    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To authorize a study of the fishery resources of the Great Lakes, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

        <title identifier="/us/sComp/101/537/tI" style="-uslm-dtd:title" styleType="OLC">
            <num style="-uslm-dtd:enum" value="I">TITLE I—</num><heading style="-uslm-dtd:header">GREAT LAKES FISH AND WILDLIFE RESTORATION </heading>
            <section identifier="/us/sComp/101/537/tI/s1001" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1001">SECTION 1001. </num><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
                <content class="block" style="-uslm-dtd:text">This title may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Great Lakes Fish and Wildlife Restoration Act of 1990</inline></shortTitle>”.</content><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s941">16 U.S.C. 941</ref> nt<b>]</b> </editorialNote>

                <num style="-uslm-dtd:enum" value="1002">SEC. 1002. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s941">16 U.S.C. 941</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">FINDINGS. </heading>
                <chapeau class="block" style="-uslm-dtd:text">Congress finds that—</chapeau>
                <paragraph identifier="/us/sComp/101/537/tI/s1002/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the Great Lakes have fish and wildlife communities that are structurally and functionally changing;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/101/537/tI/s1002/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">successful fish and wildlife management focuses on the lakes as ecosystems, and effective management requires the coordination and integration of efforts of many partners;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/101/537/tI/s1002/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">additional actions and better coordination are needed to protect and effectively manage the fish and wildlife resources, and the habitats on which the resources depend, in the Great Lakes Basin; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/101/537/tI/s1002/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">this Act allows Federal agencies, States, and Indian tribes to work in an effective partnership by providing the funding for restoration work.</content>
                </paragraph>
            </section>
            <section identifier="/us/sComp/101/537/tI/s1003" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1003">SEC. 1003. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s941a">16 U.S.C. 941a</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">PURPOSE. </heading>
                <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">The purposes of this title are—</chapeau>
                    <paragraph identifier="/us/sComp/101/537/tI/s1003/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">to develop and implement proposals for the restoration of fish and wildlife resources in the Great Lakes Basin; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1003/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to provide assistance to the Great Lakes Fisheries Commission, States, Indian Tribes, and other interested entities to encourage cooperative conservation, restoration and management of the fish and wildlife resources and their habitat in the Great Lakes Basin.</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/101/537/tI/s1004" role="definitions" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1004">SEC. 1004. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s941b">16 U.S.C. 941b</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
                <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">In this title—</chapeau>
                    <paragraph identifier="/us/sComp/101/537/tI/s1004/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">Committee</term>” means the Great Lakes Fish and Wildlife Restoration Proposal Review Committee established by section 1005(c);</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1004/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">Director</term>” means the Director of the United States Fish and Wildlife Service;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1004/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">Great Lakes Basin</term>” means the air, land, water, and living organisms within the drainage basin of the Saint Lawrence River at or upstream from the point at which the river becomes the international boundary between Canada and the United States;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1004/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">Indian Tribe</term>” means any Indian tribe, band, village, nation, or other organized group or community that  is recognized by the Bureau of Indian Affairs as eligible for the special programs and services provided by the United States to Indians because of their status as  Indians, and that has Great Lakes fish and wildlife management authority in the Great Lakes Basin;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1004/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">lower Great Lakes</term>” means the region in which is located that portion of the Great Lakes Basin which is downstream from the confluence of the Saint Clair River and Lake Huron near Port Huron, Michigan;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1004/6" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">non-Federal source</term>” includes a State government, local government, Indian tribe, other non-Federal governmental entity, private entity, and individual;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1004/7" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">nonindigenous species</term>” means a species of plant, animal, or other organism that did not occur in the  Great Lake Basin before European colonization of North America;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1004/8" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">regional project</term>” means authorized activities of the United States Fish and Wildlife Service related to fish and wildlife resource protection, restoration, maintenance, and enhancement impacting multiple States or Indian Tribes with fish and wildlife management authority in the Great Lakes