    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To complete the orderly withdrawal of the NOAA from the civil administration of the Pribilof Islands, Alaska, and to assist in the conservation of coral reefs, and for other purposes.</officialTitle></longTitle>
        <title identifier="/us/sComp/106/562/tI" style="-uslm-dtd:title" styleType="OLC">
            <num style="-uslm-dtd:enum" value="I">TITLE I—</num><heading style="-uslm-dtd:header">PRIBILOF ISLANDS </heading>
            <section identifier="/us/sComp/106/562/tI/s101" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="101">SEC. 101. </num><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
                <content class="block" style="-uslm-dtd:text">This title may be referred to as the “<quotedText style="-uslm-dtd:quote">Pribilof Islands Transition Act</quotedText>”.</content>

            <section identifier="/us/sComp/106/562/tI/s105" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="105">SEC. 105. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s1161">16 U.S.C. 1161 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">TERMINATION OF RESPONSIBILITIES. </heading>
                <subsection identifier="/us/sComp/106/562/tI/s105/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Future Obligation.—</heading>
                    <paragraph identifier="/us/sComp/106/562/tI/s105/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Notwithstanding paragraph (2) and effective beginning on the date the Secretary publishes the notice of certification required by subsection (b)(5), the Secretary of Commerce shall not be considered to have any obligation to promote or otherwise provide for the development of any form of an economy not dependent on sealing on the Pribilof Islands, Alaska, including any obligation under section 206 of the Fur Seal Act of 1966 (16 U.S.C. 1166) or section 3(c)(1)(A) of Public Law 104–91 (16 U.S.C. 1165 note).</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tI/s105/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Savings.—</heading><chapeau style="-uslm-dtd:text">This subsection shall not affect any cause of action under section 206 of the Fur Seal Act of 1966 (16 U.S.C. 1166) or section 3(c)(1)(A) of Public Law 104–91 (16 U.S.C. 1165 note)—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">that arose before the date of the enactment of this title; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">for which a judicial action is filed before the expiration of the 5-year period beginning on the date of the enactment of this title.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tI/s105/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Rule of construction.—</heading><chapeau style="-uslm-dtd:text">Nothing in this title shall be construed to imply that—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/a/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">any obligation to promote or otherwise provide for the development in the Pribilof Islands of any form of an economy not dependent on sealing was or was not established by section 206 of the Fur Seal Act of 1966 (16 U.S.C. 1166), section 3(c)(1)(A) of Public Law 104–91 (16 U.S.C. 1165 note), or any other provision of law; or</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/a/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">any cause of action could or could not arise with respect to such an obligation.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tI/s105/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Conforming amendment.—</heading><content style="-uslm-dtd:text">Section 3(c)(1) of Public Law 104–91 (16 U.S.C. 1165 note) is amended by striking subparagraph (A) and redesignating subparagraphs (B) through (D) in order as subparagraphs (A) through (C).</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tI/s105/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Property Conveyance and Cleanup.—</heading>
                    <paragraph identifier="/us/sComp/106/562/tI/s105/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">Subject to paragraph (2), there are terminated all obligations of the Secretary of Commerce and the United States to—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">convey property under section 205(a) of the Fur Seal Act of 1966 (16 U.S.C. 1165(a)); and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">carry out cleanup activities, including assessment, response, remediation, and monitoring, except for postremedial measures such as monitoring and operation and maintenance activities, related to National Oceanic and Atmospheric Administration administration of the Pribilof Islands, Alaska, under section 3 of Public Law 104–91 (16 U.S.C. 1165 note) and the Pribilof Islands Environmental Restoration Agreement between the National Oceanic and Atmospheric Administration and the State of Alaska, signed January 26, 1996.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tI/s105/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Application.—</heading><chapeau style="-uslm-dtd:text">Paragraph (1) shall apply on and after the date on which the Secretary of Commerce certifies that—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the State of Alaska has provided written confirmation that no further corrective action is required at the sites and operable units covered by the Pribilof Islands Environmental Restoration Agreement between the National Oceanic and Atmospheric Administration and the State of Alaska, signed January 26, 1996, with the exception of postremedial measures, such as monitoring and operation and maintenance activities;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the cleanup required under section 3(a) of Public Law 104–91 (16 U.S.C. 1165 note) is complete;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/b/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the properties specified in the document referred to in subsection (a) of section 205 of the Fur Seal Act of 1966 (16 U.S.C. 1165(a)) can be unconditionally offered for conveyance under that section; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/b/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">all amounts appropriated under section 206(c)(1) of the Fur Seal Act of 1966, as amended by this title, have been obligated.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tI/s105/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Financial contributions for cleanup costs.—</heading><subparagraph class="inline" identifier="/us/sComp/106/562/tI/s105/b/3/A" style="-uslm-dtd:subparagraph" styleType="OLC"><num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">On and after the date on which section 3(b)(5) of Public Law 104–91 (16 U.S.C. 1165 note) is repealed pursuant to subsection (c), the Secretary of Commerce may not seek or require financial contribution by or from any local governmental entity of the Pribilof Islands, any official of such an entity, or the owner of land on the Pribilof Islands, for cleanup costs incurred pursuant to section 3(a) of Public Law 104–91 (as in effect before such repeal), except as provided in subparagraph (B).</content></subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/106/562/tI/s105/b/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">Subparagraph (A) shall not limit the authority of the Secretary of Commerce to seek or require financial contribution from any person for costs or fees to clean up any matter that was caused or contributed to by such person on or after March 15, 2000.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tI/s105/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Certain reserved rights not conditions.—</heading><chapeau style="-uslm-dtd:text">For purposes of paragraph (2)(C), the following requirements shall not be considered to be conditions on conveyance of property:</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/b/4/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">Any requirement that a potential transferee must allow the National Oceanic and Atmospheric Administration continued access to the property to conduct environmental monitoring following remediation activities.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/b/4/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">Any requirement that a potential transferee must allow the National Oceanic and Atmospheric Administration access to the property to continue the operation, and eventual closure, of treatment facilities.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/b/4/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">Any requirement that a potential transferee must comply with institutional controls to ensure that an environmental cleanup remains protective of human health or the environment that do not unreasonably affect the use of the property.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/b/4/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">Valid existing rights in the property, including rights granted by contract, permit, right-of-way, or easement.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/b/4/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">The terms of the documents described in subsection (d)(2).</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tI/s105/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Notice of certification.—</heading><content style="-uslm-dtd:text">The Secretary shall promptly publish and submit to the Committee on Natural Resources of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate notice that the certification described in paragraph (2) has been made.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tI/s105/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Repeals.—</heading><chapeau style="-uslm-dtd:text">Effective on the date on which the Secretary of Commerce publishes the notice of certification required by subsection (b)(5), the following provisions are repealed:</chapeau>
                    <paragraph identifier="/us/sComp/106/562/tI/s105/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Subsections (a), (b), (c), and (d) of section 205 of the Fur Seal Act of 1966 (16 U.S.C. 1165).</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tI/s105/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Section 3 of Public Law 104–91 (16 U.S.C. 1165 note).</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tI/s105/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Savings.—</heading>
                    <paragraph identifier="/us/sComp/106/562/tI/s105/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Nothing in this title shall affect any obligation of the Secretary of Commerce, or of any Federal department or agency, under or with respect to any document described in paragraph (2) or with respect to any lands subject to such a document.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tI/s105/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Documents described.—</heading><chapeau style="-uslm-dtd:text">The documents referred to in paragraph (1) are the following:</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/d/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">The Transfer of Property on the Pribilof Islands: Description, Terms, and Conditions, dated February 10, 1984, between the Secretary of Commerce and various Pribilof Island entities.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/d/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">The Settlement Agreement between Tanadgusix Corporation and the City of St. Paul, dated January 11, 1988, and approved by the Secretary of Commerce on February 23, 1988.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/d/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">The Memorandum of Understanding between Tanadgusix Corporation, Tanaq Corporation, and the Secretary of Commerce, dated December 22, 1976.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tI/s105/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Notifications.—</heading>
                    <paragraph identifier="/us/sComp/106/562/tI/s105/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Not later than 30 days after the Secretary makes a determination under subsection (f) that land on St. Paul Island, Alaska, not specified for transfer in the document entitled “<quotedText style="-uslm-dtd:quote">Transfer of Property on the Pribilof Islands: Descriptions, Terms and Conditions</quotedText>”or section 522 of the Pribilof Island Transition Completion
Act of 2016, or transferred to the Secretary of the department
in which the Coast Guard is operating under section 524 of
such Act, is in excess of the needs of the Secretary and the Federal Government, the Secretary shall notify the Alaska native village corporation for St. Paul Island of the determination.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tI/s105/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Election to receive.—</heading><content style="-uslm-dtd:text">Not later than 60 days after the date receipt of the notification of the Secretary under subsection (a), the Alaska native village corporation for St. Paul Island shall notify the Secretary in writing whether the Alaska native village corporation elects to receive all right, title, and interest in the land or a portion of the land.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tI/s105/e/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Transfer.—</heading><content style="-uslm-dtd:text">If the Alaska native village corporation provides notice under paragraph (2) that the Alaska native village corporation elects to receive all right, title and interest in the land or a portion of the land, the Secretary shall transfer all right, title, and interest in the land or portion to the Alaska native village corporation at no cost.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tI/s105/e/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Other disposition.—</heading><content style="-uslm-dtd:text">If the Alaska native village corporation does not provide notice under paragraph (2) that the Alaska native village corporation elects to receive all right, title, and interest in the land or a portion of the land, the Secretary may dispose of the land in accordance with other applicable law.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tI/s105/f" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Determination.—</heading>
                    <paragraph identifier="/us/sComp/106/562/tI/s105/f/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">Not later than 2 years after the date of the enactment of this subsection and not less than once every 5 years thereafter, the Secretary shall determine whether property located on St. Paul Island and not transferred to the Secretary of the department in which the Coast Guard is operating under section 524 of the Pribilof Island Transition Completion Act of 2016 or to the Natives of the Pribilof Islands is in excess of the smallest practicable tract enclosing land—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/f/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">needed by the Secretary for the purposes of carrying out the Fur Seal Act of 1966 (16 U.S.C. 1151 et seq.);</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/f/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">in the case of land withdrawn by the Secretary on behalf of other Federal agencies, needed for carrying out the missions of those agencies for which land was withdrawn; or</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/f/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">actually used by the Federal Government in connection with the administration of any Federal installation on St. Paul Island.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tI/s105/f/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Report of determination.—</heading><chapeau style="-uslm-dtd:text">When a determination is made under paragraph (1), the Secretary shall report the determination to—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/f/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the Committee on Natural Resources of the House of Representatives;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/f/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the Committee on Commerce, Science, and Transportation of the Senate; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tI/s105/f/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the Alaska native village corporation for St. Paul Island.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>

