            <num style="-uslm-dtd:enum" value="III">TITLE III—</num>
            <heading style="-uslm-dtd:header" class="block">findings and purpose </heading>
            <section style="-uslm-dtd:section" identifier="/us/sComp/89/249/tIII/s301" styleType="traditional-inline">
                <num style="-uslm-dtd:enum" value="301">Sec. 301. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t16/s2301">16 U.S.C. 2301</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/89/249/tIII/s301/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><chapeau style="-uslm-dtd:text">The Congress hereby finds that—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/89/249/tIII/s301/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the purpose of the National Park System is to preserve outstanding natural, scenic, historic, and recreation areas for the enjoyment, education, inspiration, and use of all people;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/89/249/tIII/s301/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">units of the National Park System have recently been established near major metropolitan areas in order to preserve remaining open space and to provide recreational opportunities for urban residents (many of whom do not have access to personal motor vehicles); and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/89/249/tIII/s301/a/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">circumstances which necessarily require peoples desiring to visit units of the National Park System to rely on personal motor vehicles may diminish the natural and recreational value of such units by causing traffic congestion and environmental damage, and by requiring the provision of roads, parking, and other facilities in ever-increasing numbers and density.</content>
                </paragraph></subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/89/249/tIII/s301/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">The purpose of this title is to make the National Park System more accessible in a manner consistent with the preservation of parks and the conservation of energy by encouraging the use of transportation modes other than personal motor vehicles for access to and within units of the National Park System with minimum disruption to nearby communities through authorization of a pilot transportation program.</content>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/89/249/tIII/s302" styleType="traditional-inline">
                <num style="-uslm-dtd:enum" value="302">Sec. 302. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t16/s2302">16 U.S.C. 2302</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/89/249/tIII/s302/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><content style="-uslm-dtd:text">The Secretary of the Interior (hereinafter referred to as “<quotedText style="-uslm-dtd:quote">Secretary</quotedText>”) is authorized to formulate transportation plans and implement transportation projects where feasible pursuant to those plans for units of the national park system.</content></subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/89/249/tIII/s302/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><chapeau style="-uslm-dtd:text">To carry out the purposes of subsection (a) of this section, the Secretary is authorized to—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/89/249/tIII/s302/b/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">contract with public or private agencies or carriers to provide transportation services, capital equipment, or facilities to improve access to units of the national park system;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/89/249/tIII/s302/b/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">operate such services directly in the absence of suitable and adequate agencies or carriers;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/89/249/tIII/s302/b/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">acquire by purchase, lease, or agreement, capital equipment for such services; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/89/249/tIII/s302/b/4" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">where necessary to carry out the purposes of this title, acquire by lease, purchase, donation, exchange, or transfer, lands, waters, and interests therein which are situated outside the boundary of a unit of the national park system, which property shall be administered as part of the unit: <i style="-uslm-dtd:italic">Provided, </i>That any land or interests in land owned by a State or any of its political subdivisions may be acquired only by donation: <i style="-uslm-dtd:italic">Provided further, </i>That any land acquisition shall be subject to such statutory limitations, if any, on methods of acquisition and appropriations thereof as may be specifically applicable to such area.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/89/249/tIII/s302/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><editorialNote style="-uslm-dtd:legis-comment"><b>[</b>Repealed by section 814(d)(1)(A) of Public Law 104–333 (110 Stat. 4195).<b>]</b> </editorialNote>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/89/249/tIII/s302/d" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><content style="-uslm-dtd:text">All fees directly collected by the National Park Service in the operation of the facilities and services authorized by this title shall be covered into the Planning, Development, and Operation of Recreation Facilities appropriation account to be subject to appropriation.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/89/249/tIII/s302/e" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><content style="-uslm-dtd:text">The Secretary shall establish information programs to inform the public of available park access opportunities and to promote the use of transportation modes other than personal motor vehicles for access to and travel within the units of the national park system.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/89/249/tIII/s302/f" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><content style="-uslm-dtd:text">Transportation facilities and services provided pursuant to this title shall not be considered as concession facilities or services within the meaning of the Act of October 9, 1965 (79 Stat. 969)<ref style="-uslm-dtd:footnote-ref" idref="ID57661B22778143B98C89E0CA97A453A0" class="footnoteRef">1</ref> and may be undertaken by the Secretary directly or by contract without regard to any requirement of local, State, or Federal law respecting determinations of public convenience and necessity or other similar matters: <i style="-uslm-dtd:italic">Provided, </i>That the Secretary or his contractor shall consult with the appropriate State or local public service commission or other such body having authority to issue certificates of convenience and necessity, and any such contractor shall be subject to applicable requirements of such body unless the Secretary determines that such requirements would not be consistent with the purposes and provisions of this title.</content><footnote id="ID57661B22778143B98C89E0CA97A453A0" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">The Act of October 9, 1965, referred to in subsection (f) is classified at 16 U.S.C. 20 et seq.</p></footnote>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/89/249/tIII/s302/g" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="g">(g) </num><content style="-uslm-dtd:text">No grant of authority in this title shall be deemed to expand the exemption of section 203(b)(4) of the Interstate Commerce Act (49 U.S.C. 303(b)(4)).<ref style="-uslm-dtd:footnote-ref" idref="IDDEBB573B76A3494083941BE92833E65A" class="footnoteRef">2</ref></content><footnote id="IDDEBB573B76A3494083941BE92833E65A" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">2</sup><p style="-uslm-dtd:para; margin-left:1em">In the codification of title 49, U.S.C., section 203(b)(4) of the Interstate Commerce Act became 49 U.S.C. 10526(a)(9). See section 3(b) of Public Law 95–473 (92 Stat. 1466). However, this section of title 49 was omitted in the most recent recodification of the title. See section 102(a) of Public Law 104–88 (109 Stat. 804).</p></footnote>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/89/249/tIII/s303" styleType="traditional-inline">
