    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To assist in the conservation of rhinoceros and tigers by supporting and providing financial resources for the conservation programs of nations whose activities directly or indirectly affect rhinoceros and tiger populations, and of the CITES Secretariat.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

        <section identifier="/us/sComp/103/391/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5301">16 U.S.C. 5301 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Rhinoceros and Tiger Conservation Act of 1994</inline></shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/103/391/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5301">16 U.S.C. 5301</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">FINDINGS. </heading>
            <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">The Congress finds the following:</chapeau>
                <paragraph identifier="/us/sComp/103/391/s2/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The world's rhinoceros population is declining at an alarming rate, a 90 percent decline since 1970.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s2/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">All 5 subspecies of tiger are currently threatened with extinction in the wild, with approximately 5,000 to 6,000 tigers remaining worldwide.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s2/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">All rhinoceros species have been listed on Appendix I of CITES since 1977.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s2/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">All tiger subspecies have been listed on Appendix I of CITES since 1987.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s2/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">The tiger and all rhinoceros species, except the southern subspecies of white rhinoceros, are listed as endangered species under the Endangered Species Act of 1973 (16 U.S.C. 1531 et seq.).</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s2/6" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">In 1987, the parties to CITES adopted a resolution that urged all parties to establish a moratorium on the sale and trade in rhinoceros products (other than legally taken trophies), to destroy government stockpiles of rhinoceros horn, and to exert pressure on countries continuing to allow trade in rhinoceros products.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s2/7" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">On September 7, 1993, under section 8 of the Fishermen's Protective Act of 1967 (22 U.S.C. 1978) the Secretary certified that the People's Republic of China and Taiwan were engaged in trade of rhinoceros parts and tiger parts that diminished the effectiveness of an international conservation program for that endangered species.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s2/8" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">On September 9, 1993, the Standing Committee of CITES, in debating the continuing problem of trade in rhinoceros horn and tiger parts, adopted a resolution urging parties to CITES to implement stricter domestic measures, up to and including an immediate prohibition in trade in wildlife species.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s2/9" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="9">(9) </num><content style="-uslm-dtd:text">On November 8, 1993, under section 8 of the Fisherman's Protection<ref class="footnoteRef" idref="ID8A9A751EF7844367B07F242B9532A71B" style="-uslm-dtd:footnote-ref">1</ref> Act of 1967 (22 U.S.C. 1978), the President announced that the United States would impose trade sanctions against China and Taiwan unless substantial progress was made by March 1994 towards ending trade in rhinoceros and tiger products.</content><footnote id="ID8A9A751EF7844367B07F242B9532A71B" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">So in law. Probably should be “<quotedText style="-uslm-dtd:quote">Protective</quotedText>”.</p></footnote>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s2/10" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="10">(10) </num><chapeau style="-uslm-dtd:text">On April 11, 1994, under section 8 of the Fisherman's Protective Act of 1967 (22 U.S.C.  1978), the President—</chapeau>
                    <subparagraph identifier="/us/sComp/103/391/s2/10/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">directed that imports of wildlife specimens and products from Taiwan be prohibited, in response to Taiwan's failure to undertake sufficient actions to stop illegal rhinoceros and tiger trade; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/103/391/s2/10/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">indicated that the certification of China would remain in effect and directed that additional monitoring of China's progress be undertaken.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
        </section>
        <section identifier="/us/sComp/103/391/s3" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5302">16 U.S.C. 5302</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PURPOSES. </heading>
            <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">The purposes of this Act are the following:</chapeau>
                <paragraph identifier="/us/sComp/103/391/s3/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">To assist in the conservation of rhinoceros and tigers by supporting the conservation programs of nations whose activities directly or indirectly affect rhinoceros and tiger populations, and the CITES Secretariat.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s3/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">To provide financial resources for those programs.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s3/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">To prohibit the sale, importation, and exportation of products intended for human consumption or application containing, or labeled or advertised as containing, any substance derived from any species of rhinoceros or tiger.</content>
                </paragraph>
            </subsection>
        </section>
        <section identifier="/us/sComp/103/391/s4" role="definitions" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5303">16 U.S.C. 5303</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
            <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">In this Act—</chapeau>
                <paragraph identifier="/us/sComp/103/391/s4/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">