                    <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Definitions.—</heading>
                    <paragraph identifier="/us/sComp/106/562/tI/s105/g/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Except as provided in paragraph (2), the definitions set forth in section 101 of the Fur Seal Act of 1966 (16 U.S.C. 1151) shall apply to this section.</content>

            <num style="-uslm-dtd:enum" value="II">TITLE II—</num><heading style="-uslm-dtd:header">CORAL REEF CONSERVATION </heading>
            <section identifier="/us/sComp/106/562/tII/s201" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="201">SEC. 201. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6401">16 U.S.C. 6401 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
                <content class="block" style="-uslm-dtd:text">This title may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Coral Reef Conservation Act of 2000</inline></shortTitle>”.</content>
            </section>

                <num style="-uslm-dtd:enum" value="202">SEC. 202. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6401">16 U.S.C. 6401</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PURPOSES. </heading>
                <chapeau class="block" style="-uslm-dtd:text">The purposes of this title are—</chapeau>
                <paragraph identifier="/us/sComp/106/562/tII/s202/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">to conserve and restore the condition of United States coral reef ecosystems challenged by natural and human-accelerated changes, including increasing ocean temperatures, changing ocean chemistry, coral bleaching, coral diseases, water quality degradation, invasive species, and illegal, unreported, and unregulated fishing;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s202/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to promote the science-based management and sustainable use of coral reef ecosystems to benefit local communities and the Nation, including through improved integration and cooperation among Federal and non-Federal stakeholders responsible for managing coral reef resources;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s202/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">to develop sound scientific information on the condition of coral reef ecosystems, continuing and emerging threats to such ecosystems, and the efficacy of innovative tools, technologies, and strategies to mitigate stressors and restore such ecosystems, including evaluation criteria to determine the effectiveness of management interventions, and accurate mapping for coral reef restoration;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s202/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">to assist in the preservation of coral reefs by supporting science-based, consensus-driven, and community-based coral reef management by covered States and covered Native entities, including monitoring, conservation, and restoration projects that empower local communities, small businesses, and nongovernmental organizations;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s202/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">to provide financial resources, technical assistance, and scientific expertise to supplement, complement, and strengthen community-based management programs and conservation and restoration projects of non-Federal reefs;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s202/6" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">to establish a formal mechanism for collecting and allocating monetary donations from the private sector to be used for coral reef conservation and restoration projects;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s202/7" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="7">(7) </num><chapeau style="-uslm-dtd:text">to support rapid, effective, and science-based assessment and response to exigent circumstances that pose immediate and long-term threats to coral reefs, including—</chapeau>
                    <subparagraph identifier="/us/sComp/106/562/tII/s202/7/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">coral disease outbreaks;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s202/7/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">invasive or nuisance species;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s202/7/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">coral bleaching;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s202/7/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">natural disasters; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s202/7/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">industrial or mechanical disasters, including vessel groundings, hazardous spills, and coastal construction accidents; and</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s202/8" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">to serve as a model for advancing similar international efforts to monitor, conserve, and restore coral reef ecosystems.</content>
                </paragraph>
            </section>
            <section identifier="/us/sComp/106/562/tII/s203" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="203">SEC. 203. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6402">16 U.S.C. 6402</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">FEDERAL CORAL REEF MANAGEMENT AND RESTORATION ACTIVITIES. </heading>
                <subsection identifier="/us/sComp/106/562/tII/s203/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General </heading><chapeau style="-uslm-dtd:text">.—The Administrator, the Secretary of the Interior, or the Secretary of Commerce may conduct activities described in <foreign id="warning-d604688e376" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="H9EB37B6506174CFBAAC77F0FF3969152" legis-path="203.(b)">subsection (b)</compsdtd:internal-xref></foreign> to conserve and restore coral reefs and coral reef ecosystems that are consistent with—</chapeau>
                    <paragraph identifier="/us/sComp/106/562/tII/s203/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">all applicable laws governing resource management in Federal and State waters, including this Act;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s203/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the National Coral Reef Resilience Strategy; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s203/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">coral reef action plans in effect under <foreign id="warning-d604688e391" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="HDAEB9988AB4D4307B7B182A778CCFC90" legis-path="205.">section 205</compsdtd:internal-xref></foreign>, as applicable.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s203/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Activities Described </heading><chapeau style="-uslm-dtd:text">.—Activities described in this subsection are activities to conserve, research, monitor, assess, and restore coral reefs and coral reef ecosystems in waters managed under the jurisdiction of a Federal agency specified in <foreign id="warning-d604688e400" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="HB93B1144D22B476BB971E5AF74EBC0B4" legis-path="203.(c)">subsection (c)</compsdtd:internal-xref></foreign> or in coordination with a State in waters managed under the jurisdiction of such State, including—</chapeau>
                    <paragraph identifier="/us/sComp/106/562/tII/s203/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">developing, including through the collection of requisite in situ and remotely sensed data, high-quality and digitized maps reflecting—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s203/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">current and historical live coral cover data;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s203/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">coral reef habitat quality data;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s203/b/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">priority areas for coral reef conservation to maintain biodiversity and ecosystem structure and function, including the reef matrix, that benefit coastal communities and living marine resources;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s203/b/1/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">priority areas for coral reef restoration to enhance biodiversity and ecosystem structure and function, including the reef matrix, to benefit coastal communities and living marine resources; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s203/b/1/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">areas of concern that may require enhanced monitoring of coral health and cover;</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s203/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">enhancing compliance with Federal laws that prohibit or regulate—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s203/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the taking of coral products or species associated with coral reefs; or</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s203/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the use and management of coral reef ecosystems;</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s203/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">long-term ecological monitoring of coral reef ecosystems;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s203/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">implementing species-specific recovery plans for listed coral species consistent with the Endangered Species Act of 1973 (16 U.S.C. 1531 et seq.);</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s203/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">restoring degraded coral reef ecosystems;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s203/b/6" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">reducing land-based stressors to coral reef ecosystems;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s203/b/7" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">promoting ecologically sound navigation and anchorages, including through navigational aids and expansion of reef-safe anchorages and mooring buoy systems, to enhance recreational access while preventing or minimizing the likelihood of vessel impacts or other physical damage to coral reefs;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s203/b/8" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">monitoring and responding to severe bleaching or mortality events, disease outbreaks, invasive species outbreaks, and significant maritime accidents, including hazardous spill cleanup and the removal of grounded vessels;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s203/b/9" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="9">(9) </num><content style="-uslm-dtd:text">conducting scientific research that contributes to the understanding, sustainable use, and long-term conservation of coral reefs;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s203/b/10" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="10">(10) </num><content style="-uslm-dtd:text">enhancing public awareness, understanding, and appreciation of coral reefs and coral reef ecosystems and their ecological and socioeconomic value; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s203/b/11" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="11">(11) </num><content style="-uslm-dtd:text">centrally archiving, managing, and distributing on a public website data sets and coral reef ecosystem assessments, including the data repositories of the Coral Reef Conservation Program of the National Oceanic and Atmospheric Administration.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s203/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Federal Agencies Specified </heading><chapeau style="-uslm-dtd:text">.—A Federal agency specified in this subsection is one of the following:</chapeau>
                    <paragraph identifier="/us/sComp/106/562/tII/s203/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The National Oceanic and Atmospheric Administration.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s203/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The National Park Service.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s203/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">The United States Fish and Wildlife Service.</content>
                    </paragraph>

                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">The Office of Insular Affairs.</content>

                <num style="-uslm-dtd:enum" value="204">SEC. 204. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6403">16 U.S.C. 6403</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">NATIONAL CORAL REEF RESILIENCE STRATEGY. </heading>
                <subsection identifier="/us/sComp/106/562/tII/s204/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General </heading><chapeau style="-uslm-dtd:text">.—The Administrator shall—</chapeau>
                    <paragraph identifier="/us/sComp/106/562/tII/s204/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">not later than 2 years after the date of the enactment of the <inline style="-uslm-dtd:short-title">James M. Inhofe National Defense Authorization Act for Fiscal Year 2023</inline>, develop a national coral reef resilience strategy; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s204/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">review and revise the strategy—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s204/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">

                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">as appropriate.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s204/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Elements </heading><chapeau style="-uslm-dtd:text">.—The strategy required by <foreign id="warning-d604688e540" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="HB2DF255063264E83B3836C3B70445634" legis-path="204.(a)">subsection (a)</compsdtd:internal-xref></foreign> shall include the following:</chapeau>
                    <paragraph identifier="/us/sComp/106/562/tII/s204/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">A discussion addressing—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s204/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">continuing and emerging threats to the resilience of United States coral reef ecosystems;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s204/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">remaining gaps in coral reef ecosystem research, monitoring, and assessment;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s204/b/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the status of management cooperation and integration among Federal reef managers and covered reef managers;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s204/b/1/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">the status of efforts to manage and disseminate critical information, and enhance interjurisdictional data sharing, related to research, reports, data sets, and maps;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s204/b/1/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="E">(E) </num><chapeau style="-uslm-dtd:text">areas of special focus, which may include—</chapeau>