basin;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1004/9" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="9">(9) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">Report</term>” means the United States Fish and Wildlife Service report entitled “<term style="-uslm-dtd:quote">Great Lakes Fishery Resources Restoration Study</term>”,  submitted to the President of the Senate and the Speaker of the House of Representatives on September 13, 1995;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1004/10" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="10">(10) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">restoration</term>” means rehabilitation and maintenance of the structure, function, diversity, and dynamics of a biological system, including   reestablishment of self-sustaining populations of fish and wildlife;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1004/11" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="11">(11) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">State Director</term>” means the head of the agency, department, board, commission, or other governmental entity of each of the States of New York, Ohio, Indiana, Illinois, Michigan, Wisconsin, Minnesota, and the Commonwealth of Pennsylvania which is responsible for the management and conservation of the fish and wildlife resources of that State; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1004/12" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="12">(12) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">upper Great Lakes</term>” means that portion of the Great Lakes Basin which is upstream from the confluence of the Saint Clair River and Lake Huron near Port Huron, Michigan.</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/101/537/tI/s1005" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1005">SEC. 1005. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s941c">16 U.S.C. 941c</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">IDENTIFICATION, REVIEW, AND IMPLEMENTATION OF PROPOSALS AND REGIONAL PROJECTS. </heading>
                <subsection identifier="/us/sComp/101/537/tI/s1005/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">Subject to subsection (b)(2), the Director—</chapeau>
                    <paragraph identifier="/us/sComp/101/537/tI/s1005/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">shall encourage the development and, subject to the availability of appropriations, the implementation of fish and wildlife restoration proposals and regional projects based on the results of the Report; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1005/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in cooperation with the State Directors and Indian Tribes, shall identify, develop, and, subject to the availability of appropriations, implement regional projects in the Great Lakes Basin to be administered by Director in accordance with this section.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/101/537/tI/s1005/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Identification of Proposals and Regional Projects.—</heading>
                    <paragraph identifier="/us/sComp/101/537/tI/s1005/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Request by the director.—</heading><content style="-uslm-dtd:text">The Director shall annually request that State Directors and Indian Tribes, in cooperation or partnership with other interested entities and in accordance with subsection (a), submit proposals or regional projects for the restoration of fish and wildlife resources.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1005/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Requirements for proposals and regional projects.—</heading><chapeau style="-uslm-dtd:text">A proposal or regional project under paragraph (1) shall be—</chapeau>
                        <subparagraph identifier="/us/sComp/101/537/tI/s1005/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">submitted in the manner and form prescribed by the Director; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/101/537/tI/s1005/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">consistent with—</chapeau>
                            <clause identifier="/us/sComp/101/537/tI/s1005/b/2/B/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the goals of the Great Lakes Water Quality Agreement, as amended;</content>
                            </clause>
                            <clause identifier="/us/sComp/101/537/tI/s1005/b/2/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the 1954 Great Lakes Fisheries Convention;</content>
                            </clause>
                            <clause identifier="/us/sComp/101/537/tI/s1005/b/2/B/iii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">the 1980 Joint Strategic Plan for Management of Great Lakes Fisheries, as revised in 1997, and Fish Community Objectives for each Great Lake and connecting water as established under the Joint Strategic Plan;</content>
                            </clause>
                            <clause identifier="/us/sComp/101/537/tI/s1005/b/2/B/iv" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (16 U.S.C. 4701 et seq.);</content>
                            </clause>
                            <clause identifier="/us/sComp/101/537/tI/s1005/b/2/B/v" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">the North American Waterfowl Management Plan and joint ventures established under the plan; </content>
                            </clause>
                            <clause identifier="/us/sComp/101/537/tI/s1005/b/2/B/vi" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="vi">(vi) </num><content style="-uslm-dtd:text">the strategies outlined through the Great Lakes Regional Collaboration authorized under Executive Order 13340 (69 Fed. Reg. 29043; relating to the Great Lakes Interagency Task Force);</content>
                            </clause>
                            <clause identifier="/us/sComp/101/537/tI/s1005/b/2/B/vii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="vii">(vii) </num><content style="-uslm-dtd:text">the strategic action plan of the Great Lakes Restoration Initiative; and</content>
                            </clause>
                            <clause identifier="/us/sComp/101/537/tI/s1005/b/2/B/viii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="viii">(viii) </num><content style="-uslm-dtd:text">each applicable State wildlife action plan.</content>
