    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To amend and extend the National Foundation on the Arts and Humanities Act of 1965, to provide for the improvement of museum services, to establish a challenge grant program, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
</enactingFormula><section style="-uslm-dtd:section" styleType="OLC" role="undesignated-level" class="inline"><content style="-uslm-dtd:text">That this Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Arts, Humanities, and Cultural Affairs Act of 1976</shortTitle>”.</content>

            <num style="-uslm-dtd:enum" value="II">TITLE II—</num><heading style="-uslm-dtd:header">MUSEUM AND LIBRARY SERVICES </heading>
            <subtitle style="-uslm-dtd:subtitle" identifier="/us/sComp/94/462/tII/stA" styleType="OLC">
                <num style="-uslm-dtd:enum" value="A">Subtitle A—</num><heading style="-uslm-dtd:header">General Provisions </heading>
                <section style="-uslm-dtd:section" identifier="/us/sComp/94/462/tII/stA/s201" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="201">SEC. 201. </num><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
                    <content style="-uslm-dtd:text" class="block">This title may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Museum and Library Services Act</inline></shortTitle>”.</content><editorialNote style="-uslm-dtd:usc-reference" role="uscRef"><b>[</b><ref href="/us/usc/t20/s9101">20 U.S.C. 9101 note</ref><b>]</b> </editorialNote><sourceCredit style="-uslm-dtd:legis-history-note">Enacted October 8, 1976, P.L. 94–462, title II, sec. 201, 90 Stat. 1975, amended September 30, 1996, P.L. 104–208, title VII, sec. 702, 110 Stat. 3009–294.</sourceCredit>

                    <num style="-uslm-dtd:enum" value="202">SEC. 202. </num><heading style="-uslm-dtd:header">GENERAL DEFINITIONS. </heading>
                    <subsection style="-uslm-dtd:subsection" styleType="OLC" role="undesignated-level"><chapeau style="-uslm-dtd:text">As used in this title:</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s202/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Determined to be obscene.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">determined to be obscene</term>” means determined, in a final judgment of a court of record and of competent jurisdiction in the United States, to be obscene.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s202/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Digital literacy skills.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">digital literacy skills</term>”means the skills associated with—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s202/2/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">using technology to enable users to find, evaluate, organize, create, and communicate information;
			 and</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s202/2/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">developing digital citizenship and the responsible use of technology.</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s202/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Director.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Director</term>” means the Director of the Institute appointed under section 204.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s202/4" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Final judgment.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">final judgment</term>” means a judgment that is—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s202/4/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">not reviewed by any other court that has authority to review such judgment; or</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s202/4/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">not reviewable by any other court.</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s202/5" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Indian tribe.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Indian tribe</term>” means any tribe, band, nation, or other organized group or community, including any Alaska native village, regional corporation, or village corporation (as defined in, or established pursuant to, the Alaska Native Claims Settlement Act (43 U.S.C. 1601 et seq.)), which is recognized  as eligible for the special programs and services provided by the United States to Indians because of their status as Indians.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s202/6" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="6">(6) </num><heading style="-uslm-dtd:header">Institute.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Institute</term>” means the Institute of Museum and Library Services established under section 203.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s202/7" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="7">(7) </num><heading style="-uslm-dtd:header">Museum and library services board.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Museum and Library Services Board</term>” means the National Museum and Library Services Board established under section 207.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s202/8" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="8">(8) </num><heading style="-uslm-dtd:header">Obscene.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">obscene</term>” means, with respect to a project, that—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s202/8/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the average person, applying contemporary community standards, would find that such project, when taken as a whole, appeals to the prurient interest;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s202/8/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">such project depicts or describes sexual conduct in a patently offensive way; and</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s202/8/C" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">such project, when taken as a whole, lacks serious literary, artistic, political, or scientific value.</content>
                            </subparagraph>
                        </paragraph>

                <section style="-uslm-dtd:section" identifier="/us/sComp/94/462/tII/stA/s203" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="203">SEC. 203. </num><heading style="-uslm-dtd:header">INSTITUTE OF MUSEUM AND LIBRARY SERVICES. </heading>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s203/a" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Establishment.—</heading><content style="-uslm-dtd:text">There is established, within the National Foundation on the Arts and the Humanities, an Institute of Museum and Library Services.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s203/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Offices.—</heading><content style="-uslm-dtd:text">The Institute shall consist of an Office of Museum Services and an Office of Library Services.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s203/c" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Museum and Library Services Board.—</heading><content style="-uslm-dtd:text">There shall be a National Museum and Library Services Board within the Institute, as provided under section 207.</content>

