Act in accordance with its purposes.</content>
            </paragraph>
        </section>
        <section identifier="/us/sComp/106/247/s7" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="7">SEC. 7. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6106">16 U.S.C. 6106</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">COOPERATION. </heading>
            <subsection identifier="/us/sComp/106/247/s7/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">In carrying out this Act, the Secretary shall—</chapeau>
                <paragraph identifier="/us/sComp/106/247/s7/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">support and coordinate existing efforts to conserve neotropical migratory bird species, through—</chapeau>
                    <subparagraph identifier="/us/sComp/106/247/s7/a/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">facilitating meetings among persons involved in such efforts;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/247/s7/a/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">promoting the exchange of information among such persons;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/247/s7/a/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">developing and entering into agreements with other Federal agencies, foreign, State, and local governmental agencies, and nongovernmental organizations; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/247/s7/a/1/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">conducting such other activities as the Secretary considers to be appropriate; and</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/106/247/s7/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">coordinate activities and projects under this Act with existing efforts in order to enhance conservation of neotropical migratory bird species.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/106/247/s7/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Advisory Group.—</heading>
                <paragraph identifier="/us/sComp/106/247/s7/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">To assist in carrying out this Act, the Secretary may convene an advisory group consisting of individuals representing public and private organizations actively involved in the conservation of neotropical migratory birds. The advisory group as a whole shall have expertise in the methods and procedures set forth in section 4(2) in each country and region of the Western Hemisphere.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/247/s7/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Public participation.—</heading>
                    <subparagraph identifier="/us/sComp/106/247/s7/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Meetings.—</heading><chapeau style="-uslm-dtd:text">The advisory group shall—</chapeau>
                        <clause identifier="/us/sComp/106/247/s7/b/2/A/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">ensure that each meeting of the advisory group is open to the public; and</content>
                        </clause>
                        <clause identifier="/us/sComp/106/247/s7/b/2/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">provide, at each meeting, an opportunity for interested persons to present oral or written statements concerning items on the agenda.</content>
                        </clause>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/247/s7/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Notice.—</heading><content style="-uslm-dtd:text">The Secretary shall provide to the public timely notice of each meeting of the advisory group.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/247/s7/b/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Minutes.—</heading><content style="-uslm-dtd:text">Minutes of each meeting of the advisory group shall be kept by the Secretary and shall be made available to the public.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/106/247/s7/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Exemption from chapter 10 of title 5, united states code.—</heading><content style="-uslm-dtd:text">Chapter 10 of title 5, United States Code, shall not apply to the advisory group.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/106/247/s7/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Report to Congress.—</heading><content style="-uslm-dtd:text">Not later than 180 days after the date of the enactment of the <inline style="-uslm-dtd:short-title">Migratory Birds of the Americas Conservation Enhancements Act of 2023</inline>, the Secretary shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Natural Resources of the House of Representatives a report describing the implementation of subsection (b) by the Secretary, which shall include, if applicable, a description of the composition of the advisory group convened under paragraph (1) of that subsection.</content>
            </subsection>
        </section>
        <section identifier="/us/sComp/106/247/s8" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="8">SEC. 8. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6107">16 U.S.C. 6107</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">REPORT TO CONGRESS. </heading>
            <content class="block" style="-uslm-dtd:text">Not later than 2 years after the date of the enactment of the Neotropical Migratory Bird Conservation Improvement Act of 2006 the Secretary shall submit to Congress a report on the results and effectiveness of the program carried out under this Act, including recommendations concerning how the Act might be improved and whether the program should be continued.</content>
        </section>
        <section identifier="/us/sComp/106/247/s9" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="9">SEC. 9. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6108">16 U.S.C. 6108</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">NEOTROPICAL MIGRATORY BIRD CONSERVATION FUND. </heading>
            <subsection identifier="/us/sComp/106/247/s9/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Establishment.—</heading><content style="-uslm-dtd:text">There is established in the Treasury a separate account, which shall be known as the “<quotedText style="-uslm-dtd:quote">Neotropical Migratory Bird Conservation Fund</quotedText>”. The Fund shall consist of amounts deposited into the Fund by the Secretary of the Treasury under subsection (b).</content>
            </subsection>
            <subsection identifier="/us/sComp/106/247/s9/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Deposits Into the Fund.—</heading><chapeau style="-uslm-dtd:text">The Secretary of the Treasury shall deposit into the Fund—</chapeau>
                <paragraph identifier="/us/sComp/106/247/s9/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">all amounts received by the Secretary in the form of donations under subsection (d); and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/247/s9/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">other amounts appropriated to the Fund.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/106/247/s9/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Use.—</heading>
                <paragraph identifier="/us/sComp/106/247/s9/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Subject to paragraph (2), the Secretary may use amounts in the Account, without further Act of appropriation, to carry out this Act.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/247/s9/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Administrative expenses.—</heading><content style="-uslm-dtd:text">Of amounts in the Account available for each fiscal year, the Secretary may expend not more than 3 percent or up to $100,000, whichever is greater, to pay the administrative expenses necessary to carry out this Act.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/106/247/s9/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Acceptance and Use of Donations.—</heading><content style="-uslm-dtd:text">The Secretary may accept and use donations to carry out this Act. Amounts received by the Secretary in the form of donations shall be transferred to the Secretary of the Treasury for deposit into the Fund.</content>
            </subsection>
        </section>
        <section identifier="/us/sComp/106/247/s10" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="10">SEC. 10. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6109">16 U.S.C. 6109</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">AUTHORIZATION OF APPROPRIATIONS. </heading>
            <subsection identifier="/us/sComp/106/247/s10/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">There is authorized to be appropriated to carry out this Act $6,500,000 for each of fiscal years 2019 through 2028.</content>
            </subsection>
            <subsection identifier="/us/sComp/106/247/s10/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Use of Funds.—</heading><content style="-uslm-dtd:text">Of the amounts made available under subsection (a) for each fiscal year, not less than 75 percent
 shall be expended for projects carried out at a location outside of the
 United States.</content>
            </subsection>
        </section>
