                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Applicability of Definitions in Title 10, United States Code.—</heading><content style="-uslm-dtd:text">Except as provided in subsection (b), the definitions provided in section 101 of title 10, United States Code, apply to the provisions of this title.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stA/s212/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Additional Definitions.—</heading><chapeau style="-uslm-dtd:text">In this title:</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s212/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Active duty.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">active duty</term>” means full-time duty in the active service of a uniformed service.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s212/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Grade.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">grade</term>” means a step or degree, in a graduated scale of office or rank, that is established and designated as a grade by law or regulation.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s212/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Officer.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">officer</term>” means an officer of the commissioned corps.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s212/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Officer
 candidate </heading><content style="-uslm-dtd:text">.—The term “<term style="-uslm-dtd:term">officer candidate</term>” means an individual who is enrolled in the basic officer training program of the Administration and is under consideration for appointment as an officer under section 221(a)(2)(A).</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s212/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Flag officer.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">flag officer</term>” means an officer serving in, or having the grade of, vice admiral, rear admiral, or rear admiral (lower half).</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s212/b/6" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="6">(6) </num><heading style="-uslm-dtd:header">Secretary.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Secretary</term>” means the Secretary of Commerce.</content>
                        </paragraph>

                            <num style="-uslm-dtd:enum" value="7">(7) </num><heading style="-uslm-dtd:header">Administration.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Administration</term>” means the National Oceanic and Atmospheric Administration.</content>
                        </paragraph>

                            <num style="-uslm-dtd:enum" value="8">(8) </num><heading style="-uslm-dtd:header">Under secretary.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:quote">Under Secretary</term>” means the Under Secretary of Commerce for Oceans and Atmosphere.</content>

                    <subsection identifier="/us/sComp/107/372/tII/stA/s213/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Annual Strength on Active List.—</heading><content style="-uslm-dtd:text">The annual strength of the commissioned corps in officers on the lineal list of active duty officers of the corps shall be prescribed by law.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stA/s213/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Lineal List.—</heading><content style="-uslm-dtd:text">The Secretary shall maintain a list, known as the “<quotedText style="-uslm-dtd:quote">lineal list</quotedText>”, of officers on active duty. Officers shall be carried on the lineal list by grade and, within grade, by seniority in grade.</content>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stA/s214" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="214">SEC. 214. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3004">33 U.S.C. 3004</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">STRENGTH AND
 DISTRIBUTION IN GRADE. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stA/s214/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Grades.—</heading><chapeau style="-uslm-dtd:text">The commissioned grades in the commissioned officer corps of the Administration are the following, in relative rank with officers of the Navy:</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s214/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Vice admiral.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s214/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Rear admiral.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s214/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">Rear admiral (lower half).</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s214/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">Captain.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s214/a/5" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">Commander.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s214/a/6" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">Lieutenant commander.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s214/a/7" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">Lieutenant.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s214/a/8" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">Lieutenant (junior grade).</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s214/a/9" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="9">(9) </num><content style="-uslm-dtd:text">Ensign.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stA/s214/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Grade Distribution.—</heading><content style="-uslm-dtd:text">The Secretary shall prescribe, with respect to the distribution on the lineal list in grade, the percentages applicable to the grades set forth in subsection (a).</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stA/s214/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Annual
 Computation of Number in Grade.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s214/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In
 general.—</heading><content style="-uslm-dtd:text">Not less frequently than once each year, the Secretary shall make a computation to determine the number of officers on the lineal list authorized to be serving in each grade.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s214/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Method of
 computation.—</heading><content style="-uslm-dtd:text">The number in each grade shall be computed by applying the applicable percentage to the total number of such officers serving on active duty on the date the computation is made.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s214/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Fractions.—</heading><content style="-uslm-dtd:text">If a final fraction occurs in computing the authorized number of officers in a grade, the nearest whole number shall be taken. If the fraction is one-half, the next higher whole number shall be taken.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stA/s214/d" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Temporary
 Increase in Numbers.—</heading><content style="-uslm-dtd:text">The total number of officers authorized by law to be on the lineal list during a fiscal year may be temporarily exceeded if the average number on that list during that fiscal year does not exceed the authorized number.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stA/s214/e" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Positions of
 Importance and Responsibility.—</heading><content style="-uslm-dtd:text">Officers serving in positions designated under section 228(a) and officers recalled from retired status shall not be counted when computing authorized strengths under subsection (c) and shall not count against those strengths.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stA/s214/f" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Preservation of
 Grade and Pay.—</heading><content style="-uslm-dtd:text">No officer may be reduced in grade or pay or separated from the commissioned officer corps of the Administration as the result of a computation made to determine the authorized number of officers in the various grades.</content>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stA/s215" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="215">SEC. 215. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3005">33 U.S.C. 3005</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">NUMBER OF AUTHORIZED COMMISSIONED OFFICERS. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stA/s215/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The total number of authorized commissioned officers on the lineal list of the commissioned officer corps of the Administration shall not exceed 500.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stA/s215/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Positions of
 Importance and Responsibility.—</heading><chapeau style="-uslm-dtd:text">Officers serving in positions designated under section 228 and officers recalled from retired status or detailed to an agency other than the Administration—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s215/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">may not be counted in determining the total number of authorized officers on the lineal list under this section; and</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s215/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">may not count against such number.</content>
                        </paragraph>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stA/s216" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="216">SEC. 216. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3006">33 U.S.C. 3006</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">OBLIGATED
 SERVICE REQUIREMENT. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stA/s216/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In
 General.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s216/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Regulations.—</heading><content style="-uslm-dtd:text">The Secretary shall prescribe the obligated service requirements for appointments, training, promotions, separations, continuations, and retirements of officers not otherwise covered by law.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s216/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Written
 agreements.—</heading><content style="-uslm-dtd:text">The Secretary and officers shall enter into written agreements that describe the officers’ obligated service requirements prescribed under paragraph (1) in return for such appointments, training, promotions, separations, continuations, and retirements as the Secretary considers appropriate.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stA/s216/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Repayment
 for Failure to Satisfy Requirements.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s216/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In
 general.—</heading><content style="-uslm-dtd:text">The Secretary may require an officer who fails to meet the service requirements prescribed under subsection (a)(1) to reimburse the Secretary in an amount that bears the same ratio to the total costs of the training provided to that officer by the Secretary as the unserved portion of active duty bears to the total period of active duty the officer agreed to serve.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s216/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Obligation as debt to united states.—</heading><content style="-uslm-dtd:text">An obligation to reimburse the Secretary under paragraph (1) is, for all purposes, a debt owed to the United States.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s216/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Discharge in bankruptcy.—</heading><content style="-uslm-dtd:text">A discharge in bankruptcy under title 11 that is entered less than five years after the termination of a written agreement entered into under subsection (a)(2) does not discharge the individual signing the agreement from a debt arising under such agreement.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stA/s216/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Waiver or
 Suspension of Compliance.—</heading><chapeau style="-uslm-dtd:text">The Secretary may waive the service obligation of an officer who—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s216/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">becomes unqualified to serve on active duty in the commissioned officer corps of the Administration because of a circumstance not within the control of that officer; or</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s216/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">is—</chapeau>
                            <subparagraph identifier="/us/sComp/107/372/tII/stA/s216/c/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">not physically qualified for appointment; and</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stA/s216/c/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">determined to be unqualified for service in the commissioned officer corps of the Administration because of a physical or medical condition that was not the result of the officer's own willful misconduct.</content>
                            </subparagraph>
                        </paragraph>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stA/s217" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="217">SEC. 217. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3007">33 U.S.C. 3007</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">TRAINING AND
 PHYSICAL FITNESS. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stA/s217/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Training.—</heading><chapeau style="-uslm-dtd:text">The Secretary may take such measures as may be necessary to ensure that officers are prepared to carry out their duties in the commissioned officer corps of the Administration and proficient in the skills necessary to carry out such duties. Such measures may include the following:</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s217/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Carrying out training programs and correspondence courses, including establishing and operating a basic officer training program to provide initial indoctrination and maritime vocational training for officer candidates as well as refresher training, mid-career training, aviation training, and such other training as the Secretary considers necessary for officer development and proficiency.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s217/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Providing officers and officer candidates with educational materials.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s217/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">Acquiring such equipment as may be necessary for training and instructional purposes.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stA/s217/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Physical
 Fitness.—</heading><content style="-uslm-dtd:text">The Secretary shall ensure that officers maintain a high physical state of readiness by establishing standards of physical fitness for officers that are substantially equivalent to those prescribed for officers in the Coast Guard.</content>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stA/s218" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="218">SEC. 218. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3008">33 U.S.C. 3008</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">COOPERATIVE AVIATION CENTERS. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stA/s218/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">In this section:</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s218/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Administrator.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Administrator</term>” means the Under Secretary of Commerce for Oceans and Atmosphere and the Administrator of the National Oceanic and Atmospheric Administration.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s218/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Cooperative aviation center.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Cooperative Aviation Center</term>” means a Cooperative Aviation Center designated under subsection (b)(1).</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stA/s218/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Cooperative Aviation Centers.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s218/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Designation required.—</heading><content style="-uslm-dtd:text">The Administrator shall designate one or more Cooperative Aviation Centers for the commissioned officer corps of the Administration at institutions described in paragraph (3).</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s218/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Purpose.—</heading><content style="-uslm-dtd:text">The purpose of Cooperative Aviation Centers is to facilitate the development and recruitment of aviators for the commissioned officer corps of the Administration.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s218/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Institutions described.—</heading><chapeau style="-uslm-dtd:text">An institution described in this paragraph is an educational institution that—</chapeau>