                <section style="-uslm-dtd:section" identifier="/us/sComp/94/462/tII/stA/s204" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="204">SEC. 204. </num><heading style="-uslm-dtd:header">DIRECTOR OF THE INSTITUTE. </heading>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s204/a" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Appointment.—</heading>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s204/a/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Institute shall be headed by a Director, appointed by the President, by and with the advice and consent of the Senate.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s204/a/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Term.—</heading><content style="-uslm-dtd:text">The Director shall serve for a term of 4 years, except that if a successor to the Director has not been appointed by the President, by and with the advice and consent of the Senate, as of the date of expiration of the Director’s term, the Director may serve for not more than 1 additional year or until a successor is appointed and confirmed, whichever is earlier.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s204/a/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Qualifications.—</heading><content style="-uslm-dtd:text">Beginning with the first individual appointed to the position of Director after the date of enactment of the Museum and Library Services Act of 1996, every second individual so appointed shall be appointed from among individuals who have special competence with regard to library and information services. Beginning with the second individual appointed to the position of Director after the date of enactment of the Museum and Library Services Act of 1996, every second individual so appointed shall be appointed from among individuals who have special competence with regard to museum services.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s204/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Compensation.—</heading><content style="-uslm-dtd:text">The Director may be compensated at the rate provided for level III of the Executive Schedule under section 5314 of title 5, United States Code.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s204/c" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Duties and Powers.—</heading>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s204/c/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Primary responsibility.—</heading><content style="-uslm-dtd:text">The Director shall have primary responsibility for the development and implementation of policy to ensure the availability of museum, library, and information services adequate to meet the essential information, education, research, economic, cultural, and civic needs of the people of the United States.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s204/c/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Duties.—</heading><chapeau style="-uslm-dtd:text">In carrying out the responsibility described in paragraph (1), the Director shall—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s204/c/2/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">advise the President, Congress, and other Federal agencies and offices on museum, library, and information services in order to ensure the creation, preservation, organization, and dissemination of knowledge;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s204/c/2/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">engage Federal, State, and local governmental agencies and private entities in assessing the museum, library, and information services needs of the people of the United States, and coordinate the development of plans, policies, and activities to meet such needs effectively;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s204/c/2/C" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">carry out programs of research and development, data collection, and financial assistance to extend and improve the museum, library, and information services of the people of the United States; and</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s204/c/2/D" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">ensure that museum, library, and information services are fully integrated into the information and education infrastructures of the United States.</content>
                            </subparagraph>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s204/d" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Nondelegation.—</heading><content style="-uslm-dtd:text">The Director shall not delegate any of the functions of the Director to any person who is not an officer or employee of the Institute.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s204/e" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Interagency Agreements.—</heading><chapeau style="-uslm-dtd:text">The Director may—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s204/e/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">enter into interagency agreements to promote or assist with the museum, library, and information services-related activities of other Federal agencies, on either a reimbursable or non-reimbursable basis; and</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s204/e/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">use funds appropriated under this Act for the costs of such activities.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s204/f" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Coordination.—</heading><chapeau style="-uslm-dtd:text">The Director shall ensure coordination of the policies and activities of the Institute with the policies and activities of other agencies and offices of the Federal Government having interest in and responsibilities for the improvement of museums and libraries and information services. Where appropriate, the Director shall ensure that such policies and activities are coordinated with—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s204/f/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">programs and activities under the Elementary and Secondary Education Act of 1965 (including programs and activities under subparts 2 and 3 of part B of title II, and parts A and B of title IV, of such Act);</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s204/f/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">programs and activities under the Head Start Act (42 U.S.C. 9831 et seq.) (including programs and activities under subparagraphs (H)(vii) and (J)(iii) of section 641(d)(2) of such Act) (42 U.S.C. 9836(d)(2));</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s204/f/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">activities under the Workforce Innovation and Opportunity Act (including activities under section 121(e) of such Act)); and</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s204/f/4" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">Federal programs and activities that increase the capacity of libraries and museums to act as partners in supporting economic and community development, providing education and research, improving digital literacy skills, strengthening financial literacy and other types of literacy skills, and enhancing public safety and health awareness.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s204/g" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Interagency Collaboration.—</heading><chapeau style="-uslm-dtd:text">The Director shall work jointly with the individuals heading relevant Federal departments and agencies, including the Secretary of Labor, the Secretary of Education, the Administrator of the Small Business Administration, the Chairman of the Federal Communications Commission, the Director of the National Science Foundation, the Secretary of Health and Human Services, the Secretary of State, the Administrator of the Environmental Protection Agency, the Secretary of the Interior, the Secretary of Housing and Urban Development, the Chairman of the National Endowment for the Arts, the Chairman of the National Endowment of the Humanities, the Director of the Office of Management and Budget, the Secretary of Commerce, the Secretary of Veterans Affairs, the Secretary of Defense, the Secretary of Homeland Security, the Secretary of Agriculture, the Chief Executive Officer of the Corporation for National and Community Service, the Librarian of Congress, the Archivist of the United States, and the Director of the United States Government Publishing Office, or the designees of such individuals, on—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s204/g/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">initiatives, materials, technology, or research to support education, workforce development, economic and business development, and related activities and services undertaken by libraries;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s204/g/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">resource and policy approaches to eliminate barriers to fully leveraging the role of libraries and museums in supporting the early learning, literacy, lifelong learning, digital literacy, workforce development, and education needs of the people of the United States; and</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s204/g/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">initiatives, materials, technology, or research to support educational, cultural, historical, scientific, environmental, and other activities undertaken by museums.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s204/h" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="h">(h) </num><heading style="-uslm-dtd:header">Regulatory Authority.—</heading><content style="-uslm-dtd:text">The Director may promulgate such rules and regulations as are necessary and appropriate to implement the provisions of this title.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s204/i" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Application Procedures.—</heading>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s204/i/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">In order to be eligible to receive financial assistance under this title, a person or agency shall submit an application in accordance with procedures established by the Director by regulation.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s204/i/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Review and evaluation.—</heading><content style="-uslm-dtd:text">The Director shall establish procedures for reviewing and evaluating applications submitted under this title. Actions of the Institute and the Director in the establishment, modification, and revocation of such procedures under this Act are vested in the discretion of the Institute and the Director. In establishing such procedures, the Director shall ensure that the criteria by which applications are evaluated are consistent with the purposes of this title, taking into consideration general standards of decency and respect for the diverse beliefs and values of the American public.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s204/i/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Treatment of projects determined to be obscene.—</heading>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s204/i/3/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The procedures described in paragraph (2) shall include provisions that clearly specify that obscenity is without serious literary, artistic, political, or scientific merit, and is not protected speech.</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s204/i/3/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Prohibition.—</heading><content style="-uslm-dtd:text">No financial assistance may be provided under this title with respect to any project that is determined to be obscene.</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s204/i/3/C" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Treatment of application disapproval.—</heading><content style="-uslm-dtd:text">The disapproval of an application by the Director shall not be construed to mean, and shall not be considered as evidence that, the project for which the applicant requested financial assistance is or is not obscene.</content>
                            </subparagraph>
                        </paragraph>

                    <content style="-uslm-dtd:text" class="block">The Office of Library Services shall be headed by a Deputy Director, who shall be appointed by the Director from among individuals who have a graduate degree in library science and expertise in library and information services.                     <num style="-uslm-dtd:enum" value="206">SEC. 206. </num><heading style="-uslm-dtd:header">PERSONNEL. </heading>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s206/a" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The Director may, in accordance with applicable provisions of title 5, United States Code, appoint and determine the compensation of such employees as the Director determines to be necessary to carry out the duties of the Institute.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s206/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Appointment and Compensation of Technical and Professional Employees.—</heading>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s206/b/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Subject to paragraph (2), the Director may appoint without regard to the provisions of title 5, United States Code, governing the appointment in the competitive service and may compensate without regard to the provisions of chapter 51 or subchapter III of chapter 53 of such title (relating to the classification and General Schedule pay rates), such technical and professional employees as the Director determines to be necessary to carry out the duties of the Institute.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s206/b/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Number and compensation.—</heading>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s206/b/2/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The number of employees appointed and compensated under paragraph (1) shall not exceed ⅕ of the number of full-time regular or professional employees of the Institute.</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s206/b/2/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Rate of compensation.—</heading>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stA/s206/b/2/B/i" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Except as provided in clause (ii), the rate of basic compensation for the employees appointed and compensated under paragraph (1) may not exceed the rate prescribed for level GS–15 of the General Schedule under section 5332 of title 5, United States Code.</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stA/s206/b/2/B/ii" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">Exception.—</heading><content style="-uslm-dtd:text">The Director may appoint not more than 3 employees under paragraph (1) at a rate of basic compensation that exceeds the rate described in clause (i) but does not exceed the rate of basic pay in effect for positions at level IV of the Executive Schedule under section 5315 of title 5, United States Code.</content>
                                </clause>
                            </subparagraph>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s206/c" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Voluntary Services.—</heading><content style="-uslm-dtd:text">The Director may accept and utilize the voluntary services of individuals and reimburse the individuals for travel expenses, including per diem in lieu of subsistence, in the same amounts and to the same extent as authorized under section 5703 of title 5, United States Code, for persons employed intermittently in Federal Government service.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s206/d" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Experts and Consultants.—</heading><content style="-uslm-dtd:text">The Director may use experts and consultants, including panels of experts, who may be employed as authorized under section 3109 of title 5, United States Code.</content>

