            <num style="-uslm-dtd:enum" value="II">TITLE II—</num><heading style="-uslm-dtd:header">TRADE PREFERENCE FOR THE ANDEAN REGION </heading>
            <section style="-uslm-dtd:section" identifier="/us/sComp/102/182/tII/s201" styleType="OLC">
                <num style="-uslm-dtd:enum" value="201">SEC. 201. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t19/s3201">19 U.S.C. 3201 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
                <content style="-uslm-dtd:text" class="block">This title may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Andean Trade Preference Act</inline></shortTitle>”.</content>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/102/182/tII/s202" styleType="OLC">
                <num style="-uslm-dtd:enum" value="202">SEC. 202. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t19/s3201">19 U.S.C. 3201</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">AUTHORITY TO GRANT DUTY-FREE TREATMENT. </heading>
                <content style="-uslm-dtd:text" class="block">The President may proclaim duty-free treatment (or other preferential treatment) for all eligible articles from any beneficiary country in accordance with the provisions of this title.</content>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/102/182/tII/s203" styleType="OLC">
                <num style="-uslm-dtd:enum" value="203">SEC. 203. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t19/s3202">19 U.S.C. 3202</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">BENEFICIARY COUNTRY. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/102/182/tII/s203/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">For purposes of this title—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/a/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">beneficiary country</term>” means any country listed in subsection (b)(1) with respect to which there is in effect a proclamation by the President designating such country as a beneficiary country for purposes of this title.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/a/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">entered</term>” means entered, or withdrawn from wareh ouse for consumption, in the customs territory of the United States.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/a/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">HTS</term>” means Harmonized Tariff Schedule of the United States.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/102/182/tII/s203/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Countries Eligible for Designation; Congressional Notification.—</heading><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/b/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">In designating countries as beneficiary countries under this title, the President shall consider only the following countries or successor political entities:</content></paragraph><continuation><p style="-uslm-dtd:continuation-text" role="subparagraph">Bolivia</p><p style="-uslm-dtd:continuation-text" role="subparagraph">Ecuador</p><p style="-uslm-dtd:continuation-text" role="subparagraph">Colombia</p><p style="-uslm-dtd:continuation-text" role="subparagraph">Peru.</p></continuation>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/b/2" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Before the President designates any country as a beneficiary country for purposes of this title, he shall notify the House of Representatives and the Senate of his intention to make such designation, together with the considerations entering into such decision.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/102/182/tII/s203/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Limitations on Designation.—</heading><chapeau style="-uslm-dtd:text">The President shall not designate any country a beneficiary country under this title—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/c/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">if such country is a Communist country;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/c/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">if such country—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s203/c/2/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">has nationalized, expropriated or otherwise seized ownership or control of property owned by a United States citizen or by a corporation, partnership, or association which is 50 percent or more beneficially owned by United States citizens,</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s203/c/2/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">has taken steps to repudiate or nullify—</chapeau>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s203/c/2/B/i" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">any existing contract or agreement with, or</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s203/c/2/B/ii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">any patent, trademark, or other intellectual property of,</content>
                            </clause><continuation style="-uslm-dtd:continuation-text" role="subparagraph">a United States citizen or a corporation, partnership, or association, which is 50 percent or more beneficially owned by United States citizens, the effect of which is to nationalize, expropriate, or otherwise seize ownership or control of property so owned, or</continuation>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s203/c/2/C" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><chapeau style="-uslm-dtd:text">has imposed or enforced taxes or other exactions, restrictive maintenance or operational conditions, or other measures with respect to property so owned, the effect of which is to nationalize, expropriate, or otherwise seize ownership or control of such property, unless the President determines that—</chapeau>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s203/c/2/C/i" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">prompt, adequate, and effective compensation has been or is being made to such citizen, corporation, partnership, or association,</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s203/c/2/C/ii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">good-faith negotiations to provide prompt, adequate, and effective compensation under the applicable provisions of international law are in progress, or such country is otherwise taking steps to discharge its obligations under international law with respect to such citizen, corporation, partnership, or association, or</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s203/c/2/C/iii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">a dispute involving such citizen, corporation, partnership, or association, over compensation for such a seizure has been submitted to arbitration under the provisions of the Convention for the Settlement of Investment Disputes, or in another mutually agreed upon forum, and</content>
                            </clause><continuation style="-uslm-dtd:continuation-text" role="subparagraph">promptly furnishes a copy of such determination to the Senate and House of Representatives;</continuation>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/c/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">if such country fails to act in good faith in recognizing as binding or in enforcing arbitral awards in favor of United States citizens or a corporation, partnership, or association which is 50 percent or more beneficially owned by United States citizens, which have been made by arbitrators appointed for each case or by permanent arbitral bodies to which the parties involved have submitted their dispute;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/c/4" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><chapeau style="-uslm-dtd:text">if such country affords preferential treatment to the products of a developed country, other than the United States, and if such preferential treatment has, or is likely to have, a significant adverse effect on United States commerce, unless the President—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s203/c/4/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">has received assurances satisfactory to him that such preferential treatment will be eliminated or that action will be taken to assure that there will be no such significant adverse effect, and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s203/c/4/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">reports those assurances to the Congress;</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/c/5" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">if a government-owned entity in such country engages in the broadcast of copyrighted material, including films or television material, belonging to United States copyright owners without their express consent or such country fails to work towards the provision of adequate and effective protection of intellectual property rights;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/c/6" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">unless such country is a signatory to a treaty, convention, protocol, or other agreement regarding the extradition of United States citizens; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/c/7" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">if such country has not or is not taking steps to afford internationally recognized worker rights (as defined in section 507(4) of the Trade Act of 1974) to workers in the country (including any designated zone in that country).</content>
