    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To assist in the conservation of Asian elephants by supporting and providing financial resources for the conservation programs of nations within the range of Asian elephants and projects of persons with demonstrated expertise in the conservation of Asian elephants.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
</enactingFormula>
        <section identifier="/us/sComp/105/96/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s4261">16 U.S.C. 4261 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Asian Elephant Conservation Act of 1997</inline></shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/105/96/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s4261">16 U.S.C. 4261</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">FINDINGS. </heading>
            <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">The Congress finds the following:</chapeau>
                <paragraph identifier="/us/sComp/105/96/s2/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Asian elephant populations in nations within the range of Asian elephants have continued to decline to the point that the long-term survival of the species in the wild is in serious jeopardy.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s2/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The Asian elephant is listed as an endangered species under section 4 of the Endangered Species Act of 1973 and under appendix I of the Convention on International Trade of Endangered Species of Wild Fauna and Flora.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s2/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">Because the challenges facing the conservation of Asian elephants are so great, resources to date have not been sufficient to cope with the continued loss of habitat and the consequent diminution of Asian elephant populations.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s2/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">The Asian elephant is a flagship species for the conservation of tropical forest habitats in which it is found and provides the consequent benefit from such conservation to numerous other species of wildlife including many other endangered species.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s2/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">Among the threats to the Asian elephant in addition to habitat loss are population fragmentation, human-elephant conflict, poaching for ivory, meat, hide, bones and teeth, and capture for domestication.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s2/6" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">To reduce, remove, or otherwise effectively address these threats to the long-term viability of populations of Asian elephants in the wild will require the joint commitment and effort of nations within the range of Asian elephants, the United States and other countries, and the private sector.</content>
                </paragraph>
            </subsection>
        </section>
        <section identifier="/us/sComp/105/96/s3" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s4262">16 U.S.C. 4262</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PURPOSES. </heading>
            <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">The purposes of this Act are the following:</chapeau>
                <paragraph identifier="/us/sComp/105/96/s3/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">To perpetuate healthy populations of Asian elephants.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s3/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">To assist in the conservation and protection of Asian elephants by supporting the conservation programs of Asian elephant range states and the CITES Secretariat.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s3/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">To provide financial resources for those programs.</content>
                </paragraph>
            </subsection>
        </section>
        <section identifier="/us/sComp/105/96/s4" role="definitions" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s4263">16 U.S.C. 4263</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
            <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">In this Act:</chapeau>
                <paragraph identifier="/us/sComp/105/96/s4/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">CITES</term>” means the Convention on International Trade in Endangered Species of Wild Fauna and Flora, signed on March 3, 1973, and its appendices.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s4/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">conservation</term>” means the use of methods and procedures necessary to bring Asian elephants to the point at which there are sufficient populations in the wild to ensure that the species does not become extinct, including all activities associated with scientific resource management, such as conservation, protection, restoration, acquisition, and management of habitat; research and monitoring of known populations; assistance in the development of management plans for managed elephant ranges; CITES enforcement; law enforcement through community participation; translocation of elephants; conflict resolution initiatives; and community outreach and education.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s4/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Fund</term>” means the account established by division A, section 101(e), title I of Public Law 105–277 under the heading “<term style="-uslm-dtd:quote"><headingText style="-uslm-dtd:header-in-text">multinational species conservation fund</headingText></term>”.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s4/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Secretary</term>” means the Secretary of the Interior.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s4/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Administrator</term>” means the Administrator of the Agency for International Development.</content>
                </paragraph>
            </subsection>
        </section>
        <section identifier="/us/sComp/105/96/s5" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s4264">16 U.S.C. 4264</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ASIAN ELEPHANT CONSERVATION ASSISTANCE. </heading>
            <subsection identifier="/us/sComp/105/96/s5/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The Secretary, subject to the availability of funds and in consultation with the Administrator, shall use amounts in the Fund to provide financial assistance for projects for the conservation of Asian elephants for which final project proposals are approved by the Secretary in accordance with this section.</content>
            </subsection>
            <subsection identifier="/us/sComp/105/96/s5/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Project Proposal.—</heading><chapeau style="-uslm-dtd:text">Any relevant wildlife management authority of a nation within the range of Asian elephants whose activities directly or indirectly affect Asian elephant populations, the CITES Secretariat, or any person with demonstrated expertise in the conservation of Asian elephants, may submit to the Secretary a project proposal under this section. Each proposal shall include the following:</chapeau>
                <paragraph identifier="/us/sComp/105/96/s5/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The name of the individual responsible for conducting the project.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s5/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">A succinct statement of the purposes of the project.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s5/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">A description of the qualifications of the individuals who will conduct the project.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s5/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">An estimate of the funds and time required to complete the project.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s5/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">Evidence of support of the project by appropriate governmental entities of countries in which the project will be conducted, if the Secretary determines that the support is required for the success of the project.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s5/b/6" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">Information regarding the source and amount of matching funding available to the applicant.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s5/b/7" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">Any other information the Secretary considers to be necessary for evaluating the eligibility of the project for funding under this Act.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/105/96/s5/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Project Review and Approval.—</heading>
