    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To establish a National Fish and Wildlife Foundation.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
</enactingFormula>
        <section identifier="/us/sComp/98/244/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">National Fish and Wildlife Foundation Establishment Act</inline></shortTitle>”.</content><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s3701">16 U.S.C. 3701 note</ref><b>]</b> </editorialNote>

        <section identifier="/us/sComp/98/244/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">ESTABLISHMENT AND PURPOSES OF FOUNDATION. </heading>
            <subsection identifier="/us/sComp/98/244/s2/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Establishment.—</heading><content style="-uslm-dtd:text">There is established the National Fish and Wildlife Foundation (hereinafter in this Act referred to as the “<quotedText style="-uslm-dtd:quote">Foundation</quotedText>”). The Foundation is a charitable and nonprofit corporation and is not an agency or establishment of the United States.</content>
            </subsection>
            <subsection identifier="/us/sComp/98/244/s2/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Purposes.—</heading><chapeau style="-uslm-dtd:text">The purposes of the Foundation are—</chapeau>
                <paragraph identifier="/us/sComp/98/244/s2/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">to encourage, accept, and administer private gifts of property for the benefit of, or in connection with, the activities and services of the United States Fish and Wildlife Service and the National Oceanic and Atmospheric Administration, to further the conservation and management of fish, wildlife, plants, and other natural resources;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s2/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to undertake and conduct such other activities as will further the conservation and management of the fish, wildlife, and plant resources of the United States, and its territories and possessions, for present and future generations of Americans; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s2/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">to participate with, and otherwise assist, foreign governments, entities, and individuals in undertaking and conducting activities that will further the conservation and management of the fish, wildlife, and plant resources of other countries.</content>
                </paragraph>
            </subsection><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s3701">16 U.S.C. 3701</ref><b>]</b> </editorialNote>
        </section>
        <section identifier="/us/sComp/98/244/s3" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">BOARD OF DIRECTORS OF THE FOUNDATION. </heading>
            <subsection identifier="/us/sComp/98/244/s3/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Establishment and Membership.—</heading>
                <paragraph identifier="/us/sComp/98/244/s3/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Foundation shall have a governing Board of Directors (referred to in this Act as the “<quotedText style="-uslm-dtd:quote">Board</quotedText>”), which shall consist of 30 Directors appointed in accordance with subsection (b), each of whom shall be a United States citizen.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s3/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Representation of diverse points of view.—</heading><content style="-uslm-dtd:text">To the maximum extent practicable, the membership of the Board shall represent diverse points of view relating to conservation and management of fish, wildlife, plants, and other natural resources.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s3/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Not federal employees.—</heading><content style="-uslm-dtd:text">Appointment as a Director of the Foundation shall not constitute employment by, or the holding of an office of, the United States for the purpose of any Federal law.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/98/244/s3/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Appointment and Terms.—</heading>
                <paragraph identifier="/us/sComp/98/244/s3/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Agency heads.—</heading><content style="-uslm-dtd:text">The Director of the United States Fish and Wildlife Service and the Under Secretary of Commerce for Oceans and Atmosphere shall be Directors of the Foundation.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s3/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Appointment of directors.—</heading><chapeau style="-uslm-dtd:text">After consulting with the Secretary of Commerce and considering the recommendations submitted by the Board, the Secretary of the Interior shall appoint 28 Directors who, to the maximum extent practicable, shall—</chapeau>
                    <subparagraph identifier="/us/sComp/98/244/s3/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">be knowledgeable and experienced in matters relating to the conservation of fish, wildlife, or other natural resources; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s3/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">represent a balance of expertise in ocean, coastal, freshwater, and terrestrial resource conservation.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s3/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Terms.—</heading><content style="-uslm-dtd:text">Each Director (other than a Director described in paragraph (1)) shall be appointed for a term of 6 years.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s3/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Vacancies.—</heading>