                    </paragraph><continuation style="-uslm-dtd:continuation-text" role="subsection">Paragraphs (1), (2), (3), (5), and (7) shall not prevent the designation of any country as a beneficiary country under this title if the President determines that such designation will be in the national economic or security interest of the United States and reports such determination to the Congress with his reasons therefor.</continuation>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/102/182/tII/s203/d" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Factors Affecting Designation.—</heading><chapeau style="-uslm-dtd:text">In determining whether to designate any country a beneficiary country under this title, the President shall take into account—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/d/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">an expression by such country of its desire to be so designated;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/d/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the economic conditions in such country, the living standards of its inhabitants, and any other economic factors which he deems appropriate;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/d/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the extent to which such country has assured the United States it will provide equitable and reasonable access to the markets and basic commodity resources of such country;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/d/4" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">the degree to which such country follows the accepted rules of international trade provided for under the WTO Agreement and the multilateral trade agreements (as such terms are defined in paragraphs (9) and (4), respectively, of section 2 of the Uruguay Round Agreements Act);</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/d/5" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">the degree to which such country uses export subsidies or imposes export performance requirements or local content requirements which distort international trade;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/d/6" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">the degree to which the trade policies of such country as they relate to other beneficiary countries are contributing to the revitalization of the region;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/d/7" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">the degree to which such country is undertaking self-help measures to protect its own economic development;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/d/8" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">whether or not such country has taken or is taking steps to afford to workers in that country (including any designated zone in that country) internationally recognized worker rights;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/d/9" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="9">(9) </num><content style="-uslm-dtd:text">the extent to which such country provides under its law adequate and effective means for foreign nationals to secure, exercise, and enforce exclusive rights in intellectual property, including patent, trademark, and copyright rights;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/d/10" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="10">(10) </num><content style="-uslm-dtd:text">the extent to which such country prohibits its nationals from engaging in the broadcast of copyrighted material, including films or television material, belonging to United States copyright owners without their express consent;</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/d/11" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="11">(11) </num><content style="-uslm-dtd:text">whether such country has met the narcotics cooperation certification criteria set forth in section 490 of the Foreign Assistance Act of 1961 for eligibility for United States assistance; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/d/12" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="12">(12) </num><content style="-uslm-dtd:text">the extent to which such country is prepared to cooperate with the United States in the administration of the provisions of this Act.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/102/182/tII/s203/e" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Withdrawal or Suspension of Designation.—</heading><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/e/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1)</num><subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s203/e/1/A" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">The President may—</chapeau>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s203/e/1/A/i" styleType="OLC" class="leftIndentDecrease2">
                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">withdraw or suspend the designation of any country as a beneficiary country, or</content>
                    </clause>
                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s203/e/1/A/ii" styleType="OLC" class="leftIndentDecrease2">
                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">withdraw, suspend, or limit the application of duty-free treatment under this title to any article of any country, if, after such designation, the President determines that as a result of changed circumstances such a country should be barred from designation as a beneficiary country.</content>
                    </clause></subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s203/e/1/B" styleType="OLC" class="leftIndentDecrease2">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">The President may, after the requirements of paragraph (2) have been met—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s203/e/1/B/i" styleType="OLC" class="leftIndentDecrease2">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">withdraw or suspend the designation of any country as an ATPDEA beneficiary country, or</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s203/e/1/B/ii" styleType="OLC" class="leftIndentDecrease2">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">withdraw, suspend, or limit the application of preferential treatment under section 204(b)(1), (3), or (4) to any article of any country,</content>
                        </clause><continuation style="-uslm-dtd:continuation-text" role="subparagraph">if, after such designation, the President determines that, as a result of changed circumstances, the performance of such country is not satisfactory under the criteria set forth in section 204(b)(6)(B).</continuation>
                    </subparagraph></paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/e/2" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="2">(2)</num><subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s203/e/2/A" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">The President shall publish in the Federal Register notice of the action the President proposes to take under paragraph (1) at least 30 days before taking such action.</content></subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s203/e/2/B" styleType="OLC" class="leftIndentDecrease2">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">The United States Trade Representative shall, within the 30-day period beginning on the date on which the President publishes under subparagraph (A) notice of proposed action—</chapeau>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s203/e/2/B/i" styleType="OLC" class="leftIndentDecrease2">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">accept written comments from the public regarding such proposed action,</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s203/e/2/B/ii" styleType="OLC" class="leftIndentDecrease2">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">hold a public hearing on such proposed action, and</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s203/e/2/B/iii" styleType="OLC" class="leftIndentDecrease2">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><chapeau style="-uslm-dtd:text">publish in the Federal Register—</chapeau>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s203/e/2/B/iii/I" styleType="OLC" class="leftIndentDecrease2">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">notice of the time and place of such hearing prior to the hearing, and</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s203/e/2/B/iii/II" styleType="OLC" class="leftIndentDecrease2">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">the time and place at which such written comments will be accepted.</content>
                                </subclause>
                            </clause>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/102/182/tII/s203/f" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Reporting Requirements.—</heading>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/f/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">Not later than June 30, 2010, and annually thereafter during the period this title is in effect, the United States Trade Representative shall submit to the Congress a report regarding the operation of this title, including—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s203/f/1/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">with respect to subsections (c) and (d), the results of a general review of beneficiary countries based on the considerations described in such subsections; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s203/f/1/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the performance of each beneficiary country or ATPEA beneficiary country, as the case may be, under the criteria set forth in section 204(b)(6)(B).</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s203/f/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Public comment.—</heading><content style="-uslm-dtd:text">Before submitting the report described in paragraph (1), the United States Trade Representative shall publish a notice in the Federal Register requesting public comments on whether beneficiary countries are meeting the criteria listed in section 204(b)(6)(B).</content>
                    </paragraph>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/102/182/tII/s204" styleType="OLC">
                <num style="-uslm-dtd:enum" value="204">SEC. 204. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t19/s3203">19 U.S.C. 3203</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">ELIGIBLE ARTICLES. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/102/182/tII/s204/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s204/a/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">Unless otherwise excluded from eligibility (or otherwise provided for) by this title, the duty-free treatment (or preferential treatment) provided under this title shall apply to any article which is the growth, product, or manufacture of a beneficiary country if—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/a/1/A" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">that article is imported directly from a beneficiary country into the customs territory of the United States; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/a/1/B" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">the sum of—</chapeau>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/a/1/B/i" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the cost or value of the materials produced in a beneficiary country or 2 or more beneficiary countries under this Act, or a beneficiary country under the Caribbean Basin Economic Recovery Act or 2 or more such countries, plus</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/a/1/B/ii" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the direct costs of processing operations performed in a beneficiary country or countries (under this Act or the Caribbean Basin Economic Recovery Act),</content>
                        </clause><continuation style="-uslm-dtd:continuation-text" role="subparagraph">is not less than 35 percent of the appraised value of such article at the time it is entered.</continuation>
