                <num style="-uslm-dtd:enum" value="551">SEC. 551. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t50/s2201">50 U.S.C. 2201 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
                <content style="-uslm-dtd:text" class="block">This part may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Spoils of War Act of 1994</inline></shortTitle>”.</content>

            <section style="-uslm-dtd:section" identifier="/us/sComp/103/236/ptB/s552" styleType="OLC">
                <num style="-uslm-dtd:enum" value="552">SEC. 552. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t50/s2201">50 U.S.C. 2201</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">TRANSFERS OF SPOILS OF WAR. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/236/ptB/s552/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Eligibility for Transfer.—</heading><content style="-uslm-dtd:text">Spoils of war in the possession, custody, or control of the United States may be transferred to any other party, including any government, group, or person, by sale, grant, loan or in any other manner, only to the extent and in the same manner that property of the same type, if otherwise owned by the United States, may be so transferred.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/236/ptB/s552/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Terms and Conditions.—</heading><content style="-uslm-dtd:text">Any transfer pursuant to subsection (a) shall be subject to all of the terms, conditions, and requirements applicable to the transfer of property of the same type otherwise owned by the United States.</content>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/103/236/ptB/s553" styleType="OLC">
                <num style="-uslm-dtd:enum" value="553">SEC. 553. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t50/s2202">50 U.S.C. 2202</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PROHIBITION ON TRANSFERS TO COUNTRIES WHICH SUPPORT TERRORISM. </heading>
                <content style="-uslm-dtd:text" class="block">Spoils of war in the possession, custody, or control of the United States may not be transferred to any country determined by the Secretary of State, for purposes of section 40 of the Arms Export Control Act <editorialNote style="-uslm-dtd:legis-comment"><b>[</b>22 U.S.C. 2780<b>]</b></editorialNote>, to be a nation whose government has repeatedly provided support for acts of international terrorism.</content>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/103/236/ptB/s554" styleType="OLC">
                <num style="-uslm-dtd:enum" value="554">SEC. 554. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t50/s2203">50 U.S.C. 2203</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">REPORT ON PREVIOUS TRANSFERS. </heading>
                <content style="-uslm-dtd:text" class="block">Not later than 90 days after the date of enactment of this Act <editorialNote style="-uslm-dtd:legis-comment"><b>[</b>April 30, 1994<b>]</b></editorialNote>, the President shall submit to the appropriate congressional committees a report describing any spoils of war obtained subsequent to August 2, 1990 that were transferred to any party, including any government, group, or person, before the date of enactment of this Act <editorialNote style="-uslm-dtd:legis-comment"><b>[</b>April 30, 1994<b>]</b></editorialNote>.  Such report shall be submitted in unclassified form to the extent possible.</content>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/103/236/ptB/s555" styleType="OLC" role="definitions">
                <num style="-uslm-dtd:enum" value="555">SEC. 555. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t50/s2204">50 U.S.C. 2204</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
                <subsection style="-uslm-dtd:subsection" styleType="OLC" role="undesignated-level"><chapeau style="-uslm-dtd:text">As used in this part—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/236/ptB/s555/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">appropriate congressional committees</term>” means the Committee on Foreign Relations of the Senate and the Committee on Foreign Affairs of the House of Representatives, or, where required by law for certain reporting purposes, the Select Committee on Intelligence of the Senate and the Select Committee on Intelligence of the House of Representatives;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/236/ptB/s555/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">enemy</term>” means any country, government, group, or person that has been engaged in hostilities, whether or not lawfully authorized, with the United States;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/236/ptB/s555/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">person</term>” means—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/236/ptB/s555/3/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">any natural person;</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/236/ptB/s555/3/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">any corporation, partnership, or other legal entity; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/236/ptB/s555/3/C" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">any organization, association, or group; and</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/236/ptB/s555/4" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">spoils of war</term>” means enemy movable property lawfully captured, seized, confiscated, or found which has become United States property in accordance with the laws of war.</content>
                    </paragraph>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/103/236/ptB/s556" styleType="OLC">
                <num style="-uslm-dtd:enum" value="556">SEC. 556. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t50/s2205">50 U.S.C. 2205</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">CONSTRUCTION. </heading>
                <subsection style="-uslm-dtd:subsection" styleType="OLC" role="undesignated-level"><chapeau style="-uslm-dtd:text">Nothing in this part shall apply to—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/236/ptB/s556/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the abandonment or failure to take possession of spoils of war by troops in the field for valid military reasons related to the conduct of the immediate conflict, including the burden of transporting such property or a decision to allow allied forces to take immediate possession of certain property solely for use during an ongoing conflict;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/236/ptB/s556/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the abandonment or return of any property obtained, borrowed, or requisitioned for temporary use during military operations without intent to retain possession of such property;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/236/ptB/s556/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the destruction of spoils of war by troops in the field;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/236/ptB/s556/4" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">the return of spoils of war to previous owners from whom such property had been seized by enemy forces; or</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/236/ptB/s556/5" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5)<ref style="-uslm-dtd:footnote-ref" idref="IDC6491A49A34E4124A5BD4963B80386DC" class="footnoteRef">1</ref> </num><content style="-uslm-dtd:text">minor articles of personal property which have lawfully become the property of individual members of the armed forces as war trophies pursuant to public written authorization from the Department of Defense.</content><footnote id="IDC6491A49A34E4124A5BD4963B80386DC" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">See section 2579 of title 10, United States Code, regarding procedures for handling and retaining battlefield objects by members of the Armed Forces.</p></footnote>
                    </paragraph>
                </subsection>
            </section>
        </part>