                    <num style="-uslm-dtd:enum" value="207">SEC. 207. </num><heading style="-uslm-dtd:header">NATIONAL MUSEUM AND LIBRARY SERVICES BOARD. </heading>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s207/a" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Establishment.—</heading><content style="-uslm-dtd:text">There is established within the Institute a board to be known as the “<quotedText style="-uslm-dtd:quote">National Museum and Library Services Board</quotedText>”.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s207/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Membership.—</heading>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s207/b/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Number and appointment.—</heading><chapeau style="-uslm-dtd:text">The Museum and Library Services Board shall be composed of the following:</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s207/b/1/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">The Director.</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s207/b/1/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">The Deputy Director for the Office of Library Services.</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s207/b/1/C" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">The Deputy Director for the Office of Museum Services.</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s207/b/1/D" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">Ten members appointed by the President, from among individuals who are citizens of the United States and who are specially qualified by virtue of their education, training, or experience in the area of library services, or their commitment to libraries.</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s207/b/1/E" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">Ten members appointed by the President, from among individuals who are citizens of the United States and who are specially qualified by virtue of their education, training, or experience in the area of museum services, or their commitment to museums.</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s207/b/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Special qualifications.—</heading>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s207/b/2/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Library members.—</heading><chapeau style="-uslm-dtd:text">Of the members of the Museum and Library Services Board appointed under paragraph (1)(D)—</chapeau>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stA/s207/b/2/A/i" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">(i) </num><chapeau style="-uslm-dtd:text">five shall be professional librarians or information specialists, of whom—</chapeau>
                                    <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/94/462/tII/stA/s207/b/2/A/i/I" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">not less than one shall be knowledgeable about electronic information and technical aspects of library and information services and sciences; and</content>
                                    </subclause>
                                    <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/94/462/tII/stA/s207/b/2/A/i/II" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">not less than one other shall be knowledgeable about the library and information service needs of underserved communities, including rural communities; and</content>
                                    </subclause>
                                </clause>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stA/s207/b/2/A/ii" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the remainder shall have special competence in, or knowledge of, the needs for library and information services in the United States.</content>
                                </clause>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s207/b/2/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Museum members.—</heading><chapeau style="-uslm-dtd:text">Of the members of the Museum and Library Services Board appointed under paragraph (1)(E)—</chapeau>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stA/s207/b/2/B/i" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">(i) </num><chapeau style="-uslm-dtd:text">five shall be museum professionals who are or have been affiliated with—</chapeau>
                                    <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/94/462/tII/stA/s207/b/2/B/i/I" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">resources that, collectively, are broadly representative of the curatorial, conservation, educational, and cultural resources of the United States; or</content>
                                    </subclause>
                                    <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/94/462/tII/stA/s207/b/2/B/i/II" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">museums that, collectively, are broadly representative of various types of museums, including museums relating to science, history, technology, art, zoos, botanical gardens, and museums designed for children; and</content>
                                    </subclause>
                                </clause>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stA/s207/b/2/B/ii" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the remainder shall be individuals recognized for their broad knowledge, expertise, or experience in museums or commitment to museums.</content>
                                </clause>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s207/b/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Geographic and other representation.—</heading><content style="-uslm-dtd:text">Members of the Museum and Library Services Board shall be appointed to reflect persons from, and the needs of, various geographic regions of the United States, including rural areas. The Museum and Library Services Board may not include, at any time, more than three appointive members from a single State. In making such appointments, the President shall give due regard to equitable representation of women, minorities, and persons with disabilities who are involved with museums and libraries.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s207/b/4" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Voting.—</heading><content style="-uslm-dtd:text">The Director, the Deputy Director of the Office of Library Services, the Deputy Director of the Office of Museum Services, and the General Counsel of the Institute shall be nonvoting members of the Museum and Library Services Board.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s207/c" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Terms.—</heading>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s207/c/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Each member of the Museum and Library Services Board appointed under subparagraph (D) or (E) of subsection (b)(1) shall serve for a term of 5 years.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s207/c/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Authority to adjust terms.—</heading><content style="-uslm-dtd:text">The terms of the members appointed to the Museum and Library Service Board shall be adjusted by the President as necessary to ensure that the terms of not more than four members expire in the same year. Such adjustments shall be carried out through designation of the adjusted term at the time of appointment.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s207/c/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Vacancies.—</heading><content style="-uslm-dtd:text">Any member appointed to fill a vacancy shall serve for the remainder of the term for which the predecessor of the member was appointed.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s207/c/4" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Reappointment.—</heading><content style="-uslm-dtd:text">No appointive member of the Museum and Library Services Board who has been a member for more than 7 consecutive years shall be eligible for reappointment.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s207/c/5" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Service until successor takes office.—</heading><content style="-uslm-dtd:text">Notwithstanding any other provision of this subsection, an appointive member of the Museum and Library Services Board shall serve after the expiration of the term of the member until the successor to the member takes office.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s207/d" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Duties and Powers.—</heading>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s207/d/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Museum and Library Services Board shall advise the Director on general policies with respect to the duties, powers, and authority of the Institute relating to museum, library, and information services.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s207/d/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">National awards and medals.—</heading><content style="-uslm-dtd:text">The Museum and Library Services Board shall advise the Director in awarding national awards and medals under section 209.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s207/e" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Chairperson.—</heading><content style="-uslm-dtd:text">The Director shall serve as Chairperson of the Museum and Library Services Board.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s207/f" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Secretary.—</heading><content style="-uslm-dtd:text">The General Counsel of the Institute shall serve as Secretary of the Museum and Library Services
 Board.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s207/g" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Meetings.—</heading>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s207/g/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Museum and Library Services Board shall meet not less than 2 times each year and at the call of the Director.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s207/g/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Vote.—</heading><content style="-uslm-dtd:text">All decisions by the Museum and Library Services Board with respect to the exercise of its duties and powers shall be made by a majority vote of the members of the Board who are present and authorized to vote.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s207/h" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="h">(h) </num><heading style="-uslm-dtd:header">Quorum.—</heading><content style="-uslm-dtd:text">A majority of the voting members of the Museum and Library Services Board shall constitute a quorum for the conduct of business at official meetings, but a lesser number of members may hold hearings.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s207/i" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Compensation and Travel Expenses.—</heading>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s207/i/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Compensation.—</heading><content style="-uslm-dtd:text">Each member of the Museum and Library Services Board who is not an officer or employee of the Federal Government may be compensated at a rate to be fixed by the President, but not to exceed the daily equivalent of the maximum annual rate of pay authorized for a position above grade GS–15 of the General Schedule under section 5108 of title 5, United States Code, for each day (including travel time) during which such member is engaged in the performance of the duties of the Museum and Library Services Board. Members of the Museum and Libraries Services Board who are full-time officers or employees of the Federal Government may not receive additional pay, allowances, or benefits by reason of their service on the Museum and Library Services Board.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s207/i/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Travel expenses.—</heading><content style="-uslm-dtd:text">Each member of the Museum and Library Services Board shall receive travel expenses, including per diem in lieu of subsistence, in accordance with applicable provisions under subchapter I of chapter 57 of title 5, United States Code.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s207/j" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="j">(j) </num><heading style="-uslm-dtd:header">Coordination.—</heading><content style="-uslm-dtd:text">The Director, with the advice of the Museum and Library Services Board, shall coordinate the development and implementation of policies and activities as described in subsections (f) and (g) of section 204.</content>