                    </subparagraph><continuation style="-uslm-dtd:continuation-text" role="paragraph">For purposes of determining the percentage referred to in subparagraph (B), the term “<term style="-uslm-dtd:term">beneficiary country</term>” includes the Commonwealth of Puerto Rico and the United States Virgin Islands. If the cost or value of materials produced in the customs territory of the United States (other than the Commonwealth of Puerto Rico) is included with respect to an article to which this paragraph applies, an amount not to exceed 15 percent of the appraised value of the article at the time it is entered that is attributed to such United States cost or value may be applied toward determining the percentage referred to in subparagraph (B).</continuation></paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s204/a/2" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">The Secretary of the Treasury shall prescribe such regulations as may be necessary to carry out paragraph (1) including, but not limited to, regulations providing that, in order to be eligible for duty-free treatment under this title, an article must be wholly the growth, product, or manufacture of a beneficiary country, or must be a new or different article of commerce which has been grown, produced, or manufactured in the beneficiary country; but no article or material of a beneficiary country shall be eligible for such treatment by virtue of having merely undergone—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/a/2/A" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">simple combining or packaging operations, or</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/a/2/B" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">mere dilution with water or mere dilution with another substance that does not materially alter the characteristics of the article.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s204/a/3" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">As used in this subsection, the phrase “<quotedText style="-uslm-dtd:quote">direct costs of processing operations</quotedText>” includes, but is not limited to—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/a/3/A" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">all actual labor costs involved in the growth, production, manufacture, or assembly of the specific merchandise, including fringe benefits, on-the-job training and the cost of engineering, supervisory, quality control, and similar personnel; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/a/3/B" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">dies, molds, tooling, and depreciation on machinery and equipment which are allocable to the specific merchandise.</content>
                        </subparagraph><continuation style="-uslm-dtd:continuation-text" role="paragraph">Such phrase does not include costs which are not directly attributable to the merchandise concerned or are not costs of manufacturing the product, such as (i) profit, and (ii) general expense of doing business which are either not allocable to the specific merchandise or are not related to the growth, production, manufacture, or assembly of the merchandise, such as administrative salaries, casualty and liability insurance, advertising, interest, and salesmen's salaries, commissions or expenses.</continuation>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s204/a/4" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">If the President, pursuant to section 223 of the Caribbean Basin Economic Recovery Expansion Act of 1990, considers that the implementation of revised rules of origin for products of beneficiary countries designated under the Caribbean Basin Economic Recovery Act (19 U.S.C. 2701 et seq.) would be appropriate, the President may include similarly revised rules of origin for products of beneficiary countries designated under this title in any suggested legislation transmitted to the Congress that contains such rules of origin for products of beneficiary countries under the Caribbean Basin Economic Recovery Act.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/102/182/tII/s204/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Exceptions and Special Rules.—</heading>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s204/b/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Certain articles that are not import-sensitive.—</heading><chapeau style="-uslm-dtd:text">The President may proclaim duty-free treatment under this title for any article described in subparagraph (A), (B), (C), or (D) that is the growth, product, or manufacture of an ATPDEA beneficiary country, that is imported directly into the customs territory of the United States from an ATPDEA beneficiary country, and that meets the requirements of this section, if the President determines that such article is not import-sensitive in the context of imports from ATPDEA beneficiary countries:</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/1/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">Footwear not designated at the time of the effective date of this title as eligible for purposes of the generalized system of preferences under title V of the Trade Act of 1974.</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/1/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">Petroleum, or any product derived from petroleum, provided for in headings 2709 and 2710 of the HTS.</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/1/C" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">Watches and watch parts (including cases, bracelets and straps), of whatever type including, but not limited to, mechanical, quartz digital or quartz analog, if such watches or watch parts contain any material which is the product of any country with respect to which HTS column 2 rates of duty apply.</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/1/D" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">Handbags, luggage, flat goods, work gloves, and leather wearing apparel that were not designated on August 5, 1983, as eligible articles for purposes of the generalized system of preferences under title V of the Trade Act of 1974.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s204/b/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Exclusions.—</heading><chapeau style="-uslm-dtd:text">Subject to paragraph (3), duty-free treatment under this title may not be extended to—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/2/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">textiles and apparel articles which were not eligible articles for purposes of this title on January 1, 1994, as this title was in effect on that date;</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/2/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">rum and tafia classified in subheading 2208.40 of the HTS;</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/2/C" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">sugars, syrups, and sugar-containing products subject to over-quota duty rates under applicable tariff-rate quotas; or</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/2/D" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">tuna prepared or preserved in any manner in airtight containers, except as provided in paragraph (4).</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s204/b/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Apparel articles and certain textile articles.—</heading>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/3/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Apparel articles that are imported directly into the customs territory of the United States from an ATPDEA beneficiary country shall enter the United States free of duty and free of any quantitative restrictions, limitations, or consultation levels, but only if such articles are described in subparagraph (B).</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/3/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Covered articles.—</heading><chapeau style="-uslm-dtd:text">The apparel articles referred to in subparagraph (A) are the following:</chapeau>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/3/B/i" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Apparel articles assembled from products of the united states or atpdea beneficiary countries or products not available in commercial quantities.—</heading><chapeau style="-uslm-dtd:text">Apparel articles sewn or otherwise assembled in 1 or more ATPDEA beneficiary countries, or the United States, or both, exclusively from any one or any combination of the following:</chapeau>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/B/i/I" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">Fabrics or fabric components wholly formed, or components knit-to-shape, in the United States, from yarns wholly formed in the United States or 1 or more ATPDEA beneficiary countries (including fabrics not formed from yarns, if such fabrics are classifiable under heading 5602 or 5603 of the HTS and are formed in the United States). Apparel articles shall qualify under this subclause only if all dyeing, printing, and finishing of the fabrics from which the articles are assembled, if the fabrics are knit fabrics, is carried out in the United States. Apparel articles shall qualify under this subclause only if all dyeing, printing, and finishing of the fabrics from which the articles are assembled, if the fabrics are woven fabrics, is carried out in the United States.</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/B/i/II" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">Fabrics or fabric components formed or components knit-to-shape, in 1 or more ATPDEA beneficiary countries, from yarns wholly formed in 1 or more ATPDEA beneficiary countries, if such fabrics (including fabrics not formed from yarns, if such fabrics are classifiable under heading 5602 or 5603 of the HTS and are formed in 1 or more ATPDEA beneficiary countries) or components are in chief value of llama, alpaca, or vicuña.</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/B/i/III" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="III">(III) </num><content style="-uslm-dtd:text">Fabrics or yarns, to the extent that apparel articles of such fabrics or yarns would be eligible for preferential treatment, without regard to the source of the fabrics or yarns, under Annex 401 of the NAFTA.</content>