                    <subparagraph identifier="/us/sComp/98/244/s3/b/4/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Secretary of the Interior shall fill a vacancy on the Board.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s3/b/4/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Term of appointments to fill unexpired terms.—</heading><content style="-uslm-dtd:text">An individual appointed to fill a vacancy that occurs before the expiration of the term of a Director shall be appointed for the remainder of the term.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s3/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Reappointment.—</heading><content style="-uslm-dtd:text">An individual (other than an individual described in paragraph (1)) shall not serve more than 2 consecutive terms as a Director, excluding any term of less than 6 years.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s3/b/6" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><heading style="-uslm-dtd:header">Request for removal.—</heading><content style="-uslm-dtd:text">The executive committee of the Board may submit to the Secretary of the Interior a letter describing the nonperformance of a Director and requesting the removal of the Director from the Board.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s3/b/7" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="7">(7) </num><heading style="-uslm-dtd:header">Consultation before removal.—</heading><content style="-uslm-dtd:text">Before removing any Director from the Board, the Secretary of the Interior shall consult with the Secretary of Commerce.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/98/244/s3/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Chairman.—</heading><content style="-uslm-dtd:text">The Chairman shall be elected by the Board from its members for a 2-year term.</content>
            </subsection>
            <subsection identifier="/us/sComp/98/244/s3/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Quorum.—</heading><content style="-uslm-dtd:text">A majority of the current membership of the Board shall constitute a quorum for the transaction of business.</content>
            </subsection>
            <subsection identifier="/us/sComp/98/244/s3/e" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Meetings.—</heading><content style="-uslm-dtd:text">The Board shall meet at the call of the Chairman at least once a year. If a Director misses 3 consecutive regularly scheduled meetings, that individual may be removed from the Board and that vacancy filled in accordance with subsection (b).</content>
            </subsection>
            <subsection identifier="/us/sComp/98/244/s3/f" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Reimbursement of Expenses.—</heading><content style="-uslm-dtd:text">Members of the Board shall serve without pay, but may be reimbursed for the actual and necessary traveling and subsistence expenses incurred by them in the performance of the duties of the Foundation.</content>
            </subsection>
            <subsection identifier="/us/sComp/98/244/s3/g" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">General Powers.—</heading>
                <paragraph identifier="/us/sComp/98/244/s3/g/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">The Board may complete the organization of the Foundation by—</chapeau>
                    <subparagraph identifier="/us/sComp/98/244/s3/g/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">appointing officers and employees;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s3/g/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">adopting a constitution and bylaws consistent with the purposes of the Foundation and the provisions of this Act; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s3/g/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">undertaking of other such acts as may be necessary to carry out the provisions of this Act.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s3/g/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">The following limitations apply with respect to the appointment of officers and employees of the Foundation:</chapeau>
                    <subparagraph identifier="/us/sComp/98/244/s3/g/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Officers and employees of the Foundation shall be appointed without regard to the provisions of title 5, United States Code, governing appointments in the competitive service, and may be paid without regard to the provisions of chapter 51 and subchapter III of chapter 53 of such title relating to classification and General Schedule pay rates.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s3/g/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Executive director.—</heading><chapeau style="-uslm-dtd:text">The Foundation shall have an Executive Director who shall be—</chapeau>
                        <clause identifier="/us/sComp/98/244/s3/g/2/B/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">appointed by, and serve at the direction of, the Board as the chief executive officer of the Foundation; and</content>
                        </clause>
                        <clause identifier="/us/sComp/98/244/s3/g/2/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">knowledgeable and experienced in matters relating to fish and wildlife conservation.</content>
                        </clause>
                    </subparagraph>
                </paragraph>
            </subsection><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s3702">16 U.S.C. 3702</ref><b>]</b> </editorialNote>
        </section>
        <section identifier="/us/sComp/98/244/s4" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><heading style="-uslm-dtd:header">RIGHTS AND OBLIGATIONS OF THE FOUNDATION. </heading>
            <subsection identifier="/us/sComp/98/244/s4/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">The Foundation—</chapeau>