                    <num style="-uslm-dtd:enum" value="208">SEC. 208. </num><heading style="-uslm-dtd:header">CONTRIBUTIONS. </heading>
                    <content style="-uslm-dtd:text" class="block">The Institute is authorized to solicit, accept, receive, and invest in the name of the United States, gifts, bequests, or devises of money and other property or services and to use such property or services in furtherance of the functions of the Institute. Any proceeds from such gifts, bequests, or devises, after acceptance by the Institute, shall be paid by the donor or the representative of the donor to the Director.                     <num style="-uslm-dtd:enum" value="210">SEC. 210. </num><heading style="-uslm-dtd:header">POLICY RESEARCH, DATA COLLECTION, ANALYSIS AND MODELING, EVALUATION, AND DISSEMINATION. </heading>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s210/a" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The Director shall regularly support and conduct, as appropriate, policy research, data collection,
 analysis
 and modeling, evaluation, and dissemination of information to extend and
 improve the Nation’s museum, library, and information services.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s210/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Objectives.—</heading><chapeau style="-uslm-dtd:text">The objectives of the policy research, data collection, analysis and modeling, evaluation, and
 dissemination of information carried out under this section include the
 following:</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s210/b/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">To enhance and expand the capacity of museums, libraries, and information services to anticipate,
 respond to, and meet the evolving needs of communities and the public,
 including by identifying trends and developments that may impact the need
 for and delivery of services.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s210/b/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">To provide information and data on the role, value, and impact of museum, library, and information
 resources, including the identification of trends and potential gaps in
 the
 availability and use of museum and library services by their communities
 and the public.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s210/b/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">To measure the effectiveness of museums, libraries, and information services throughout the United
 States, including the impact of Federal programs authorized under this
 Act.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s210/b/4" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">To identify indicators and outcomes that can be used to create enhancements to the efficiency and
 efficacy of museum, library, and information services.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s210/b/5" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">To promote advancement and growth in museum, library, and information services through sharing of
 best
 practices and effective strategies in order to better serve the people
 of the United States.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s210/b/6" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="6">(6) </num><chapeau style="-uslm-dtd:text">To facilitate planning for, and building of, institutional capacity in order to improve—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s210/b/6/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">museum, library,
 and information services at the national, State, local, and regional
 levels; and</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s210/b/6/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">international communications and cooperative networks.</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s210/b/7" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">To support and enhance collaborative professional networks and consortia that use shared,
 meaningful,
 and actionable data analysis and modeling to advance museum, library, and
 information services and address community needs.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s210/c" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Authority to Contract and Enter Into Other Arrangements.—</heading><content style="-uslm-dtd:text">The Director is authorized to enter into grants, contracts, cooperative agreements, and other
 arrangements with Federal
 agencies, public and private organizations, and other entities with
 expertise the Director determines appropriate, to further the objectives
 described in
 subsection (b) and to carry out the responsibilities under subsection (f).</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s210/d" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Consultation and Public Engagement.—</heading><chapeau style="-uslm-dtd:text">In carrying out subsection (a) and in furtherance of the objectives described in subsection (b),
 the Director—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s210/d/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">shall conduct ongoing collaboration (as determined appropriate by the Director) and consult with—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s210/d/1/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">State library administrative agencies; and</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s210/d/1/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">National, State, tribal, and regional museum and library organizations; and</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s210/d/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">may also collaborate or consult with—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s210/d/2/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">cooperative networks of geographic- or discipline-based museums and libraries; and</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s210/d/2/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">other applicable agencies, organizations (including international organizations), entities
 (including entities with expertise in the fields of
 data collection, analysis and modeling, and evaluation), and community
 stakeholders.</content>
                            </subparagraph>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s210/e" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Assistance to Museums and Libraries.—</heading><content style="-uslm-dtd:text">The Director shall provide technical support and assistance (and other resources, to the extent
 practicable) to ensure consistency in data reporting and help the museum
 and library fields with
 meeting the objectives of this section.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s210/f" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Dissemination.—</heading>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s210/f/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">Each year, the Director shall widely disseminate, as appropriate to further the objectives
 described in
 subsection (b)—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s210/f/1/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the results, data, reports, findings,
 studies, surveys, and other information obtained under this section;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s210/f/1/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the means and approaches by which the objectives described in subsection (b) were accomplished; and</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stA/s210/f/1/C" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">information regarding the manner and extent to which collaboration and consultation were conducted,
 as required by subsection (d).</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s210/f/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Formats to be used.—</heading><content style="-uslm-dtd:text">The information described in paragraph (1) shall
 be shared in formats that facilitate access and ease of use and are
 searchable.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stA/s210/g" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s210/g/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">There are authorized to be appropriated to carry out this section $3,500,000 for each of the fiscal years 2020 through 2025.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stA/s210/g/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Availability of funds.—</heading><content style="-uslm-dtd:text">Sums appropriated under paragraph (1) for any fiscal year shall remain available for obligation until expended.</content>
                        </paragraph>

                    <num style="-uslm-dtd:enum" value="211">SEC. 211. </num><heading style="-uslm-dtd:header">SHORT TITLE. </heading>

                    <num style="-uslm-dtd:enum" value="212">SEC. 212. </num><heading style="-uslm-dtd:header">PURPOSE. </heading>
                    <subsection style="-uslm-dtd:subsection" styleType="OLC" role="undesignated-level"><chapeau style="-uslm-dtd:text">It is the purpose of this subtitle—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/s212/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">to enhance coordination among Federal programs that relate to library, education, and information services;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/s212/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to promote continuous improvement in library services in all types of libraries in order to better serve the people of the United States;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/s212/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">to facilitate access to resources in all types of libraries for the purpose of cultivating an educated and informed citizenry;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/s212/4" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">to encourage resource sharing among all types of libraries for the purpose of achieving economical and efficient delivery of library services to the public;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/s212/5" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">to promote literacy, education, and lifelong learning, including by building learning partnerships with school libraries in our Nation's schools, including tribal schools, and developing resources, capabilities, and programs in support of State, tribal, and local efforts to offer a well-rounded educational experience to all students;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/s212/6" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">to enable libraries to develop services that meet the needs of communities throughout the Nation, including people of diverse geographic, cultural, and socioeconomic backgrounds, individuals with disabilities, residents of rural and urban areas, Native Americans, military families, veterans, and caregivers;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/s212/7" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">to enable libraries to serve as anchor institutions to support community revitalization through enhancing and expanding the services and resources provided by libraries, including those services and resources relating to workforce development, economic and business development, critical thinking skills, health information, digital literacy skills, financial literacy and other types of literacy skills, and new and emerging technology;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/s212/8" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">to enhance the skills of the current library workforce and to recruit future professionals, including those from diverse and underrepresented backgrounds, to the field of library and information services;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/s212/9" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="9">(9) </num><content style="-uslm-dtd:text">to ensure the preservation of knowledge and library collections in all formats and to enable libraries to serve their communities during disasters;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/s212/10" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="10">(10) </num><content style="-uslm-dtd:text">to enhance the role of libraries within the information infrastructure of the United States in order to support research, education, and innovation; </content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/s212/11" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="11">(11) </num><content style="-uslm-dtd:text">to promote library services that provide users with access to information through national, State, local, regional, and international collaborations and networks; and</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/s212/12" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="12">(12) </num><content style="-uslm-dtd:text">to encourage, support, and disseminate model programs of library and museum collaboration.</content>

                    <num style="-uslm-dtd:enum" value="213">SEC. 213. </num><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
                    <subsection style="-uslm-dtd:subsection" styleType="OLC" role="undesignated-level"><chapeau style="-uslm-dtd:text">As used in this subtitle:</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/s213/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Library.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">library</term>” includes—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/s213/1/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">a public library;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/s213/1/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">a public elementary school or secondary school library;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/s213/1/C" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">a tribal library;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/s213/1/D" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">an academic library;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/s213/1/E" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="E">(E) </num><chapeau style="-uslm-dtd:text">a research library, which for the purposes of this subtitle means a library that—</chapeau>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/s213/1/E/i" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">makes publicly available library services and materials suitable for scholarly research and not otherwise available to the public; and</content>
                                </clause>
                                <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/s213/1/E/ii" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">is not an integral part of an institution of higher education; and</content>
                                </clause>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/s213/1/F" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">a private library or other special library, but only if the State in which such private or special library is located determines that the library should be considered a library for purposes of this subtitle.</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/s213/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Library consortium.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">library consortium</term>” means any local, statewide, regional, interstate, or international cooperative association of library entities which provides for the systematic and effective coordination of the resources of school, public, academic, and special libraries and information centers, for improved services for the clientele of such library entities.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/s213/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">State.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">State</term>”, unless otherwise specified, includes each of the 50 States of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, the Republic of the Marshall Islands, the Federated States of Micronesia, and the Republic of Palau.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/s213/4" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">State library administrative agency.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">State library administrative agency</term>” means the official agency of a State charged by the law of the State with the extension and development of public library services throughout the State.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/s213/5" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">State plan.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">State plan</term>” means the document which gives assurances that the officially designated State library administrative agency has the fiscal and legal authority and capability to administer all aspects of this subtitle, provides assurances for establishing the State's policies, priorities, criteria, and procedures necessary to the implementation of all programs under this subtitle, submits copies for approval as required by regulations promulgated by the Director, identifies a State's library needs, and sets forth the activities to be taken toward meeting the identified needs supported with the assistance of Federal funds made available under this subtitle.</content>
                        </paragraph>