                                </subclause>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/3/B/ii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">Additional fabrics.—</heading><chapeau style="-uslm-dtd:text">At the request of any interested party, the President is authorized to proclaim additional fabrics and yarns as eligible for preferential treatment under clause (i)(III) if—</chapeau>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/B/ii/I" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">the President determines that such fabrics or yarns cannot be supplied by the domestic industry in commercial quantities in a timely manner;</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/B/ii/II" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">the President has obtained advice regarding the proposed action from the appropriate advisory committee established under section 135 of the Trade Act of 1974 (19 U.S.C. 2155) and the United States International Trade Commission;</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/B/ii/III" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="III">(III) </num><content style="-uslm-dtd:text">within 60 days after the request, the President has submitted a report to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate that sets forth the action proposed to be proclaimed and the reasons for such action, and the advice obtained under subclause (II);</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/B/ii/IV" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="IV">(IV) </num><content style="-uslm-dtd:text">a period of 60 calendar days, beginning with the first day on which the President has met the requirements of subclause (III), has expired; and</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/B/ii/V" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="V">(V) </num><content style="-uslm-dtd:text">the President has consulted with such committees regarding the proposed action during the period referred to in subclause (III).</content>
                                </subclause>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/3/B/iii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><heading style="-uslm-dtd:header">Apparel articles assembled in 1 or more atpdea beneficiary countries from regional fabrics or regional components.—</heading><subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/B/iii/I" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">Subject to the limitation set forth in subclause (II), apparel articles sewn or otherwise assembled in 1 or more ATPDEA beneficiary countries from fabrics or from fabric components formed or from components knit-to-shape, in 1 or more ATPDEA beneficiary countries, from yarns wholly formed in the United States or 1 or more ATPDEA beneficiary countries (including fabrics not formed from yarns, if such fabrics are classifiable under heading 5602 or 5603 of the HTS and are formed in 1 or more ATPDEA beneficiary countries), whether or not the apparel articles are also made from any of the fabrics, fabric components formed, or components knit-to-shape described in clause (i) (unless the apparel articles are made exclusively from any of the fabrics, fabric components formed, or components knit-to-shape described in clause (i)).</content></subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/B/iii/II" styleType="OLC" class="leftIndentDecrease1">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">The preferential treatment referred to in subclause (I) shall be extended in the 1-year period beginning October 1, 2002, and in each of the 10 succeeding 1-year periods, to imports of apparel articles in an amount not to exceed the applicable percentage of the aggregate square meter equivalents of all apparel articles imported into the United States in the preceding 12-month period for which data are available.</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/B/iii/III" styleType="OLC" class="leftIndentDecrease1">
                                    <num style="-uslm-dtd:enum" value="III">(III) </num><chapeau style="-uslm-dtd:text">For purposes of subclause (II), the term “<term style="-uslm-dtd:term">applicable percentage</term>” means—</chapeau>
                                    <item style="-uslm-dtd:item" identifier="/us/sComp/102/182/tII/s204/b/3/B/iii/III/aa" styleType="OLC" class="leftIndentDecrease1">
                                        <num style="-uslm-dtd:enum" value="aa">(aa) </num><content style="-uslm-dtd:text">2 percent for the 1-year period beginning October 1, 2002, increased in each of the 4 succeeding 1-year periods by equal increments, so that for the period beginning October 1, 2006, the applicable percentage does not exceed 5 percent; and</content>
                                    </item>
                                    <item style="-uslm-dtd:item" identifier="/us/sComp/102/182/tII/s204/b/3/B/iii/III/bb" styleType="OLC" class="leftIndentDecrease1">
                                        <num style="-uslm-dtd:enum" value="bb">(bb) </num><content style="-uslm-dtd:text">for the 1-year period beginning October 1, 2007, and for the succeeding 5-year period, the percentage determined under item (aa) for the 1-year period beginning October 1, 2006.</content>
                                    </item>
                                </subclause>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/3/B/iv" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iv">(iv) </num><heading style="-uslm-dtd:header">Handloomed, handmade, and folklore articles.—</heading><content style="-uslm-dtd:text">A handloomed, handmade, or folklore article of an ATPDEA beneficiary country identified under subparagraph (C) that is certified as such by the competent authority of such beneficiary country.</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/3/B/v" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="v">(v) </num><heading style="-uslm-dtd:header">Certain other apparel articles.—</heading>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/B/v/I" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><heading style="-uslm-dtd:header">General rule.—</heading><content style="-uslm-dtd:text">Any apparel article classifiable under subheading 6212.10 of the HTS, except for articles entered under clause (i), (ii), (iii), or (iv), if the article is both cut and sewn or otherwise assembled in the United States, or one or more ATPDEA beneficiary countries, or both.</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/B/v/II" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><heading style="-uslm-dtd:header">Limitation.—</heading><content style="-uslm-dtd:text">During the 1-year period beginning on October 1, 2003, and during each of the 9 succeeding 1-year periods, apparel articles described in subclause (I) of a producer or an entity controlling production shall be eligible for preferential treatment under this paragraph only if the aggregate cost of fabrics (exclusive of all findings and trimmings) formed in the United States that are used in the production of all such articles of that producer or entity that are entered and eligible under this clause during the preceding 1-year period is at least 75 percent of the aggregate declared customs value of the fabric (exclusive of all findings and trimmings) contained in all such articles of that producer or entity that are entered and eligible under this clause during the preceding 1-year period.</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/B/v/III" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="III">(III) </num><heading style="-uslm-dtd:header">Development of procedure to ensure compliance.—</heading><content style="-uslm-dtd:text">The United States Customs Service shall develop and implement methods and procedures to ensure ongoing compliance with the requirement set forth in subclause (II). If the Customs Service finds that a producer or an entity controlling production has not satisfied such requirement in a 1-year period, then apparel articles described in subclause (I) of that producer or entity shall be ineligible for preferential treatment under this paragraph during any succeeding 1-year period until the aggregate cost of fabrics (exclusive of all findings and trimmings) formed in the United States that are used in the production of such articles of that producer or entity entered during the preceding 1-year period is at least 85 percent of the aggregate declared customs value of the fabric (exclusive of all findings and trimmings) contained in all such articles of that producer or entity that are entered and eligible under this clause during the preceding 1-year period.</content>
                                </subclause>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/3/B/vi" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="vi">(vi) </num><heading style="-uslm-dtd:header">Special rules.—</heading>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/B/vi/I" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><heading style="-uslm-dtd:header">Exception for findings and trimmings.—</heading><content style="-uslm-dtd:text">An article otherwise eligible for preferential treatment under this paragraph shall not be ineligible for such treatment because the article contains findings or trimmings of foreign origin, if such findings and trimmings do not exceed 25 percent of the cost of the components of the assembled product. Examples of findings and trimmings are sewing thread, hooks and eyes, snaps, buttons, “<quotedText style="-uslm-dtd:quote">bow buds</quotedText>”, decorative lace, trim, elastic strips, zippers, including zipper tapes and labels, and other similar products.</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/B/vi/II" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><heading style="-uslm-dtd:header">Certain interlining.—</heading><item style="-uslm-dtd:item" identifier="/us/sComp/102/182/tII/s204/b/3/B/vi/II/aa" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="aa">(aa) </num><content style="-uslm-dtd:text">An article otherwise eligible for preferential treatment under this paragraph shall not be ineligible for such treatment because the article contains certain interlinings of foreign origin, if the value of such interlinings (and any findings and trimmings) does not exceed 25 percent of the cost of the components of the assembled article.</content></item>
                                    <item style="-uslm-dtd:item" identifier="/us/sComp/102/182/tII/s204/b/3/B/vi/II/bb" styleType="OLC" class="leftIndentDecrease1">
                                        <num style="-uslm-dtd:enum" value="bb">(bb) </num><content style="-uslm-dtd:text">Interlinings eligible for the treatment described in division (aa) include only a chest type plate, “<quotedText style="-uslm-dtd:quote">hymo</quotedText>” piece, or “<quotedText style="-uslm-dtd:quote">sleeve header</quotedText>”, of woven or weft-inserted warp knit construction and of coarse animal hair or man-made filaments.</content>
                                    </item>
                                    <item style="-uslm-dtd:item" identifier="/us/sComp/102/182/tII/s204/b/3/B/vi/II/cc" styleType="OLC" class="leftIndentDecrease1">
                                        <num style="-uslm-dtd:enum" value="cc">(cc) </num><content style="-uslm-dtd:text">The treatment described in this subclause shall terminate if the President makes a determination that United States manufacturers are producing such interlinings in the United States in commercial quantities.</content>