                            </clause>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1005/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Sea lamprey authority.—</heading><content style="-uslm-dtd:text">The Great Lakes Fishery Commission shall retain authority and responsibility to formulate and implement a comprehensive program to eradicate or minimize sea lamprey populations in the Great Lakes Basin.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/101/537/tI/s1005/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Review of Proposals.—</heading>
                    <paragraph identifier="/us/sComp/101/537/tI/s1005/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Establishment of committee.—</heading><content style="-uslm-dtd:text">There is established the Great Lakes Fish and Wildlife Restoration Proposal Review Committee, which shall operate under the guidance of the United States Fish and Wildlife Service.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1005/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Membership and appointment.—</heading>
                        <subparagraph identifier="/us/sComp/101/537/tI/s1005/c/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The Committee shall consist of 2 representatives of each of the State Directors and Indian Tribes, of whom—</chapeau>
                            <clause identifier="/us/sComp/101/537/tI/s1005/c/2/A/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">1 representative shall be the individual appointed by the State Director or Indian Tribe to the Council of Lake Committees of the Great Lakes Fishery Commission; and</content>
                            </clause>
                            <clause identifier="/us/sComp/101/537/tI/s1005/c/2/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">1 representative shall have expertise in wildlife management.</content>
                            </clause>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/101/537/tI/s1005/c/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Appointments.—</heading><content style="-uslm-dtd:text">Each representative shall serve at the pleasure of the appointing State Director or Tribal Chair.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/101/537/tI/s1005/c/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Observer.—</heading><content style="-uslm-dtd:text">The  United States Fish and Wildlife Service shall participate as an observer of the Committee.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/101/537/tI/s1005/c/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">Recusal.—</heading><content style="-uslm-dtd:text">A member of the Committee shall recuse himself or herself from consideration of proposals that the member, or the entity that the member represents, has submitted.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1005/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Functions.—</heading><chapeau style="-uslm-dtd:text">The Committee shall—</chapeau>
                        <subparagraph identifier="/us/sComp/101/537/tI/s1005/c/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">meet at least annually;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/101/537/tI/s1005/c/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">review proposals and regional projects developed in accordance with subsection (b) to assess the effectiveness and appropriateness of the proposals and regional projects in fulfilling the purposes of this title; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/101/537/tI/s1005/c/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">recommend to the Director any of those proposals and regional projects that should be funded and implemented under this section.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/101/537/tI/s1005/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Implementation of Proposals and Regional Projects.—</heading>
                    <paragraph identifier="/us/sComp/101/537/tI/s1005/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">After considering recommendations of the Committee and the goals specified in section 1006, the Director shall—</chapeau>
                        <subparagraph identifier="/us/sComp/101/537/tI/s1005/d/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">select proposals and regional projects to be implemented; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/101/537/tI/s1005/d/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">subject to the availability of appropriations and subsection (e), fund implementation of the proposals and regional projects.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1005/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Selection criteria.—</heading><content style="-uslm-dtd:text">In selecting and funding proposals and regional projects, the Director shall take into account the effectiveness and appropriateness of the proposals and regional projects in fulfilling the purposes of other laws applicable to restoration of the fish and wildlife resources and habitat of the Great Lakes Basin.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/101/537/tI/s1005/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Cost Sharing.—</heading>
                    <paragraph identifier="/us/sComp/101/537/tI/s1005/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading>
                        <subparagraph identifier="/us/sComp/101/537/tI/s1005/e/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Non-federal share.—</heading><content style="-uslm-dtd:text">Except as provided in paragraphs (3) and (5) and subject to paragraph (2), not less than 25 percent of the cost of implementing a proposal or regional project
 selected under subsection (d) (excluding the cost of establishing sea lamprey barriers) shall be paid in cash or in-kind contributions by non-Federal sources.</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/101/537/tI/s1005/e/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Time period for providing match.—</heading><content style="-uslm-dtd:text">The non-Federal share of the cost of implementing a proposal or regional project required under subparagraph (A) may be provided at any time during the 2-year period preceding January 1 of the year in which the Director receives the application for the proposal or regional project.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1005/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Authorized sources of non-federal share.—</heading>