                <num style="-uslm-dtd:enum" value="303">Sec. 303. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t16/s2303">16 U.S.C. 2303</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/89/249/tIII/s303/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><content style="-uslm-dtd:text">To carry out the purposes of this title, the Secretary of Transportation, the Secretary of Housing and Urban Development, the Secretary of Health, Education, and Welfare,<ref style="-uslm-dtd:footnote-ref" idref="ID66B9385E2C9A4CF793579A5AFC008658" class="footnoteRef">3</ref> and the Secretary of Commerce, and the heads of such other Federal departments or agencies as the Secretary deems necessary are directed to assist the Secretary in the formulation and implementation of transportation projects.</content><footnote id="ID66B9385E2C9A4CF793579A5AFC008658" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">3</sup><p style="-uslm-dtd:para; margin-left:1em">In section 303, the Secretary of Health, Education, and Welfare is now known as the Secretary of Health and Human Services.</p></footnote></subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/89/249/tIII/s303/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">Within one hundred and eighty days from the enactment of this Act, the Secretary shall prepare and submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Natural Resources of the House of Representatives, a compilation of Federal statutes and programs providing authority for the planning, funding, or operation of transportation projects which might be utilized by the Secretary to carry out the purpose of this title. The Secretary shall revise the compilation thereafter as he deems necessary.</content>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/89/249/tIII/s304" styleType="traditional-inline">
                <num style="-uslm-dtd:enum" value="304">Sec. 304. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t16/s2304">16 U.S.C. 2304</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/89/249/tIII/s304/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><chapeau style="-uslm-dtd:text">The Secretary shall, during the formulation of any transportation plan authorized pursuant to section 302 of this title—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/89/249/tIII/s304/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">give public notice of intention to formulate such a plan by publication in the Federal Register and in a newspaper or periodical having general circulation in the vicinity of the affected unit of the national park system;<ref style="-uslm-dtd:footnote-ref" idref="ID7AC3B99F2CF241F4ACF88A9CA369C16D" class="footnoteRef">1</ref></content><footnote id="ID7AC3B99F2CF241F4ACF88A9CA369C16D" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">In section 304(a), paragraph (1) should end with “<quotedText style="-uslm-dtd:quote">; and</quotedText>”.</p></footnote>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/89/249/tIII/s304/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">following such notice hold a public meeting at a location or locations convenient to the affected unit of the National Park System.</content>
                </paragraph></subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/89/249/tIII/s304/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><chapeau style="-uslm-dtd:text">Prior to the implementation of any project developed pursuant to the transportation plan formulated pursuant to subsection (a) of this section, the Secretary shall—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/89/249/tIII/s304/b/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">establish procedures, including but not limited to public meetings, to give State and local governments and the public adequate notice and an opportunity to comment on the proposed transportation project; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/89/249/tIII/s304/b/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">submit, when the proposed project would involve an expenditure in excess of $100,000 in any fiscal year, a detailed report to the Committee on Energy and Natural Resources of the United States Senate and the Committee on Natural Resources of the United States House of Representatives. The Secretary may proceed with the implementation of such plan only after sixty days (not counting days on which the Senate or House of Representatives has adjourned for more than three consecutive days) have elapsed following submission of the plan.</content>
                    </paragraph>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/89/249/tIII/s305" styleType="traditional-inline">
                <num style="-uslm-dtd:enum" value="305">Sec. 305. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t16/s2305">16 U.S.C. 2305</ref><b>]</b> </editorialNote><chapeau style="-uslm-dtd:text">The Secretary shall submit a report to the Congress within three years of the effective date of this Act. The report shall include, but not be limited to, his findings and recommendations regarding—</chapeau>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/89/249/tIII/s305/a" styleType="OLC" class="leftIndentIncrease1">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><content style="-uslm-dtd:text">preservation of natural resource values within units of the National Park System through access alternatives;</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/89/249/tIII/s305/b" styleType="OLC" class="leftIndentIncrease1">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">effects of transportation projects on communities in close proximity to the units of the National Park System; and</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/89/249/tIII/s305/c" styleType="OLC" class="leftIndentIncrease1">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><content style="-uslm-dtd:text">future transportation projects formulated pursuant to this title.</content>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/89/249/tIII/s306" styleType="traditional-inline">
                <num style="-uslm-dtd:enum" value="306">Sec. 306. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t16/s2306">16 U.S.C. 2306</ref><b>]</b> </editorialNote><content style="-uslm-dtd:text">In carrying out the purposes of this title, there is hereby authorized to be appropriated $1,000,000 for fiscal year 1979; $2,000,000 for fiscal year 1980; and $3,000,000 for fiscal year 1981, which shall remain available until expended. In a fiscal year when the amounts actually appropriated are less than the amounts listed above, the authorized but unappropriated amount shall continue to be available for appropriation in succeeding fiscal years.</content>
            </section>