                                    </item>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/B/vi/III" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="III">(III) </num><heading style="-uslm-dtd:header">De minimis rule.—</heading><content style="-uslm-dtd:text">An article that would otherwise be ineligible for preferential treatment under this subparagraph because the article contains yarns not wholly formed in the United States or in one or more ATPDEA beneficiary countries shall not be ineligible for such treatment if the total weight of all such yarns is not more than 7 percent of the total weight of the good.</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/B/vi/IV" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="IV">(IV) </num><heading style="-uslm-dtd:header">Special origin rule.—</heading><content style="-uslm-dtd:text">An article otherwise eligible for preferential treatment under clause (i) or (iii) shall not be ineligible for such treatment because the article contains nylon filament yarn (other than elastomeric yarn) that is classifiable under subheading 5402.10.30, 5402.10.60, 5402.31.30, 5402.31.60, 5402.32.30, 5402.32.60, 5402.41.10, 5402.41.90, 5402.51.00, or 5402.61.00 of the HTS from a country that is a party to an agreement with the United States establishing a free trade area, which entered into force before January 1, 1995.</content>
                                </subclause>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/3/B/vii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="vii">(vii) </num><heading style="-uslm-dtd:header">Textile luggage.—</heading><chapeau style="-uslm-dtd:text">Textile luggage—</chapeau>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/B/vii/I" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">assembled in an ATPDEA beneficiary country from fabric wholly formed and cut in the United States, from yarns wholly formed in the United States, that is entered under subheading 9802.00.80 of the HTS; or</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/B/vii/II" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">assembled from fabric cut in an ATPDEA beneficiary country from fabric wholly formed in the United States from yarns wholly formed in the United States.</content>
                                </subclause>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/3/B/viii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="viii">(viii) </num><heading style="-uslm-dtd:header">Removal of designation of fabrics or yarns not available in commercial quantities.—</heading><content style="-uslm-dtd:text">If the President determines that any fabric or yarn was determined to be eligible for preferential treatment under clause (i)(III) or (ii) on the basis of fraud, the President is authorized to remove that designation from that fabric or yarn with respect to articles entered after such removal.</content>
                            </clause>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/3/C" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Handloomed, handmade, and folklore articles.—</heading><content style="-uslm-dtd:text">For purposes of subparagraph (B)(iv), the President shall consult with representatives of the ATPDEA beneficiary countries concerned for the purpose of identifying particular textile and apparel goods that are mutually agreed upon as being handloomed, handmade, or folklore goods of a kind described in section 2.3(a), (b), or (c) of the Annex or Appendix 3.1.B.11 of the Annex.</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/3/D" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">Penalties for transshipment.—</heading>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/3/D/i" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Penalties for exporters.—</heading><content style="-uslm-dtd:text">If the President determines, based on sufficient evidence, that an exporter has engaged in transshipment with respect to apparel articles from an ATPDEA beneficiary country, then the President shall deny all benefits under this title to such exporter, and any successor of such exporter, for a period of 2 years.</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/3/D/ii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">Penalties for countries.—</heading><content style="-uslm-dtd:text">Whenever the President finds, based on sufficient evidence, that transshipment has occurred, the President shall request that the ATPDEA beneficiary country or countries through whose territory the transshipment has occurred take all necessary and appropriate actions to prevent such transshipment. If the President determines that a country is not taking such actions, the President shall reduce the quantities of apparel articles that may be imported into the United States from such country by the quantity of the transshipped articles multiplied by 3, to the extent consistent with the obligations of the United States under the WTO.</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/3/D/iii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><heading style="-uslm-dtd:header">Transshipment described.—</heading><content style="-uslm-dtd:text">Transshipment within the meaning of this subparagraph has occurred when preferential treatment under subparagraph (A) has been claimed for an apparel article on the basis of material false information concerning the country of origin, manufacture, processing, or assembly of the article or any of its components. For purposes of this clause, false information is material if disclosure of the true information would mean or would have meant that the article is or was ineligible for preferential treatment under subparagraph (A).</content>
                            </clause>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/3/E" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="E">(E) </num><heading style="-uslm-dtd:header">Bilateral emergency actions.—</heading>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/3/E/i" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The President may take bilateral emergency tariff actions of a kind described in section 4 of the Annex with respect to any apparel article imported from an ATPDEA beneficiary country if the application of tariff treatment under subparagraph (A) to such article results in conditions that would be cause for the taking of such actions under such section 4 with respect to a like article described in the same 8-digit subheading of the HTS that is imported from Mexico.</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/3/E/ii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">Rules relating to bilateral emergency action.—</heading><chapeau style="-uslm-dtd:text">For purposes of applying bilateral emergency action under this subparagraph—</chapeau>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/E/ii/I" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">the requirements of paragraph (5) of section 4 of the Annex (relating to providing compensation) shall not apply;</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/E/ii/II" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">the term “<term style="-uslm-dtd:term">transition period</term>” in section 4 of the Annex shall mean the period ending July 31, 2013; and</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/3/E/ii/III" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="III">(III) </num><content style="-uslm-dtd:text">the requirements to consult specified in section 4 of the Annex shall be treated as satisfied if the President requests consultations with the ATPDEA beneficiary country in question and the country does not agree to consult within the time period specified under section 4 of the Annex.</content>
                                </subclause>
                            </clause>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s204/b/4" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Tuna.—</heading>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/4/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">General rule.—</heading><content style="-uslm-dtd:text">Tuna that is harvested by United States vessels or ATPDEA beneficiary country vessels, that is prepared or preserved in any manner, in an ATPDEA beneficiary country, in foil or other flexible airtight containers weighing with their contents not more than 6.8 kilograms each, and that is imported directly into the customs territory of the United States from an ATPDEA beneficiary country, shall enter the United States free of duty and free of any quantitative restrictions.</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/4/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">In this paragraph—</chapeau>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/4/B/i" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">United states vessel.—</heading><chapeau style="-uslm-dtd:text">A “<quotedText style="-uslm-dtd:quote">United States vessel</quotedText>” is—</chapeau>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/4/B/i/I" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">a vessel that has a certificate of documentation with a fishery endorsement under chapter 121 of title 46, United States Code; or</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/4/B/i/II" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">in the case of a vessel without a fishery endorsement, a vessel that is documented under the laws of the United States and for which a license has been issued pursuant to section 9 of the South Pacific Tuna Act of 1988 (16 U.S.C. 973g).</content>
                                </subclause>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/4/B/ii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">ATPDEA vessel.—</heading><chapeau style="-uslm-dtd:text">An “<quotedText style="-uslm-dtd:quote">ATPDEA vessel</quotedText>” is a vessel—</chapeau>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/4/B/ii/I" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">which is registered or recorded in an ATPDEA beneficiary country;</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/4/B/ii/II" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">which sails under the flag of an ATPDEA beneficiary country;</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/4/B/ii/III" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="III">(III) </num><content style="-uslm-dtd:text">which is at least 75 percent owned by nationals of an ATPDEA beneficiary country or by a company having its principal place of business in an ATPDEA beneficiary country, of which the manager or managers, chairman of the board of directors or of the supervisory board, and the majority of the members of such boards are nationals of an ATPDEA beneficiary country and of which, in the case of a company, at least 50 percent of the capital is owned by an ATPDEA beneficiary country or by public bodies or nationals of an ATPDEA beneficiary country;</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/4/B/ii/IV" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="IV">(IV) </num><content style="-uslm-dtd:text">of which the master and officers are nationals of an ATPDEA beneficiary country; and</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/4/B/ii/V" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="V">(V) </num><content style="-uslm-dtd:text">of which at least 75 percent of the crew are nationals of an ATPDEA beneficiary country.</content>
