            <num style="-uslm-dtd:enum" value="IV">TITLE IV—</num><heading style="-uslm-dtd:header">ENVIRONMENTAL IMPROVEMENT AND RESTORATION FUND </heading>
            <section identifier="/us/sComp/105/83/tIV/s401" style="-uslm-dtd:section" styleType="traditional-inline">
                <num style="-uslm-dtd:enum" value="401">Sec. 401. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t43/s1474d">43 U.S.C. 1474d</ref><b>]</b> </editorialNote><subsection class="inline" identifier="/us/sComp/105/83/tIV/s401/a" style="-uslm-dtd:subsection" styleType="OLC"><num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Fund.—</heading><content style="-uslm-dtd:text">One half of the amounts awarded by the Supreme Court to the United States in the case of United States of America v. State of Alaska (117 S.Ct. 1888) shall be deposited in a fund in the Treasury of the United States to be known as the “<quotedText style="-uslm-dtd:quote">Environmental Improvement and Restoration Fund</quotedText>” (referred to in this section as the “<quotedText style="-uslm-dtd:quote">Fund</quotedText>”).</content></subsection>
                <subsection identifier="/us/sComp/105/83/tIV/s401/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Investments.—</heading>
                    <paragraph identifier="/us/sComp/105/83/tIV/s401/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Secretary of the Treasury shall invest amounts in the Fund in interest bearing obligations of the United States.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/105/83/tIV/s401/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Acquisition of obligations.—</heading><chapeau style="-uslm-dtd:text">For the purpose of investments under paragraph (1), obligations may be acquired—</chapeau>
                        <subparagraph identifier="/us/sComp/105/83/tIV/s401/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">on original issue at the issue price; or</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/105/83/tIV/s401/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">by purchase of outstanding obligations at the market price.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/105/83/tIV/s401/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Sale of obligations.—</heading><content style="-uslm-dtd:text">Any obligations acquired by the Fund may be sold by the Secretary of the Treasury at the market price.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/105/83/tIV/s401/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Credits to fund.—</heading><content style="-uslm-dtd:text">The interest earned from investments of the Fund shall be covered into and form a part of the Fund.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/105/83/tIV/s401/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Transfer and Availability of Amounts Earned.—</heading><chapeau style="-uslm-dtd:text">Each year, interest earned and covered into the Fund in the previous fiscal year shall be made available as follows:</chapeau>
                    <paragraph identifier="/us/sComp/105/83/tIV/s401/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">To the extent provided in the subsequent appropriations Acts, 80 percent of such amounts shall be made available to be equally divided among the Directors of the National Park Service, the United States Fish and Wildlife Service, the Bureau of Land Management, and the Chief of the Forest Service for high priority deferred maintenance and modernization of facilities that directly enhance the experience of visitors, including natural, cultural, recreational, and historic resources protection projects in National Parks, National Wildlife Refuges, and the public lands respectively as provided in subsection (d) and for payment to the State of Louisiana and its lessees for oil and gas drainage in the West Delta field. The Secretary shall submit with the annual budget submission to Congress a list of high priority maintenance and modernization projects for congressional consideration.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/105/83/tIV/s401/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">20 percent of such amounts shall be made available without further appropriation to the Secretary of Commerce for the purpose of carrying out marine research activities in the North Pacific in accordance with subsection (e).</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/105/83/tIV/s401/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Projects.—</heading><content style="-uslm-dtd:text">A project referred to in subsection (c)(1) shall be consistent with the laws governing the National Park System, the National Wildlife Refuge System, the public lands and Forest Service lands and management plan for such unit.</content>
                </subsection>
                <subsection identifier="/us/sComp/105/83/tIV/s401/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Marine Research Activities.—</heading><paragraph class="inline" identifier="/us/sComp/105/83/tIV/s401/e/1" style="-uslm-dtd:paragraph" styleType="OLC"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Funds available under subsection (c)(2) shall be used by the Secretary of Commerce according to this subsection to provide grants to Federal, State, private or foreign organizations or individuals to conduct research activities on or relating to the fisheries or marine ecosystems in the north Pacific Ocean, Bering Sea, and Arctic Ocean (including any lesser related bodies of water).</content></paragraph>
                    <paragraph class="leftIndentDecrease1" identifier="/us/sComp/105/83/tIV/s401/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Research priorities and grant requests shall be reviewed by a board to be known as the  North Pacific Research Board (referred to in this subsection as the “<quotedText style="-uslm-dtd:quote">Board</quotedText>”). The Board shall seek to avoid duplicating other research activities, and shall place a priority on cooperative research efforts designed to address pressing fishery management or marine ecosystem information needs.</content>
                    </paragraph>
                    <paragraph class="leftIndentDecrease1" identifier="/us/sComp/105/83/tIV/s401/e/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">The Board shall be comprised of the following representatives or their designees—</chapeau>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/105/83/tIV/s401/e/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the Secretary of Commerce;</content>
                        </subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/105/83/tIV/s401/e/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the Secretary of State;</content>
                        </subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/105/83/tIV/s401/e/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the Secretary of the Interior;</content>
                        </subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/105/83/tIV/s401/e/3/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">the Commandant of the Coast Guard;</content>
                        </subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/105/83/tIV/s401/e/3/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">the Director of the Office of Naval Research;</content>
                        </subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/105/83/tIV/s401/e/3/F" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">the Alaska Commissioner of Fish and Game, who shall also be a co-chair of the Board;</content>