                            <clause identifier="/us/sComp/106/562/tII/s204/b/1/E/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">improving natural coral recruitment;</content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s204/b/1/E/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">preventing avoidable losses of corals and their habitat;</content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s204/b/1/E/iii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">enhancing the resilience of coral populations;</content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s204/b/1/E/iv" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">supporting a resilience-based management approach;</content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s204/b/1/E/v" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">developing, coordinating, and implementing watershed management plans;</content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s204/b/1/E/vi" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="vi">(vi) </num><content style="-uslm-dtd:text">building and sustaining watershed management capacity at the local level;</content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s204/b/1/E/vii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="vii">(vii) </num><content style="-uslm-dtd:text">providing data essential for coral reef fisheries management;</content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s204/b/1/E/viii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="viii">(viii) </num><content style="-uslm-dtd:text">building capacity for coral reef fisheries management;</content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s204/b/1/E/ix" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ix">(ix) </num><content style="-uslm-dtd:text">increasing understanding of coral reef ecosystem services;</content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s204/b/1/E/x" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="x">(x) </num><content style="-uslm-dtd:text">educating the public on the importance of coral reefs, threats and solutions; and</content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s204/b/1/E/xi" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="xi">(xi) </num><content style="-uslm-dtd:text">evaluating intervention efficacy;</content>
                            </clause>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s204/b/1/F" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">the status of conservation efforts, including the use of marine protected areas to serve as replenishment zones developed consistent with local practices and traditions and in cooperation with, and with respect for the scientific, technical, and management expertise and responsibilities of, covered reef managers;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s204/b/1/G" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">science-based adaptive management and restoration efforts; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s204/b/1/H" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="H">(H) </num><content style="-uslm-dtd:text">management of coral reef emergencies and disasters.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s204/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">A statement of national goals and objectives designed to guide—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s204/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">future Federal coral reef management and restoration activities authorized under <foreign id="warning-d604688e632" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="H6B1A9668F88F439C8DFA51278355A4D6" legis-path="203.">section 203</compsdtd:internal-xref></foreign>;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s204/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">conservation and restoration priorities for grants awarded under <foreign id="warning-d604688e639" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="H1B5D85F3919E4193A745ACA5230CC01C" legis-path="211.">section 211</compsdtd:internal-xref></foreign>; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s204/b/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">research priorities for the reef research coordination institutes designated under <foreign id="warning-d604688e646" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="H3017AFAF8CD34E57885C04572A46E3BC" legis-path="213.(b)(1)(B)">section 213(b)(1)(B)</compsdtd:internal-xref></foreign>.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s204/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">A designation of priority areas for conservation, and priority areas for restoration, to support the review and approval of grants under <foreign id="warning-d604688e653" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="H743ACF339895414B9C502BE0BA94305E" legis-path="211.(e)">section 211(e)</compsdtd:internal-xref></foreign>.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s204/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">Technical assistance in the form of general templates for use by covered reef managers and Federal reef managers to guide the development of coral reef action plans under <foreign id="warning-d604688e660" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="HDAEB9988AB4D4307B7B182A778CCFC90" legis-path="205.">section 205</compsdtd:internal-xref></foreign>, including guidance on the best science-based practices to respond to coral reef emergencies that can be included in coral reef action plans. </content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s204/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Consultations </heading><chapeau style="-uslm-dtd:text">.—In developing all elements of the strategy required by <foreign id="warning-d604688e669" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="HB2DF255063264E83B3836C3B70445634" legis-path="204.(a)">subsection (a)</compsdtd:internal-xref></foreign>, the Administrator shall—</chapeau>
                    <paragraph identifier="/us/sComp/106/562/tII/s204/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">consult with the Secretary of the Interior, the Task Force, covered States, and covered Native entities;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s204/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">consult with the Secretary of Defense, as appropriate;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s204/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">engage stakeholders, including covered States, coral reef stewardship partnerships, reef research institutes and research centers described in section 213, and recipients of grants under <foreign id="warning-d604688e684" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="H1B5D85F3919E4193A745ACA5230CC01C" legis-path="211.">section 211</compsdtd:internal-xref></foreign>; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s204/c/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">solicit public review and comment regarding scoping and the draft strategy.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s204/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Submission to Congress; Publication.—</heading><chapeau style="-uslm-dtd:text">The Administrator shall—</chapeau>
                    <paragraph identifier="/us/sComp/106/562/tII/s204/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">submit the strategy required by subsection (a) and any revisions to the strategy to the appropriate congressional committees; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s204/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">publish the strategy and any such revisions on public websites of—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s204/d/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the Coral Reef Conservation Program of the National Oceanic and Atmospheric Administration; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s204/d/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the Task Force.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/106/562/tII/s205" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="205">SEC. 205. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6404">16 U.S.C. 6404</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">CORAL REEF ACTION PLANS. </heading>
                <subsection identifier="/us/sComp/106/562/tII/s205/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Plans Prepared by Federal Reef Managers. </heading>
                    <paragraph identifier="/us/sComp/106/562/tII/s205/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In General </heading><chapeau style="-uslm-dtd:text">.—Not later than 3 years after the date of the enactment of the <inline style="-uslm-dtd:short-title">James M. Inhofe National Defense Authorization Act for Fiscal Year 2023</inline> and 2 years after the date of publication of each National Coral Reef Resilience Strategy, each Federal reef manager shall—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s205/a/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">prepare a coral reef action plan to guide management and restoration activities to be undertaken within the responsibilities and jurisdiction of the manager; or </content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s205/a/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">in the case of a reef under the jurisdiction of a Federal reef manager for which there is an action plan in effect as of such date of enactment, update that plan to comply with the requirements of this subsection. </content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s205/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Elements.—</heading><chapeau style="-uslm-dtd:text">A plan prepared under paragraph (1) by a Federal reef manager shall include a discussion of the following:</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s205/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">Short- and medium-term coral reef conservation and restoration objectives within the jurisdiction of the manager.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s205/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">A current adaptive management framework to inform research, monitoring, and assessment needs.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s205/a/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">Tools, strategies, and partnerships necessary to identify, monitor, and address pollution, water quality, and other negative impacts to coral reef ecosystems within the jurisdiction of the manager.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s205/a/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">The status of efforts to improve coral reef ecosystem management cooperation and integration between Federal reef managers and covered reef managers, including the identification of existing research and monitoring activities that can be leveraged for coral reef status and trends assessments within the jurisdiction of the manager.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s205/a/2/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">Estimated budgetary and resource considerations necessary to carry out the plan.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s205/a/2/F" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">Contingencies for response to and recovery from emergencies and disasters.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s205/a/2/G" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">In the case of an updated plan, annual records of significant management and restoration actions taken under the previous plan, cash and noncash resources used to undertake the actions, and the source of such resources.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s205/a/2/H" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="H">(H) </num><content style="-uslm-dtd:text">Documentation by the Federal reef manager that the plan is consistent with the National Coral Reef Resilience Strategy.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s205/a/2/I" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">A data management plan to ensure data, assessments, and accompanying information are appropriately preserved, curated, publicly accessible, and broadly reusable. </content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s205/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Submission to Task Force </heading><content style="-uslm-dtd:text">.—Each Federal reef manager shall submit a plan prepared under <foreign id="warning-d604688e787" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="H11314AE71DEC495297F6049589E7D4A1" legis-path="205.(a)(1)">paragraph (1)</compsdtd:internal-xref></foreign> to the Task Force. </content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s205/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Application of Administrative Procedure Act.—</heading><content style="-uslm-dtd:text">Each plan prepared under <foreign id="warning-d604688e796" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="H11314AE71DEC495297F6049589E7D4A1" legis-path="205.(a)(1)">paragraph (1)</compsdtd:internal-xref></foreign> shall be subject to the requirements of subchapter II of chapter 5, and chapter 7, of title 5, United States Code (commonly known as the “<quotedText style="-uslm-dtd:quote">Administrative Procedure Act</quotedText>”). </content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s205/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Plans Prepared by Covered Reef Managers.—</heading>
                    <paragraph identifier="/us/sComp/106/562/tII/s205/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">A covered reef manager may elect to prepare, submit to the Task Force, and maintain a coral reef action plan to guide management and restoration activities to be undertaken within the responsibilities and jurisdiction of the manager. </content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s205/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Effective period.—</heading><content style="-uslm-dtd:text">A plan prepared under this subsection shall remain in effect for 5 years, or until an updated plan is submitted to the Task Force, whichever occurs first. </content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s205/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Elements.—</heading><chapeau style="-uslm-dtd:text">A plan prepared under <foreign id="warning-d604688e823" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="H613EA3883BCC4146AB663F3B7F7F1E46" legis-path="205.(b)(1)">paragraph (1)</compsdtd:internal-xref></foreign> by a covered reef manager—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s205/b/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">shall contain a discussion of—</chapeau>
                            <clause identifier="/us/sComp/106/562/tII/s205/b/3/A/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">short- and medium-term coral reef conservation and restoration objectives within the jurisdiction of the manager;</content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s205/b/3/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">estimated budgetary and resource considerations necessary to carry out the plan;</content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s205/b/3/A/iii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">in the case of an updated plan, annual records of significant management and restoration actions taken under the previous plan, cash and noncash resources used to undertake the actions, and the source of such resources; and</content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s205/b/3/A/iv" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">contingencies for response to and recovery from emergencies and disasters; and</content>