                <paragraph identifier="/us/sComp/98/244/s4/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">shall have perpetual succession;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s4/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">may conduct business throughout the several States, territories, and possessions of the United States and abroad;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s4/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">shall have its principal offices in the District of Columbia or in a county in the State of Maryland or Virginia that borders on the District of Columbia; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s4/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">shall at all times maintain a designated agent authorized to accept service of process for the Foundation.</content>
                </paragraph><continuation role="subsection" style="-uslm-dtd:continuation-text">The serving of notice to, or service of process upon, the agent required under paragraph (4), or mailed to the business address of such agent, shall be deemed as service upon or notice to the Foundation.</continuation>
            </subsection>
            <subsection identifier="/us/sComp/98/244/s4/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Seal.—</heading><content style="-uslm-dtd:text">The Foundation shall have an official seal selected by the Board which shall be judicially noticed.</content>
            </subsection>
            <subsection identifier="/us/sComp/98/244/s4/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Powers.—</heading>
                <paragraph identifier="/us/sComp/98/244/s4/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">To carry out the purposes described in section 2, the Foundation shall have, in addition to the powers otherwise given it under this Act, the usual powers of a corporation acting as a trustee in the District of Columbia, including the power—</chapeau>
                    <subparagraph identifier="/us/sComp/98/244/s4/c/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">to accept, receive, solicit, hold, administer, and use any gift, devise, or bequest, either absolutely or in trust, of real or personal property or any income therefrom or other interest therein;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s4/c/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">to acquire by purchase or exchange any real or personal property or interest therein, subject to subsection (e);</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s4/c/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">to invest any funds provided to the Foundation by the Federal Government in obligations of the United States or in obligations or securities that are guaranteed or insured by the United States;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s4/c/1/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">to deposit any funds provided to the Foundation by the Federal Government into accounts at
1 or more financial institutions that are members of the
Federal Deposit Insurance Corporation or the Securities
Investment Protection Corporation;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s4/c/1/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">to make use of any interest or investment income that accrues as a consequence of actions taken under subparagraph (C) or (D) to carry out the purposes of the Foundation;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s4/c/1/F" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">to use Federal funds to make payments under cooperative agreements entered into with willing private landowners to provide substantial long-term benefits for the restoration or enhancement of fish, wildlife, plants, and other natural resources on private land;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s4/c/1/G" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">unless otherwise required by the instrument of transfer, to sell, donate, lease, invest, reinvest, retain or otherwise dispose of any property or income therefrom;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s4/c/1/H" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="H">(H) </num><content style="-uslm-dtd:text">to borrow money and issue bonds, debentures, or other debt instruments;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s4/c/1/I" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">to sue and be sued, and complain and defend itself in any court of competent jurisdiction, except that the Directors of the Foundation shall not be personally liable, except for gross negligence;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s4/c/1/J" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="J">(J) </num><content style="-uslm-dtd:text">to enter into contracts or other arrangements with public agencies and private organizations and persons and to make such payments as may be necessary to carry out its functions; </content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s4/c/1/K" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="K">(K) </num><content style="-uslm-dtd:text">to receive and administer restitution and community service payments, amounts for mitigation of impacts to natural resources, and other amounts arising from legal, regulatory, or administrative proceedings, subject to the condition that the amounts are received or administered for purposes that further the conservation and management of fish, wildlife, plants, and other natural resources; and<ref class="footnoteRef" idref="ID30C8B8D10918445E86FA50A91FFEB90D" style="-uslm-dtd:footnote-ref">1</ref></content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s4/c/1/L" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="L">(L) </num><content style="-uslm-dtd:text">to do acts necessary to carry out the purposes of the Foundation.</content>