                        <subparagraph identifier="/us/sComp/101/537/tI/s1005/e/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The Director may determine the non-Federal share under paragraph (1) by taking into account—</chapeau>
                            <clause identifier="/us/sComp/101/537/tI/s1005/e/2/A/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the appraised value of land or a conservation easement as described in subparagraph (B); or</content>
                            </clause>
                            <clause identifier="/us/sComp/101/537/tI/s1005/e/2/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><chapeau style="-uslm-dtd:text">as described in subparagraph (C), the costs associated with—</chapeau>
                                <subclause identifier="/us/sComp/101/537/tI/s1005/e/2/A/ii/I" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">securing a conservation easement; and</content>
                                </subclause>
                                <subclause identifier="/us/sComp/101/537/tI/s1005/e/2/A/ii/II" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">restoration or enhancement of the conservation easement.</content>
                                </subclause>
                            </clause>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/101/537/tI/s1005/e/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Appraisal of conservation easement.—</heading>
                            <clause identifier="/us/sComp/101/537/tI/s1005/e/2/B/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The value of a conservation easement may be used to satisfy the non-Federal share of the cost of implementing a proposal or regional project required under paragraph (1)(A) if the Director determines that the conservation easement—</chapeau>
                                <subclause identifier="/us/sComp/101/537/tI/s1005/e/2/B/i/I" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">meets the requirements of subsection (b)(2);</content>
                                </subclause>
                                <subclause identifier="/us/sComp/101/537/tI/s1005/e/2/B/i/II" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">is acquired before the end of the grant period of the proposal or regional project;</content>
                                </subclause>
                                <subclause identifier="/us/sComp/101/537/tI/s1005/e/2/B/i/III" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="III">(III) </num><content style="-uslm-dtd:text">is held in perpetuity for the conservation purposes of the programs of the United States Fish and Wildlife Service related to the Great Lakes Basin, as described in section 1006, by an accredited land trust or conservancy or a Federal, State, or tribal agency;</content>
                                </subclause>
                                <subclause identifier="/us/sComp/101/537/tI/s1005/e/2/B/i/IV" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="IV">(IV) </num><content style="-uslm-dtd:text">is connected either physically or through a conservation planning process to the proposal or regional project; and</content>
                                </subclause>
                                <subclause identifier="/us/sComp/101/537/tI/s1005/e/2/B/i/V" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="V">(V) </num><content style="-uslm-dtd:text">is appraised in accordance with clause (ii).</content>
                                </subclause>
                            </clause>
                            <clause identifier="/us/sComp/101/537/tI/s1005/e/2/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">Appraisal.—</heading><chapeau style="-uslm-dtd:text">With respect to the appraisal of a conservation easement described in clause (i)—</chapeau>
                                <subclause identifier="/us/sComp/101/537/tI/s1005/e/2/B/ii/I" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">the appraisal valuation date shall be not later than 1 year after the price of the conservation easement was set under a contract; and</content>
                                </subclause>
                                <subclause identifier="/us/sComp/101/537/tI/s1005/e/2/B/ii/II" style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><chapeau style="-uslm-dtd:text">the appraisal shall—</chapeau>
                                    <item identifier="/us/sComp/101/537/tI/s1005/e/2/B/ii/II/aa" style="-uslm-dtd:item" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="aa">(aa) </num><content style="-uslm-dtd:text">conform to the Uniform Standards of Professional Appraisal Practice (USPAP); and</content>
                                    </item>
                                    <item identifier="/us/sComp/101/537/tI/s1005/e/2/B/ii/II/bb" style="-uslm-dtd:item" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="bb">(bb) </num><content style="-uslm-dtd:text">be completed by a Federal- or State-certified appraiser.</content>
                                    </item>
                                </subclause>
                            </clause>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/101/537/tI/s1005/e/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Costs of securing conservation easements.—</heading>
                            <clause identifier="/us/sComp/101/537/tI/s1005/e/2/C/i" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">All costs associated with securing a conservation easement and restoration or enhancement of that conservation easement may be used to satisfy the non-Federal share of the cost of implementing a proposal or regional project required under paragraph (1)(A) if the activities and expenses associated with securing the conservation easement and restoration or enhancement of that conservation easement meet the requirements of subparagraph (B)(i).</content>
                            </clause>
                            <clause identifier="/us/sComp/101/537/tI/s1005/e/2/C/ii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">Inclusion.—</heading><content style="-uslm-dtd:text">The costs referred to in clause (i) may include cash, in-kind contributions, and indirect costs.</content>