                            </clause>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s205/b/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">may contain a discussion of—</chapeau>
                            <clause identifier="/us/sComp/106/562/tII/s205/b/3/B/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the status of efforts to improve coral reef ecosystem management cooperation and integration between Federal reef managers and covered reef managers, including the identification of existing research and monitoring activities that can be leveraged for coral reef status and trends assessments within the jurisdiction of the manager;</content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s205/b/3/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">a current adaptive management framework to inform research, monitoring, and assessment needs; </content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s205/b/3/B/iii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">tools, strategies, and partnerships necessary to identify, monitor, and address pollution and water quality impacts to coral reef ecosystems within the jurisdiction of the manager; and</content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s205/b/3/B/iv" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">a data management plan to ensure data, assessments, and accompanying information are appropriately preserved, curated, publicly accessible, and broadly reusable.</content>
                            </clause>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s205/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Technical assistance </heading><content style="-uslm-dtd:text">.—The Administrator and the Task Force shall make reasonable efforts to provide technical assistance upon request by a Federal reef manager or covered reef manager developing a coral reef action plan under this section.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s205/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Publication </heading><content style="-uslm-dtd:text">.—The Administrator shall publish each coral reef action plan prepared and submitted to the Task Force under this section on the public website of the Coral Reef Conservation Program of the National Oceanic and Atmospheric Administration.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/106/562/tII/s206" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="206">SEC. 206. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6405">16 U.S.C. 6405</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">CORAL REEF STEWARDSHIP PARTNERSHIPS. </heading>
                <subsection identifier="/us/sComp/106/562/tII/s206/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In general </heading><content style="-uslm-dtd:text">.—To further community-based stewardship of coral reefs, coral reef stewardship partnerships for Federal and non-Federal coral reefs may be established in accordance with this section.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s206/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Standards and Procedures </heading><chapeau style="-uslm-dtd:text">The Administrator shall develop and adopt—</chapeau>
                    <paragraph identifier="/us/sComp/106/562/tII/s206/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">standards for identifying individual coral reefs and ecologically significant units of coral reefs; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s206/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">processes for adjudicating multiple applicants for stewardship of the same coral reef or ecologically significant unit of a reef to ensure no geographic overlap in representation among stewardship partnerships authorized by this section.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s206/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Membership for Federal Coral Reefs </heading><chapeau style="-uslm-dtd:text">.—A coral reef stewardship partnership that has identified, as the subject of its stewardship activities, a coral reef or ecologically significant unit of a coral reef that is fully or partially under the management jurisdiction of any Federal agency specified in <foreign id="warning-d604688e909" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="HB93B1144D22B476BB971E5AF74EBC0B4" legis-path="203.(c)">section 203(c)</compsdtd:internal-xref></foreign> shall, at a minimum, include the following:</chapeau>
                    <paragraph identifier="/us/sComp/106/562/tII/s206/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">That Federal agency, a representative of which shall serve as chairperson of the coral reef stewardship partnership.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s206/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">A State or county’s resource management agency to the extent that such partnership covers a reef within such States or county’s jurisdiction.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s206/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">A coral reef research center designated under <foreign id="warning-d604688e924" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="HF129CAED7C604787B99DB2D63FDCCB5F" legis-path="q:HC102D7AEEFBF453BAB032E1C22818CE0:212.(b)">section 212(b)</compsdtd:internal-xref></foreign>.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s206/c/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">A nongovernmental organization.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s206/c/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">A covered Native entity culturally affiliated with the subject reef or ecologically significant unit, if any.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s206/c/6" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">Such other members as the partnership considers appropriate, such as interested stakeholder groups and covered Native entities.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s206/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Membership for non-Federal Coral Reefs.—</heading>
                    <paragraph identifier="/us/sComp/106/562/tII/s206/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general </heading><chapeau style="-uslm-dtd:text">.—A coral reef stewardship partnership that has identified, as the subject of its stewardship activities, a coral reef or ecologically significant component of a coral reef that is not under the management jurisdiction of any Federal agency specified in <foreign id="warning-d604688e949" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="HB93B1144D22B476BB971E5AF74EBC0B4" legis-path="203.(c)">section 203(c)</compsdtd:internal-xref></foreign> shall, at a minimum, include the following:</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s206/d/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">A State or county’s resource management agency or a covered Native entity, a representative of which shall serve as the chairperson of the coral reef stewardship partnership.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s206/d/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">A coral reef research center designated under <foreign id="warning-d604688e960" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="HF129CAED7C604787B99DB2D63FDCCB5F" legis-path="212.(b)">section 212(b)</compsdtd:internal-xref></foreign>.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s206/d/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">A nongovernmental organization.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s206/d/1/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">Such other members as the partnership considers appropriate, such as interested stakeholder groups.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s206/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Additional members.—</heading>
                        <subparagraph identifier="/us/sComp/106/562/tII/s206/d/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general </heading><content style="-uslm-dtd:text">.—Subject to subparagraph (B), a coral reef stewardship partnership described in paragraph (1) may also include representatives of one or more Federal agencies.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s206/d/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Requests; approval </heading><chapeau style="-uslm-dtd:text">.—A representative of a Federal agency described in subparagraph (A) may become a member of a coral reef stewardship partnership described in paragraph (1) if—</chapeau>
                            <clause identifier="/us/sComp/106/562/tII/s206/d/2/B/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the representative submits a request to become a member to the chairperson of the partnership referred to in paragraph (1)(A); and</content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s206/d/2/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the chairperson consents to the request.</content>
                            </clause>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s206/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Nonapplicability of Federal Advisory Committee Act.—</heading><content style="-uslm-dtd:text">The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to coral reef stewardship partnerships under this section.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/106/562/tII/s207" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="207">SEC. 207. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6406">16 U.S.C. 6406</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">BLOCK GRANTS. </heading>
                <subsection identifier="/us/sComp/106/562/tII/s207/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General </heading><content style="-uslm-dtd:text">.—In each fiscal year beginning in fiscal year 2023 and subject to the availability of appropriations, the Administrator shall provide block grants of financial assistance of not less than $500,000 to each covered State to support management and restoration activities and further the implementation of coral reef action plans in effect under <foreign id="warning-d604688e1012" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="HDAEB9988AB4D4307B7B182A778CCFC90" legis-path="205.">section 205</compsdtd:internal-xref></foreign> by covered States and non-Federal coral reef stewardship partnerships in accordance with this section. The Administrator shall review each covered State’s application for block grant funding to ensure that applications are consistent with applicable action plans and the National Coral Reef Resilience Strategy.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s207/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Responsibilities of the Administrator </heading><chapeau style="-uslm-dtd:text">.—The Administrator is responsible for—</chapeau>
                    <paragraph identifier="/us/sComp/106/562/tII/s207/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">providing guidance on the proper documentation of expenditures authorized under this Act;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s207/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">issuing annual solicitations to covered States for awards under this section; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s207/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">determining the appropriate allocation of additional amounts among covered States in accordance with this section.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s207/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Responsibilities of Covered States </heading><chapeau style="-uslm-dtd:text">.—Each covered State is responsible for documenting and reporting—</chapeau>
                    <paragraph identifier="/us/sComp/106/562/tII/s207/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">such State’s use of Federal funds received under this Act; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s207/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">such expenditures of non-Federal funds made in furtherance of coral reef management and restoration as the Administrator determines appropriate.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s207/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Cooperative Agreements.—</heading><content style="-uslm-dtd:text">Subject to the availability of appropriations, the Administrator may seek to enter into a cooperative agreement with a covered State to fund coral reef conservation and restoration activities in waters managed under the jurisdiction of such covered State that are consistent with the National Coral Reef Resilience Strategy and any applicable action plan under <foreign id="warning-d604688e1053" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="HDAEB9988AB4D4307B7B182A778CCFC90" legis-path="205.">section 205</compsdtd:internal-xref></foreign>.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s207/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">All Islands Committee.—</heading><content style="-uslm-dtd:text">The Administrator may enter into a cooperative agreement with the All Islands Committee of the Task Force to provide support for its activities.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/106/562/tII/s208" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="208">SEC. 208. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6407">16 U.S.C. 6407</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">CORAL REEF STEWARDSHIP FUND. </heading>
                <subsection identifier="/us/sComp/106/562/tII/s208/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Agreement </heading><content style="-uslm-dtd:text">.—The Administrator shall seek to enter into an agreement with the National Fish and Wildlife Foundation (in this section referred to as the “<quotedText style="-uslm-dtd:quote">Foundation</quotedText>”), authorizing the Foundation to receive, hold, and administer funds received under this section.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s208/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Fund.—</heading>
                    <paragraph identifier="/us/sComp/106/562/tII/s208/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general </heading><chapeau style="-uslm-dtd:text">.—The Foundation shall establish an account, which shall—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s208/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">be known as the “<quotedText style="-uslm-dtd:quote">Coral Reef Stewardship Fund</quotedText>” (in this section referred to as the “<quotedText style="-uslm-dtd:quote">Fund</quotedText>”); and </content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s208/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">serve as the successor to the account known before the date of the enactment of the <inline style="-uslm-dtd:short-title">James M. Inhofe National Defense Authorization Act for Fiscal Year 2023</inline> as the Coral Reef Conservation Fund and administered through a public-private partnership with the Foundation. </content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s208/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Deposits.—</heading><content style="-uslm-dtd:text">The Foundation shall deposit funds received under this section into the Fund. </content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s208/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Purposes.—</heading><chapeau style="-uslm-dtd:text">The Fund shall be available solely to support coral reef stewardship activities that—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s208/b/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">further the purposes of this title; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s208/b/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">are consistent with—</chapeau>