                            <subparagraph identifier="/us/sComp/107/372/tII/stA/s218/b/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">applies to enter into an agreement with the Administrator providing for the establishment of the program at the institution;</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stA/s218/b/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">has, as a part of its curriculum, a four-year baccalaureate program of professional flight and piloting instruction that is accredited by the Aviation Accreditation Board International; and</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stA/s218/b/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">is located in a geographic area that experiences a wide variation in climate-related activity, including frequent high winds, convective activity (including tornadoes), periods of low visibility, heat, and snow and ice episodes, to provide opportunities for pilots to demonstrate skill in all weather conditions compatible with future encounters during their service in the commissioned officer corps of the Administration.</content>
                            </subparagraph>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stA/s218/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Cooperative Aviation Centers Advisor.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s218/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Assignment.—</heading><content style="-uslm-dtd:text">The Administrator shall assign an officer or employee of the commissioned officer corps of the Administration to serve as the Cooperative Aviation Centers Advisor.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stA/s218/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Duties.—</heading><chapeau style="-uslm-dtd:text">The Cooperative Aviation Centers Advisor shall—</chapeau>
                            <subparagraph identifier="/us/sComp/107/372/tII/stA/s218/c/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">

 RECRUITING MATERIALS FOR PUBLIC RELATIONS. </heading>
                    <content class="block" style="-uslm-dtd:text">The Secretary may use for public relations purposes of the Department of Commerce any advertising materials developed for use for recruitment and retention of personnel for the commissioned officer corps of the Administration. Any such use shall be under such conditions and subject to such restrictions as the Secretary shall prescribe.</content>

corps of the Administration and to members of other uniformed services for service and achievement in support of the missions of the Administration.</content>

 Appointments.—</heading>

                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Grades.—</heading>

                                <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In
 general.—</heading><chapeau style="-uslm-dtd:text">Except as provided in subparagraph (B), an original appointment of an officer may be made in such grades as may be appropriate for—</chapeau>

                                <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Appointment of officer candidates.—</heading>
                                <clause identifier="/us/sComp/107/372/tII/stB/s221/a/1/B/i" style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Limitation on grade.—</heading><content style="-uslm-dtd:text">An original appointment of an officer candidate, upon graduation from the basic officer training program of the commissioned officer corps of the Administration, may not be made in any other grade than ensign.</content>
                                </clause>
                                <clause identifier="/us/sComp/107/372/tII/stB/s221/a/1/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">Rank.—</heading><content style="-uslm-dtd:text">Officer candidates receiving appointments as ensigns upon graduation from the basic officer training program shall take rank according to their proficiency as shown by the order of their merit at date of graduation.</content>
                                </clause>
                            </subparagraph>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s221/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Source
 of appointments.—</heading><chapeau style="-uslm-dtd:text">An original appointment may be made from among the following:</chapeau>
                            <subparagraph identifier="/us/sComp/107/372/tII/stB/s221/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">Graduates of the basic officer training program of the commissioned officer corps of the Administration.</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stB/s221/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">Subject to the approval of the Secretary of Defense, graduates of the military service academies of the United States who otherwise meet the academic standards for enrollment in the training program described in subparagraph (A).</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stB/s221/a/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">(C) </num><chapeau style="-uslm-dtd:text">Graduates of the State maritime academies who—</chapeau>
                                <clause identifier="/us/sComp/107/372/tII/stB/s221/a/2/C/i" style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">otherwise meet the academic standards for enrollment in the training program described in subparagraph (A);</content>
                                </clause>
                                <clause identifier="/us/sComp/107/372/tII/stB/s221/a/2/C/ii" style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">completed at least three years of regimented training while at a State maritime academy; and</content>
                                </clause>
                                <clause identifier="/us/sComp/107/372/tII/stB/s221/a/2/C/iii" style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">obtained an unlimited tonnage or unlimited horsepower Merchant Mariner Credential from the United States Coast Guard.</content>
                                </clause>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stB/s221/a/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">Licensed officers of the United States merchant marine who have served two or more years aboard a vessel of the United States in the capacity of a licensed officer, who otherwise meet the academic standards for enrollment in the training program described in subparagraph (A).</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s221/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">In this subsection:</chapeau>
                            <subparagraph identifier="/us/sComp/107/372/tII/stB/s221/a/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Military service academies of the united states.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">military service academies of the United States</term>” means the following:</chapeau>
                                <clause identifier="/us/sComp/107/372/tII/stB/s221/a/3/A/i" style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">The United States Military Academy, West Point, New York.</content>
                                </clause>
                                <clause identifier="/us/sComp/107/372/tII/stB/s221/a/3/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">The United States Naval Academy, Annapolis, Maryland.</content>
                                </clause>

                                <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">State maritime academy.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">State maritime academy</term>” has the meaning given the term in section 51102 of title 46, United States Code. </content>
                            </subparagraph>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s221/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Reappointment.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s221/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Except as provided in paragraph (2), an individual who previously served in the commissioned officer corps of the Administration may be appointed by the Secretary to the grade the individual held prior to separation.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s221/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Reappointments to higher grades.—</heading><content style="-uslm-dtd:text">An appointment under paragraph (1) to a position of importance and responsibility designated under section 228 may only be made by the President.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s221/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Qualifications.—</heading><chapeau style="-uslm-dtd:text">An appointment under subsection (a) or (b) may—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s221/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">be given only to an individual who is a citizen of the United States; and</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s221/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">not be given.<ref class="footnoteRef" idref="ID75650C451ACE4442948FDDD8362BAF7B" style="-uslm-dtd:footnote-ref">3</ref> to an individual until the individual's mental, moral, physical, and professional fitness to perform the duties of an officer has been established under such regulations as the Secretary shall prescribe.</content><footnote id="ID75650C451ACE4442948FDDD8362BAF7B" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">3</sup><p style="-uslm-dtd:para; margin-left:1em">The period after “<quotedText style="-uslm-dtd:quote">not be given</quotedText>” in paragraph (2) is so in law.</p></footnote>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s221/d" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Order of
 Precedence.—</heading><content style="-uslm-dtd:text">Appointees under this section shall take precedence in the grade to which appointed in accordance with the dates of their commissions as commissioned officers in such grade. The order of precedence of appointees whose dates of commission are the same shall be determined by the Secretary. </content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s221/e" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Inter-service Transfers.—</heading><chapeau style="-uslm-dtd:text">For inter-service transfers (as described in Department of Defense Directive 1300.4 (dated December 27, 2006)) the Secretary shall—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s221/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">coordinate with the Secretary of Defense and the Secretary of the Department in which the Coast Guard is operating to promote and streamline inter-service transfers;</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s221/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">give preference to such inter-service transfers for recruitment purposes as determined appropriate by the Secretary; and</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s221/e/3" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">reappoint such inter-service transfers to the equivalent grade in the commissioned officer corps of the Administration.</content>
                        </paragraph>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stB/s222" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="222">SEC. 222. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3022">33 U.S.C. 3022</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PERSONNEL
 BOARDS. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s222/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Convening.—</heading><content style="-uslm-dtd:text">Not less frequently than once each year and at such other times as the Secretary determines necessary, the Secretary shall convene a personnel board.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s222/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Membership.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s222/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In
 general.—</heading><content style="-uslm-dtd:text">A board convened under subsection (a) shall consist of five or more officers who are serving in or above the permanent grade of the officers under consideration by the board.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s222/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Retired
 officers.—</heading><content style="-uslm-dtd:text">Officers on the retired list may be recalled to serve on such personnel boards as the Secretary considers necessary.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s222/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">No
 membership on two successive boards.—</heading><content style="-uslm-dtd:text">No officer may be a member of two successive personnel boards convened to consider officers of the same grade for promotion or separation.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s222/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Duties.—</heading><chapeau style="-uslm-dtd:text">Each personnel board shall—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s222/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">recommend to the Secretary such changes as may be necessary to correct any erroneous position on the lineal list that was caused by administrative error; and</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s222/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">make selections and recommendations to the Secretary and the President for the appointment, promotion, involuntary separation, continuation, and involuntary retirement of officers in the commissioned officer corps of the Administration as prescribed in this title.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s222/d" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Action on
 Recommendations Not Acceptable.—</heading><content style="-uslm-dtd:text">If any recommendation by a board convened under subsection (a) is not accepted by the Secretary or the President, the board shall make such further recommendations as the Secretary or the President considers appropriate.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s222/e" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Authority for Officers to Opt Out of Promotion
 Consideration.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s222/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Director of the National Oceanic and Atmospheric Administration Commissioned Officer Corps may provide that an officer, upon the officer’s request and with the approval of the Director, be excluded from consideration for promotion by a personnel board convened under this section.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s222/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Approval.—</heading><chapeau style="-uslm-dtd:text">The Director shall approve a request made by an officer under paragraph (1) only if—</chapeau>
                            <subparagraph identifier="/us/sComp/107/372/tII/stB/s222/e/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the basis for the request is to allow the officer to complete a broadening assignment, advanced education, another assignment of significant value to the Administration, a career progression requirement delayed by the assignment or education, or a qualifying personal or professional circumstance, as determined by the Director;</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stB/s222/e/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the Director determines the exclusion from consideration is in the best interest of the Administration; and</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stB/s222/e/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the officer has not previously failed selection for promotion to the grade for which the officer requests the exclusion from consideration.</content>
                            </subparagraph>
                        </paragraph>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stB/s223" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="223">SEC. 223. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3023">33 U.S.C. 3023</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SEPARATION OF ENSIGNS FOUND NOT FULLY QUALIFIED. </heading>
                    <content class="block" style="-uslm-dtd:text">If an officer in the  grade of ensign is at any time found not fully qualified,  the officer shall be separated from the commissioned service.</content>