                <section style="-uslm-dtd:section" identifier="/us/sComp/94/462/tII/stB/s214" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="214">SEC. 214. </num><heading style="-uslm-dtd:header">AUTHORIZATION OF APPROPRIATIONS. </heading>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stB/s214/a" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">There are authorized to be appropriated—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/s214/a/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">to carry out chapters 1, 2, and 3, $232,000,000 for each of the fiscal years 2020 through 2025; and</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/s214/a/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to carry out chapter 4, $24,500,000 for each of the fiscal years 2020 through 2025.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stB/s214/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Forward Funding.—</heading>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/s214/b/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">To the end of affording the responsible Federal, State, and local officers adequate notice of available Federal financial assistance for carrying out ongoing library activities and projects, appropriations for grants contracts, or other payments under any program under this subtitle are authorized to be included in the appropriations Act for the fiscal year preceding the fiscal year during which such activities and projects shall be carried out.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/s214/b/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Additional authorization of appropriations.—</heading><content style="-uslm-dtd:text">In order to effect a transition to the timing of appropriation action authorized by subsection (a), the application of this section may result in the enactment, in a fiscal year, of separate appropriations for a program under this subtitle (whether in the same appropriations Act or otherwise) for two consecutive fiscal years.</content>
                        </paragraph>

                <chapter style="-uslm-dtd:chapter" identifier="/us/sComp/94/462/tII/stB/ch1" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">CHAPTER 1—</num><heading style="-uslm-dtd:header">BASIC PROGRAM REQUIREMENTS </heading>
                    <section style="-uslm-dtd:section" identifier="/us/sComp/94/462/tII/stB/ch1/s221" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="221">SEC. 221. </num><heading style="-uslm-dtd:header">RESERVATIONS AND ALLOTMENTS. </heading>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stB/ch1/s221/a" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Reservations.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s221/a/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">From the amount appropriated under the authority of section 214 for any fiscal year, the Director—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s221/a/1/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">shall reserve 2.25 percent to award grants in accordance with section 261; and</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s221/a/1/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">shall reserve 3.75 percent to award national leadership grants or contracts in accordance with section 262.</content>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s221/a/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Special rule.—</heading><content style="-uslm-dtd:text">If the funds reserved pursuant to paragraph (1)(B) for a fiscal year have not been obligated by the end of such fiscal year, then such funds shall be allotted in accordance with subsection (b) for the fiscal year succeeding the fiscal year for which the funds were so reserved.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stB/ch1/s221/b" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Allotments.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s221/b/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">From the sums appropriated under the authority of section 214 and not reserved under subsection (a) for any fiscal year, the Director shall award grants from minimum allotments, as determined under paragraph (3), to each State. Any sums remaining after minimum allotments are made for such year shall be allotted in the manner set forth in paragraph (2).</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s221/b/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Remainder.—</heading><content style="-uslm-dtd:text">From the remainder of any sums appropriated under the authority of section 214 that are not reserved under subsection (a) and not allotted under paragraph (1) for any fiscal year, the Director shall award grants to each State in an amount that bears the same relation to such remainder as the population of the State bears to the population of all States.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s221/b/3" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Minimum allotments.—</heading>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s221/b/3/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">For purposes of this subsection, the minimum allotment for each State shall be $680,000, except that the minimum allotment shall be $60,000 in the case of the United States Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, the Republic of the Marshall Islands, the Federated States of Micronesia, and the Republic of Palau.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s221/b/3/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Ratable reductions.—</heading><content style="-uslm-dtd:text">Notwithstanding subparagraph (A), if the sum appropriated under the authority of section 214 and not reserved under subsection (a) for any fiscal year is insufficient to fully satisfy the requirement of subparagraph (A), each of the minimum allotments under such subparagraph shall be reduced ratably.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s221/b/3/C" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Exception.—</heading>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch1/s221/b/3/C/i" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">Notwithstanding subparagraph (A), if the sum appropriated under the authority of section 214 and
 not reserved under subsection (a) for any fiscal year exceeds the
 aggregate of the allotments for all States under this subsection for
 fiscal year 2019—</chapeau>
                                        <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/94/462/tII/stB/ch1/s221/b/3/C/i/I" styleType="OLC">
                                            <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">the minimum allotment for each State otherwise receiving a minimum allotment of $680,000 under
 subparagraph (A) shall be increased to $1,000,000; and</content>
                                        </subclause>
                                        <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/94/462/tII/stB/ch1/s221/b/3/C/i/II" styleType="OLC">
                                            <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">the minimum allotment for each State otherwise receiving a minimum allotment of $60,000 under
 subparagraph (A) shall be increased to $100,000.</content>
                                        </subclause>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch1/s221/b/3/C/ii" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">Insufficient funds to award alternative minimum.—</heading><content style="-uslm-dtd:text">If the sum appropriated under the authority of section 214 and not reserved under subsection (a)
 for any fiscal year exceeds the aggregate of the allotments for all States
 under this subsection for fiscal year 2019, yet is insufficient to fully
 satisfy the requirement of clause (i), such excess amount shall first be
 allotted among the States described in clause (i)(I) so as to increase
 equally the minimum allotment for each such State above $680,000. After
 the requirement of clause (i)(I) is fully satisfied for any fiscal year,
 any remainder of such excess amount shall be allotted among the States
 described in clause (i)(II) so as to increase equally the minimum
 allotment for each such State above $60,000.</content>
                                    </clause>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s221/b/4" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Data.—</heading><content style="-uslm-dtd:text">The population of each State and of all the States shall be determined by the Director on the basis of the most recent data available from the Bureau of the Census.</content>
                            </paragraph>

                        <num style="-uslm-dtd:enum" value="222">SEC. 222. </num><heading style="-uslm-dtd:header">ADMINISTRATION. </heading>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stB/ch1/s222/a" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Not more than 4 percent of the total amount of funds received under this subtitle for any fiscal year by a State may be used for administrative costs.</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stB/ch1/s222/b" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Construction.—</heading><content style="-uslm-dtd:text">Nothing in this section shall be construed to limit spending for evaluation costs under section 224(c) from sources other than this subtitle.</content>

                    <section style="-uslm-dtd:section" identifier="/us/sComp/94/462/tII/stB/ch1/s223" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="223">SEC. 223. </num><heading style="-uslm-dtd:header">PAYMENTS; FEDERAL SHARE; AND MAINTENANCE OF EFFORT REQUIREMENTS. </heading>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stB/ch1/s223/a" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Payments.—</heading><content style="-uslm-dtd:text">Subject to appropriations provided pursuant to section 214, the Director shall pay to each State library administrative agency having a State plan approved under section 224 the Federal share of the cost of the activities described in the State plan.</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stB/ch1/s223/b" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Federal Share.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s223/b/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Federal share shall be 66 percent.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s223/b/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Non-federal share.—</heading><content style="-uslm-dtd:text">The non-Federal share of payments shall be provided from non-Federal, State, or local sources.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stB/ch1/s223/c" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Maintenance of Effort.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s223/c/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">State expenditures.—</heading>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s223/c/1/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Requirement.—</heading>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch1/s223/c/1/A/i" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The amount otherwise payable to a State for a fiscal year pursuant to an allotment under this chapter shall be reduced if the level of State expenditures, as described in paragraph (2), for the previous fiscal year is less than the average of the total of such expenditures for the 3 fiscal years preceding that previous fiscal year. The amount of the reduction in the allotment for any fiscal year shall be equal to the allotment multiplied by a fraction—</chapeau>
                                        <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/94/462/tII/stB/ch1/s223/c/1/A/i/I" styleType="OLC">
                                            <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">the numerator of which is the result obtained by subtracting the level of such State expenditures for the fiscal year for which the determination is made, from the average of the total level of such State expenditures for the 3 fiscal years preceding the fiscal year for which the determination is made; and</content>
                                        </subclause>
                                        <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/94/462/tII/stB/ch1/s223/c/1/A/i/II" styleType="OLC">
                                            <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">the denominator of which is the average of the total level of such State expenditures for the 3 fiscal years preceding the fiscal year for which the determination is made.</content>
                                        </subclause>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch1/s223/c/1/A/ii" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">Calculation.—</heading><content style="-uslm-dtd:text">Any decrease in State expenditures resulting from the application of subparagraph (B) shall be excluded from the calculation of the average level of State expenditures for any 3-year period described in clause (i).</content>
                                    </clause>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s223/c/1/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Decrease in federal support.—</heading><content style="-uslm-dtd:text">If the amount made available under this subtitle for a fiscal year is less than the amount made available under this subtitle for the preceding fiscal year, then the expenditures required by subparagraph (A) for such preceding fiscal year shall be decreased by the same percentage as the percentage decrease in the amount so made available.</content>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s223/c/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Level of state expenditures.—</heading><content style="-uslm-dtd:text">The level of State expenditures for the purposes of paragraph (1) shall include all State dollars expended by the State library administrative agency for library programs that are consistent with the purposes of this subtitle. All funds included in the maintenance of effort calculation under this subsection shall be expended during the fiscal year for which the determination is made, and shall not include capital expenditures, special one-time project costs, or similar windfalls.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s223/c/3" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Waiver.—</heading><content style="-uslm-dtd:text">The Director may waive the requirements of paragraph (1) if the Director determines that such a waiver would be equitable due to exceptional or uncontrollable circumstances such as a natural disaster or a precipitous and unforeseen decline in the financial resources of the State.</content>
                            </paragraph>