                            <clause identifier="/us/sComp/106/562/tII/s208/b/3/B/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the National Coral Reef Resilience Strategy; and</content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s208/b/3/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">coral reef action plans in effect, if any, under <foreign id="warning-d604688e1127" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="HDAEB9988AB4D4307B7B182A778CCFC90" legis-path="205.">section 205</compsdtd:internal-xref></foreign> covering a coral reef or ecologically significant component of a coral reef to be impacted by such activities, if applicable. </content>
                            </clause>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s208/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Investment of amounts.—</heading>
                        <subparagraph identifier="/us/sComp/106/562/tII/s208/b/4/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Investment of amounts </heading><content style="-uslm-dtd:text">.—The Foundation shall invest such portion of the Fund as is not required to meet current withdrawals in interest-bearing obligations of the United States or in obligations guaranteed as to both principal and interest by the United States.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s208/b/4/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Interest and proceeds.—</heading><content style="-uslm-dtd:text">The interest on, and the proceeds from the sale or redemption of, any obligations held in the Fund shall be credited to and form a part of the Fund. </content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s208/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Review of performance.—</heading><chapeau style="-uslm-dtd:text">The Administrator shall conduct a continuing review of all deposits into, and disbursements from, the Fund. Each review shall include a written assessment concerning the extent to which the Foundation has implemented the goals and requirements of—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s208/b/5/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">this section; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s208/b/5/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the National Coral Reef Resilience Strategy. </content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s208/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Authorization To Solicit Donations.—</heading>
                    <paragraph identifier="/us/sComp/106/562/tII/s208/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general </heading><content style="-uslm-dtd:text">.—Pursuant to an agreement entered into under subsection (a), the Foundation may accept, receive, solicit, hold, administer, and use any gift (including, notwithstanding section 1342 of title 31, United States Code, donations of services) to further the purposes of this title.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s208/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Deposits in fund.—</heading><content style="-uslm-dtd:text">Notwithstanding section 3302 of title 31, United States Code, any funds received as a gift shall be deposited and maintained in the Fund.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s208/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Administration.—</heading><content style="-uslm-dtd:text">Under an agreement entered into pursuant to <foreign id="warning-d604688e1182" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="H700AA4ADF0B84FF09BE2B0E73222E0B1" legis-path="208.(a)">subsection (a)</compsdtd:internal-xref></foreign>, and subject to the availability of appropriations, the Administrator may transfer funds appropriated for such purposes to carry out this title to the Foundation. Amounts received by the Foundation under this subsection may be used for matching, in whole or in part, contributions (whether in money, services, or property) made to the Foundation by private persons, State or local government agencies, or covered Native entities.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/106/562/tII/s209" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="209">SEC. 209. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6408">16 U.S.C. 6408</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">EMERGENCY ASSISTANCE. </heading>
                <subsection identifier="/us/sComp/106/562/tII/s209/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General </heading><content style="-uslm-dtd:text">.—Notwithstanding any other provision of law, from funds appropriated pursuant to the authorization of appropriations under <foreign id="warning-d604688e1196" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="H118EAAFC6C324CFD8A0C15BFB3B1726B" legis-path="215.">section 215</compsdtd:internal-xref></foreign>, the Administrator may provide emergency assistance to any covered State or coral reef stewardship partnership to respond to immediate harm to coral reefs or coral reef ecosystems arising from any of the exigent circumstances described in <foreign id="warning-d604688e1199" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="H2A9A61DF7C3D4E078DEA3CA60BDB4F00" legis-path="209.(b)">subsection (b)</compsdtd:internal-xref></foreign>.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s209/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Coral Reef Exigent Circumstances.—</heading><chapeau style="-uslm-dtd:text">The Administrator shall develop a list of, and criteria for, circumstances that pose an exigent threat to coral reefs, including—</chapeau>
                    <paragraph identifier="/us/sComp/106/562/tII/s209/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">new and ongoing outbreaks of disease;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s209/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">new and ongoing outbreaks of invasive or nuisance species;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s209/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">new and ongoing coral bleaching events;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s209/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">natural disasters;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s209/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">industrial or mechanical incidents, such as vessel groundings, hazardous spills, or coastal construction accidents; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s209/b/6" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">such other circumstances as the Administrator determines appropriate. </content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s209/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Annual Report on Exigent Circumstances.—</heading><chapeau style="-uslm-dtd:text">On February 1 of each year, the Administrator shall submit to the appropriate congressional committees, the Committee on Appropriations of the Senate, and the Committee on Appropriations of the House of Representatives a report that—</chapeau>
                    <paragraph identifier="/us/sComp/106/562/tII/s209/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">describes locations with exigent circumstances described in <foreign id="warning-d604688e1242" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="H2A9A61DF7C3D4E078DEA3CA60BDB4F00" legis-path="209.(b)">subsection (b)</compsdtd:internal-xref></foreign> that were considered but declined for emergency assistance, and the rationale for the decision; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s209/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text"> with respect to each instance in which emergency assistance under this section was provided—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s209/c/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the location and a description of the exigent circumstances that prompted the emergency assistance, the entity that received the assistance, and the current and expected outcomes from the assistance;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s209/c/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">a description of activities of the National Oceanic and Atmospheric Administration that were curtailed as a result of providing the emergency assistance; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s209/c/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">an assessment of whether further action is needed to restore the affected coral reef, recommendations for such restoration, and a cost estimate to implement such recommendations.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/106/562/tII/s210" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="210">SEC. 210. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6409">16 U.S.C. 6409</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">CORAL REEF DISASTER FUND. </heading>
                <subsection identifier="/us/sComp/106/562/tII/s210/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Agreements </heading><content style="-uslm-dtd:text">.—The Administrator shall seek to enter into an agreement with the National Fish and Wildlife Foundation (in this section referred to as the “<quotedText style="-uslm-dtd:quote">Foundation</quotedText>”), authorizing the Foundation to receive, hold, and administer funds received under this section.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s210/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Fund.—</heading>
                    <paragraph identifier="/us/sComp/106/562/tII/s210/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general </heading><content style="-uslm-dtd:text">.—The Foundation shall establish an account, to be known as the “<quotedText style="-uslm-dtd:quote">Coral Reef Disaster Fund</quotedText>” (in this section referred to as the “<quotedText style="-uslm-dtd:quote">Fund</quotedText>”).</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s210/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Deposits </heading><content style="-uslm-dtd:text">.—The Foundation shall deposit funds received under this section into the Fund. </content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s210/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Purposes.—</heading><chapeau style="-uslm-dtd:text">The Fund shall be available solely to support the long-term recovery of coral reefs from exigent circumstances described in <foreign id="warning-d604688e1301" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="H2A9A61DF7C3D4E078DEA3CA60BDB4F00" legis-path="209.(b)">section 209(b)</compsdtd:internal-xref></foreign>—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s210/b/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">in partnership with non-Federal stakeholders; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s210/b/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">in a manner that is consistent with—</chapeau>
                            <clause identifier="/us/sComp/106/562/tII/s210/b/3/B/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the National Coral Reef Resilience Strategy; and</content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s210/b/3/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">coral reef action plans in effect, if any, under <foreign id="warning-d604688e1320" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="HDAEB9988AB4D4307B7B182A778CCFC90" legis-path="205.">section 205</compsdtd:internal-xref></foreign>.</content>
                            </clause>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s210/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Investment of amounts.—</heading>

                <num style="-uslm-dtd:enum" value="211">SEC. 211. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6410">16 U.S.C. 6410</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">RUTH D. GATES CORAL REEF CONSERVATION GRANT PROGRAM. </heading>
                <subsection identifier="/us/sComp/106/562/tII/s211/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Subject to the availability of appropriations, the Administrator shall establish a program (to be known as the “<quotedText style="-uslm-dtd:quote">Ruth D. Gates Coral Reef Conservation Grant Program</quotedText>”) to provide grants for projects for the conservation and restoration of coral reef ecosystems (in this section referred to as “<quotedText style="-uslm-dtd:quote">coral reef projects</quotedText>”) pursuant to proposals approved by the Administrator in accordance with this section.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s211/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Matching Requirements for Grants.—</heading>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general </heading><content style="-uslm-dtd:text">.—Except as provided in <foreign id="warning-d604688e1386" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="H9B4B80C2593044E2A0161E54D1486D0E" legis-path="211.(b)(3)">paragraph (3)</compsdtd:internal-xref></foreign>, Federal funds for any coral reef project for which a grant is provided under <foreign id="warning-d604688e1389" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="HCAEAE07948DD432998B89E02AD2E3F6A" legis-path="211.(a)">subsection (a)</compsdtd:internal-xref></foreign> may not exceed 50 percent of the total cost of the project. </content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Non-Federal share.—</heading><content style="-uslm-dtd:text">The non-Federal share of the cost of a coral reef project may be provided by in-kind contributions and other noncash support.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Waiver </heading><content style="-uslm-dtd:text">.—The Administrator may waive all or part of the matching requirement under <foreign id="warning-d604688e1404" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="HD3B28339BFC84A9288E02B5DB0F29DC0" legis-path="211.(b)(1)">paragraph (1)</compsdtd:internal-xref></foreign> if the Administrator determines that no reasonable means are available through which an applicant can meet the matching requirement with respect to a coral reef project and the probable benefit of the project outweighs the public interest in the matching requirement.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s211/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Eligibility.—</heading>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general </heading><content style="-uslm-dtd:text">.—An entity described in <foreign id="warning-d604688e1417" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="H86B0980DC0B3471582F34E7B1BD6D49C" legis-path="211.(c)(2)">paragraph (2)</compsdtd:internal-xref></foreign> may submit to the Administrator a proposal for a coral reef project.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Entities described </heading><chapeau style="-uslm-dtd:text">.—An entity described in this paragraph is—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/c/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">a covered reef manager or a covered Native entity;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/c/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">a regional fishery management council established under the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1801 et seq.);</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/c/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">a coral reef stewardship partnership seeking to implement a coral reef action plan in effect under section 205;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/c/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">a coral reef research center designated under <foreign id="warning-d604688e1442" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="HB6795CDA5E584E33B1741790011B4321" legis-path="214.