                </section>
                <section identifier="/us/sComp/107/372/tII/stB/s224" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="224">SEC. 224. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3024">33 U.S.C. 3024</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PROMOTION BY SELECTION TO PERMANENT GRADES ABOVE LIEUTENANT (JUNIOR GRADE). </heading>
                    <content class="block" style="-uslm-dtd:text">Promotion to fill vacancies in each permanent grade above the grade of lieutenant (junior grade) shall be made by selection from the next lower grade upon recommendation of the personnel board.</content>
                </section>
                <section identifier="/us/sComp/107/372/tII/stB/s225" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="225">SEC. 225. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3025">33 U.S.C. 3025</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">LENGTH OF SERVICE FOR PROMOTION PURPOSES. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s225/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">General Rule.—</heading><content style="-uslm-dtd:text">Each officer shall be assumed to have, for promotion purposes, at least the same length of service as any other officer below that officer on the lineal list.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s225/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Exception.—</heading><content style="-uslm-dtd:text">Notwithstanding subsection (a), an officer who has lost numbers shall be assumed to have, for promotion purposes, no greater service than the officer next above such officer in such officer's new position on the lineal list.</content>
                    </subsection>
                </section>

                    <num style="-uslm-dtd:enum" value="226">SEC. 226. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3026">33 U.S.C. 3026</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">APPOINTMENTS AND PROMOTIONS TO PERMANENT GRADES. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s226/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Appointments
 in and promotions to all permanent grades, other than a grade described in subsection (b), shall be made by the President.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s226/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Flag Officers.—</heading><content style="-uslm-dtd:text">Appointments in and promotions to the grade of rear admiral (upper half) or above shall be made by the President, by and with the advice and consent of the Senate.</content>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stB/s227" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="227">SEC. 227. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3027">33 U.S.C. 3027</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">GENERAL QUALIFICATION OF OFFICERS FOR PROMOTION TO HIGHER PERMANENT GRADE. </heading>
                    <content class="block" style="-uslm-dtd:text">No officer may be promoted to a higher permanent grade on the active list until the officer has passed a satisfactory mental and physical examination in accordance with regulations prescribed by the Secretary.</content>
                </section>
                <section identifier="/us/sComp/107/372/tII/stB/s228" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="228">SEC. 228. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3028">33 U.S.C. 3028</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">POSITIONS OF IMPORTANCE AND RESPONSIBILITY. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s228/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Designation of Positions.—</heading><content style="-uslm-dtd:text">The Secretary may designate positions in the Administration as being positions of importance and responsibility for which it is appropriate that officers of the Administration, if serving in those positions, serve in the grade of vice admiral, rear admiral, or rear admiral (lower half), as designated by the Secretary for each position.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s228/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Assignment of Officers to Designated Positions.—</heading><content style="-uslm-dtd:text">The Secretary may assign officers to positions designated under subsection (a).</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s228/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Director of NOAA Commissioned Officer Corps and Assistant Administrator for Marine and Aviation Operations.—</heading><content style="-uslm-dtd:text">The President shall designate one position as responsible for oversight of the vessel and aircraft fleets and for the administration of the commissioned officer corps. The President shall fill that position by appointing, by and with the advice and consent of the Senate, an officer on the lineal list who has served, on the date of such appointment, in the grade of captain or above for not less than one year. For the specific purpose of administering the commissioned officer corps, that position shall carry the title of Director of the National Oceanic and Atmospheric Administration Commissioned Officer Corps. For the specific purpose of administering the vessel and aircraft fleets, that position shall carry the title of Assistant Administrator of the National Oceanic and Atmospheric Administration for Marine and Aviation Operations.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s228/d" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Grade.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s228/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Temporary appointment to grade designated for position.—</heading><content style="-uslm-dtd:text">An officer assigned to a position under this section while so serving has the grade designated for that position, if appointed to that grade by the President.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s228/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Reversion to permanent grade.—</heading><content style="-uslm-dtd:text">An officer who has served in a grade above captain, upon termination of the officer's assignment to the position for which that appointment was made, shall, unless appointed or assigned to another position for which a higher grade is designated or immediately beginning a period of terminal leave, revert to the grade and number the officer would have occupied but for serving in a grade above that of captain. In such a case, the officer shall be an extra number in that grade.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s228/e" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Limit on Number of Officers Appointed.—</heading><content style="-uslm-dtd:text">The total number of officers serving on active duty at any one time in the grade of rear admiral (lower half) or above may not exceed five, with only one serving in the grade of vice admiral.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s228/f" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Pay and Allowances.—</heading><content style="-uslm-dtd:text">An officer appointed to a grade under this section, while serving in that grade or in a period of annual leave used at the end of the appointment, shall have the pay and allowances of the grade to which appointed.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s228/g" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Effect of Appointment.—</heading><chapeau style="-uslm-dtd:text">An appointment of an officer under this section—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s228/g/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">does not vacate the permanent grade held by the officer; and</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s228/g/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">creates a vacancy on the active list.</content>
                        </paragraph>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stB/s229" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="229">SEC. 229. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3029">33 U.S.C. 3029</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">TEMPORARY
 APPOINTMENTS. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s229/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Appointments
 by President.—</heading><content style="-uslm-dtd:text">Temporary appointments in the grade of ensign, lieutenant junior grade, or lieutenant may be made by the President.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s229/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Termination.—</heading><content style="-uslm-dtd:text">A temporary appointment to a position under subsection (a) shall terminate upon approval of a permanent appointment for such position made by the President.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s229/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Order of
 Precedence.—</heading><content style="-uslm-dtd:text">Appointees under subsection (a) shall take precedence in the grade to which appointed in accordance with the dates of their appointments as officers in such grade. The order of precedence of appointees who are appointed on the same date shall be determined by the Secretary.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s229/d" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Any One
 Grade.—</heading><content style="-uslm-dtd:text">When determined by the Secretary to be in the best interest of the commissioned officer corps of the Administration, officers in any permanent grade may be temporarily promoted one grade by the President. Any such temporary promotion terminates upon the transfer of the officer to a new assignment.</content>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stB/s230" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="230">SEC. 230. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3030">33 U.S.C. 3030</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">TEMPORARY APPOINTMENT OR ADVANCEMENT OF COMMISSIONED OFFICERS IN TIME OF WAR OR NATIONAL EMERGENCY. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s230/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Officers of the Administration shall be subject in like manner and to the same extent as personnel of the Navy to all laws authorizing temporary appointment or advancement of commissioned officers in time of war or national emergency.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s230/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Limitations.—</heading><chapeau style="-uslm-dtd:text">Subsection (a) shall be applied subject to the following limitations:</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s230/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">A commissioned officer in the service of a military department under section 251 may, upon the recommendation of the Secretary of the military department concerned, be temporarily promoted to a higher rank or grade.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s230/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">A commissioned officer in the service of the Administration may be temporarily promoted to fill vacancies in ranks and grades caused by the transfer of commissioned officers to the service and jurisdiction of a military department under section 251.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s230/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">Temporary appointments may be made in all grades to which original appointments in the Administration are authorized, except that the number of officers holding temporary appointments may not exceed the number of officers transferred to a military department under section 251.</content>
                        </paragraph>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stB/s231" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="231">SEC. 231. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3031">33 U.S.C. 3031</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PAY AND ALLOWANCES; DATE OF ACCEPTANCE OF PROMOTION. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s231/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Acceptance and Date of Promotion.—</heading><chapeau style="-uslm-dtd:text">An officer of the commissioned corps who is promoted to a higher grade—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s231/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">is deemed for all purposes to have accepted the promotion upon the date the promotion is made by the President, unless the officer expressly declines the promotion; and</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s231/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">shall receive the pay and allowances of the higher grade from that date unless the officer is entitled under another provision of law to receive the pay and allowances of the higher grade from an earlier date.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s231/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Oath of Office.—</heading><content style="-uslm-dtd:text">An officer who subscribed to the oath of office required by section 3331 of title 5, United States Code, shall not be required to renew such oath or to take a new oath upon promotion to a higher grade, if the service of the officer after the taking of such oath is continuous.</content>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stB/s232" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="232">SEC. 232. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3032">33 U.S.C. 3032</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SERVICE CREDIT AS DECK OFFICER OR JUNIOR ENGINEER FOR PROMOTION PURPOSES. </heading>
                    <content class="block" style="-uslm-dtd:text">For purposes of promotion, there shall be counted in addition to active commissioned service, service as deck officer or junior engineer.</content>
                </section>
                <section identifier="/us/sComp/107/372/tII/stB/s233" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="233">SEC. 233. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3033">33 U.S.C. 3033</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SUSPENSION DURING WAR OR EMERGENCY. </heading>
                    <content class="block" style="-uslm-dtd:text">In time of emergency declared by the President or by the Congress, and in time of war, the President is authorized, in the President's discretion, to suspend the operation of all or any part of the provisions of law pertaining to promotion of commissioned officers of the Administration.</content>
                </section>
                <section identifier="/us/sComp/107/372/tII/stB/s234" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="234">SEC. 234. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3034">33 U.S.C. 3034</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">OFFICER
 CANDIDATES. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s234/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Determination of Number.—</heading><content style="-uslm-dtd:text">The Secretary shall determine the number of appointments of officer candidates.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s234/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Appointment.—</heading><content style="-uslm-dtd:text">Appointment of officer candidates shall be made under regulations, which the Secretary shall prescribe, including regulations with respect to determining age limits, methods of selection of officer candidates, term of service as an officer candidate before graduation from the basic officer training program of the Administration, and all other matters affecting such appointment.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s234/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Dismissal.—</heading><content style="-uslm-dtd:text">The Secretary may dismiss from the basic officer training program of the Administration any officer candidate who, during the officer candidate's term as an officer candidate, the Secretary considers unsatisfactory in either academics or conduct, or not adapted for a career in the commissioned officer corps of the Administration. Officer candidates shall be subject to rules governing discipline prescribed by the Director of the National Oceanic and Atmospheric Administration Commissioned Officer Corps.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s234/d" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Agreement.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s234/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In
 general.—</heading><content style="-uslm-dtd:text">Each officer candidate shall sign an agreement with the Secretary in accordance with section 216(a)(2) regarding the officer candidate's term of service in the commissioned officer corps of the Administration.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s234/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Elements.—</heading><chapeau style="-uslm-dtd:text">An agreement signed by an officer candidate under paragraph (1) shall provide that the officer candidate agrees to the following:</chapeau>