“<term style="-uslm-dtd:term">CITES</term>” means the Convention on International Trade in Endangered Species of Wild Fauna and Flora, signed on March 3, 1973, and its appendices;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s4/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">
“<term style="-uslm-dtd:term">conservation</term>” means the use of all methods and procedures necessary to bring rhinoceros and tigers to the point at which there are sufficient populations to ensure that those species do not become extinct, including all activities associated with scientific resource management, such as research, census, law enforcement, habitat protection, acquisition, and management, propagation, live trapping, and transportation;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s4/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">``Fund'' means the the<ref class="footnoteRef" idref="ID5761F0487DF642B99DA91987FA26BE2E" style="-uslm-dtd:footnote-ref">2</ref> account established by division A, section 101(e), title I of Public Law 105–277 under the heading ``<headingText style="-uslm-dtd:header-in-text">multinational species conservation fund</headingText>'';</content><footnote id="ID5761F0487DF642B99DA91987FA26BE2E" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">2</sup><p style="-uslm-dtd:para; margin-left:1em">So in law. Section 6(a)(1) of the Rhinoceros and Tiger Conservation Reauthorization Act of 2001 (P.L. 107–112, 115 Stat. 2097) amended this section by striking ``Rhinoceros and Tiger Conservation Fund established under section 6(a)'' and inserting ``the account established by division A, section 101(e), title I of Public Law 105–277 under the heading `<headingText style="-uslm-dtd:header-in-text">multinational species conservation fund</headingText>'''. The amendment should probably have struck ``the'' before ``Rhinoceros and Tiger''.</p></footnote>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s4/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">
“<term style="-uslm-dtd:term">Secretary</term>” means the Secretary of the Interior;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s4/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">
“<term style="-uslm-dtd:term">Administrator</term>” means the Administrator of the Agency for International Development; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s4/6" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><chapeau style="-uslm-dtd:text">
“<term style="-uslm-dtd:term">person</term>” means—</chapeau>
                    <subparagraph identifier="/us/sComp/103/391/s4/6/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">an individual, corporation, partnership, trust, association, or other private entity;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/103/391/s4/6/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">an officer, employee, agent, department, or instrumentality of—</chapeau>
                        <clause identifier="/us/sComp/103/391/s4/6/B/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the Federal Government;</content>
                        </clause>
                        <clause identifier="/us/sComp/103/391/s4/6/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">any State, municipality, or political subdivision of a State; or</content>
                        </clause>
                        <clause identifier="/us/sComp/103/391/s4/6/B/iii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">any foreign government;</content>
                        </clause>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/103/391/s4/6/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">a State, municipality, or political subdivision of a State; or</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/103/391/s4/6/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">any other entity subject to the jurisdiction of the United States.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
        </section>
        <section identifier="/us/sComp/103/391/s5" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5304">16 U.S.C. 5304</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">RHINOCEROS AND TIGER CONSERVATION ASSISTANCE. </heading>
            <subsection identifier="/us/sComp/103/391/s5/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The Secretary, subject to the availability of appropriations and in consultation with the Administrator, shall use amounts in the Fund to provide financial assistance for projects for the conservation of rhinoceros and tigers.</content>
            </subsection>
            <subsection identifier="/us/sComp/103/391/s5/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Project Proposal.—</heading><chapeau style="-uslm-dtd:text">A country whose activities directly or indirectly affect rhinoceros or tiger populations, the CITES Secretariat, or any other person may submit to the Secretary a project proposal under this section. Each proposal shall—</chapeau>
                <paragraph identifier="/us/sComp/103/391/s5/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">name the individual responsible for conducting the project;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s5/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">state the purposes of the project succinctly;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s5/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">describe the qualifications of the individuals who will conduct the project;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s5/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">estimate the funds and time required to complete the project;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s5/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">provide evidence of support of the project by appropriate governmental entities of countries in which the project will be conducted, if the Secretary determines that the support is required for the success of the project; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s5/b/6" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">provide any other information the Secretary considers to be necessary for evaluating the eligibility of the project for funding under this Act.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/103/391/s5/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Project Review and Approval.—</heading><content style="-uslm-dtd:text">Within 30 days of receiving a final project proposal, the Secretary shall provide a copy of the proposal to the Administrator. The Secretary shall review each final project proposal to determine if it meets the criteria set forth in subsection (d). Not later than 6 months after receiving a final project proposal, and subject to the availability of funds, the Secretary, after consulting with the Administrator, shall approve or disapprove the proposal and provide written notification to the person who submitted the proposal and to the Administrator.</content>