(b)">section 212(b)</compsdtd:internal-xref></foreign>; or</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/c/2/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">a nongovernmental organization or research institution with demonstrated expertise in the conservation or restoration of coral reefs in practice or through significant contributions to the body of existing scientific research on coral reefs.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s211/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Project Proposals </heading><chapeau style="-uslm-dtd:text">.—Each proposal for a grant under this section for a coral reef project shall include the following:</chapeau>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The name of the individual or entity responsible for conducting the project.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">A description of the qualifications of the individual or entity.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/d/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">A succinct statement of the purposes of the project.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/d/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">An estimate of the funds and time required to complete the project.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/d/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">Evidence of support for the project by appropriate representatives of States or other government jurisdictions in which the project will be conducted.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/d/6" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">Information regarding the source and amount of matching funding available to the applicant.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/d/7" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">A description of how the project meets one or more of the criteria under <foreign id="warning-d604688e1483" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="H802B54A71AAC446DB18E8E222B81A130" legis-path="211.(e)(2)">subsection (e)(2)</compsdtd:internal-xref></foreign>.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/d/8" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">In the case of a proposal submitted by a coral reef stewardship partnership, a description of how the project aligns with the applicable coral reef action plan in effect under <foreign id="warning-d604688e1490" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="HDAEB9988AB4D4307B7B182A778CCFC90" legis-path="205.">section 205</compsdtd:internal-xref></foreign>.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/d/9" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="9">(9) </num><content style="-uslm-dtd:text">Any other information the Administrator considers to be necessary for evaluating the eligibility of the project for a grant under this subsection.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s211/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Project Review and Approval.—</heading>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Administrator shall review each coral reef project proposal submitted under this section to determine if the project meets the criteria set forth in <foreign id="warning-d604688e1508" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="H38BD02194BE9461C98735CA09C993AE1" legis-path="211.(f)">subsection (f)</compsdtd:internal-xref></foreign>.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Prioritization of conservation projects </heading><chapeau style="-uslm-dtd:text">.—The Administrator shall prioritize the awarding of funding for projects that meet the criteria for approval described in—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/e/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">subparagraphs (A) through (G) of subsection (f)(2) that are proposed to be conducted within priority areas identified for coral reef conservation by the Administrator under the National Coral Reef Resilience Strategy; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/e/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">subparagraphs (E) through (L) of subsection (f)(2) that are proposed to be conducted within priority areas identified for coral reef restoration by the Administrator under the National Coral Reef Resilience Strategy.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/e/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Review; approval or disapproval </heading><chapeau style="-uslm-dtd:text">.—Not later than 180 days after receiving a proposal for a coral reef project under this section, the Administrator shall—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/e/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">request and consider written comments on the proposal from each Federal agency, State government, covered Native entity, or other government jurisdiction, including the relevant regional fishery management councils established under the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1801 et seq.), or any National Marine Sanctuary or Marine National Monument, with jurisdiction or management authority over coral reef ecosystems in the area where the project is to be conducted, including the extent to which the project is consistent with locally established priorities, unless such entities were directly involved in the development of the project proposal;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/e/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">provide for the merit-based peer review of the proposal and require standardized documentation of that peer review;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/e/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">after considering any written comments and recommendations based on the reviews under subparagraphs (A) and (B), approve or disapprove the proposal; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/e/3/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">provide written notification of that approval or disapproval, with summaries of all written comments, recommendations, and peer reviews, to the entity that submitted the proposal, and each of those States, covered Native entity, and other government jurisdictions that provided comments under subparagraph (A).</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s211/f" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Criteria for Approval </heading><chapeau style="-uslm-dtd:text">.—The Administrator may not approve a proposal for a coral reef project under this section unless the project—</chapeau>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/f/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">is consistent with—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/f/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the National Coral Reef Resilience Strategy; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/f/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">any Federal or non-Federal coral reef action plans in effect under section 205 covering a coral reef or ecologically significant unit of a coral reef to be affected by the project; and</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/f/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">will enhance the conservation and restoration of coral reefs by—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/f/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">addressing conflicts arising from the use of environments near coral reefs or from the use of corals, species associated with coral reefs, and coral products, including supporting consensus-driven and community-based planning and management initiatives for the protection of coral reef ecosystems;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/f/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">improving compliance with laws that prohibit or regulate the taking of coral products or species associated with coral reefs or regulate the use and management of coral reef ecosystems;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/f/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">designing and implementing networks of real-time water quality monitoring along coral reefs, including data collection related to turbidity, nutrient availability, harmful algal blooms, and plankton assemblages, with an emphasis on coral reefs impacted by agriculture and urban development;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/f/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">promoting ecologically sound navigation and anchorages, including mooring buoy systems to promote enhanced recreational access, near coral reefs;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/f/2/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">furthering the goals and objectives of coral reef action plans in effect under section 205;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/f/2/F" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">mapping the location and distribution of coral reefs and potential coral reef habitat;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/f/2/G" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">stimulating innovation to advance the ability of the United States to understand, research, or monitor coral reef ecosystems, or to develop management or adaptation options to conserve and restore coral reef ecosystems;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/f/2/H" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="H">(H) </num><content style="-uslm-dtd:text">implementing research to ensure the population viability of coral species in United States waters listed as threatened or endangered under the Endangered Species Act of 1973 as detailed in the population-based recovery criteria included in species-specific recovery plans established under such Act;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/f/2/I" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">developing and implementing cost-effective methods to restore degraded coral reef ecosystems or to create geographically appropriate coral reef ecosystems in suitable waters, including by improving habitat or promoting success of keystone species, with an emphasis on novel restoration strategies and techniques to advance coral reef recovery and growth near population centers threatened by rising sea levels and storm surge;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/f/2/J" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="J">(J) </num><content style="-uslm-dtd:text">translating and applying coral genetics research to coral reef ecosystem restoration, including research related to traits that promote resilience to increasing ocean temperatures, changing ocean chemistry, coral bleaching, coral diseases, and invasive species;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/f/2/K" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="K">(K) </num><content style="-uslm-dtd:text">developing and maintaining in situ native coral propagation sites; or</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/f/2/L" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="L">(L) </num><chapeau style="-uslm-dtd:text">developing and maintaining ex situ coral propagation nurseries and land-based coral gene banks to—</chapeau>
                            <clause identifier="/us/sComp/106/562/tII/s211/f/2/L/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">conserve or augment genetic diversity of native coral populations;</content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s211/f/2/L/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">support captive breeding of rare coral species; or</content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s211/f/2/L/iii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">enhance resilience of native coral populations to increasing ocean temperatures, changing ocean chemistry, coral bleaching, and coral diseases through selective breeding, conditioning, or other approaches that target genes, gene expression, phenotypic traits, or phenotypic plasticity.</content>
                            </clause>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s211/g" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Funding Requirements </heading><chapeau style="-uslm-dtd:text">.—To the extent practicable based upon proposals for coral reef projects submitted to the Administrator, the Administrator shall ensure that funding for grants awarded under this section during a fiscal year is distributed as follows:</chapeau>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/g/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Not less than 40 percent of funds available shall be awarded for projects in areas of the Pacific Ocean subject to the jurisdiction or control of the United States.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/g/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Not less than 40 percent of the funds available shall be awarded for projects in areas of the Atlantic Ocean, the Gulf of Mexico, or the Caribbean Sea subject to the jurisdiction or control of the United States.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/g/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">To the extent there are viable applications made by eligible coral reef stewardship partners, not more than 67 percent of funds distributed in each region in accordance with paragraphs (1) and (2) may be made exclusively available to projects that are—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/g/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">submitted by a coral reef stewardship partnership; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s211/g/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">consistent with the coral reef action plan in effect under section 205 by such a partnership.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s211/g/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">Of the funds distributed to support projects in accordance with paragraph (3), not less than 20 percent and not more than 33 percent shall be awarded for projects submitted by a Federal coral reef stewardship partnership, to the extent there are viable applications made by eligible Federal coral reef stewardship partnerships.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s211/h" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="h">(h) </num><heading style="-uslm-dtd:header">Task Force </heading><content style="-uslm-dtd:text">.—The Administrator may consult with the Secretary of the Interior and the Task Force to obtain guidance in establishing priorities and evaluating proposals for coral reef projects under this section.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/106/562/tII/s212" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="212">SEC. 212. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6411">16 U.S.C. 6411</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">CORAL REEF RESEARCH. </heading>
                <subsection identifier="/us/sComp/106/562/tII/s212/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Reef research Coordination Institutes.—</heading>