                    </subparagraph><footnote id="ID30C8B8D10918445E86FA50A91FFEB90D" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">Stipulated in reauthorizing language in P.L. 102–440: “<quotedText style="-uslm-dtd:quote">Beginning in fiscal year 1993 and hereafter, the National Fish and Wildlife Foundation may continue to draw down Federal funds when matching requirements have been met:<i style="-uslm-dtd:italic">Provided, </i>That interest earned by the Foundation and its subgrantees on funds drawn down to date, but not immediately disbursed, shall be used to fund all activities as approved by the Board of Directors:<i style="-uslm-dtd:italic">Provided further,</i>That the Foundation's subgrantees shall be exempt from the audit reporting and compliance requirements of OMB Circular A–133, for all grants of $100,000 or less. The Foundation shall amend its grant contracts to ensure that its subgrantees are advised and certify that they will comply with all applicable Federal laws and regulations imposed on individuals or organizations receiving Federal funds.</quotedText>”.</p></footnote>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s4/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Treatment of real property.—</heading>
                    <subparagraph identifier="/us/sComp/98/244/s4/c/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">For purposes of this Act, an interest in real property shall be treated as including easements or other rights for preservation, conservation, protection, or enhancement by and for the public of natural, scenic, historic, scientific, educational, inspirational, or recreational resources.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s4/c/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Encumbered real property.—</heading><content style="-uslm-dtd:text">A gift, devise, or bequest may be accepted by the Foundation even though the gift, devise, or bequest is encumbered, restricted, or subject to beneficial interests of private persons if any current or future interest in the gift, devise, or bequest is for the benefit of the Foundation.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s4/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Savings clause.—</heading><content style="-uslm-dtd:text">The acceptance and administration of amounts by the Foundation under paragraph (1)(K) does not alter, supersede, or limit any regulatory or statutory requirement associated with those amounts.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/98/244/s4/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Certain Lands, Waters, and Interests Not Subject to Condemnation.—</heading><content style="-uslm-dtd:text">No lands or waters, or interests therein, that are owned by the Foundation and are determined by the Director of the United States Fish and Wildlife Service or the Migratory Bird Conservation Commission, as the case may be, to be valuable for purposes of fish and wildlife conservation or management shall be subject to condemnation by any State or political subdivision, or any agent or instrumentality thereof.</content>
            </subsection>
            <subsection identifier="/us/sComp/98/244/s4/e" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Acquisition, Management and Disposal of Real Property.—</heading><paragraph class="inline" identifier="/us/sComp/98/244/s4/e/1" style="-uslm-dtd:paragraph" styleType="OLC"><num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">The Foundation may only use Federal funds for the acquisition of interests in real property if—</chapeau>
                <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/98/244/s4/e/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the interest is a long-term property interest; and</content>
                </subparagraph>
                <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/98/244/s4/e/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the Foundation notifies the Federal agency that administers the program under which the funds were provided of the proposed acquisition, and the agency does not object in writing to the proposed acquisition within 60 calendar days after the date of the notification.</content>
                </subparagraph></paragraph>
                <paragraph class="leftIndentDecrease1" identifier="/us/sComp/98/244/s4/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The Foundation shall convey to the United States Fish and Wildlife Service for inclusion within the National Wildlife Refuge System any real property acquired by the Foundation in whole or in part with Federal funds if the Director, within 1 year after the date on which the property was acquired by the Foundation, requests the conveyance in writing.</content>
                </paragraph>
                <paragraph class="leftIndentDecrease1" identifier="/us/sComp/98/244/s4/e/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3)</num><subparagraph class="inline" identifier="/us/sComp/98/244/s4/e/3/A" style="-uslm-dtd:subparagraph" styleType="OLC"><num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">Subject to subparagraph (B), the Foundation may—</chapeau>
                    <clause class="leftIndentDecrease2" identifier="/us/sComp/98/244/s4/e/3/A/i" style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">convey to another person any real property acquired in whole or in part with Federal funds and not conveyed under paragraph (2); and</content>
                    </clause>
                    <clause class="leftIndentDecrease2" identifier="/us/sComp/98/244/s4/e/3/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">grant or otherwise provide Federal funds to another person for purposes of assisting that person to acquire real property in whole or in part with such funds.</content>
                    </clause></subparagraph>
                    <subparagraph class="leftIndentDecrease2" identifier="/us/sComp/98/244/s4/e/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">The Foundation may only make a conveyance or provide Federal funds under subparagraph (A) if—</chapeau>
                        <clause class="leftIndentDecrease2" identifier="/us/sComp/98/244/s4/e/3/B/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the conveyance or provision is subject to terms and conditions that will ensure that the real property will be administered for the long-term conservation and management of fish and wildlife and in a manner that will provide for appropriate public access and use; and</content>