                                </subclause>
                            </clause>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s204/b/5" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Customs procedures.—</heading>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/5/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/5/A/i" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Regulations.—</heading><content style="-uslm-dtd:text">Any importer that claims preferential treatment under paragraph (1), (3), or (4) shall comply with customs procedures similar in all material respects to the requirements of Article 502(1) of the NAFTA as implemented pursuant to United States law, in accordance with regulations promulgated by the Secretary of the Treasury.</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/5/A/ii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">Determination.—</heading>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/5/A/ii/I" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">In order to qualify for the preferential  treatment under paragraph (1), (3), or (4) and for a Certificate of Origin to be valid with respect to any article for which such treatment is claimed, there shall be in effect a determination by the President that each country described in subclause (II)—</chapeau>
                                    <item style="-uslm-dtd:item" identifier="/us/sComp/102/182/tII/s204/b/5/A/ii/I/aa" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="aa">(aa) </num><content style="-uslm-dtd:text">has implemented and follows, or</content>
                                    </item>
                                    <item style="-uslm-dtd:item" identifier="/us/sComp/102/182/tII/s204/b/5/A/ii/I/bb" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="bb">(bb) </num><content style="-uslm-dtd:text">is making substantial progress toward implementing and following,</content>
                                    </item><continuation style="-uslm-dtd:continuation-text" role="subclause">procedures and requirements similar in all material respects to the relevant procedures and requirements under chapter 5 of the NAFTA.</continuation>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/5/A/ii/II" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><heading style="-uslm-dtd:header">Country described.—</heading><chapeau style="-uslm-dtd:text">A country is described in this subclause if it is an ATPDEA beneficiary country—</chapeau>
                                    <item style="-uslm-dtd:item" identifier="/us/sComp/102/182/tII/s204/b/5/A/ii/II/aa" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="aa">(aa) </num><content style="-uslm-dtd:text">from which the article is exported; or</content>
                                    </item>
                                    <item style="-uslm-dtd:item" identifier="/us/sComp/102/182/tII/s204/b/5/A/ii/II/bb" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="bb">(bb) </num><content style="-uslm-dtd:text">in which materials used in the production of the article originate or in which the article or such materials undergo production that contributes to a claim that the article is eligible for preferential treatment under paragraph (1), (3), or (4).</content>
                                    </item>
                                </subclause>
                            </clause>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/5/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Certificate of origin.—</heading><content style="-uslm-dtd:text">The Certificate of Origin that otherwise would be required pursuant to the provisions of subparagraph (A) shall not be required in the case of an article imported under paragraph (1), (3), or (4) if such Certificate of Origin would not be required under Article 503 of the NAFTA (as implemented pursuant to United States law), if the article were imported from Mexico.</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/5/C" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Report on cooperation of atpdea countries concerning circumvention.—</heading><chapeau style="-uslm-dtd:text">The United States Commissioner of Customs shall conduct a study analyzing the extent to which each ATPDEA beneficiary country—</chapeau>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/5/C/i" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">has cooperated fully with the United States, consistent with its domestic laws and procedures, in instances of circumvention or alleged circumvention of existing quotas on imports of textile and apparel goods, to establish necessary relevant facts in the places of import, export, and, where applicable, transshipment, including investigation of circumvention practices, exchanges of documents, correspondence, reports, and other relevant information, to the extent such information is available;</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/5/C/ii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">has taken appropriate measures, consistent with its domestic laws and procedures, against exporters and importers involved in instances of false declaration concerning quantities, description, classification, or origin of textile and apparel goods; and</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/5/C/iii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">has penalized the individuals and entities involved in any such circumvention, consistent with its domestic laws and procedures, and has worked closely to seek the cooperation of any third country to prevent such circumvention from taking place in that third country.</content>
                            </clause><continuation style="-uslm-dtd:continuation-text" role="subparagraph">The Commissioner of Customs shall submit to the Congress, not later than October 1, 2003, a report on the study conducted under this subparagraph.</continuation>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s204/b/6" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">In this subsection—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/6/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Annex.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">the Annex</term>” means Annex 300-B of the NAFTA.</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/6/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">ATPDEA beneficiary country.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">ATPDEA beneficiary country</term>” means any “<quotedText style="-uslm-dtd:quote">beneficiary country</quotedText>”, as defined in section 203(a)(1) of this title, which the President designates as an ATPDEA beneficiary country, taking into account the criteria contained in subsections (c) and (d) of section 203 and other appropriate criteria, including the following:</chapeau>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/6/B/i" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">(i) </num><chapeau style="-uslm-dtd:text">Whether the beneficiary country has demonstrated a commitment to—</chapeau>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/6/B/i/I" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">undertake its obligations under the WTO, including those agreements listed in section 101(d) of the Uruguay Round Agreements Act, on or ahead of schedule; and</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/6/B/i/II" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">participate in negotiations toward the completion of the FTAA or another free trade agreement.</content>
                                </subclause>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/6/B/ii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">The extent to which the country provides protection of intellectual property rights consistent with or greater than the protection afforded under the Agreement on Trade-Related Aspects of Intellectual Property Rights described in section 101(d)(15) of the Uruguay Round Agreements Act.</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/6/B/iii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">(iii) </num><chapeau style="-uslm-dtd:text">The extent to which the country provides internationally recognized worker rights, including—</chapeau>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/6/B/iii/I" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">the right of association;</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/6/B/iii/II" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">the right to organize and bargain collectively;</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/6/B/iii/III" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="III">(III) </num><content style="-uslm-dtd:text">a prohibition on the use of any form of forced or compulsory labor;</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/6/B/iii/IV" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="IV">(IV) </num><content style="-uslm-dtd:text">a minimum age for the employment of children; and</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/6/B/iii/V" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="V">(V) </num><content style="-uslm-dtd:text">acceptable conditions of work with respect to minimum wages,  hours of work, and occupational safety and health.</content>
                                </subclause>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/6/B/iv" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">Whether the country has implemented its commitments to eliminate the worst forms of child labor, as defined in section 507(6) of the Trade Act of 1974.</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/6/B/v" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">The extent to which the country has met the counternarcotics certification criteria set forth in section 490 of the Foreign Assistance Act of 1961 (22 U.S.C. 2291j) for eligibility for United States assistance.</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/6/B/vi" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="vi">(vi) </num><content style="-uslm-dtd:text">The extent to which the country has taken steps to become a party to and implements the Inter-American Convention Against Corruption.</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/6/B/vii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="vii">(vii) </num><chapeau style="-uslm-dtd:text">The extent to which the country—</chapeau>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/6/B/vii/I" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">applies transparent, nondiscriminatory, and competitive procedures in government procurement equivalent to those contained in the Agreement on Government Procurement described in section 101(d)(17) of the Uruguay Round Agreements Act; and</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/102/182/tII/s204/b/6/B/vii/II" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">contributes to efforts in international fora to develop and implement international rules in transparency in government procurement.</content>
