            <heading style="-uslm-dtd:header" class="block">GENERAL PROVISIONS </heading>

                <num style="-uslm-dtd:enum" value="8109">Sec. 8109. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t50/s98d">50 U.S.C. 98d note</ref><b>]</b> </editorialNote><subsection style="-uslm-dtd:subsection" identifier="/us/sComp/105/262/tVIII/s8109/a" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Disposal of Certain Materials in National Defense Stockpile.—</heading><content style="-uslm-dtd:text">Subject to subsection (c), the President shall dispose of materials contained in the National Defense Stockpile and specified in the table in subsection (b) so as to result in receipts to the United States in the amount of $100,000,000 by the end of fiscal year 1999.</content></subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/105/262/tVIII/s8109/b" styleType="OLC">

                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/105/262/tVIII/s8109/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Minimization of Disruption and Loss.—</heading><chapeau style="-uslm-dtd:text">The President may not dispose of materials under subsection (a) to the extent that the disposal will result in—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/105/262/tVIII/s8109/c/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">undue disruption of the usual markets of producers, processors, and consumers of the materials proposed for disposal; or</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/105/262/tVIII/s8109/c/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">avoidable loss to the United States.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/105/262/tVIII/s8109/d" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Treatment of Receipts.—</heading><content style="-uslm-dtd:text">Notwithstanding section 9 of the Strategic and Critical Materials Stock Piling Act (50 U.S.C. 98h), funds received as a result of the disposal of materials authorized for disposal under subsection (a) shall be deposited into the general fund of the Treasury.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/105/262/tVIII/s8109/e" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Relationship to Other Disposal Authority.—</heading><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/105/262/tVIII/s8109/e/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The disposal authority provided in subsection (a) is new disposal authority and is in addition to, and shall not affect, any other disposal authority provided by law regarding the materials specified in such subsection.</content></paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/105/262/tVIII/s8109/e/2" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The disposal authority provided in subsection (a) is referred to in section 3303 of the National Defense Authorization Act for Fiscal Year 1999, and the quantities of the materials specified in the table in subsection (b) are included in the quantities specified in the table in subsection (b) of such section 3303.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/105/262/tVIII/s8109/f" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Definition.—</heading><content style="-uslm-dtd:text">In this section, the term “<term style="-uslm-dtd:term">National Defense Stockpile</term>” means the stockpile provided for in section 4 of the Strategic and Critical Materials Stock Piling Act (50 U.S.C. 98c).</content>