                        </subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/105/83/tIV/s401/e/3/G" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">the Chairman of the North Pacific Fishery Management Council;</content>
                        </subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/105/83/tIV/s401/e/3/H" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="H">(H) </num><content style="-uslm-dtd:text">the Chairman of the Arctic Research Commission;</content>
                        </subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/105/83/tIV/s401/e/3/I" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">the Director of the Oil Spill Recovery Institute;</content>
                        </subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/105/83/tIV/s401/e/3/J" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="J">(J) </num><content style="-uslm-dtd:text">the Director of the Alaska SeaLife Center;</content>
                        </subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/105/83/tIV/s401/e/3/K" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="K">(K) </num><content style="-uslm-dtd:text">five members nominated by the Governor of Alaska and appointed by the Secretary of Commerce, one of whom shall represent fishing interests, one of whom shall represent Alaska Natives, one of whom shall represent environmental interests, one of whom shall represent academia, and one of whom shall represent oil and gas interests;</content>
                        </subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/105/83/tIV/s401/e/3/L" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="L">(L) </num><content style="-uslm-dtd:text">three members nominated by the Governor of Washington and appointed by the Secretary of Commerce; </content>
                        </subparagraph>
                        <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/105/83/tIV/s401/e/3/M" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="M">(M) </num><content style="-uslm-dtd:text">one member nominated by the Governor of Oregon and appointed by the Secretary of Commerce;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/105/83/tIV/s401/e/3/N" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="N">(N) </num><content style="-uslm-dtd:text">one member who shall represent fishing interests and shall be nominated by the Board and appointed by the Secretary; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/105/83/tIV/s401/e/3/O" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="O">(O) </num><content style="-uslm-dtd:text">one member who shall represent Alaska Natives and possesses personal knowledge of, and direct experience with, subsistence uses and shall be nominated by the Board and appointed by the Secretary.</content>
                        </subparagraph><continuation role="paragraph" style="-uslm-dtd:continuation-text">The members of the Board shall be individuals knowledgeable by education, training, or experience regarding fisheries or marine ecosystems in the north Pacific Ocean, Bering Sea, or Arctic Ocean. Three nominations shall be submitted for each member to be appointed under subparagraphs (K), (L), and (M). Board members appointed under subparagraphs (K), (L), and (M) shall serve for three-year terms, and may be reappointed. Board members appointed under subparagraphs (N) and (O) shall serve for 3-year terms, and may be reappointed once.</continuation>
                    </paragraph>
                    <paragraph class="leftIndentDecrease1" identifier="/us/sComp/105/83/tIV/s401/e/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4)</num><subparagraph class="inline" identifier="/us/sComp/105/83/tIV/s401/e/4/A" style="-uslm-dtd:subparagraph" styleType="OLC"><num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">The Secretary of Commerce shall review grants recommended by the Board. If the Secretary does not approve a grant recommended by the Board, the Secretary shall explain in writing the reasons for not approving such grant, and the amount recommended to be used for such grant shall be available only for other grants recommended by the Board.</content></subparagraph>
                        <subparagraph class="leftIndentDecrease2" identifier="/us/sComp/105/83/tIV/s401/e/4/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">The Board shall establish written criteria for the submission of grant requests through a competitive process and for deciding upon the award of grants. Grants shall be recommended by the Board on the basis of merit in accordance with the priorities established by the Board. The Secretary shall provide the Board such administrative and technical support as is necessary for the effective functioning of the Board. The Board shall be considered an advisory panel established under section 302(g) of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1801 et seq.) for the purposes of section 302(i)(1) of such Act, and the other procedural matters applicable to advisory panels under section 302(i) of such Act shall apply to the Board to the extent practicable. Members of the Board may be reimbursed for actual expenses incurred in performance of their duties for the Board. Not more than 15 percent of the funds provided to the Secretary of Commerce under paragraph (1) may be used to provide support for the Board and administer grants under this subsection.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/105/83/tIV/s401/e/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><chapeau style="-uslm-dtd:text">If the amount made available for a fiscal year under subsection (c)(2) is less than the amount made available in the previous fiscal year, the Administrator of the National Oceanic and Atmospheric Administration may increase the 15 percent cap on administrative expenses provided under paragraph (4)(B) for that fiscal year to prioritize—</chapeau>
                        <subparagraph identifier="/us/sComp/105/83/tIV/s401/e/5/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">continuing operation of the Board;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/105/83/tIV/s401/e/5/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">maximizing the percentage of funds directed to research; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/105/83/tIV/s401/e/5/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">maintaining the highest quality standards in administering grants under this subsection.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/105/83/tIV/s401/e/6" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">All decisions of the Board, including grant recommendations, shall be by majority vote of the members listed in paragraphs (3)(A), (3)(F), (3)(G), (3)(J), and (3)(N), in consultation with the other members. The five voting members may act on behalf of the Board in all matters of administration, including the disposition of research funds not made available by this section, at any time on or after October 1, 2000.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/105/83/tIV/s401/f" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Sunset.—</heading><editorialNote style="-uslm-dtd:legis-comment"><b>[</b>This subsection was repealed by section 352 of the Department of the Interior and Related Agencies Appropriations Act, 2000 (H.R. 3423 of the 106th Congress, as introduced on November 17, 1999, and enacted into law by section 1000(a)(3) of Public Law 106–113 (113 Stat. 1535)).<b>]</b> </editorialNote>
                </subsection>