                            <subparagraph identifier="/us/sComp/107/372/tII/stB/s234/d/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">That the officer candidate will complete the course of instruction at the basic officer training program of the Administration.</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stB/s234/d/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">That upon graduation from such program, the officer candidate—</chapeau>
                                <clause identifier="/us/sComp/107/372/tII/stB/s234/d/2/B/i" style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">will accept an appointment, if tendered, as an officer; and</content>
                                </clause>
                                <clause identifier="/us/sComp/107/372/tII/stB/s234/d/2/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">will serve on active duty for at least four years immediately after such appointment.</content>
                                </clause>
                            </subparagraph>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s234/e" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Regulations.—</heading><chapeau style="-uslm-dtd:text">The Secretary shall prescribe regulations to carry out this section. Such regulations shall include—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s234/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">standards for determining what constitutes a breach of an agreement signed under subsection (d)(1); and</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s234/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">procedures for determining whether such a breach has occurred.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s234/f" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Repayment.—</heading><content style="-uslm-dtd:text">An officer candidate or former officer candidate who does not fulfill the terms of the obligation to serve as specified under subsection (d) shall be subject to the repayment provisions of section 216(b).</content>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stB/s235" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="235">SEC. 235. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3035">33 U.S.C. 3035</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PROCUREMENT OF
 PERSONNEL. </heading>
                    <content class="block" style="-uslm-dtd:text">The Secretary may take such measures as the Secretary determines necessary in order to obtain recruits for the commissioned officer corps of the Administration, including advertising.</content>
                </section>
                <section identifier="/us/sComp/107/372/tII/stB/s236" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="236">SEC. 236. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3036">33 U.S.C. 3036</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">CAREER FLEXIBILITY TO ENHANCE RETENTION OF
 OFFICERS. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s236/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Programs Authorized.—</heading><content style="-uslm-dtd:text">The Secretary may carry out a program under which officers may be inactivated from active duty in order to meet personal or professional needs and returned to active duty at the end of such period of inactivation from active duty.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s236/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Period of Inactivation From Active Duty; Effect
 of Inactivation.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s236/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The period of inactivation from active duty under a program under this section of an officer participating in the program shall be such period as the Secretary shall specify in the agreement of the officer under subsection (c), except that such period may not exceed three years.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s236/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Exclusion from retirement.—</heading><content style="-uslm-dtd:text">Any period of participation of an officer in a program under this section shall not count toward eligibility for retirement or computation of retired pay under subtitle C. </content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s236/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Agreement.—</heading><chapeau style="-uslm-dtd:text">Each officer who participates in a program under this section shall enter into a written agreement with the Secretary under which that officer shall agree as follows:</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s236/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">To undergo during the period of the inactivation of the officer from active duty under the program such inactive duty training as the Director of the National Oceanic and Atmospheric Administration Commissioned Officer Corps shall require in order to ensure that the officer retains proficiency, at a level determined by the Director to be sufficient, in the technical skills, professional qualifications, and physical readiness of the officer during the inactivation of the officer from active duty.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s236/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Following completion of the period of the inactivation of the officer from active duty under the program, to serve two months on active duty for each month of the period of the inactivation of the officer from active duty under the program.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s236/d" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Conditions of Release.—</heading><chapeau style="-uslm-dtd:text">The Secretary shall— </chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s236/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">prescribe regulations specifying the guidelines regarding the conditions of release that must be considered and addressed in the agreement required by subsection (c); and </content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s236/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">at a minimum, prescribe the procedures and standards to be used to instruct an officer on the obligations to be assumed by the officer under paragraph (1) of such subsection while the officer is released from active duty.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s236/e" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Order to Active Duty.—</heading><content style="-uslm-dtd:text">Under regulations prescribed by the Secretary, an officer participating in a program under this section may, in the discretion of the Secretary, be required to terminate participation in the program and be ordered to active duty.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s236/f" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Pay and Allowances.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s236/f/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Basic pay.—</heading><content style="-uslm-dtd:text">During each month of participation in a program under this section, an officer who participates in the program shall be paid basic pay in an amount equal to two-thirtieths of the amount of monthly basic pay to which the officer would otherwise be entitled under section 204 of title 37, United States Code, as a member of the uniformed services on active duty in the grade and years of service of the officer when the officer commences participation in the program.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s236/f/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Special or incentive pay or bonus.—</heading>
                            <subparagraph identifier="/us/sComp/107/372/tII/stB/s236/f/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Prohibition.—</heading><content style="-uslm-dtd:text">An officer who participates in a program under this section shall not, while participating in the program, be paid any special or incentive pay or bonus to which the officer is otherwise entitled under an agreement under chapter 5 of title 37, United States Code, that is in force when the officer commences participation in the program.</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stB/s236/f/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Not treated as failure to perform
 services.—</heading><content style="-uslm-dtd:text">The inactivation from active duty of an officer participating in a program under this section shall not be treated as a failure of the officer to perform any period of service required of the officer in connection with an agreement for a special or incentive pay or bonus under chapter 5 of title 37, United States Code, that is in force when the officer commences participation in the program. </content>
                            </subparagraph>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s236/f/3" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Return to active duty.—</heading>
                            <subparagraph identifier="/us/sComp/107/372/tII/stB/s236/f/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Special or incentive pay or bonus.—</heading><chapeau style="-uslm-dtd:text">Subject to subparagraph (B), upon the return of an officer to active duty after completion by the officer of participation in a program under this section—</chapeau>
                                <clause identifier="/us/sComp/107/372/tII/stB/s236/f/3/A/i" style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">any agreement entered into by the officer under chapter 5 of title 37, United States Code, for the payment of a special or incentive pay or bonus that was in force when the officer commenced participation in the program shall be revived, with the term of such agreement after revival being the period of the agreement remaining to run when the officer commenced participation in the program; and</content>
                                </clause>
                                <clause identifier="/us/sComp/107/372/tII/stB/s236/f/3/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">any special or incentive pay or bonus shall be payable to the officer in accordance with the terms of the agreement concerned for the term specified in clause (i).</content>
                                </clause>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stB/s236/f/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Limitation.—</heading>
                                <clause identifier="/us/sComp/107/372/tII/stB/s236/f/3/B/i" style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">Subparagraph (A) shall not apply to any special or incentive pay or bonus otherwise covered by that subparagraph with respect to an officer if, at the time of the return of the officer to active duty as described in that subparagraph—</chapeau>
                                    <subclause identifier="/us/sComp/107/372/tII/stB/s236/f/3/B/i/I" style="-uslm-dtd:subclause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">such pay or bonus is no longer authorized by law; or</content>
                                    </subclause>
                                    <subclause identifier="/us/sComp/107/372/tII/stB/s236/f/3/B/i/II" style="-uslm-dtd:subclause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">the officer does not satisfy eligibility criteria for such pay or bonus as in effect at the time of the return of the officer to active duty.</content>
                                    </subclause>
                                </clause>
                                <clause identifier="/us/sComp/107/372/tII/stB/s236/f/3/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">Pay or bonus ceases being
 authorized.—</heading><content style="-uslm-dtd:text">Subparagraph (A) shall cease to apply to any special or incentive pay or bonus otherwise covered by that subparagraph with respect to an officer if, during the term of the revived agreement of the officer under subparagraph (A)(i), such pay or bonus ceases being authorized by law. </content>
                                </clause>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stB/s236/f/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Repayment.—</heading><content style="-uslm-dtd:text">An officer who is ineligible for payment of a special or incentive pay or bonus otherwise covered by this paragraph by reason of subparagraph (B)(i)(II) shall be subject to the requirements for repayment of such pay or bonus in accordance with the terms of the applicable agreement of the officer under chapter 5 of title 37, United States Code.</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stB/s236/f/3/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">Required service is additional.—</heading><content style="-uslm-dtd:text">Any service required of an officer under an agreement covered by this paragraph after the officer returns to active duty as described in subparagraph (A) shall be in addition to any service required of the officer under an agreement under subsection (c).</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s236/f/4" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Travel and transportation allowance.—</heading>
                            <subparagraph identifier="/us/sComp/107/372/tII/stB/s236/f/4/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">Subject to subparagraph (B), an officer who participates in a program under this section is entitled, while participating in the program, to the travel and transportation allowances authorized by section 452 of title 37, United States Code, for—</chapeau>
                                <clause identifier="/us/sComp/107/372/tII/stB/s236/f/4/A/i" style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">travel performed from the residence of the officer, at the time of release from active duty to participate in the program, to the location in the United States designated by the officer as the officer’s residence during the period of participation in the program; and</content>
                                </clause>
                                <clause identifier="/us/sComp/107/372/tII/stB/s236/f/4/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">travel performed to the residence of the officer upon return to active duty at the end of the participation of the officer in the program.</content>
                                </clause>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stB/s236/f/4/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Single residence.—</heading><content style="-uslm-dtd:text">An allowance is payable under this paragraph only with respect to travel of an officer to and from a single residence.</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s236/f/5" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Leave balance.—</heading><content style="-uslm-dtd:text">An officer who participates in a program under this section is entitled to carry forward the leave balance existing as of the day on which the officer begins participation and accumulated in accordance with section 701 of title 10, United States Code, but not to exceed 60 days.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s236/g" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Promotion.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s236/g/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">An officer participating in a program under this section shall not, while participating in the program, be eligible for consideration for promotion under subtitle B.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s236/g/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Return to service.—</heading><chapeau style="-uslm-dtd:text">Upon the return of an officer to active duty after completion by the officer of participation in a program under this section—</chapeau>
                            <subparagraph identifier="/us/sComp/107/372/tII/stB/s236/g/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the Secretary may adjust the date of rank of the officer in such manner as the Secretary shall prescribe in regulations for purposes of this section; and</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stB/s236/g/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the officer shall be eligible for consideration for promotion when officers of the same competitive category, grade, and seniority are eligible for consideration for promotion.</content>