                        </clause>
                        <clause class="leftIndentDecrease2" identifier="/us/sComp/98/244/s4/e/3/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the Foundation notifies the Federal agency that administers the Federal program under which the funds were provided of the proposed conveyance or provision of Federal funds, and the agency does not object in writing to the proposed conveyance or provision of Federal funds within 60 calendar days after the date of the notification.</content>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph class="leftIndentDecrease1" identifier="/us/sComp/98/244/s4/e/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">All real property acquired by the Foundation in whole or in part with Federal funds and held by it shall be administered for the conservation and management of fish and wildlife and in a manner that will provide for appropriate public access and use.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s4/e/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Reconveyance of real property.—</heading><chapeau style="-uslm-dtd:text">The Foundation shall convey at not less than fair market value any real property acquired by the Foundation in whole or in part with Federal funds if the Foundation notifies the Federal agency that administers the Federal program under which the funds were provided, and the agency does not disagree within 60 calendar days after the date of the notification, that—</chapeau>
                    <subparagraph identifier="/us/sComp/98/244/s4/e/5/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the property is no longer valuable for the purpose of conservation or management of fish, wildlife, plants, and other natural resources; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s4/e/5/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the purposes of the Foundation would be better served by use of the proceeds of the conveyance for other authorized activities of the Foundation.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/98/244/s4/f" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Expenditures for Printing Services or Capital Equipment.—</heading><content style="-uslm-dtd:text">The Foundation shall not make any expenditure of Federal funds in connection with any one transaction for printing services or capital equipment that is greater than $10,000 unless the expenditure is approved by the Federal agency that administers the Federal program under which the funds were provided.</content>
            </subsection>
            <subsection identifier="/us/sComp/98/244/s4/g" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Notice to Members of Congress.—</heading><content style="-uslm-dtd:text">The Foundation shall not make a grant of Federal funds in an amount greater than $10,000 unless, by not later than 30 days before the grant is made, the Foundation provides notice of the grant to the Member of Congress for the congressional district in which the project to be funded with the grant will be carried out.</content><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s3703">16 U.S.C. 3703</ref><b>]</b> </editorialNote>
            </subsection>
        </section>
        <section identifier="/us/sComp/98/244/s5" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><heading style="-uslm-dtd:header">ADMINISTRATIVE SERVICES AND SUPPORT. </heading>
            <subsection identifier="/us/sComp/98/244/s5/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Provision of Services.—</heading><content style="-uslm-dtd:text">The Secretary may provide personnel, facilities, and other administrative services to the Foundation, including reimbursement of expenses under section 3, not to exceed the current Federal Government per diem rates, for a period of up to five years from the date of enactment of this Act.</content>
            </subsection>
            <subsection identifier="/us/sComp/98/244/s5/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Reimbursement.—</heading><content style="-uslm-dtd:text">The Foundation may reimburse the Secretary for any administrative service provided under subsection (a). The Secretary shall deposit any reimbursement received under this subsection into the Treasury to the credit of the appropriations then current and chargeable for the cost of providing such services.</content>
            </subsection><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s3704">16 U.S.C. 3704</ref><b>]</b> </editorialNote>
        </section>
        <section identifier="/us/sComp/98/244/s6" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="6">SEC. 6. </num><heading style="-uslm-dtd:header">VOLUNTEER STATUS. </heading>
            <content class="block" style="-uslm-dtd:text">The Secretary of the Interior or the Secretary of Commerce may accept, without regard to the civil service classification laws, rules, or regulations, the services of the Foundation, the Board, and the officers and employees of the Board, without compensation from the Department of the Interior or the Department of Commerce, as volunteers in the performance of the functions authorized herein, in the manner provided for under section 7(c) of the Fish and Wildlife Act of 1956 (16 U.S.C. 742f(c)).</content><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s3705">16 U.S.C. 3705</ref><b>]</b> </editorialNote>
        </section>
        <section identifier="/us/sComp/98/244/s7" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="7">SEC. 7. </num><heading style="-uslm-dtd:header">AUDITS, REPORT REQUIREMENTS, AND PETITION OF ATTORNEY GENERAL FOR EQUITABLE RELIEF. </heading>
            <subsection identifier="/us/sComp/98/244/s7/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Audits.—</heading><content style="-uslm-dtd:text">For purposes of the Act entitled “<quotedText style="-uslm-dtd:quote">An Act for audit accounts of private corporations established under Federal law</quotedText>” approved August 30, 1964 (Public Law 88–504, 36 U.S.C. 1101–1103), the Foundation shall be treated as a private corporation established under Federal law.</content>