                                </subclause>
                            </clause>
                            <clause style="-uslm-dtd:clause" identifier="/us/sComp/102/182/tII/s204/b/6/B/viii" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="viii">(viii) </num><content style="-uslm-dtd:text">The extent to which the country has taken steps to support the efforts of the United States to combat terrorism.</content>
                            </clause>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/6/C" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">NAFTA.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">NAFTA</term>” means the North American Free Trade Agreement entered into between the United States, Mexico, and Canada on December 17, 1992.</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/6/D" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">WTO.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">WTO</term>” has the meaning given that term in section 2 of the Uruguay Round Agreements Act (19 U.S.C. 3501).</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/6/E" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="E">(E) </num><heading style="-uslm-dtd:header">ATPDEA.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">ATPDEA</term>” means the Andean Trade Promotion and Drug Eradication Act.</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/b/6/F" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="F">(F) </num><heading style="-uslm-dtd:header">FTAA.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">FTAA</term>” means the Free Trade Area for the Americas.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/102/182/tII/s204/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Suspension of Duty-Free Treatment.—</heading><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s204/c/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The President may by proclamation suspend the duty-free treatment provided by this title with respect to any eligible article and may proclaim a duty rate for such article if such action is proclaimed under chapter 1 of title II of the Trade Act of 1974 or section 232 of the Trade Expansion Act of 1962.</content></paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s204/c/2" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">In any report by the United States International Trade Commission to the President under section 202(f) of the Trade Act of 1974 regarding any article for which duty-free treatment has been proclaimed by the President pursuant to this title, the Commission shall state whether and to what extent its findings and recommendations apply to such article when imported from beneficiary countries.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s204/c/3" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">For purposes of section 203 of the Trade Act of 1974, the suspension of the duty-free treatment provided by this title shall be treated as an increase in duty.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s204/c/4" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">No proclamation providing solely for a suspension referred to in paragraph (3) of this subsection with respect to any article shall be taken under section 203 of the Trade Act of 1974 unless the United States International Trade Commission, in addition to making an affirmative determination with respect to such article under section 202(b) of the Trade Act of 1974, determines in the course of its investigation under such section that the serious injury (or threat thereof) substantially caused by imports to the domestic industry producing a like or directly competitive article results from the duty-free treatment provided by this title.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s204/c/5" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="5">(5)</num><subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/c/5/A" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">Any action taken under section 203 of the Trade Act of 1974 that is in effect when duty-free treatment is proclaimed under section 202 of this title shall remain in effect until modified or terminated.</content></subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/c/5/B" styleType="OLC" class="leftIndentDecrease2">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">If any article is subject to any such action at the time duty-free treatment is proclaimed under section 202 of this title, the President may reduce or terminate the application of such action to the importation of such article from beneficiary countries prior to the otherwise scheduled date on which such reduction or termination would occur pursuant to the criteria and procedures of section 204 of the Trade Act of 1974.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/102/182/tII/s204/d" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Emergency Relief With Respect to Perishable Products.—</heading><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s204/d/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">If a petition is filed with the United States International Trade Commission pursuant to the provisions of section 201 of the Trade Act of 1974 regarding a perishable product and alleging injury from imports from beneficiary countries, then the petition may also be filed with the Secretary of Agriculture with a request that emergency relief be granted pursuant to paragraph (3) of this subsection with respect to such article.</content></paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s204/d/2" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">Within 14 days after the filing of a petition under paragraph (1) of this subsection—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/d/2/A" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">if the Secretary of Agriculture has reason to believe that a perishable product from a beneficiary country is being imported into the United States in such increased quantities as to be a substantial cause of serious injury, or the threat thereof, to the domestic industry producing a perishable product like or directly competitive with the imported product and that emergency action is warranted, he shall advise the President and recommend that the President take emergency action; or</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/d/2/B" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the Secretary of Agriculture shall publish a notice of his determination not to recommend the imposition of emergency action and so advise the petitioner.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s204/d/3" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">Within 7 days after the President receives a recommendation from the Secretary of Agriculture to take emergency action pursuant to paragraph (2) of this subsection, he shall issue a proclamation withdrawing the duty-free treatment provided by this title or publish a notice of his determination not to take emergency action.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s204/d/4" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><chapeau style="-uslm-dtd:text">The emergency action provided by paragraph (3) of this subsection shall cease to apply—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/d/4/A" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">upon the taking of action under section 203 of the Trade Act of 1974,</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/d/4/B" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">on the day a determination by the President not to take action under section 203(b)(2) of such Act becomes final,</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/d/4/C" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">in the event of a report of the United States International Trade Commission containing a negative finding, on the day of the Commission's report is submitted to the President, or</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/d/4/D" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">whenever the President determines that because of changed circumstances such relief is no longer warranted.</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s204/d/5" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><chapeau style="-uslm-dtd:text">For purposes of this subsection, the term ``perishable product'<ref style="-uslm-dtd:footnote-ref" idref="ID102AB55A366A4A00A843852024B9E206" class="footnoteRef">1</ref> means—</chapeau><footnote id="ID102AB55A366A4A00A843852024B9E206" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">So in law. The quoted phrase in the matter preceding subparagraph (A) was enacted without including closing double quotation marks.</p></footnote>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/d/5/A" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">live plants and fresh cut flowers provided for in chapter 6 of the HTS;</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/d/5/B" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">fresh or chilled vegetables provided for in headings 0701 through 0709 (except subheading 0709.52.00) and heading 0714 of the HTS;</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/d/5/C" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">fresh fruit provided for in subheadings 0804.20 through 0810.90 (except citrons of subheadings 0805.90.00, tamarinds and kiwi fruit of subheading 0810.90.20, and cashew apples, mameyes colorados, sapodillas, soursops and sweetsops of subheading 0810.90.40) of the HTS; or</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s204/d/5/D" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">concentrated citrus fruit juice provided for in subheadings 2009.11.00, 2009.19.40, 2009.20.40, 2009.30.20, and 2009.30.60 of the HTS.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/102/182/tII/s204/e" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Section 22 Fees.—</heading><content style="-uslm-dtd:text">No proclamation issued pursuant to this title shall affect fees imposed pursuant to section 22 of the Agricultural Adjustment Act of 1933 (7 U.S.C. 624).</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/102/182/tII/s204/f" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Tariff-Rate Quotas.—</heading><content style="-uslm-dtd:text">No quantity of an agricultural product subject to a tariff-rate quota that exceeds the in-quota quantity shall be eligible for duty-free treatment under this Act.</content>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/102/182/tII/s205" styleType="OLC">