                    <section style="-uslm-dtd:section" identifier="/us/sComp/94/462/tII/stB/ch1/s224" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="224">SEC. 224. </num><heading style="-uslm-dtd:header">STATE PLANS. </heading>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stB/ch1/s224/a" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">State Plan Required.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/a/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">In order to be eligible to receive a grant under this subtitle, a State library administrative agency shall submit a State plan to the Director once every 5 years, as determined by the Director.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/a/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Duration.—</heading><content style="-uslm-dtd:text">The State plan shall cover a period of 5 fiscal years.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/a/3" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Revisions.—</heading><content style="-uslm-dtd:text">If a State library administrative agency makes a substantive revision to its State plan, then the State library administrative agency shall submit to the Director an amendment to the State plan containing such revision not later than April 1 of the fiscal year preceding the fiscal year for which the amendment will be effective.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stB/ch1/s224/b" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Contents.—</heading><chapeau style="-uslm-dtd:text">The State plan shall—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/b/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">establish goals, and specify priorities, for the State consistent with the purposes of this subtitle;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/b/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">describe activities that are consistent with the goals and priorities established under paragraph (1), the purposes of this subtitle, and section 231, that the State library administrative agency will carry out during such year using such grant;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/b/3" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">describe the procedures that such agency will use to carry out the activities described in paragraph (2);</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/b/4" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">describe the methodology that such agency will use to evaluate the success of the activities established under paragraph (2) in achieving the goals and meeting the priorities described in paragraph (1);</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/b/5" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">describe the procedures that such agency will use to involve libraries and library users throughout the State in policy decisions regarding implementation of this subtitle;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/b/6" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="6">(6) </num><chapeau style="-uslm-dtd:text">describe how the State library administrative agency will work with other State agencies and offices where appropriate to coordinate resources, programs, and activities and leverage, but not replace, the Federal and State investment in—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/b/6/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">programs and activities under the Elementary and Secondary Education Act of 1965 (including programs and activities under subparts 2 and 3 of part B of title II, and parts A and B of title IV, of such Act);</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/b/6/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">early childhood education, including coordination with—</chapeau>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/b/6/B/i" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the State's activities carried out under subsections (b)(4) and (e)(1) of section 642 of the Head Start Act (42 U.S.C. 9837); and</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/b/6/B/ii" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the activities described in the State's strategic plan in accordance with section 642B(a)(4)(B)(i) of such Act (42 U.S.C. 9837b(a)(4)(B)(i));</content>
                                    </clause>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/b/6/C" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="C">(C) </num><chapeau style="-uslm-dtd:text">workforce development, including coordination with—</chapeau>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/b/6/C/i" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the activities carried out by the State workforce development board under section 101 of the Workforce Innovation and Opportunity Act; </content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/b/6/C/ii" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the State's one-stop delivery system established under section 121(e) of such Act; and</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/b/6/C/iii" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">the activities carried out by the State in support of adult education and literacy under title II of such Act; and</content>
                                    </clause>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/b/6/D" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">other Federal programs and activities that relate to library services, including economic, business, and community development , health information, critical thinking skills, digital literacy skills, financial literacy and other types of literacy skills;</content>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/b/7" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">provide assurances that the State will comply with subsection (f); and</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/b/8" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">provide assurances satisfactory to the Director that such agency will make such reports, in such form and containing such information, as the Director may reasonably require to carry out this subtitle and to determine the extent to which funds provided under this subtitle have been effective in carrying out the purposes of this subtitle.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stB/ch1/s224/c" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Evaluation and Report.—</heading><content style="-uslm-dtd:text">Each State library administrative agency receiving a grant under this subtitle shall independently evaluate, and report to the Director regarding, the activities assisted under this subtitle, prior to the end of the 5-year plan.</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stB/ch1/s224/d" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Information.—</heading><content style="-uslm-dtd:text">Each library receiving assistance under this subtitle shall submit to the State library administrative agency such information as such agency may require to meet the requirements of subsection (c).</content>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stB/ch1/s224/e" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Approval.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/e/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Director shall approve any State plan under this subtitle that meets the requirements of this subtitle and provides satisfactory assurances that the provisions of such plan will be carried out.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/e/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Public availability.—</heading><content style="-uslm-dtd:text">Each State library administrative agency receiving a grant under this subtitle shall make the State plan available to the public, including through electronic means.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/e/3" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Administration.—</heading><chapeau style="-uslm-dtd:text">If the Director determines that the State plan does not meet the requirements of this section, the Director shall—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/e/3/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">immediately notify the State library administrative agency of such determination and the reasons for such determination;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/e/3/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">offer the State library administrative agency the opportunity to revise its State plan;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/e/3/C" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">provide technical assistance in order to assist the State library administrative agency in meeting the requirements of this section; and</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/e/3/D" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">provide the State library administrative agency the opportunity for a hearing.</content>
                                </subparagraph>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Internet Safety.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">No funds made available under this subtitle for a library described in section 213(1)(A) or (B) that does not receive services at discount rates under section 254(h)(6) of the Communications Act of 1934 (47 U.S.C. 254(h)(6)) may be used to purchase computers used to access the Internet, or to pay for direct costs associated with accessing the Internet, for such library unless—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/1/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">such library—</chapeau>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/1/A/i" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="i">(i) </num><chapeau style="-uslm-dtd:text">has in place a policy of Internet safety for minors that includes the operation of a technology protection measure with respect to any of its computers with Internet access that protects against access through such computers to visual depictions that are—</chapeau>
                                        <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/1/A/i/I" styleType="OLC">
                                            <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">obscene;</content>
                                        </subclause>
                                        <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/1/A/i/II" styleType="OLC">
                                            <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">child pornography; or</content>
                                        </subclause>
                                        <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/1/A/i/III" styleType="OLC">
                                            <num style="-uslm-dtd:enum" value="III">(III) </num><content style="-uslm-dtd:text">harmful to minors; and</content>
                                        </subclause>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/1/A/ii" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">is enforcing the operation of such technology protection measure during any use of such computers by minors; and</content>
                                    </clause>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/1/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">such library—</chapeau>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/1/B/i" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="i">(i) </num><chapeau style="-uslm-dtd:text">has in place a policy of Internet safety that includes the operation of a technology protection measure with respect to any of its computers with Internet access that protects against access through such computers to visual depictions that are—</chapeau>
                                        <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/1/B/i/I" styleType="OLC">
                                            <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">obscene; or</content>
                                        </subclause>
                                        <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/1/B/i/II" styleType="OLC">
                                            <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">child pornography; and</content>
                                        </subclause>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/1/B/ii" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">is enforcing the operation of such technology protection measure during any use of such computers.</content>
                                    </clause>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Access to other materials.—</heading><content style="-uslm-dtd:text">Nothing in this subsection shall be construed to prohibit a library from limiting Internet access to or otherwise protecting against materials other than those referred to in subclauses (I), (II), and (III) of paragraph (1)(A)(i).</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/3" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Disabling during certain use.—</heading><content style="-uslm-dtd:text">An administrator, supervisor, or other authority may disable a technology protection measure under paragraph (1) to enable access for bona fide research or other lawful purposes.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/4" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Timing and applicability of implementation.—</heading>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/4/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">A library covered by paragraph (1) shall certify the compliance of such library with the requirements of paragraph (1) as part of the application process for the next program funding year under this subtitle following the effective date of this subsection, and for each subsequent program funding year thereafter.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/4/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Process.—</heading>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/4/B/i" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Libraries with internet safety policies and technology protection measures in place.—</heading><content style="-uslm-dtd:text">A library covered by paragraph (1) that has in place an Internet safety policy meeting the requirements of paragraph (1) shall certify its compliance with paragraph (1) during each annual program application cycle under this subtitle.</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/4/B/ii" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">Libraries without internet safety policies and technology protection measures in place.—</heading><chapeau style="-uslm-dtd:text">A library covered by paragraph (1) that does not have in place an Internet safety policy meeting the requirements of paragraph (1)—</chapeau>
                                        <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/4/B/ii/I" styleType="OLC">
                                            <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">for the first program year after the effective date of this subsection in which the library applies for funds under this subtitle, shall certify that it is undertaking such actions, including any necessary procurement procedures, to put in place an Internet safety policy that meets such requirements; and</content>
                                        </subclause>
                                        <subclause style="-uslm-dtd:subclause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/4/B/ii/II" styleType="OLC">
                                            <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">for the second program year after the effective date of this subsection in which the library applies for funds under this subtitle, shall certify that such library is in compliance with such requirements.</content>
                                        </subclause><continuation style="-uslm-dtd:continuation-text" role="clause">Any library covered by paragraph (1) that is unable to certify compliance with such requirements in such second program year shall be ineligible for all funding under this subtitle for such second program year and all subsequent program years until such time as such library comes into compliance with such requirements.</continuation>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/4/B/iii" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="iii">(iii) </num><heading style="-uslm-dtd:header">Waivers.—</heading><content style="-uslm-dtd:text">Any library subject to a certification under clause (ii)(II) that cannot make the certification otherwise required by that clause may seek a waiver of that clause if State or local procurement rules or regulations or competitive bidding requirements prevent the making of the certification otherwise required by that clause. The library shall notify the Director of the Institute of Museum and Library Services of the applicability of that clause to the library. Such notice shall certify that the library will comply with the requirements in paragraph (1) before the start of the third program year after the effective date of this subsection for which the library is applying for funds under this subtitle.</content>
                                    </clause>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/5" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Noncompliance.—</heading>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/5/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Use of general education provisions act remedies.—</heading><chapeau style="-uslm-dtd:text">Whenever the Director of the Institute of Museum and Library Services has reason to believe that any recipient of funds this subtitle is failing to comply substantially with the requirements of this subsection, the Director may—</chapeau>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/5/A/i" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">withhold further payments to the recipient under this subtitle,</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/5/A/ii" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">issue a complaint to compel compliance of the recipient through a cease and desist order, or</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/5/A/iii" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">enter into a compliance agreement with a recipient to bring it into compliance with such requirements.</content>
                                    </clause>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/5/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Recovery of funds prohibited.—</heading><content style="-uslm-dtd:text">The actions authorized by subparagraph (A) are the exclusive remedies available with respect to the failure of a library to comply substantially with a provision of this subsection, and the Director shall not seek a recovery of funds from the recipient for such failure.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/5/C" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Recommencement of payments.—</heading><content style="-uslm-dtd:text">Whenever the Director determines (whether by certification or other appropriate evidence) that a recipient of funds who is subject to the withholding of payments under subparagraph (A)(i) has cured the failure providing the basis for the withholding of payments, the Director shall cease the withholding of payments to the recipient under that subparagraph.</content>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/6" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="6">(6) </num><heading style="-uslm-dtd:header">Separability.—</heading><content style="-uslm-dtd:text">If any provision of this subsection is held invalid, the remainder of this subsection shall not be affected thereby.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/7" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="7">(7) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">In this subsection:</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/7/A" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Child pornography.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">child pornography</term>” has the meaning given such term in section 2256 of title 18, United States Code.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/7/B" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Harmful to minors.—</heading><chapeau style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">harmful to minors</term>” means any picture, image, graphic image file, or other visual depiction that—</chapeau>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/7/B/i" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">taken as a whole and with respect to minors, appeals to a prurient interest in nudity, sex, or excretion;</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/7/B/ii" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">depicts, describes, or represents, in a patently offensive way with respect to what is suitable for minors, an actual or simulated sexual act or sexual contact, actual or simulated normal or perverted sexual acts, or a lewd exhibition of the genitals; and</content>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/7/B/iii" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">taken as a whole, lacks serious literary, artistic, political, or scientific value as to minors.</content>
                                    </clause>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/7/C" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Minor.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">minor</term>” means an individual who has not attained the age of 17.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/7/D" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">Obscene.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">obscene</term>” has the meaning applicable to such term in section 1460 of title 18, United States Code.</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch1/s224/f/7/E" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="E">(E) </num><heading style="-uslm-dtd:header">Sexual act; sexual contact.—</heading><content style="-uslm-dtd:text">The terms “<term style="-uslm-dtd:term">sexual act</term>” and “<quotedText style="-uslm-dtd:quote">sexual contact</quotedText>” have the meanings given such terms in section 2246 of title 18, United States Code.</content>
                                </subparagraph>