                            </subparagraph>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stB/s236/h" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="h">(h) </num><heading style="-uslm-dtd:header">Continued Entitlements.—</heading><chapeau style="-uslm-dtd:text">An officer participating in a program under this section shall, while participating in the program, be treated as a member of the uniformed services on active duty for a period of more than 30 days for purposes of—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s236/h/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the entitlement of the officer and of the dependents of the officer to medical and dental care under the provisions of chapter 55 of title 10, United States Code; and</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stB/s236/h/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">retirement or separation for physical disability under the provisions of subtitle C.</content>
                        </paragraph>
                    </subsection>
                </section>
            </subtitle>
            <subtitle identifier="/us/sComp/107/372/tII/stC" style="-uslm-dtd:subtitle; -uslm-dtd-nonstandard:cap-lc 10 bold" styleType="nonstandard">
                <num style="-uslm-dtd:enum" value="C">subtitle C—</num><heading style="-uslm-dtd:header">Separation and Retirement of Officers </heading>
                <section identifier="/us/sComp/107/372/tII/stC/s241" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="241">SEC. 241. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3041">33 U.S.C. 3041</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">INVOLUNTARY RETIREMENT OR SEPARATION. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stC/s241/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Transfer of Officers to Retired List; Separation From Service.—</heading><chapeau style="-uslm-dtd:text">As recommended by a personnel board convened under section 222—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stC/s241/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">an officer in the permanent grade of captain or commander may—</chapeau>
                            <subparagraph identifier="/us/sComp/107/372/tII/stC/s241/a/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">except as provided by subparagraph (B), be transferred to the retired list; or</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stC/s241/a/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">if the officer is not qualified for retirement, be separated from service; and</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stC/s241/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">an officer in the permanent grade of lieutenant commander, lieutenant, or lieutenant (junior grade) who is not qualified for retirement may be separated from the service.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stC/s241/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Computations.—</heading><content style="-uslm-dtd:text">In any fiscal year, the total number of officers selected for retirement or separation under subsection (a) plus the number of officers retired for age may not exceed the whole number nearest 4 percent of the total number of officers authorized to be on the active list, except as otherwise provided by law.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stC/s241/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Effective Date of Retirements and Separations.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stC/s241/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Subject to paragraph (2), a retirement or separation under subsection (a) shall take effect on such date as is determined by the Secretary.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stC/s241/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Determination of date.—</heading><chapeau style="-uslm-dtd:text">The effective date determined under paragraph (1) for a retirement or separation under subsection (a) shall be—</chapeau>
                            <subparagraph identifier="/us/sComp/107/372/tII/stC/s241/c/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">except as provided by subparagraph (B), not earlier than 60 days after the date on which the Secretary approves the retirement or separation; or</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stC/s241/c/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">if the officer concerned requests an earlier effective date, such earlier date as is determined by the Secretary.</content>
                            </subparagraph>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stC/s241/d" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Deferment of
                                        Retirement or Separation for Medical Reasons.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stC/s241/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In
 general.—</heading><content style="-uslm-dtd:text">If the Secretary determines that the evaluation of the medical condition of an officer requires hospitalization or medical observation that cannot be completed with confidence in a manner consistent with the officer's well-being before the date on which the officer would otherwise be required to retire or be separated under this section, the Secretary may defer the retirement or separation of the officer.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stC/s241/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Consent
 required.—</heading><content style="-uslm-dtd:text">A deferment may only be made with the written consent of the officer involved. If the officer does not provide written consent to the deferment, the officer shall be retired or separated as scheduled.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stC/s241/d/3" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Limitation.—</heading><content style="-uslm-dtd:text">A deferment of retirement or separation under this subsection may not extend for more than 30 days after completion of the evaluation requiring hospitalization or medical observation.</content>
                        </paragraph>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stC/s242" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="242">SEC. 242. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3042">33 U.S.C. 3042</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SEPARATION PAY. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stC/s242/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Authorization of Payment.—</heading><content style="-uslm-dtd:text">An officer who is separated under section 241(a)(2) and who has completed more than three years of continuous active service immediately before that separation is entitled to separation pay computed under subsection (b) unless the Secretary determines that the conditions under which the officer is separated do not warrant payment of that pay.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stC/s242/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Amount of Separation Pay.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stC/s242/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Six or more years.—</heading><chapeau style="-uslm-dtd:text">In the case of an officer who has completed six or more years of continuous active service immediately before that separation, the amount of separation pay to be paid to the officer under this section is 10 percent of the product of—</chapeau>
                            <subparagraph identifier="/us/sComp/107/372/tII/stC/s242/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the years of active service creditable to the officer; and</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stC/s242/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">12 times the monthly basic pay to which the officer was entitled at the time of separation.</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stC/s242/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Three to six years.—</heading><content style="-uslm-dtd:text">In the case of an officer who has completed three or more but fewer than six years of continuous active service immediately before that separation, the amount of separation pay to be paid to the officer under this section is one-half of the amount computed under paragraph (1).</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stC/s242/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Other Conditions, Requirements, and Administrative Provisions.—</heading><content style="-uslm-dtd:text">The provisions of subsections (f), (g), and (h) of section 1174 of title 10, United States Code, shall apply to separation pay under this section in the same manner as such provisions apply to separation pay under that section.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stC/s242/d" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Exception.—</heading><chapeau style="-uslm-dtd:text">An officer discharged for twice failing selection for promotion to the next higher grade is not entitled to separation pay under this section if the officer—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stC/s242/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">expresses a desire not to be selected for promotion; or</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stC/s242/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">requests removal from the list of selectees.</content>
                        </paragraph>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stC/s243" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="243">SEC. 243. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3043">33 U.S.C. 3043</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">MANDATORY RETIREMENT FOR AGE. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stC/s243/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Officers Below Grade of Rear Admiral (Lower Half).—</heading><content style="-uslm-dtd:text">Unless retired or separated earlier, each officer on the lineal list of the commissioned corps who is serving in a grade below the grade of rear admiral (lower half) shall be retired or separated (as specified in section 1251(e) of title 10, United States Code) on the first day of the month following the month in which the officer becomes 62 years of age.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stC/s243/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Flag Officers.—</heading><content style="-uslm-dtd:text">Notwithstanding subsection (a), the President may defer the retirement of an officer serving in a position that carries a grade above captain for such period as the President considers advisable, but such a deferment may not extend beyond the first day of the month following the month in which the officer becomes 64 years of age.</content>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stC/s244" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="244">SEC. 244. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3044">33 U.S.C. 3044</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">RETIREMENT FOR LENGTH OF SERVICE. </heading>
                    <content class="block" style="-uslm-dtd:text">An officer who has completed 20 years of service, of which at least 10 years was service as a commissioned officer, may at any time thereafter, upon application by such officer and in the discretion of the President, be placed on the retired list.</content>
                </section>
                <section identifier="/us/sComp/107/372/tII/stC/s245" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="245">SEC. 245. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3045">33 U.S.C. 3045</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">COMPUTATION OF RETIRED PAY. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stC/s245/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Officers First Becoming Members Before September 8, 1980.—</heading><chapeau style="-uslm-dtd:text">Each officer on the retired list who first became a member of a uniformed service before September 8, 1980, shall receive retired pay at the rate determined by multiplying—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stC/s245/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the retired pay base determined under section 1406(g) of title 10, United States Code; by</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stC/s245/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the retired pay multiplier determined under section 1409 of such title for the number of years of service that may be credited to the officer under section 1405 of such title as if the officer's service were service as a member of the Armed Forces.</content>
                        </paragraph><continuation role="subsection" style="-uslm-dtd:continuation-text">The retired pay so computed may not exceed 75 percent of the retired pay base.</continuation>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stC/s245/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Officers First Becoming Members on or After September 8, 1980.—</heading><chapeau style="-uslm-dtd:text">Each officer on the retired list who first became a member of a uniformed service on or after September 8, 1980, shall receive retired pay at the rate determined by multiplying—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stC/s245/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the retired pay base determined under section 1407 of title 10, United States Code; by</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stC/s245/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the retired pay multiplier determined under section 1409 of such title for the number of years of service that may be credited to the officer under section 1405 of such title as if the officer's service were service as a member of the Armed Forces.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stC/s245/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Treatment of Full and Fractional Parts of Months in Computing Years of Service.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stC/s245/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">In computing the number of years of service of an officer for the purposes of subsection (a)—</chapeau>
                            <subparagraph identifier="/us/sComp/107/372/tII/stC/s245/c/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">each full month of service that is in addition to the number of full years of service creditable to the officer shall be credited as 1⁄12 of a year; and</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stC/s245/c/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">any remaining fractional part of a month shall be disregarded.</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stC/s245/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Rounding.—</heading><content style="-uslm-dtd:text">Retired pay computed under this section, if not a multiple of $1, shall be rounded to the next lower multiple of $1.</content>
                        </paragraph>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stC/s246" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="246">SEC. 246. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3046">33 U.S.C. 3046</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">RETIRED GRADE AND RETIRED PAY. </heading>
                    <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">Each officer retired pursuant to law shall be placed on the retired list with the highest grade satisfactorily held by that officer while on active duty including active duty pursuant to recall, under permanent or temporary appointment, and shall receive retired pay based on such highest grade, if—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stC/s246/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the officer's performance of duty in such highest grade has been satisfactory, as determined by the Secretary of the department or departments under whose jurisdiction the officer served; and</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stC/s246/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">unless retired for disability, the officer's length of service in such highest grade is no less than that required by the Secretary of officers retiring under permanent appointment in that grade.</content>
                        </paragraph>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stC/s247" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="247">SEC. 247. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3047">33 U.S.C. 3047</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">RETIRED RANK AND PAY HELD PURSUANT TO OTHER LAWS UNAFFECTED. </heading>
                    <content class="block" style="-uslm-dtd:text">Nothing in this subtitle shall prevent an officer from being placed on the retired list with the highest rank and with the highest retired pay to which the officer is entitled under any other provision of law.</content>
                </section>
                <section identifier="/us/sComp/107/372/tII/stC/s248" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="248">SEC. 248. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3048">33 U.S.C. 3048</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">CONTINUATION ON ACTIVE DUTY; DEFERRAL OF RETIREMENT. </heading>
