    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To authorize the Secretary of the Interior to carry out a program to be known as the Junior Duck Stamp Conservation and Design Program, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
</enactingFormula>
        <section style="-uslm-dtd:section" identifier="/us/sComp/103/340/s1" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t16/s719">16 U.S.C. 719 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content style="-uslm-dtd:text" class="block">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Junior Duck Stamp Conservation and Design Program Act of 1994</inline></shortTitle>”.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/103/340/s2" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t16/s719">16 U.S.C. 719</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ESTABLISHMENT OF PROGRAM. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/340/s2/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">The Secretary of the Interior (in this Act referred to as the “<quotedText style="-uslm-dtd:quote">Secretary</quotedText>”) may carry out in accordance with this Act a program to be known as the “<quotedText style="-uslm-dtd:quote">Junior Duck Stamp Conservation and Design Program</quotedText>” (in this Act referred to as the “<quotedText style="-uslm-dtd:quote">Program</quotedText>”) to accomplish the goals of—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/340/s2/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">providing to school children environmental education opportunities relating to the conservation and management of migratory birds; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/340/s2/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">increasing the capacity for schools, States, and other educational programs to conduct conservation and education programs.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/340/s2/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Program Features.—</heading><chapeau style="-uslm-dtd:text">The Program shall consist of—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/340/s2/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">conducting in all interested States the activities which on the day before the date of the enactment of this Act are conducted under the program known as the Junior Duck Stamp Conservation and Design Program;</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/340/s2/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">other activities authorized under the Program by this or any other Act; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/340/s2/b/3" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">any other activity necessary to carry out the conservation and education goals of the Program.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/340/s2/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Effort To Conduct Program in All States.—</heading>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/340/s2/c/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Secretary shall take appropriate steps to seek to conduct the Program in all of the States.</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/340/s2/c/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Annual report.—</heading><content style="-uslm-dtd:text">The Secretary shall annually submit a report to the Congress on the status of the Program in each of the States.</content>
                </paragraph>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/103/340/s3" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t16/s719a">16 U.S.C. 719a</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">JUNIOR DUCK STAMP. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/340/s3/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Competition.—</heading><chapeau style="-uslm-dtd:text">As part of the Program, the Secretary may annually conduct a competition to—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/340/s3/a/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">solicit the submission by students at elementary and secondary schools of designs relating to conservation of migratory birds; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/340/s3/a/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">select winning designs from among those submissions for use for licensing and marketing under subsection (b).</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/340/s3/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Licensing and Marketing of Design of Junior Duck Stamps.—</heading><chapeau style="-uslm-dtd:text">As part of the Program, the Secretary may—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/340/s3/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">license and market winning designs selected in competitions under subsection (a); and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/340/s3/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">license and market stamps bearing those designs, which shall be known as Junior Duck Stamps.</content>
                </paragraph>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/340/s3/c" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Use of Proceeds.—</heading><chapeau style="-uslm-dtd:text">Amounts received under subsection (b)—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/340/s3/c/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">shall be available to the Secretary until expended, without further appropriations, solely for—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/340/s3/c/1/A" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">awards, prizes, and scholarships to individuals who submit designs in competitions under subsection (a), that are—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/340/s3/c/1/A/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">selected in such a competition as winning designs; or</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/340/s3/c/1/A/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">otherwise determined in such a competition to be superior;</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/340/s3/c/1/B" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">awards and prizes to schools, students, teachers, and other participants to further education activities related to the conservation education goals of the Program;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/340/s3/c/1/C" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">award ceremonies for winners of national and State Junior Duck Stamp competitions;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/340/s3/c/1/D" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><chapeau style="-uslm-dtd:text">travel expenses for winners of national and State Junior Duck Stamp competitions to award ceremonies, if—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/340/s3/c/1/D/i" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the event is intended to honor students for winning a national competition; or</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/103/340/s3/c/1/D/ii" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the event is intended to honor students for winning a State competition;</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/340/s3/c/1/E" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">expenses for licensing and marketing under subsection (b);</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/340/s3/c/1/F" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">expenses for migratory bird reference materials or supplies awarded to schools that participate in the Program; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/103/340/s3/c/1/G" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">expenses for marketing and educational materials developed to promote the Program;<ref style="-uslm-dtd:footnote-ref" idref="IDA4B8AFCA61C145F8AA6A51D11962CEF7" class="footnoteRef">1</ref></content><footnote id="IDA4B8AFCA61C145F8AA6A51D11962CEF7" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">Punctuation so in law.</p></footnote>
                    </subparagraph>
                </paragraph>
            </subsection>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/103/340/s4" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t16/s719b">16 U.S.C. 719b</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ACCEPTANCE OF GIFTS, DEVISES, AND BEQUESTS. </heading>
            <content style="-uslm-dtd:text" class="block">The Secretary may accept and use any gift, devise, or bequest of personal property, or proceeds thereof, for the purpose of funding the activities described in section 3(c)(1) (A) and (B).</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/103/340/s5" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t16/s719b–1">16 U.S.C. 719b–1</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DEFINITION OF STATE. </heading>
            <content style="-uslm-dtd:text" class="block">For the purposes of this Act, the term “<term style="-uslm-dtd:term">State</term>” includes the District of Columbia, the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands, American Samoa, Guam, the Virgin Islands, and any other territory or possession of the United States.</content>
        </section>
        <section style="-uslm-dtd:section" identifier="/us/sComp/103/340/s6" styleType="OLC">
            <num style="-uslm-dtd:enum" value="6">SEC. 6. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t16/s719c">16 U.S.C. 719c</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">AUTHORIZATION OF APPROPRIATIONS. </heading>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/340/s6/a" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Authorization.—</heading><content style="-uslm-dtd:text">There are authorized to be appropriated to the Secretary for administrative expenses of the Program $350,000 for each of the fiscal years 2006 through 2010.</content>
            </subsection>
            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/103/340/s6/b" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Limitations on Use for Distribution to State and Regional Coordinators to Implement Competitions.—</heading><chapeau style="-uslm-dtd:text">Of the amount appropriated under this section for a fiscal year—</chapeau>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/340/s6/b/1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">not more than $100,000 may be used by the Secretary to administer the Program; and</content>
                </paragraph>
                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/103/340/s6/b/2" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">not more than $250,000 may be distributed to State and regional coordinators to implement competitions under the Program.</content>
                </paragraph>
            </subsection>
        </section>
    </main>