            </subsection>
            <subsection identifier="/us/sComp/103/391/s5/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Criteria for Approval.—</heading><chapeau style="-uslm-dtd:text">The Secretary may approve a project under this section if the project will enhance programs for conservation of rhinoceros or tigers by assisting efforts to—</chapeau>
                <paragraph identifier="/us/sComp/103/391/s5/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">implement conservation programs;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s5/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">enhance compliance with provisions of CITES and laws of the United States or a foreign country that prohibit or regulate the taking or trade of rhinoceros or tigers or the use of rhinoceros or tiger habitat; or</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s5/d/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">develop sound scientific information on that species' habitat condition and carrying capacity, total numbers and population trends, or annual reproduction and mortality.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/103/391/s5/e" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Project Sustainability.—</heading><content style="-uslm-dtd:text">To the maximum extent practical, in determining whether to approve project proposals under this section, the Secretary shall give consideration to projects which will enhance sustainable conservation programs to ensure effective long-term conservation of rhinoceros and tigers.</content>
            </subsection>
            <subsection identifier="/us/sComp/103/391/s5/f" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Project Reporting.—</heading><content style="-uslm-dtd:text">Each person that receives assistance under this section for a project shall provide periodic reports, as the Secretary considers necessary, to the Secretary and the Administrator. Each report shall include all information requested by the Secretary, after consulting with the Administrator, for evaluating the progress and success of the project.</content>
            </subsection>
            <subsection identifier="/us/sComp/103/391/s5/g" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Multiyear Grants.—</heading>
                <paragraph identifier="/us/sComp/103/391/s5/g/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Authorization.—</heading><content style="-uslm-dtd:text">The Secretary may award to a person who is otherwise eligible for a grant under this section a multiyear grant of up to 5 years to carry out a project that the person demonstrates is an effective, long-term conservation strategy for rhinoceroses or tigers and the habitat of rhinoceroses or tigers.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s5/g/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Effect.—</heading><content style="-uslm-dtd:text">Nothing in this subsection precludes the Secretary from awarding a grant on an annual basis.</content>
                </paragraph>
            </subsection>
        </section>
        <section identifier="/us/sComp/103/391/s6" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="6">SEC. 6. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5305">16 U.S.C. 5305</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ACCEPTANCE AND USE OF DONATIONS. </heading>
            <content class="block" style="-uslm-dtd:text">The Secretary may accept and use donations to provide assistance under section 5. Amounts received by the Secretary in the form of donations shall be transferred to the Secretary of the Treasury for deposit into the Fund.</content>
        </section>
        <section identifier="/us/sComp/103/391/s7" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="7">SEC. 7. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5305a">16 U.S.C. 5305a</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PROHIBITION ON SALE, IMPORTATION, OR EXPORTATION OF PRODUCTS LABELED OR ADVERTISED AS RHINOCEROS OR TIGER PRODUCTS. </heading>
            <subsection identifier="/us/sComp/103/391/s7/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Prohibition.—</heading><content style="-uslm-dtd:text">A person shall not sell, import, or export, or attempt to sell, import, or export, any product, item, or substance intended for human consumption or application containing, or labeled or advertised as containing, any substance derived from any species of rhinoceros or tiger.</content>
            </subsection>
            <subsection identifier="/us/sComp/103/391/s7/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Penalties.—</heading>
                <paragraph identifier="/us/sComp/103/391/s7/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Criminal penalty.—</heading><content style="-uslm-dtd:text">A person engaged in business as an importer, exporter, or distributor that knowingly violates subsection (a) shall be fined under title 18, United States Code, imprisoned not more than 6 months, or both.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s7/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Civil penalties.—</heading>
                    <subparagraph identifier="/us/sComp/103/391/s7/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">A person that knowingly violates subsection (a), and a person engaged in business as an importer, exporter, or distributor that violates subsection (a), may be assessed a civil penalty by the Secretary of not more than $12,000 for each violation.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/103/391/s7/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Manner of assessment and collection.—</heading><content style="-uslm-dtd:text">A civil penalty under this paragraph shall be assessed, and may be collected, in the manner in which a civil penalty under the Endangered Species Act of 1973 may be assessed and collected under section 11(a) of that Act (16 U.S.C. 1540(a)).</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/103/391/s7/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Products, Items, and Substances.—</heading><content style="-uslm-dtd:text">Any product, item, or substance sold, imported, or exported, or attempted to be sold, imported, or exported, in violation of this section or any regulation issued under this section shall be subject to seizure and forfeiture to the United States.</content>
            </subsection>