                    <content class="block" style="-uslm-dtd:text">The provisions of subchapter IV of chapter 36 of title 10, United States Code, relating to continuation on active duty and deferral of retirement shall apply to commissioned officers of the Administration.</content>
                </section>
                <section identifier="/us/sComp/107/372/tII/stC/s249" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="249">SEC. 249. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3049">33 U.S.C. 3049</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">RECALL TO ACTIVE DUTY. </heading>
                    <content class="block" style="-uslm-dtd:text">The provisions of chapter 39 of title 10, United States Code, relating to recall of retired officers to active duty, including the limitations on such recalls, shall apply to commissioned officers of the Administration.</content>
                </section>
            </subtitle>
            <subtitle identifier="/us/sComp/107/372/tII/stD" style="-uslm-dtd:subtitle; -uslm-dtd-nonstandard:cap-lc 10 bold" styleType="nonstandard">
                <num style="-uslm-dtd:enum" value="D">subtitle D—</num><heading style="-uslm-dtd:header">Service of Officers With the Military Departments </heading>
                <section identifier="/us/sComp/107/372/tII/stD/s251" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="251">SEC. 251. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3061">33 U.S.C. 3061</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">COOPERATION WITH AND TRANSFER TO MILITARY DEPARTMENTS. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stD/s251/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Transfers of Resources and Officers During National Emergency.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stD/s251/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Transfers authorized.—</heading><content style="-uslm-dtd:text">The President may, whenever in the judgment of the President a sufficient national emergency exists, transfer to the service and jurisdiction of a military department such vessels, equipment, stations, and officers of the Administration as the President considers to be in the best interest of the country.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stD/s251/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Responsibility for funding of transferred resources and officers.—</heading><content style="-uslm-dtd:text">After any such transfer all expenses connected therewith shall be defrayed out of the appropriations for the department to which the transfer is made.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stD/s251/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Return of transferred resources and officers.—</heading><content style="-uslm-dtd:text">Such transferred vessels, equipment, stations, and officers shall be returned to the Administration when the national emergency ceases, in the opinion of the President.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stD/s251/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Rule of construction.—</heading><content style="-uslm-dtd:text">Nothing in this section shall be construed as transferring the Administration or any of its functions from the Department of Commerce except in time of national emergency and to the extent provided in this section.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stD/s251/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Limitation on Transfer of Officers.—</heading><content style="-uslm-dtd:text">This section does not authorize the transfer of an officer of the Administration to a military department if the accession or retention of that officer in that military department is otherwise not authorized by law.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stD/s251/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Status of Transferred Officers.—</heading><content style="-uslm-dtd:text">An officer of the Administration transferred under this section, shall, while under the jurisdiction of a military department, have proper military status and shall be subject to the laws, regulations, and orders for the government of the Army, Navy, or Air Force, as the case may be, insofar as the same may be applicable to persons whose retention permanently in the military service of the United States is not contemplated by law.</content>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stD/s252" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="252">SEC. 252. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3062">33 U.S.C. 3062</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">RELATIVE RANK OF OFFICERS WHEN SERVING WITH ARMY, NAVY, OR AIR FORCE. </heading>
                    <content class="block" style="-uslm-dtd:text">When serving with the Army, Navy, or Air Force, an officer of the Administration shall rank with and after officers of corresponding grade in the Army, Navy, or Air Force of the same length of service in grade. Nothing in this subtitle shall be construed to affect or alter an officer's rates of pay and allowances when not assigned to military duty.</content>
                </section>
                <section identifier="/us/sComp/107/372/tII/stD/s253" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="253">SEC. 253. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3063">33 U.S.C. 3063</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">RULES AND REGULATIONS WHEN COOPERATING WITH MILITARY DEPARTMENTS. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stD/s253/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Joint Regulations.—</heading><chapeau style="-uslm-dtd:text">The Secretary of Defense and the Secretary of Commerce shall jointly prescribe regulations—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stD/s253/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">governing the duties to be performed by the Administration in time of war; and</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stD/s253/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">providing for the cooperation of the Administration with the military departments in time of peace in preparation for its duties in time of war.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stD/s253/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Approval.—</heading><content style="-uslm-dtd:text">Regulations under subsection (a) shall not be effective unless approved by each of those Secretaries.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stD/s253/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Communications.—</heading><content style="-uslm-dtd:text">Regulations under subsection (a) may provide procedures for making reports and communications between a military department and the Administration.</content>
                    </subsection>

                    <num style="-uslm-dtd:enum" value="261">SEC. 261. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3071">33 U.S.C. 3071</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">APPLICABILITY OF CERTAIN PROVISIONS OF TITLE 10, UNITED STATES CODE. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s261/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Provisions Made Applicable to the Corps.—</heading><chapeau style="-uslm-dtd:text">The rules of law that apply to the Armed Forces under the following provisions of title 10, United States Code, as those provisions are in effect from time to time, apply also to the commissioned officer corps of the Administration:</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s261/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Chapter 40, relating to leave.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s261/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Section 533(b), relating to constructive service.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s261/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">Section 716, relating to transfers between the armed forces and to and from National Oceanic and Atmospheric Administration.</content>

                        </paragraph>

                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s261/a/27" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="27">(27) </num><content style="-uslm-dtd:text">Such other provisions of subtitle A of that title as may be adopted for applicability to the commissioned officer corps of the National Oceanic and Atmospheric Administration by any other provision of law.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s261/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">References.—</heading><content style="-uslm-dtd:text">The authority vested by title 10, United States Code, in the “<quotedText style="-uslm-dtd:quote">military departments</quotedText>”, “<quotedText style="-uslm-dtd:quote">the Secretary concerned</quotedText>”, or “<quotedText style="-uslm-dtd:quote">the Secretary of Defense</quotedText>” with respect to the provisions of law referred to in subsection (a) shall be exercised, with respect to the commissioned officer corps of the Administration, by the Secretary of Commerce or the Secretary's designee. For purposes of paragraph (8) of subsection (a), the term “<term style="-uslm-dtd:term">Inspector General</term>” in section 1034 of such title 10 shall mean the Inspector General of the Department of Commerce.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s261/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Regulations Regarding Protected Communications and
 Prohibition of Retaliatory Personnel Actions.—</heading><content style="-uslm-dtd:text">The Secretary may prescribe regulations to carry out the application of section 1034 of title 10, United States Code, to the commissioned officer corps of the Administration, including by prescribing such administrative procedures for investigation and appeal within the commissioned officer corps as the Secretary considers appropriate.</content>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stE/s261A" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="261A">SEC. 261A. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3071a">33 U.S.C. 3071a</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">APPLICABILITY OF
 CERTAIN PROVISIONS OF TITLE 37, UNITED STATES
 CODE. </heading>
                    <chapeau class="block" style="-uslm-dtd:text">The provisions of law applicable to the Armed Forces under the following provisions of title 37, United States Code, shall apply to the commissioned officer corps of the Administration:</chapeau>
                    <paragraph identifier="/us/sComp/107/372/tII/stE/s261A/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Section 403(l), relating to temporary continuation of housing allowance for dependents of members dying on active duty.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/107/372/tII/stE/s261A/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Section 415, relating to initial uniform allowances.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/107/372/tII/stE/s261A/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">Section 488, relating to allowances for recruiting expenses.</content>
                    </paragraph>
                </section>
                <section identifier="/us/sComp/107/372/tII/stE/s262" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="262">SEC. 262. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3072">33 U.S.C. 3072</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ELIGIBILITY FOR VETERANS BENEFITS AND OTHER RIGHTS, PRIVILEGES, IMMUNITIES, AND BENEFITS UNDER CERTAIN PROVISIONS OF LAW. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s262/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">Active service of officers of the Administration shall be deemed to be active military service for the purposes of all rights, privileges, immunities, and benefits under the following:</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s262/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Laws administered by the Secretary of Veterans Affairs.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s262/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The Servicemembers Civil Relief Act.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s262/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">Section 210 of the Social Security Act (42 U.S.C. 410), as in effect before September 1, 1950.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s262/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Exercise of Authority.—</heading><content style="-uslm-dtd:text">In the administration of the laws and regulations referred to in subsection (a), with respect to the Administration, the authority vested in the Secretary of Defense and the Secretaries of the military departments and their respective departments shall be exercised by the Secretary of Commerce.</content>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stE/s263" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="263">SEC. 263. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3073">33 U.S.C. 3073</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">MEDICAL AND DENTAL CARE. </heading>
                    <content class="block" style="-uslm-dtd:text">The Secretary may provide medical and dental care, including care in private facilities, for personnel of the Administration entitled to that care by law or regulation.</content>
                </section>
                <section identifier="/us/sComp/107/372/tII/stE/s264" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="264">SEC. 264. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3074">33 U.S.C. 3074</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">COMMISSARY PRIVILEGES. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s264/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Extension of Privilege.—</heading><content style="-uslm-dtd:text">Commissioned officers, ships' officers, and members of crews of vessels of the Administration shall be permitted to purchase commissary and quartermaster supplies as far as available from the Armed Forces at the prices charged officers and enlisted members of the Armed Forces.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s264/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Sales of Rations, Stores, Uniforms, and Related Equipment.—</heading><content style="-uslm-dtd:text">The Secretary may purchase ration supplies for messes, stores, uniforms, accouterments, and related equipment for sale aboard ship and shore stations of the Administration to members of the uniformed services and to personnel assigned to such ships or shore stations.  Sales shall be in accordance with regulations prescribed by the Secretary, and proceeds therefrom shall, as far as is practicable, fully reimburse the appropriations charged without regard to fiscal year.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s264/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Surviving Spouses' Rights.—</heading><content style="-uslm-dtd:text">Rights extended to members of the uniformed services in this section are extended to their surviving spouses and to such others as are designated by the Secretary concerned.</content>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stE/s265" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="265">SEC. 265. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3075">33 U.S.C. 3075</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">AUTHORITY TO USE APPROPRIATED FUNDS FOR TRANSPORTATION AND REIMBURSEMENT OF CERTAIN ITEMS. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s265/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Transportation of Effects of Deceased Officers.—</heading><content style="-uslm-dtd:text">In the case of an officer who dies on active duty, the Secretary may provide, from appropriations made available to the Administration, transportation (including packing, unpacking, crating, and uncrating) of personal and household effects of that officer to the official residence of record of that officer. However, upon application by the dependents of such an officer, such transportation may be provided to such other location as may be determined by the Secretary.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s265/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Reimbursement for Supplies Furnished by Officers to Distressed and Shipwrecked Persons.—</heading><chapeau style="-uslm-dtd:text">Under regulations prescribed by the Secretary, appropriations made available to the Administration may be used to reimburse an officer for food, clothing, medicines, and other supplies furnished by the officer—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s265/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">for the temporary relief of distressed persons in remote localities; or</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s265/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to shipwrecked persons who are temporarily provided for by the officer.</content>