                    <paragraph identifier="/us/sComp/106/562/tII/s212/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Establishment </heading><content style="-uslm-dtd:text">.—The Administrator shall designate 2 reef research coordination institutes for the purpose of advancing and sustaining essential capabilities in coral reef research, one each in the Atlantic and Pacific basins, to be known as the “<quotedText style="-uslm-dtd:quote">Atlantic Reef Research Coordination Institute</quotedText>” and the “<quotedText style="-uslm-dtd:quote">Pacific Reef Research Coordination Institute</quotedText>”, respectively.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s212/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Membership.—</heading><content style="-uslm-dtd:text">Each institute designated under paragraph (1) shall be housed within a single coral reef research center designated by the Administrator under subsection (b).</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s212/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Functions.—</heading><chapeau style="-uslm-dtd:text">The institutes designated under paragraph (1) shall—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s212/a/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">conduct federally directed research to fill national and regional coral reef ecosystem research gaps and improve understanding of, and responses to, continuing and emerging threats to the resilience of United States coral reef ecosystems consistent with the National Coral Reef Resilience Strategy;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s212/a/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">support ecological research and monitoring to study the effects of conservation and restoration activities funded by this title on promoting more effective coral reef management and restoration; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s212/a/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><chapeau style="-uslm-dtd:text">through agreements—</chapeau>
                            <clause identifier="/us/sComp/106/562/tII/s212/a/3/C/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">collaborate directly with States, covered Native entities, covered coral reef managers, nonprofit organizations, and other coral reef research centers designated under subsection (b);</content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s212/a/3/C/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><chapeau style="-uslm-dtd:text">assist in the development and implementation of—</chapeau>
                                <subclause identifier="/us/sComp/106/562/tII/s212/a/3/C/ii/I" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">the National Coral Reef Resilience Strategy; and</content>
                                </subclause>
                                <subclause identifier="/us/sComp/106/562/tII/s212/a/3/C/ii/II" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">coral reef action plans under section 205;</content>
                                </subclause>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s212/a/3/C/iii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">build capacity within non-Federal governmental resource management agencies to establish research priorities and translate and apply research findings to management and restoration practices; and</content>
                            </clause>
                            <clause identifier="/us/sComp/106/562/tII/s212/a/3/C/iv" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iv">(iv) </num><chapeau style="-uslm-dtd:text">conduct public education and awareness programs for policymakers, resource managers, and the general public on—</chapeau>
                                <subclause identifier="/us/sComp/106/562/tII/s212/a/3/C/iv/I" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">coral reefs and coral reef ecosystems;</content>
                                </subclause>
                                <subclause identifier="/us/sComp/106/562/tII/s212/a/3/C/iv/II" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">best practices for coral reef ecosystem management and restoration;</content>
                                </subclause>
                                <subclause identifier="/us/sComp/106/562/tII/s212/a/3/C/iv/III" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="III">(III) </num><content style="-uslm-dtd:text">the value of coral reefs; and</content>
                                </subclause>
                                <subclause identifier="/us/sComp/106/562/tII/s212/a/3/C/iv/IV" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="IV">(IV) </num><content style="-uslm-dtd:text">the threats to the sustainability of coral reef ecosystems.</content>
                                </subclause>
                            </clause>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s212/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Coral Reef Research Centers.—</heading>
                    <paragraph identifier="/us/sComp/106/562/tII/s212/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general </heading><chapeau style="-uslm-dtd:text">.—The Administrator shall—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s212/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">periodically solicit applications for designation of qualifying institutions in covered States as coral reef research centers; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s212/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">designate all qualifying institutions in covered States as coral reef research centers.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s212/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Qualifying institutions.—</heading><chapeau style="-uslm-dtd:text">For purposes of paragraph (1), an institution is a qualifying institution if the Administrator determines that the institution—</chapeau>
                        <subparagraph identifier="/us/sComp/106/562/tII/s212/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">is operated by an institution of higher education or nonprofit marine research organization;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s212/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">has established management-driven national or regional coral reef research or restoration programs;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s212/b/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">has demonstrated abilities to coordinate closely with appropriate Federal and State agencies, and other academic and nonprofit organizations; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/106/562/tII/s212/b/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">maintains significant local community engagement and outreach programs related to coral reef ecosystems.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/106/562/tII/s213" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="213">SEC. 213. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6412">16 U.S.C. 6412</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">CORAL REEF PRIZE COMPETITIONS. </heading>
                <subsection identifier="/us/sComp/106/562/tII/s213/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Subject to the availability of appropriations, the head of any Federal agency with a representative serving on the United States Coral Reef Task Force established by section 10011 of the <inline style="-uslm-dtd:short-title">James M. Inhofe National Defense Authorization Act for Fiscal Year 2023</inline>, may, individually or in cooperation with one or more agencies, carry out a program to award prizes competitively under section 24 of the Stevenson-Wydler Technology Innovation Act of 1980 (15 U.S.C. 3719).</content>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s213/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Purposes </heading><content style="-uslm-dtd:text">.—Any program carried out under this section shall be for the purpose of stimulating innovation to advance the ability of the United States to understand, research, or monitor coral reef ecosystems, or to develop management or adaptation options to preserve, sustain, and restore coral reef ecosystems.</content>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s213/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Priority programs.—</heading><chapeau style="-uslm-dtd:text">Priority shall be given to establishing programs under this section that address communities, environments, or industries that are in distress as a result of the decline or degradation of coral reef ecosystems, including—</chapeau>
                    <paragraph identifier="/us/sComp/106/562/tII/s213/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">scientific research and monitoring that furthers the understanding of causes behind coral reef decline and degradation and the generally slow recovery following disturbances, including changing ocean chemistry, temperature-related bleaching, disease, and their associated impacts on coral physiology;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s213/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the development of monitoring or management options for communities or industries that are experiencing significant financial hardship;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s213/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the development of adaptation options to alleviate economic harm and job loss caused by damage to coral reef ecosystems;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s213/c/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">the development of measures to help vulnerable communities or industries, with an emphasis on rural communities and businesses; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s213/c/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">the development of adaptation and management options for impacted tourism industries.</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/106/562/tII/s214" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="214">SEC. 214. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6413">16 U.S.C. 6413</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">REPORTS ON ADMINISTRATION. </heading>
                <subsection identifier="/us/sComp/106/562/tII/s214/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General </heading><chapeau style="-uslm-dtd:text">.—Not later than 2 years after the date of the enactment of the <inline style="-uslm-dtd:short-title">James M. Inhofe National Defense Authorization Act for Fiscal Year 2023</inline>, and every 2 years thereafter, the Administrator shall submit to the committees specified in subsection (b) a report on the administration of this title during the 2-year period preceding submission of the report, including—</chapeau>
                    <paragraph identifier="/us/sComp/106/562/tII/s214/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">a description of all activities undertaken to implement the National Coral Reef Resilience Strategy;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s214/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">a statement of all funds obligated under the authorities of this title; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s214/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">a summary, disaggregated by State, of Federal and non-Federal contributions toward the costs of each project or activity funded, in full or in part, under this title.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s214/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Committees Specified.—</heading><chapeau style="-uslm-dtd:text">The committees specified in this subsection are—</chapeau>
                    <paragraph identifier="/us/sComp/106/562/tII/s214/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the Committee on Commerce, Science, and Transportation, Committee on Environment and Public Works, Committee on Energy and Natural Resources, and the Committee on Appropriations of the Senate; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s214/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the Committee on Natural Resources and the Committee on Appropriations of the House of Representatives.</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/106/562/tII/s215" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="215">SEC. 215. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6414">16 U.S.C. 6414</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">AUTHORIZATION OF APPROPRIATIONS. </heading>
                <subsection identifier="/us/sComp/106/562/tII/s215/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General </heading><chapeau style="-uslm-dtd:text">.—There is authorized to be appropriated to the Administrator $45,000,000 for each of fiscal years 2023 through 2027 to carry out this title which shall remain available until expended. Of such amounts, there is authorized to be appropriated for each such fiscal year—</chapeau>
                    <paragraph identifier="/us/sComp/106/562/tII/s215/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">$12,000,000 to carry out <foreign id="warning-d604688e1888" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="H7DB75FA264664F88AEEE3BB0947DC669" legis-path="207.">section 207</compsdtd:internal-xref></foreign>;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s215/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">$3,500,000 for activities authorized under <foreign id="warning-d604688e1895" note="processing mode: unknown" role="passthroughContent"><compsdtd:internal-xref xmlns:compsdtd="http://schemas.gpo.gov/xml/comps-dtd" idref="H1B5D85F3919E4193A745ACA5230CC01C" legis-path="211.">section 211</compsdtd:internal-xref></foreign>; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/106/562/tII/s215/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">$4,500,000 to be provided to the cooperative institutes designated under section 212(a) to carry out the functions described in such section.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/106/562/tII/s215/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Administration </heading><content style="-uslm-dtd:text">.—Not more than 10 percent of the amounts appropriated under subsection (a) may be used for program administration or overhead costs incurred by the National Oceanic and Atmospheric Administration or the Department of Commerce.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/106/562/tII/s216" role="definitions" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="216">SEC. 216. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s6415">16 U.S.C. 6415</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
                <chapeau class="block" style="-uslm-dtd:text">In this title:</chapeau>