                    <num style="-uslm-dtd:enum" value="2">CHAPTER 2—</num><heading style="-uslm-dtd:header">LIBRARY PROGRAMS </heading>
                    <section style="-uslm-dtd:section" identifier="/us/sComp/94/462/tII/stB/ch2/s231" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="231">SEC. 231. </num><heading style="-uslm-dtd:header">GRANTS TO STATES. </heading>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stB/ch2/s231/a" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">Of the funds provided to a State library administrative agency under section 214, such agency shall expend, either directly or through subgrants of cooperative agreements, at least 96 percent of such funds for—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch2/s231/a/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">expanding services for learning and access to information and educational resources in a variety of formats (including new and emerging technology), in all types of libraries, for individuals of all ages in order to support such individuals' needs for education, lifelong learning, workforce development, economic and business development, health information, critical thinking skills, digital literacy skills, and financial literacy and other types of literacy skills;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch2/s231/a/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">establishing or enhancing electronic and other linkages and improved coordination among and between libraries and entities, as described in section 224(b)(6), for the purpose of improving the quality of and access to library and information services;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch2/s231/a/3" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">(3)</num><subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch2/s231/a/3/A" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">providing training and professional development, including continuing education, to enhance the skills of the current library workforce and leadership, and advance the delivery of library and information services; and</content></subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch2/s231/a/3/B" styleType="OLC" class="leftIndentDecrease1">
                                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">enhancing efforts to recruit future professionals, including those from diverse and underrepresented backgrounds, to the field of library and information services;</content>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch2/s231/a/4" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">developing public and private partnerships with other agencies, tribes, and community-based organizations;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch2/s231/a/5" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">targeting library services to individuals of diverse geographic, cultural, and socioeconomic backgrounds, to individuals with disabilities, and to individuals with limited functional literacy or information skills;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch2/s231/a/6" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">targeting library and information services to persons having difficulty using a library and to underserved urban and rural communities, including children (from birth through age 17) from families with incomes below the poverty line (as defined by the Office of Management and Budget and revised annually in accordance with section 673(2) of the Community Services Block Grant Act (42 U.S.C. 9902(2))) applicable to a family of the size involved;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch2/s231/a/7" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">developing library services that provide all users access to information through local, State, regional, national, and international collaborations and networks; and</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch2/s231/a/8" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">carrying out other activities consistent with the purposes set forth in section 212, as described in the State library administrative agency's plan.</content>
                            </paragraph>
                        </subsection>