            </subsection>
            <subsection identifier="/us/sComp/98/244/s7/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Report.—</heading><content style="-uslm-dtd:text">The Foundation shall, as soon as practicable after the end of each fiscal year, transmit to the Committee on Resources of the House of Representatives and the Committee on Environment and Public Works of the Senate a report of its proceedings and activities during such year, including a full and complete statement of its receipts, expenditures, and investments; and a description of all acquisition and disposal of real property that is subject to section 4(e). The report shall include a detailed statement of the recipient, amount, and purpose of each grant made by the Foundation in the fiscal year.</content>
            </subsection>
            <subsection identifier="/us/sComp/98/244/s7/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Relief with Respect to Certain Foundation Acts or Failure to Act.—</heading><chapeau style="-uslm-dtd:text">If the Foundation—</chapeau>
                <paragraph identifier="/us/sComp/98/244/s7/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">engages in, or threatens to engage in, any act, practice, or policy that is inconsistent with its purposes set forth in section 2(b); or</content>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s7/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">refuses, fails, or neglects to discharge its obligations under this Act, or threatens to do'</content>
                </paragraph><continuation role="subsection" style="-uslm-dtd:continuation-text">the Attorney General of the United States may petition in the United States District Court for the District of Columbia for such equitable relief as may be necessary or appropriate.</continuation>
            </subsection><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s3706">16 U.S.C. 3706</ref><b>]</b> </editorialNote>
        </section>
        <section identifier="/us/sComp/98/244/s8" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="8">SEC. 8. </num><heading style="-uslm-dtd:header">UNITED STATES RELEASE FROM LIABILITY. </heading>
            <content class="block" style="-uslm-dtd:text">The United States shall not be liable for any debts, defaults, acts, or omissions of the Foundation nor shall the full faith and credit of the United States extend to any obligation of the Foundation.</content><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s3707">16 U.S.C. 3707</ref><b>]</b> </editorialNote>
        </section>
        <section identifier="/us/sComp/98/244/s9" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="9">SEC. 9. </num><heading style="-uslm-dtd:header">AMENDMENT AND REPEAL. </heading>
            <content class="block" style="-uslm-dtd:text">The Congress expressly reserves the right to repeal or amend this Act at any time.</content><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s3708">16 U.S.C. 3708</ref><b>]</b> </editorialNote>
        </section>
        <section identifier="/us/sComp/98/244/s10" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="10">SEC. 10. </num><heading style="-uslm-dtd:header">AUTHORIZATION OF APPROPRIATIONS. </heading>
            <subsection identifier="/us/sComp/98/244/s10/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading>
                <paragraph identifier="/us/sComp/98/244/s10/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">There are authorized to be appropriated to carry out this Act for each of fiscal years 2021 through 2030—</chapeau>
                    <subparagraph identifier="/us/sComp/98/244/s10/a/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">$15,000,000 to the Secretary of the Interior;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s10/a/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">$5,000,000 to the Secretary of Agriculture; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s10/a/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">$5,000,000 to the Secretary of Commerce.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s10/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Requirement of advance payment.—</heading><content style="-uslm-dtd:text">The amount made available for a fiscal year under paragraph (1) shall be provided to the Foundation in an advance payment of the entire amount on October 1, or as soon as practicable thereafter, of the fiscal year.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s10/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Use of appropriated funds.—</heading><content style="-uslm-dtd:text">Subject to paragraph (4), amounts made available under paragraph (1) shall be provided to the Foundation for use for matching, on a 1-to-1 basis, contributions (whether in currency, services, or property) made to the Foundation, or to a recipient of a grant provided by the Foundation, by private persons and State and local government agencies.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s10/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Prohibition on use for administrative expenses.—</heading><content style="-uslm-dtd:text">No Federal funds made available under paragraph (1) shall be used by the Foundation for administrative expenses of the Foundation, including for salaries, travel and transportation expenses, and other overhead expenses.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/98/244/s10/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Additional Authorization.—</heading>
                <paragraph identifier="/us/sComp/98/244/s10/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Amounts from federal agencies.—</heading>