            <subsection identifier="/us/sComp/103/391/s7/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Regulations.—</heading><content style="-uslm-dtd:text">After consultation with the Secretary of the Treasury, the Secretary of Health and Human Services, and the United States Trade Representative, the Secretary shall issue such regulations as are appropriate to carry out this section.</content>
            </subsection>
            <subsection identifier="/us/sComp/103/391/s7/e" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Enforcement.—</heading><content style="-uslm-dtd:text">The Secretary, the Secretary of the Treasury, and the Secretary of the department in which the Coast Guard is operating shall enforce this section in the manner in which the Secretaries carry out enforcement activities under section 11(e) of the Endangered Species Act of 1973 (16 U.S.C. 1540(e)).</content>
            </subsection>
            <subsection identifier="/us/sComp/103/391/s7/f" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Use of Penalty Amounts.—</heading><content style="-uslm-dtd:text">Amounts received as penalties, fines, or forfeiture of property under this section shall be used in accordance with section 6(d) of the Lacey Act Amendments of 1981 (16 U.S.C. 3375(d)).</content>
            </subsection>
        </section>
        <section identifier="/us/sComp/103/391/s8" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="8">SEC. 8. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5305b">16 U.S.C. 5305b</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">EDUCATIONAL OUTREACH PROGRAM. </heading>
            <subsection identifier="/us/sComp/103/391/s8/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Not later than 180 days after the date of enactment of this section, the Secretary shall develop and implement an educational outreach program in the United States for the conservation of rhinoceros and tiger species.</content>
            </subsection>
            <subsection identifier="/us/sComp/103/391/s8/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Guidelines.—</heading><content style="-uslm-dtd:text">The Secretary shall publish in the Federal Register guidelines for the program.</content>
            </subsection>
            <subsection identifier="/us/sComp/103/391/s8/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Contents.—</heading><chapeau style="-uslm-dtd:text">Under the program, the Secretary shall publish and disseminate information regarding—</chapeau>
                <paragraph identifier="/us/sComp/103/391/s8/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">laws protecting rhinoceros and tiger species, in particular laws prohibiting trade in products containing, or labeled or advertised as containing, their parts;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s8/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">use of traditional medicines that contain parts or products of rhinoceros and tiger species, health risks associated with their use, and available alternatives to the medicines; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s8/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the status of rhinoceros and tiger species and the reasons for protecting the species.</content>
                </paragraph>
            </subsection>
        </section>
        <section identifier="/us/sComp/103/391/s9" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="9">SEC. 9. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5305c">16 U.S.C. 5305c</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ADVISORY GROUP. </heading>
            <subsection identifier="/us/sComp/103/391/s9/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">To assist in carrying out this Act, the Secretary may convene an advisory group consisting of individuals representing public and private organizations actively involved in the conservation of rhinoceros and tiger species.</content>
            </subsection>
            <subsection identifier="/us/sComp/103/391/s9/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Public Participation.—</heading>
                <paragraph identifier="/us/sComp/103/391/s9/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Meetings.—</heading><chapeau style="-uslm-dtd:text">The Advisory Group shall—</chapeau>
                    <subparagraph identifier="/us/sComp/103/391/s9/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">ensure that each meeting of the advisory group is open to the public; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/103/391/s9/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">provide, at each meeting, an opportunity for interested persons to present oral or written statements concerning items on the agenda.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s9/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Notice.—</heading><content style="-uslm-dtd:text">The Secretary shall provide to the public timely notice of each meeting of the advisory group.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/103/391/s9/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Minutes.—</heading><content style="-uslm-dtd:text">Minutes of each meeting of the advisory group shall be kept by the Secretary and shall be made available to the public.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/103/391/s9/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Exemption From Chapter 10 of Title 5, United States Code.—</heading><content style="-uslm-dtd:text">Chapter 10 of title 5, United States Code, shall not apply to the advisory group.</content>
            </subsection>
        </section>
        <section identifier="/us/sComp/103/391/s10" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="10">SEC. 10. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s5306">16 U.S.C. 5306</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">AUTHORIZATION OF APPROPRIATIONS. </heading>
            <subsection identifier="/us/sComp/103/391/s10/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">There is authorized to be appropriated to the Fund $10,000,000 for each of fiscal years 2025 through 2029 to carry out this Act, to remain available until expended.</content>
            </subsection>
            <subsection identifier="/us/sComp/103/391/s10/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Administrative Expenses.—</heading><content style="-uslm-dtd:text">Of amounts available each fiscal year to carry out this Act, the Secretary may expend not more than 3 percent or $100,000, whichever is greater, to pay the administrative expenses necessary to carry out this Act.</content>
            </subsection>