                            </clause>
                            <clause identifier="/us/sComp/101/537/tI/s1005/e/2/C/iii" style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><heading style="-uslm-dtd:header">Exclusion.—</heading><content style="-uslm-dtd:text">The costs referred to in clause (i) may not be costs associated with mitigation or litigation (other than costs associated with the Natural Resource Damage Assessment program).</content>
                            </clause>
                        </subparagraph>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1005/e/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Regional projects.—</heading><content style="-uslm-dtd:text">Regional projects selected under subsection (d) shall be exempt from cost sharing if the Director determines that the authorization for the project does not require a non-Federal cost-share.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1005/e/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Exclusion of federal funds from non-federal share.—</heading><content style="-uslm-dtd:text">The Director may not consider the expenditure, directly or indirectly, of Federal funds received by any entity to be a contribution by a non-Federal source for purposes of this subsection.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1005/e/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Effect on certain indian tribes.—</heading><content style="-uslm-dtd:text">Nothing in this subsection affects an Indian tribe affected by an alternative applicable cost sharing requirement under the Indian Self-Determination and Education Assistance Act (25 U.S.C. 450 et seq.).</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/101/537/tI/s1006" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1006">SEC. 1006. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s941d">16 U.S.C. 941d</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">GOALS OF UNITED STATES FISH AND WILDLIFE SERVICE PROGRAMS RELATED TO GREAT LAKES FISH AND WILDLIFE RESOURCES. </heading>
                <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">In administering programs of the United States Fish and Wildlife Service related to the Great Lakes Basin, the Director shall seek to achieve the following goals:</chapeau>
                    <paragraph identifier="/us/sComp/101/537/tI/s1006/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Restoring and maintaining self-sustaining fish and wildlife resources.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1006/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Minimizing the impacts of contaminants on fishery and wildlife resources.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1006/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">Protecting, maintaining, and, where degraded and destroyed, restoring fish and wildlife habitat, including the enhancement and creation of wetlands that result in a net gain in the amount of those habitats.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1006/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">Stopping illegal activities adversely impacting fishery and wildlife resources.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1006/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">Restoring threatened and endangered species to viable, self-sustaining levels.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1006/6" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">Protecting, managing, and conserving migratory birds.</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/101/537/tI/s1007" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1007">SEC. 1007. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s941e">16 U.S.C. 941e</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ESTABLISHMENT OF OFFICES. </heading>
                <subsection identifier="/us/sComp/101/537/tI/s1007/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Lower Great Lakes Fish and Wildlife Conservation Office.—</heading>
                    <paragraph identifier="/us/sComp/101/537/tI/s1007/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Director shall establish an office with necessary administrative and technical support services to carry out all United States Fish and Wildlife Service operational activities related to fishery resource protection, restoration, maintenance, and enhancement in the Lower Great Lakes.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1007/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Name and location.—</heading><content style="-uslm-dtd:text">The office shall be known as the “<quotedText style="-uslm-dtd:quote">Lower Great Lakes Fish and Wildlife Conservation Office</quotedText>”, and shall be centrally located in the lower Great Lakes so as to facilitate fishery resource restoration and enhancement activities relating to the lower Great Lakes.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1007/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Responsibilities.—</heading><content style="-uslm-dtd:text">The responsibilities of the Lower Great Lakes Fish and Wildlife Conservation Office shall include operational activities of the United States Fish and Wildlife Service related to fishery resource protection, restoration, maintenance, and enhancement in the Lower Great Lakes.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/101/537/tI/s1007/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Upper Great Lakes Fish and Wildlife Conservation Offices.—</heading>