                    <subparagraph identifier="/us/sComp/98/244/s10/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">In addition to the amounts authorized to be appropriated under subsection (a), Federal departments, agencies, or instrumentalities are authorized to provide funds to the Foundation through Federal financial assistance grants, cooperative agreements, participating agreements, and similar instruments used for providing partnership funds, subject to the condition that the amounts are used for purposes that further the conservation and management of fish, wildlife, plants, and other natural resources in accordance with this Act.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s10/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Funding agreements.—</heading><content style="-uslm-dtd:text">Federal departments, agencies, and instrumentalities may enter into a Federal funding agreement with the Foundation for a period of not more than 10 years.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s10/b/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Advances.—</heading><content style="-uslm-dtd:text">Federal departments, agencies, or instrumentalities may, and should when possible, advance amounts described in subparagraph (A) to the Foundation in a lump sum without regard to when the expenses for which the amounts are used are incurred.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s10/b/1/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">Management fees.—</heading><content style="-uslm-dtd:text">The Foundation may assess and collect fees for the management of amounts received under this paragraph.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s10/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Use of amounts accepted from federal agencies.—</heading><content style="-uslm-dtd:text">Federal funds provided to the Foundation under paragraph (1) may be used by the Foundation for matching, in whole or in part, contributions (whether in currency, services, or property) made to the Foundation by private persons, State and local government agencies, and other entities.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s10/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Administration of amounts.—</heading>
                    <subparagraph identifier="/us/sComp/98/244/s10/b/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">In entering into contracts, agreements, or other partnerships pursuant to this Act, a Federal department, agency, or instrumentality shall have discretion to waive any competitive process applicable to the department, agency, or instrumentality for entering into contracts, agreements, or partnerships with the Foundation if the purpose of the waiver is—</chapeau>
                        <clause identifier="/us/sComp/98/244/s10/b/3/A/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">to address an environmental emergency resulting from a natural or other disaster; or</content>
                        </clause>
                        <clause identifier="/us/sComp/98/244/s10/b/3/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">as determined by the head of the applicable Federal department, agency, or instrumentality, to reduce administrative expenses and expedite the conservation and management of fish, wildlife, plants, and other natural resources.</content>
                        </clause>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/98/244/s10/b/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Reports.—</heading><content style="-uslm-dtd:text">The Foundation shall include in the annual report submitted under section 7(b) a description of any use of the authority under subparagraph (A) by a Federal department, agency, or instrumentality in that fiscal year.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/98/244/s10/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Prohibition on Use of Grant Amounts for Litigation and Lobbying Expenses.—</heading><chapeau style="-uslm-dtd:text">Amounts provided as a grant by the Foundation shall not be used for—</chapeau>
                <paragraph identifier="/us/sComp/98/244/s10/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">any expense related to litigation; or</content>
                </paragraph>
                <paragraph identifier="/us/sComp/98/244/s10/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">any activity the purpose of which is to influence legislation pending before Congress.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/98/244/s10/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Use of Gifts, Devises, or Bequests of Money or Other Property.—</heading><content style="-uslm-dtd:text">Any gifts, devises, or bequests of amounts or other property, or any other amounts or other property, transferred to, deposited with, or otherwise in the possession of the Foundation pursuant to this Act, may be made available by the Foundation to Federal departments, agencies, or instrumentalities and may be accepted and expended (or the disposition of the amounts or property directed), without further appropriation, by those Federal departments, agencies, or instrumentalities, subject to the condition that the amounts or property be used for purposes that further the conservation and management of fish, wildlife, plants, and other natural resources.</content>
            </subsection><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s3709">16 U.S.C. 3709</ref><b>]</b> </editorialNote>
        </section>
        <section identifier="/us/sComp/98/244/s11" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="11">SEC. 11. </num><heading style="-uslm-dtd:header">LIMITATION ON AUTHORITY. </heading>
            <content class="block" style="-uslm-dtd:text">Nothing in this Act authorizes the Foundation to perform any function the exclusive authority for which is provided to the National Park Foundation by subchapter II of chapter 1011 of title 54, United States Code.</content><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s3710">16 U.S.C. 3710</ref><b>]</b> </editorialNote>