                        </paragraph>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stE/s266" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="266">SEC. 266. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3076">33 U.S.C. 3076</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PRESENTATION OF UNITED STATES FLAG UPON RETIREMENT. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s266/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Presentation of Flag Upon Retirement.—</heading><content style="-uslm-dtd:text">Upon the release of a commissioned officer from active commissioned service for retirement, the Secretary shall present a United States flag to the officer.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s266/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Multiple Presentations Not Authorized.—</heading><content style="-uslm-dtd:text">An officer is not eligible for presentation of a flag under subsection (a) if the officer has previously been presented a flag under this section or any other provision of law providing for the presentation of a United States flag incident to release from active service for retirement.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s266/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">No Cost to Recipient.—</heading><content style="-uslm-dtd:text">The presentation of a flag under this section shall be at no cost to the recipient.</content>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stE/s267" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="267">SEC. 267. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3077">33 U.S.C. 3077</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">EDUCATION LOAN
 REPAYMENT PROGRAM. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s267/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Authority to
 Repay Education Loans.—</heading><chapeau style="-uslm-dtd:text">For the purpose of maintaining adequate numbers of officers of the commissioned officer corps of the Administration on active duty who have skills required by the commissioned officer corps, the Secretary may repay, in the case of a person described in subsection (b), a loan that—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s267/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">was used by the person to finance education; and</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s267/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">was obtained from a governmental entity, private financial institution, educational institution, or other authorized entity.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s267/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Eligible
 Persons.—</heading><chapeau style="-uslm-dtd:text">To be eligible to obtain a loan repayment under this section, a person must—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s267/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">satisfy one of the requirements specified in subsection (c);</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s267/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">be fully qualified for, or hold, an appointment as a commissioned officer in the commissioned officer corps of the Administration; and</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s267/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">sign a written agreement to serve on active duty, or, if on active duty, to remain on active duty for a period in addition to any other incurred active duty obligation.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s267/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Academic and
 Professional Requirements.—</heading><chapeau style="-uslm-dtd:text">One of the following academic requirements must be satisfied for purposes of determining the eligibility of an individual for a loan repayment under this section:</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s267/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The person is fully qualified in a profession that the Secretary has determined to be necessary to meet identified skill shortages in the commissioned officer corps of the Administration.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s267/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The person is enrolled as a full-time student in the final year of a course of study at an accredited educational institution (as determined by the Secretary of Education) leading to a degree in a profession that will meet identified skill shortages in the commissioned officer corps of the Administration.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s267/d" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Loan
 Repayments.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s267/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In
 general.—</heading><content style="-uslm-dtd:text">Subject to the limits established under paragraph (2), a loan repayment under this section may consist of the payment of the principal, interest, and related expenses of a loan obtained by a person described in subsection (b).</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s267/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Limitation on amount.—</heading><content style="-uslm-dtd:text">For each year of obligated service that a person agrees to serve in an agreement described in subsection (b)(3), the Secretary may pay not more than the amount specified in section 2173(e)(2) of title 10, United States Code.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s267/e" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Active Duty
 Service Obligation.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s267/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In
 general.—</heading><content style="-uslm-dtd:text">A person entering into an agreement described in subsection (b)(3) incurs an active duty service obligation.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s267/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Length
 of obligation determined under
 regulations.—</heading>
                            <subparagraph identifier="/us/sComp/107/372/tII/stE/s267/e/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In
 general.—</heading><content style="-uslm-dtd:text">Except as provided in subparagraph (B), the length of the obligation under paragraph (1) shall be determined under regulations prescribed by the Secretary.</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stE/s267/e/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Minimum obligation.—</heading><content style="-uslm-dtd:text">The regulations prescribed under subparagraph (A) may not provide for a period of obligation of less than one year for each maximum annual amount, or portion thereof, paid on behalf of the person for qualified loans.</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s267/e/3" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Persons
 on active duty before entering into
 agreement.—</heading><content style="-uslm-dtd:text">The active duty service obligation of persons on active duty before entering into the agreement shall be served after the conclusion of any other obligation incurred under the agreement.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s267/e/4" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Concurrent completion of service
 obligations.—</heading><content style="-uslm-dtd:text">A service obligation under this section may be completed concurrently with a service obligation under section 216. </content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s267/f" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Effect of
 Failure to Complete Obligation.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s267/f/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Alternative obligations.—</heading><content style="-uslm-dtd:text">An officer who is relieved of the officer's active duty obligation under this section before the completion of that obligation may be given any alternative obligation, at the discretion of the Secretary.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s267/f/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Repayment.—</heading><content style="-uslm-dtd:text">An officer who does not complete the period of active duty specified in the agreement entered into under subsection (b)(3), or the alternative obligation imposed under paragraph (1), shall be subject to the repayment provisions under section 216.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s267/g" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Rulemaking.—</heading><chapeau style="-uslm-dtd:text">The Secretary shall prescribe regulations to carry out this section, including—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s267/g/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">standards for qualified loans and authorized payees; and</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s267/g/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">other terms and conditions for the making of loan repayments.</content>
                        </paragraph>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stE/s268" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="268">SEC. 268. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3078">33 U.S.C. 3078</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">INTEREST PAYMENT
 PROGRAM. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s268/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Authority.—</heading><content style="-uslm-dtd:text">The Secretary may pay the interest and any special allowances that accrue on one or more student loans of an eligible officer, in accordance with this section.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s268/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Eligible
 Officers.—</heading><chapeau style="-uslm-dtd:text">An officer is eligible for the benefit described in subsection (a) while the officer—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s268/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">is serving on active duty;</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s268/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">has not completed more than three years of service on active duty;</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s268/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">is the debtor on one or more unpaid loans described in subsection (c); and</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s268/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">is not in default on any such loan.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s268/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Student
 Loans.—</heading><chapeau style="-uslm-dtd:text">The authority to make payments under subsection (a) may be exercised with respect to the following loans:</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s268/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">A loan made, insured, or guaranteed under part B of title IV of the Higher Education Act of 1965 (20 U.S.C. 1071 et seq.).</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s268/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">A loan made under part D of such title (20 U.S.C. 1087a et seq.).</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s268/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">A loan made under part E of such title (20 U.S.C. 1087aa et seq.).</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s268/d" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Maximum
 Benefit.—</heading><content style="-uslm-dtd:text">Interest and any special allowance may be paid on behalf of an officer under this section for any of the 36 consecutive months during which the officer is eligible under subsection (b).</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s268/e" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Coordination
 With Secretary of Education.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s268/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In
 general.—</heading><content style="-uslm-dtd:text">The Secretary shall consult with the Secretary of Education regarding the administration of this section.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s268/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Reimbursement authorized.—</heading><chapeau style="-uslm-dtd:text">The Secretary is authorized to reimburse the Secretary of Education—</chapeau>
                            <subparagraph identifier="/us/sComp/107/372/tII/stE/s268/e/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">for the funds necessary to pay interest and special allowances on student loans under this section (in accordance with sections 428(o), 455(l), and 464(j) of the Higher Education Act of 1965 (20 U.S.C. 1078(o), 1087e(l), and 1087dd(j)); and</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stE/s268/e/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">for any reasonable administrative costs incurred by the Secretary of Education in coordinating the program under this section with the administration of the student loan programs under parts B, D, and E of title IV of the Higher Education Act of 1965 (20 U.S.C. 1071 et seq., 1087a et seq., 1087aa et seq.).</content>
                            </subparagraph>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s268/f" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Special
 Allowance Defined.—</heading><content style="-uslm-dtd:text">In this section, the term “<term style="-uslm-dtd:term">special allowance</term>” means a special allowance that is payable under section 438 of the Higher Education Act of 1965 (20 U.S.C. 1087–1).</content>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stE/s269" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="269">SEC. 269. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3079">33 U.S.C. 3079</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">STUDENT
 PRE-COMMISSIONING EDUCATION ASSISTANCE PROGRAM. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Authority to
 Provide Financial Assistance.—</heading><chapeau style="-uslm-dtd:text">For the purpose of maintaining adequate numbers of officers of the commissioned officer corps of the Administration on active duty, the Secretary may provide financial assistance to a person described in subsection (b) for expenses of the person while the person is pursuing on a full-time basis at an accredited educational institution (as determined by the Secretary of Education) a program of education approved by the Secretary that leads to—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">a baccalaureate degree in not more than five academic years; or</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">a postbaccalaureate degree.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Eligible
 Persons.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In
 general.—</heading><chapeau style="-uslm-dtd:text">A person is eligible to obtain financial assistance under subsection (a) if the person—</chapeau>
                            <subparagraph identifier="/us/sComp/107/372/tII/stE/s269/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">is enrolled on a full-time basis in a program of education referred to in subsection (a) at any educational institution described in such subsection;</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stE/s269/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">meets all of the requirements for acceptance into the commissioned officer corps of the Administration except for the completion of a baccalaureate degree; and</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stE/s269/b/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">enters into a written agreement with the Secretary described in paragraph (2).</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Agreement.—</heading><chapeau style="-uslm-dtd:text">A written agreement referred to in paragraph (1)(C) is an agreement between the person and the Secretary in which the person—</chapeau>
                            <subparagraph identifier="/us/sComp/107/372/tII/stE/s269/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">agrees to accept an appointment as an officer, if tendered; and</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stE/s269/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">upon completion of the person's educational program, agrees to serve on active duty, immediately after appointment, for—</chapeau>
                                <clause identifier="/us/sComp/107/372/tII/stE/s269/b/2/B/i" style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">up to three years if the person received less than three years of assistance; and</content>
                                </clause>
                                <clause identifier="/us/sComp/107/372/tII/stE/s269/b/2/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">up to five years if the person received at least three years of assistance.</content>