                <paragraph identifier="/us/sComp/106/562/tII/s216/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Administrator.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Administrator</term>” means the Administrator of the National Oceanic and Atmospheric Administration.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Alaska native corporation </heading><content style="-uslm-dtd:text">.—The term “<term style="-uslm-dtd:term">Alaska Native Corporation</term>” has the meaning given the term “<term style="-uslm-dtd:term">Native Corporation</term>” in section 3 of the Alaska Native Claims Settlement Act (43 U.S.C. 1602). </content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Appropriate congressional committees.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">appropriate congressional committees</term>” means the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Natural Resources of the House of Representatives.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Conservation </heading><chapeau style="-uslm-dtd:text">.—The term “<term style="-uslm-dtd:term">conservation</term>” means the use of methods and procedures necessary to preserve or sustain native corals and associated species as diverse, viable, and self-perpetuating coral reef ecosystems with minimal impacts from invasive species, including—</chapeau>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/4/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">all activities associated with resource management, such as monitoring, assessment, protection, restoration, sustainable use, management of habitat, and maintenance or augmentation of genetic diversity;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/4/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">mapping;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/4/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">scientific expertise and technical assistance in the development and implementation of management strategies for marine protected areas and marine resources required by Federal law;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/4/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">law enforcement;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/4/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">conflict resolution initiatives;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/4/F" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">community outreach and education; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/4/G" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">promotion of safe and ecologically sound navigation and anchoring.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Coral </heading><chapeau style="-uslm-dtd:text">.—The term “<term style="-uslm-dtd:term">coral</term>” means species of the phylum Cnidaria, including—</chapeau>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/5/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">all species of the orders Antipatharia (black corals), Scleractinia (stony corals), Alcyonacea (soft corals, organ pipe corals, gorgonians), and Helioporacea (blue coral), of the class Anthozoa; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/5/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">all species of the order Anthoathecata (fire corals and other hydrocorals) of the class Hydrozoa.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/6" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><heading style="-uslm-dtd:header">Coral products </heading><content style="-uslm-dtd:text">.—The term “<term style="-uslm-dtd:term">coral products</term>” means any living or dead specimens, parts, or derivatives, or any product containing specimens, parts, or derivatives, of any species of coral. </content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/7" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="7">(7) </num><heading style="-uslm-dtd:header">Coral reef.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">coral reef</term>” means calcium carbonate structures in the form of a reef or shoal, composed in whole or in part by living coral, skeletal remains of coral, crustose coralline algae, and other associated sessile marine plants and animals.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/8" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="8">(8) </num><heading style="-uslm-dtd:header">Coral reef ecosystem.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">coral reef ecosystem</term>” means—</chapeau>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/8/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">corals and other geographically and ecologically associated marine communities of other reef organisms (including reef plants and animals) associated with coral reef habitat; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/8/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the biotic and abiotic factors and processes that control or significantly affect coral calcification rates, tissue growth, reproduction, recruitment, abundance, coral-algal symbiosis, and biodiversity in such habitat.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/9" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="9">(9) </num><heading style="-uslm-dtd:header">Coral reef ecosystem services </heading><chapeau style="-uslm-dtd:text">.—The term “<term style="-uslm-dtd:quote">coral reef ecosystem services</term>” means the attributes and benefits provided by coral reef ecosystems including—</chapeau>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/9/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">protection of coastal beaches, structures, and infrastructure;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/9/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">habitat for organisms of economic, ecological, biomedical, medicinal, and cultural value;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/9/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">serving as centers for the promulgation, performance, and training of cultural practices representative of traditional ecological knowledge; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/9/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">aesthetic value.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/10" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="10">(10) </num><heading style="-uslm-dtd:header">Covered native entity.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">covered Native entity</term>” means a Native entity with interests in a coral reef ecosystem.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/11" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="11">(11) </num><heading style="-uslm-dtd:header">Covered reef manager </heading><chapeau style="-uslm-dtd:text">.—The term “<term style="-uslm-dtd:term">covered reef manager</term>” means—</chapeau>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/11/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">a management unit of a covered State with jurisdiction over a coral reef ecosystem; </content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/11/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">a covered State; or </content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/11/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">a coral reef stewardship partnership under section 206.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/12" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="12">(12) </num><heading style="-uslm-dtd:header">Covered state </heading><content style="-uslm-dtd:text">.—The term “<term style="-uslm-dtd:term">covered State</term>” means Florida, Hawaii, and the territories of American Samoa, the Commonwealth of the Northern Mariana Islands, Guam, Puerto Rico, and the United States Virgin Islands.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/13" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="13">(13) </num><heading style="-uslm-dtd:header">Federal reef manager.—</heading>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/13/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general </heading><chapeau style="-uslm-dtd:text">.—The term “<term style="-uslm-dtd:term">Federal reef manager</term>” means—</chapeau>
                        <clause identifier="/us/sComp/106/562/tII/s216/13/A/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">a management unit of a Federal agency specified in subparagraph (B) with lead management jurisdiction over a coral reef ecosystem; or </content>
                        </clause>
                        <clause identifier="/us/sComp/106/562/tII/s216/13/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">a coral reef stewardship partnership under section 206(c).</content>
                        </clause>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/13/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Federal agencies specified.—</heading><chapeau style="-uslm-dtd:text">A Federal agency specified in this subparagraph is one of the following:</chapeau>
                        <clause identifier="/us/sComp/106/562/tII/s216/13/B/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">The National Oceanic and Atmospheric Administration.</content>
                        </clause>
                        <clause identifier="/us/sComp/106/562/tII/s216/13/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">The National Park Service.</content>
                        </clause>
                        <clause identifier="/us/sComp/106/562/tII/s216/13/B/iii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">The United States Fish and Wildlife Service.</content>
                        </clause>
                        <clause identifier="/us/sComp/106/562/tII/s216/13/B/iv" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">The Office of Insular Affairs.</content>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/14" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="14">(14) </num><heading style="-uslm-dtd:header">Institution of higher education </heading><content style="-uslm-dtd:text">.—The term “<term style="-uslm-dtd:term">institution of higher education</term>” has the meaning given that term in section 101 of the Higher Education Act of 1965 (20 U.S.C. 1001).</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/15" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="15">(15) </num><heading style="-uslm-dtd:header">Interested stakeholder groups.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">interested stakeholder groups</term>” means any of the following with interest in an applicable coral reef or ecologically significant unit of a coral reef:</chapeau>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/15/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">A business.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/15/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">A commercial or recreational fisherman.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/15/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">A recreationalist.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/15/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">A Federal, State, Tribal, or local government unit with related jurisdiction.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/15/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">An institution of higher education (as such term is defined in section 101(a) of the Higher Education Act of 1965 (20 U.S.C. 1001(a)).</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/15/F" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">A nongovernmental organization.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/16" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="16">(16) </num><heading style="-uslm-dtd:header">National Coral Reef Resilience Strategy.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">National Coral Reef Resilience Strategy</term>” means the National Coral Reef Resilience Strategy in effect under section 204.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/17" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="17">(17) </num><heading style="-uslm-dtd:header">Native entity </heading><chapeau style="-uslm-dtd:text">.—The term “<term style="-uslm-dtd:term">Native entity</term>” means any of the following:</chapeau>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/17/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">An Indian Tribe (as defined in section 4 of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 5304)).</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/17/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">An Alaska Native Corporation. </content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/17/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">The Department of Hawaiian Home Lands. </content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/17/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">The Office of Hawaiian Affairs.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/17/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">A Native Hawaiian organization (as defined in section 6207 of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7517)).</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/18" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="18">(18) </num><heading style="-uslm-dtd:header">Nonprofit organization </heading><chapeau style="-uslm-dtd:text">.—The term “<term style="-uslm-dtd:term">nonprofit organization</term>” means any corporation, trust, association, cooperative, or other organization, not including an institution of higher education, that—</chapeau>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/18/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">is operated primarily for scientific, educational, service, charitable, or similar purposes in the public interest; </content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/18/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">is not organized primarily for profit; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/18/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">uses net proceeds to maintain, improve, or expand the operations of the organization.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/19" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="19">(19) </num><heading style="-uslm-dtd:header">Restoration </heading><content style="-uslm-dtd:text">.—The term “<term style="-uslm-dtd:term">restoration</term>” means the use of methods and procedures necessary to enhance, rehabilitate, recreate, or create a functioning coral reef or coral reef ecosystem, in whole or in part, within suitable waters of the historical geographic range of such ecosystems, to provide ecological, economic, cultural, or coastal resiliency services associated with healthy coral reefs and benefit native populations of coral reef organisms.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/20" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="20">(20) </num><heading style="-uslm-dtd:header">Resilience.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">resilience</term>” means the capacity for corals within their native range, coral reefs, or coral reef ecosystems to resist and recover from natural and human disturbances, and maintain structure and function to provide coral reef ecosystem services, as determined by clearly identifiable, measurable, and science-based standards.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/21" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="21">(21) </num><heading style="-uslm-dtd:header">Secretary.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Secretary</term>” means the Secretary of Commerce.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/22" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="22">(22) </num><heading style="-uslm-dtd:header">State </heading><chapeau style="-uslm-dtd:text">.—The term “<term style="-uslm-dtd:term">State</term>” means—</chapeau>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/22/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">any State of the United States that contains a coral reef ecosystem within its seaward boundaries;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/22/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">American Samoa, the Commonwealth of the Northern Mariana Islands, Guam, Puerto Rico, or the United States Virgin Islands; or</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/106/562/tII/s216/22/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">any other territory or possession of the United States or separate sovereign in free association with the United States that contains a coral reef ecosystem within its seaward boundaries.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/23" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="23">(23) </num><heading style="-uslm-dtd:header">Stewardship </heading><content style="-uslm-dtd:text">.—The term “<term style="-uslm-dtd:term">stewardship</term>”, with respect to a coral reef, includes conservation, restoration, and public outreach and education.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/106/562/tII/s216/24" style="-uslm-dtd:paragraph" styleType="OLC">