                    <paragraph identifier="/us/sComp/101/537/tI/s1007/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Director shall establish one or more offices with necessary administrative and technical support services to carry out United States Fish and Wildlife Service operational activities related to fishery resource protection, restoration, maintenance, and enhancement in the upper Great Lakes.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1007/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Name and location.—</heading><content style="-uslm-dtd:text">Each of the offices shall be known as an “<quotedText style="-uslm-dtd:quote">Upper Great Lakes Fish and Wildlife Conservation Office</quotedText>”, and shall be appropriately located so as to facilitate fishery resource activities in the upper Great Lakes.</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1007/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Responsibilities.—</heading><content style="-uslm-dtd:text">The responsibilities of the Upper Great Lakes Fish and Wildlife Conservation Offices shall include operational activities of the United States Fish and Wildlife Service related to fishery resource protection, restoration, maintenance, and enhancement in the Upper Great Lakes.</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/101/537/tI/s1008" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1008">SEC. 1008. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s941f">16 U.S.C. 941f</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">REPORTS. </heading>
                <subsection identifier="/us/sComp/101/537/tI/s1008/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">Not later than December 31, 2021, and not later than December 31, 2027, the Director shall submit to the Committee on Natural Resources of the House of Representatives and the Committee on Environment and Public Works of the Senate a report that describes, with respect to the period covered by the report—</chapeau>
                    <paragraph identifier="/us/sComp/101/537/tI/s1008/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">actions taken to solicit and review proposals under section 1005;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1008/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the results of proposals implemented under section 1005; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1008/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">progress toward the accomplishment of the goals specified in section 1006.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/101/537/tI/s1008/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Public Access to Data.—</heading><chapeau style="-uslm-dtd:text">For each of fiscal years 2023 through 2028, the Director shall make available through a public access website of the Department information that describes—</chapeau>
                    <paragraph identifier="/us/sComp/101/537/tI/s1008/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">actions taken to solicit and review proposals under section 1005;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1008/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the results of proposals implemented under section 1005;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1008/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">progress toward the accomplishment of the goals specified in section 1006;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1008/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">the priorities proposed for funding in the annual budget process under this title; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1008/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">actions taken in support of the Great Lakes Restoration Initiative Action Plan based on the recommendations of the Great Lakes Regional Collaboration authorized under Executive Order 13340 (69 Fed. Reg. 29043; relating to the Great Lakes Interagency Task Force).</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/101/537/tI/s1008/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Continued Monitoring and Assessment of Study Findings and Recommendations.—</heading><chapeau style="-uslm-dtd:text">The Director—</chapeau>
                    <paragraph identifier="/us/sComp/101/537/tI/s1008/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">shall continue to monitor the status, and the assessment, management, and restoration needs, of the fish and wildlife resources of the Great Lakes Basin; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/101/537/tI/s1008/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">may reassess and update, as necessary, the findings and recommendations of the Report.</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/101/537/tI/s1009" style="-uslm-dtd:section" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1009">SEC. 1009. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t16/s941g">16 U.S.C. 941g</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">AUTHORIZATION OF APPROPRIATIONS. </heading>
                <subsection identifier="/us/sComp/101/537/tI/s1009/a" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">
(a) </num><heading style="-uslm-dtd:header">Authorization.—</heading><chapeau style="-uslm-dtd:text">There are authorized to be appropriated to the Director for each of fiscal years 2023 through 2028—</chapeau>
                    <paragraph identifier="/us/sComp/101/537/tI/s1009/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">$6,000,000 to implement fish and wildlife restoration proposals as selected by the Director under section 1005(e), of which—</chapeau>
                        <subparagraph identifier="/us/sComp/101/537/tI/s1009/a/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">not more than the lesser of 33 1/3 percent or $2,000,000 may be allocated to implement regional projects by the United States Fish and Wildlife Service, as selected by the Director under section 1005(e); and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/101/537/tI/s1009/a/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the lesser of 3 percent or $300,000 shall be allocated to the United States Fish and Wildlife Service to cover costs incurred in administering the proposals by any entity; and</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph class="leftIndentIncrease1" identifier="/us/sComp/101/537/tI/s1009/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">$2,000,000, which shall be allocated for the activities of the Upper Great Lakes Fish and Wildlife Conservation Offices and the Lower Great Lakes Fish and Wildlife Conservation Office under section 1007.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/101/537/tI/s1009/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Prohibition on Use of Funds for Federal Acquisition of Interests in Land.—</heading><content style="-uslm-dtd:text">No funds appropriated or used to carry out this Act may be used for acquisition by the Federal Government of any interest in land.</content>