                <paragraph identifier="/us/sComp/105/96/s5/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Within 30 days after receiving a final project proposal, the Secretary shall provide a copy of the proposal to the Administrator. The Secretary shall review each final project proposal to determine if it meets the criteria set forth in subsection (d).</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s5/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Consultation; approval or disapproval.—</heading><chapeau style="-uslm-dtd:text">Not later than 6 months after receiving a final project proposal, and subject to the availability of funds, the Secretary, after consulting with the Administrator, shall—</chapeau>
                    <subparagraph identifier="/us/sComp/105/96/s5/c/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">request written comments on the proposal from each country within which the project is to be conducted;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/105/96/s5/c/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">after requesting those comments, approve or disapprove the proposal; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/105/96/s5/c/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">provide written notification of that approval or disapproval to the person who submitted the proposal and the Administrator.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/105/96/s5/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Criteria for Approval.—</heading><chapeau style="-uslm-dtd:text">The Secretary may approve a final project proposal under this section if the project will enhance programs for conservation of Asian elephants by assisting efforts to—</chapeau>
                <paragraph identifier="/us/sComp/105/96/s5/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">implement conservation programs;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s5/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">address the conflicts between humans and elephants that arise from competition for the same habitat;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s5/d/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">enhance compliance with provisions of CITES and laws of the United States or a foreign country that prohibit or regulate the taking or trade of Asian elephants or regulate the use and management of Asian elephant habitat;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s5/d/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">develop sound scientific information on the condition of Asian elephant habitat, Asian elephant population numbers and trends, or the threats to such habitat, numbers, or trends; or</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s5/d/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">promote cooperative projects on those topics with other foreign governments, affected local communities, nongovernmental organizations, or others in the private sector.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/105/96/s5/e" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Project Sustainability.—</heading><content style="-uslm-dtd:text">To the maximum extent practical, in determining whether to approve project proposals under this section, the Secretary shall give consideration to projects which will enhance sustainable integrated conservation development programs to ensure effective, long-term conservation of Asian elephants.</content>
            </subsection>
            <subsection identifier="/us/sComp/105/96/s5/f" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Project Reporting.—</heading><content style="-uslm-dtd:text">Each person who receives assistance under this section for a project shall provide periodic reports, as the Secretary considers necessary, to the Secretary and the Administrator. Each report shall include all information required by the Secretary, after consulting with the Administrator, for evaluating the progress and success of the project.</content>
            </subsection>
            <subsection identifier="/us/sComp/105/96/s5/g" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Matching Funds.—</heading><content style="-uslm-dtd:text">In determining whether to approve project proposals under this section, the Secretary shall give priority to those projects for which there exists some measure of matching funds.</content>
            </subsection>
            <subsection identifier="/us/sComp/105/96/s5/h" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="h">(h) </num><heading style="-uslm-dtd:header">Limitation on Use for Captive Breeding.—</heading><content style="-uslm-dtd:text">Amounts provided as a grant under this Act may not be used for captive breeding of Asian elephants other than for release in the wild.</content>
            </subsection>
            <subsection identifier="/us/sComp/105/96/s5/i" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Multiyear Grants.—</heading>
                <paragraph identifier="/us/sComp/105/96/s5/i/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Authorization.—</heading><content style="-uslm-dtd:text">The Secretary may award to a person who is otherwise eligible for a grant under this section a multiyear grant of up to 5 years to carry out a project that the person demonstrates is an effective, long-term conservation strategy for Asian elephants and the habitat of Asian elephants.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s5/i/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Effect.—</heading><content style="-uslm-dtd:text">Nothing in this subsection precludes the Secretary from awarding a grant on an annual basis.</content>
                </paragraph>
            </subsection>
        </section>
        <section identifier="/us/sComp/105/96/s6" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="6">SEC. 6. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s4265">16 U.S.C. 4265</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ACCEPTANCE AND USE OF DONATIONS. </heading>
            <content class="block" style="-uslm-dtd:text">The Secretary may accept and use donations to provide assistance under section 5. Amounts received by the Secretary in the form of donations shall be transferred to the Secretary of the Treasury for deposit into the Fund.</content>
        </section>
        <section identifier="/us/sComp/105/96/s7" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="7">SEC. 7. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s4265a">16 U.S.C. 4265a</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ADVISORY GROUP. </heading>
            <subsection identifier="/us/sComp/105/96/s7/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">To assist in carrying out this Act, the Secretary may convene an advisory group consisting of individuals representing public and private organizations actively involved in the conservation of Asian elephants.</content>
            </subsection>
            <subsection identifier="/us/sComp/105/96/s7/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Public Participation.—</heading>
                <paragraph identifier="/us/sComp/105/96/s7/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Meetings.—</heading><chapeau style="-uslm-dtd:text">The Advisory Group shall—</chapeau>
                    <subparagraph identifier="/us/sComp/105/96/s7/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">ensure that each meeting of the advisory group is open to the public; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/105/96/s7/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">provide, at each meeting, an opportunity for interested persons to present oral or written statements concerning items on the agenda.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s7/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Notice.—</heading><content style="-uslm-dtd:text">The Secretary shall provide to the public timely notice of each meeting of the advisory group.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/105/96/s7/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Minutes.—</heading><content style="-uslm-dtd:text">Minutes of each meeting of the advisory group shall be kept by the Secretary and shall be made available to the public.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/105/96/s7/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Exemption From Chapter 10 of Title 5, United States Code.—</heading><content style="-uslm-dtd:text">Chapter 10 of title 5, United States Code, shall not apply to the advisory group.</content>
            </subsection>
        </section>
        <section identifier="/us/sComp/105/96/s8" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="8">SEC. 8. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s4266">16 U.S.C. 4266</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">AUTHORIZATION OF APPROPRIATIONS. </heading>
            <subsection identifier="/us/sComp/105/96/s8/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">There is authorized to be appropriated to the Fund $5,000,000 for each of fiscal years 2025 through 2029 to carry out this Act, which may remain available until expended.</content>
            </subsection>
            <subsection identifier="/us/sComp/105/96/s8/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Administrative Expenses.—</heading><content style="-uslm-dtd:text">Of amounts available each fiscal year to carry out this Act, the Secretary may expend not more than 3 percent or $100,000, whichever is greater, to pay the administrative expenses necessary to carry out this Act.</content>
            </subsection>