                                </clause>
                            </subparagraph>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Qualifying
 Expenses.—</heading><chapeau style="-uslm-dtd:text">Expenses for which financial assistance may be provided under subsection (a) are the following:</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Tuition and fees charged by the educational institution involved.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The cost of educational materials.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">In the case of a program of education leading to a baccalaureate degree, laboratory expenses.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269/c/4" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">Such other expenses as the Secretary considers appropriate.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269/d" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Limitation
 on Amount.—</heading><content style="-uslm-dtd:text">The Secretary shall prescribe the amount of financial assistance provided to a person under subsection (a), which may not exceed the amount specified in section 2173(e)(2) of title 10, United States Code, for each year of obligated service that a person agrees to serve in an agreement described in subsection (b)(2).</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269/e" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Duration of
 Assistance.—</heading><content style="-uslm-dtd:text">Financial assistance may be provided to a person under subsection (a) for not more than five consecutive academic years.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269/f" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Subsistence
 Allowance.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269/f/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In
 general.—</heading><content style="-uslm-dtd:text">A person who receives financial assistance under subsection (a) shall be entitled to a monthly subsistence allowance at a rate prescribed under paragraph (2) for the duration of the period for which the person receives such financial assistance.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269/f/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Determination of amount.—</heading><content style="-uslm-dtd:text">The Secretary shall prescribe monthly rates for subsistence allowance provided under paragraph (1), which shall be equal to the amount specified in section 2144(a) of title 10, United States Code.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269/g" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Initial
 Clothing Allowance.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269/g/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Training.—</heading><content style="-uslm-dtd:text">The Secretary may prescribe a sum which shall be credited to each person who receives financial assistance under subsection (a) to cover the cost of the person's initial clothing and equipment issue.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269/g/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Appointment.—</heading><content style="-uslm-dtd:text">Upon completion of the program of education for which a person receives financial assistance under subsection (a) and acceptance of appointment in the commissioned officer corps of the Administration, the person may be issued a subsequent clothing allowance equivalent to that normally provided to a newly appointed officer.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269/h" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="h">(h) </num><heading style="-uslm-dtd:header">Termination
 of Financial Assistance.—</heading>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269/h/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In
 general.—</heading><chapeau style="-uslm-dtd:text">The Secretary shall terminate the assistance provided to a person under this section if—</chapeau>
                            <subparagraph identifier="/us/sComp/107/372/tII/stE/s269/h/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the Secretary accepts a request by the person to be released from an agreement described in subsection (b)(2);</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stE/s269/h/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the misconduct of the person results in a failure to complete the period of active duty required under the agreement; or</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stE/s269/h/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the person fails to fulfill any term or condition of the agreement.</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269/h/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Reimbursement.—</heading><content style="-uslm-dtd:text">The Secretary may require a person who receives assistance described in subsection (c), (f), or (g) under an agreement entered into under subsection (b)(1)(C) to reimburse the Secretary in an amount that bears the same ratio to the total costs of the assistance provided to that person as the unserved portion of active duty bears to the total period of active duty the officer agreed to serve under the agreement.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269/h/3" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Waiver.—</heading><chapeau style="-uslm-dtd:text">The Secretary may waive the service obligation of a person through an agreement entered into under subsection (b)(1)(C) if the person—</chapeau>
                            <subparagraph identifier="/us/sComp/107/372/tII/stE/s269/h/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">becomes unqualified to serve on active duty in the commissioned officer corps of the Administration because of a circumstance not within the control of that person; or</content>
                            </subparagraph>
                            <subparagraph identifier="/us/sComp/107/372/tII/stE/s269/h/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">is—</chapeau>
                                <clause identifier="/us/sComp/107/372/tII/stE/s269/h/3/B/i" style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">not physically qualified for appointment; and</content>
                                </clause>
                                <clause identifier="/us/sComp/107/372/tII/stE/s269/h/3/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">determined to be unqualified for service in the commissioned officer corps of the Administration because of a physical or medical condition that was not the result of the person's own misconduct or grossly negligent conduct.</content>
                                </clause>
                            </subparagraph>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269/h/4" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Obligation as debt to united states.—</heading><content style="-uslm-dtd:text">An obligation to reimburse the Secretary imposed under paragraph (2) is, for all purposes, a debt owed to the United States.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269/h/5" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Discharge in bankruptcy.—</heading><content style="-uslm-dtd:text">A discharge in bankruptcy under title 11, United States Code, that is entered less than five years after the termination of a written agreement entered into under subsection (b)(1)(C) does not discharge the person signing the agreement from a debt arising under such agreement or under paragraph (2).</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269/i" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Regulations.—</heading><content style="-uslm-dtd:text">The Secretary may prescribe such regulations and orders as the Secretary considers appropriate to carry out this section.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269/j" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="j">(j) </num><heading style="-uslm-dtd:header">Concurrent Completion of Service
 Obligations.—</heading><content style="-uslm-dtd:text">A service obligation under this section may be completed concurrently with a service obligation under section 216.</content>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stE/s269A" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="269A">SEC. 269A. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3079a">33 U.S.C. 3079a</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">TREATMENT OF COMMISSION IN COMMISSIONED OFFICER
 CORPS AS EMPLOYMENT IN ADMINISTRATION FOR PURPOSES OF
 CERTAIN HIRING DECISIONS. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269A/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">In any case in which the Secretary accepts an application for a position of employment with the Administration and limits consideration of applications for such position to applications submitted by individuals serving in a career or career-conditional position in the competitive service within the Administration, the Secretary shall deem an officer who has served as an officer in the commissioned officer corps of the Administration for at least three years to be serving in a career or career-conditional position in the competitive service within the Administration for purposes of such limitation.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269A/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Career Appointments.—</heading><content style="-uslm-dtd:text">If the Secretary selects an application submitted by an officer described in subsection (a) for a position described in such subsection, the Secretary shall give such officer a career or career-conditional appointment in the competitive service, as appropriate.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269A/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Competitive Service Defined.—</heading><content style="-uslm-dtd:text">In this section, the term “<term style="-uslm-dtd:term">competitive service</term>” has the meaning given the term in section 2102 of title 5, United States Code.</content>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stE/s269B" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="269B">SEC. 269B. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3079b">33 U.S.C. 3079b</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORE LEAVE FOR PROFESSIONAL MARINERS. </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269B/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The Under Secretary may prescribe regulations relating to shore leave for professional mariners without regard to the requirements of section 6305 of title 5, United States Code.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269B/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Requirements.—</heading><chapeau style="-uslm-dtd:text">The regulations prescribed under subsection (a) shall—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269B/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">require that a professional mariner serving aboard an ocean-going vessel be granted a leave of absence of 4 days per pay period; and</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269B/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">provide that a professional mariner serving in a temporary promotion position aboard a vessel may be paid the difference between such mariner’s temporary and permanent rates of pay for leave accrued while serving in the temporary promotion position.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269B/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Professional Mariner Defined.—</heading><content style="-uslm-dtd:text">In this section, the term “<quotedText style="-uslm-dtd:quote">professional mariner</quotedText>” means an individual employed on a vessel of the Administration who has the necessary expertise to serve 
in the engineering, deck, steward, electronic technician, or survey department.</content>
                    </subsection>
                </section>
                <section identifier="/us/sComp/107/372/tII/stE/s269C" style="-uslm-dtd:section" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="269C">SEC. 269C. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s3079c">33 U.S.C. 3079c</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ELIGIBILITY OF FORMER OFFICERS TO COMPETE FOR CERTAIN POSITIONS.<ref class="footnoteRef" idref="IDB4794D0564AA43749844DB6A1173CAB8" style="-uslm-dtd:footnote-ref">4</ref> </heading>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269C/a" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">An individual who was separated from the commissioned officer corps of the Administration under honorable conditions after not fewer than 3 years of active service may not be denied the opportunity to compete for a vacant position with respect to which the agency in which the position is located will accept applications from individuals outside the workforce of that agency under merit promotion procedures.</content>
                    </subsection><footnote id="IDB4794D0564AA43749844DB6A1173CAB8" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">4</sup><p style="-uslm-dtd:para; margin-left:1em">Section 269C, as added by section 8404(a) of division H of Public Law 119–60 (enacted December 18, 2025), is repealed pursuant to subsection (g) of such section 269C. See such subsection (g) below for details when the repeal takes effect.</p></footnote>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269C/b" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Type of Appointment.—</heading><content style="-uslm-dtd:text">If selected for a position pursuant to subsection (a), an individual described in that subsection shall receive a career or career-conditional appointment, as appropriate.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269C/c" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Announcements.—</heading><chapeau style="-uslm-dtd:text">The area of consideration for a merit promotion announcement with respect to a position that includes consideration of individuals within the Federal service for that position shall—</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269C/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">indicate that individuals described in subsection (a) are eligible to apply for the position; and</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269C/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">be publicized in accordance with section 3327 of title 5, United States Code.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269C/d" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Rule of Construction.—</heading><content style="-uslm-dtd:text">Nothing in this section may be construed to confer an entitlement to veterans’ preference that is not otherwise required by any statute or regulation relating to veterans’ preference.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269C/e" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Regulations.—</heading><content style="-uslm-dtd:text">The Director of the Office of Personnel Management shall prescribe regulations necessary for the administration of this section.</content>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269C/f" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Reporting Requirement.—</heading><chapeau style="-uslm-dtd:text">Not later than 3 years after the date of enactment of the National Defense Authorization Act for Fiscal Year 2026, the Administrator shall submit to the Committees on Commerce, Science, and Transportation and Homeland Security and Governmental Affairs of the Senate and the Committee on Natural Resources, the Committee on Science, Space, and Technology, and the Committee on Oversight and Government Reform of the House of Representatives a report which includes the following:</chapeau>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269C/f/1" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">A description of how the Administrator has utilized the authority granted under this section, including the number and locations of individuals hired utilizing the authority granted under this section.</content>
                        </paragraph>
                        <paragraph identifier="/us/sComp/107/372/tII/stE/s269C/f/2" style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">An overview of the impact to Federal employment for former members of the commissioned officer corps of the Administration as a result of the authority granted under this section.</content>
                        </paragraph>
                    </subsection>
                    <subsection identifier="/us/sComp/107/372/tII/stE/s269C/g" style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Sunset.—</heading><content style="-uslm-dtd:text">This section shall be repealed on the date that is 5 years after the date of enactment of the National Defense Authorization Act for Fiscal Year 2026.</content>
                    </subsection>