                <num style="-uslm-dtd:enum" value="205">SEC. 205. </num><heading style="-uslm-dtd:header">RELATED AMENDMENTS. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/102/182/tII/s205/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Increase in Duty-Free Tourist Allowance.—</heading><content style="-uslm-dtd:text">Note 4 to subchapter IV of chapter 98 of the HTS is amended by inserting before the period the following: “<quotedText style="-uslm-dtd:quote">or a country designated as a beneficiary country under the Andean Trade Preference Act</quotedText>”.</content>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/102/182/tII/s205/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Treatment of Insular Possessions Products.—</heading><content style="-uslm-dtd:text">General Note 3(a)(iv) of the HTS (relating to products of the insular possessions) is amended by adding at the end thereof the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="E">“(E) </num><content style="-uslm-dtd:text">Subject to the provisions in section 204 of the Andean Trade Preference Act, goods which are imported from insular possessions of the United States shall receive duty treatment no less favorable than the treatment afforded such goods when they are imported from a beneficiary country under such Act.”</content>
                    </subparagraph></quotedContent>.</content>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/102/182/tII/s206" styleType="OLC">
                <num style="-uslm-dtd:enum" value="206">SEC. 206. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t19/s3204">19 U.S.C. 3204</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">INTERNATIONAL TRADE COMMISSION REPORTS ON IMPACT OF THE ANDEAN TRADE PREFERENCE ACT. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/102/182/tII/s206/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Reporting Requirements.—</heading>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s206/a/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The United States International Trade Commission (in this section referred to as the “<quotedText style="-uslm-dtd:quote">Commission</quotedText>”) shall submit to Congress and the President biennial reports regarding the economic impact of this title on United States industries and consumers, and, in conjunction with other agencies, the effectiveness of this title in promoting drug-related crop eradication and crop substitution efforts of the beneficiary countries.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s206/a/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Submission.—</heading><content style="-uslm-dtd:text">During the period that this title is in effect, the report required by paragraph (1) shall be submitted on December 31 of each year that the report required by section 215 of the Caribbean Basin Economic Recovery Act is not submitted.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s206/a/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Treatment of puerto rico, etc.—</heading><content style="-uslm-dtd:text">For purposes of this section, industries in the Commonwealth of Puerto Rico and the insular possessions of the United States are considered to be United States industries.</content>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/102/182/tII/s206/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Report Requirements.—</heading><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s206/b/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">Each report required under subsection (a) shall include, but not be limited to, an assessment by the Commission regarding—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s206/b/1/A" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the actual effect, during the period covered by the report, of this title on the United States economy generally as well as on those specific domestic industries which produce articles that are like, or directly competitive with, articles being imported into the United States from beneficiary countries;</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s206/b/1/B" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the probable future effect that this title will have on the United States economy generally, as well as on such domestic industries, before the provisions of this title terminate; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s206/b/1/C" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the estimated effect that this title has had on the drug-related crop eradication and crop substitution efforts of the beneficiary countries.</content>
                    </subparagraph></paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s206/b/2" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">In preparing the assessments required under paragraph (1), the Commission shall, to the extent practicable—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s206/b/2/A" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">analyze the production, trade and consumption of United States products affected by this title, taking into consideration employment, profit levels, and use of productive facilities with respect to the domestic industries concerned, and such other economic factors in such industries as it considers relevant, including prices, wages, sales, inventories, patterns of demand, capital investment, obsolescence of equipment, and diversification of production; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s206/b/2/B" styleType="OLC" class="leftIndentDecrease1">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">describe the nature and extent of any significant change in employment, profit levels, and use of productive facilities, and such other conditions as it deems relevant in the domestic industries concerned, which it believes are attributable to this title.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/102/182/tII/s206/c" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Submission Dates; Public Comment.—</heading><paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s206/c/1" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Each report required under subsection (a) shall be submitted to the Congress before the close of the 9-month period beginning on the day after the last day of the period covered by the report.</content></paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s206/c/2" styleType="OLC" class="leftIndentDecrease1">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The Commission shall provide an opportunity for the submission by the public, either orally or in writing, or both, of information relating to matters that will be addressed in the reports.</content>
                    </paragraph>
                </subsection>
            </section>
            <section style="-uslm-dtd:section" identifier="/us/sComp/102/182/tII/s208" styleType="OLC">
                <num style="-uslm-dtd:enum" value="208">SEC. 208. </num><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t19/s3206">19 U.S.C. 3206</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">TERMINATION OF PREFERENTIAL TREATMENT. </heading>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/102/182/tII/s208/a" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">No duty-free treatment or other preferential treatment extended to beneficiary countries under this title shall—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s208/a/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">remain in effect—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s208/a/1/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">with respect to Colombia after July 31, 2013; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s208/a/1/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">with respect to Peru after December 31, 2010;</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s208/a/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">remain in effect with respect to Ecuador after June 30, 2009, except that duty-free treatment and other preferential treatment under this title shall remain in effect with respect to Ecuador during the period beginning on July 1, 2009, and ending on July 31, 2013, unless the President reviews the criteria set forth in section 203, and on or before June 30, 2009, reports to the Committee on Finance of the Senate and the Committee on Ways and Means of the House of Representatives pursuant to subsection (b) that—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s208/a/2/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the President has determined that Ecuador does not satisfy the requirements set forth in section 203(c) for being designated as a beneficiary country; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s208/a/2/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">in making that determination, the President has taken into account each of the factors set forth in section 203(d); and</content>
                        </subparagraph>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s208/a/3" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">remain in effect with respect to Bolivia after June 30, 2009, except that duty-free treatment and other preferential treatment under this title shall remain in effect with respect to Bolivia during the period beginning on July 1, 2009, and ending on December 31, 2010, only if the President reviews the criteria set forth in section 203, and on or before June 30, 2009, reports to the Committee on Finance of the Senate and the Committee on Ways and Means of the House of Representatives pursuant to subsection (b) that—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s208/a/3/A" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the President has determined that Bolivia satisfies the requirements set forth in section 203(c) for being designated as a beneficiary country; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/102/182/tII/s208/a/3/B" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">in making that determination, the President has taken into account each of the factors set forth in section 203(d).</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/102/182/tII/s208/b" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Reports.—</heading><chapeau style="-uslm-dtd:text">On or before June 30, 2009, the President shall make determinations pursuant to subsections (a)(2)(A) and (a)(3)(A) and report to the Committee on Finance of the Senate and the Committee on Ways and Means of the House of Representatives on—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s208/b/1" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">such determinations; and</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/102/182/tII/s208/b/2" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the reasons for such determinations.</content>
                    </paragraph>
                </subsection>