                            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stB/ch3/schB/s262/a" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">From the amounts reserved under section 221(a)(1)(B) for any fiscal year the Director shall establish and carry out a program  to enhance the quality of library services nationwide and to provide coordination between libraries and museums, including by carrying out activities such as—</chapeau>
                                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch3/schB/s262/a/1" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">building workforce and institutional capacity for managing the national information infrastructure and serving the information and education needs of the public;</content>
                                </paragraph>
                                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch3/schB/s262/a/2" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="2">(2)</num><subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch3/schB/s262/a/2/A" styleType="OLC" class="inline"><num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">research and demonstration projects related to the improvement of libraries or the enhancement of library and information services through effective and efficient use of new and emerging technologies, including projects that enable library users to acquire digital literacy skills and that make information resources more accessible and available; and</content></subparagraph>
                                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch3/schB/s262/a/2/B" styleType="OLC" class="leftIndentDecrease1">
                                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">dissemination of information derived from such projects;</content>
                                    </subparagraph>
                                </paragraph>
                                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch3/schB/s262/a/3" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">conserving, preserving, and digitizing library materials and resources, giving priority to projects emphasizing coordination, optimizing conditions for storage and future use, offering staff training, avoiding duplication, and providing access by researchers beyond the institution or library entity undertaking the project;</content>
                                </paragraph>
                                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch3/schB/s262/a/4" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="4">(4) </num><chapeau style="-uslm-dtd:text">enhancing the ability of libraries to provide services to affected communities in the event of an emergency or disaster through—</chapeau>
                                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch3/schB/s262/a/4/A" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">the development of national, regional, statewide, or local emergency and disaster management plans that—</chapeau>
                                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch3/schB/s262/a/4/A/i" styleType="OLC">
                                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">address communication and coordination of information and services for affected communities; and</content>
                                        </clause>
                                        <clause style="-uslm-dtd:clause" identifier="/us/sComp/94/462/tII/stB/ch3/schB/s262/a/4/A/ii" styleType="OLC">
                                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">ensure the preservation of knowledge and library collections; and</content>
                                        </clause>
                                    </subparagraph>
                                    <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stB/ch3/schB/s262/a/4/B" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the implementation of the emergency and disaster management plans described in subparagraph (A), or otherwise enabling libraries to provide services consistent with this Act to affected communities in the event of an emergency or disaster; and</content>
                                    </subparagraph>
                                </paragraph>
                                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch3/schB/s262/a/5" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">model programs demonstrating cooperative efforts between libraries and museums.</content>
                                </paragraph>
                            </subsection>
                            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stB/ch3/schB/s262/b" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Grants, Contracts, or Cooperative Agreements.—</heading>
                                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch3/schB/s262/b/1" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Director may carry out the activities described in subsection (a) by entering into
 arrangements, including grants, contracts, cooperative agreements, and
 other forms of assistance, with libraries, library consortia and
 associations, institutions of higher education, museums, and other
 entities that the Director determines appropriate.</content>
                                </paragraph>
                                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch3/schB/s262/b/2" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Competitive basis.—</heading><content style="-uslm-dtd:text">Grants, contracts, cooperative agreements, and other arrangements or forms of assistance under this section shall be awarded on a competitive basis.</content>
                                </paragraph>
                            </subsection>
                            <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stB/ch3/schB/s262/c" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Special Rule.—</heading><chapeau style="-uslm-dtd:text">The Director shall make every effort to ensure that activities assisted under this section—</chapeau>
                                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch3/schB/s262/c/1" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">are administered
 by appropriate library and museum professionals or experts;</content>
                                </paragraph>
                                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch3/schB/s262/c/2" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">reflect and serve a range of library types and geographically diverse areas;</content>
                                </paragraph>
                                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch3/schB/s262/c/3" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">include evaluation, analysis, and dissemination components; and</content>
                                </paragraph>
                                <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch3/schB/s262/c/4" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">to the extent practicable, actively involve, have direct impact on, or provide future application in, libraries.</content>

                    <num style="-uslm-dtd:enum" value="4">CHAPTER 4—</num><heading style="-uslm-dtd:header">LAURA BUSH 21ST CENTURY LIBRARIANS </heading>
                    <section style="-uslm-dtd:section" identifier="/us/sComp/94/462/tII/stB/ch4/s264" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="264">SEC. 264. </num><heading style="-uslm-dtd:header">LAURA BUSH 21ST CENTURY LIBRARIAN PROGRAM. </heading>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stB/ch4/s264/a" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Purpose.—</heading><chapeau style="-uslm-dtd:text">It is the purpose of this chapter to develop a diverse workforce of librarians by—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch4/s264/a/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">recruiting and educating the next generation of librarians from diverse and underrepresented
backgrounds, including by encouraging at the middle school, high school, and postsecondary levels students to pursue careers in library and information science;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch4/s264/a/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">developing faculty and library leaders from diverse and
underrepresented backgrounds, including by increasing the institutional capacity of graduate schools of library and information science; and</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch4/s264/a/3" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">enhancing the training and professional development of librarians and the library workforce to enable librarians and the library workforce to meet the needs of their communities, including those needs relating to education, lifelong learning, workforce development, economic and business development, health information, critical thinking skills, digital literacy skills, financial and other types of literacy skills, and new and emerging technology.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stB/ch4/s264/b" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Activities.—</heading><chapeau style="-uslm-dtd:text">From the amounts provided under section 214(a)(2), the Director may enter into arrangements, including grants, contracts, cooperative agreements, and other forms of assistance, with libraries, library consortia and associations, institutions of higher education (as defined in section 101 of the Higher Education Act of 1965 (20 U.S.C. 1001)), and other entities that the Director determines appropriate, for projects that further the purpose of this chapter, such as projects that—</chapeau>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch4/s264/b/1" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">increase the number of students enrolled in nationally accredited graduate library and information science programs and preparing for careers of service in libraries;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch4/s264/b/2" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">recruit future professionals, including efforts to attract promising middle school, high school, or postsecondary students to consider careers in library and information science;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch4/s264/b/3" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">develop or enhance professional development programs for librarians and the library workforce;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch4/s264/b/4" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">enhance curricula within nationally accredited graduate library and information science programs;</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch4/s264/b/5" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">enhance doctoral education in order to develop faculty to educate the future generation of library professionals and develop the future generation of library leaders; and</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stB/ch4/s264/b/6" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">conduct research, including research to support the successful recruitment and education of the next generation of librarians.</content>
                            </paragraph>
                        </subsection>
                        <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stB/ch4/s264/c" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Evaluation.—</heading><content style="-uslm-dtd:text">The Director shall establish procedures for reviewing and evaluating projects supported under this chapter.</content>

                    <subsection style="-uslm-dtd:subsection" styleType="OLC" role="undesignated-level"><chapeau style="-uslm-dtd:text">It is the purpose of this subtitle—</chapeau>

                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">to encourage and support museums in carrying out their educational role, as core providers of learning and in conjunction with schools, families, and communities;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s272/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">to encourage and support museums in carrying out their public service role of connecting the whole of society to the cultural, artistic, historical, natural, and scientific understandings that constitute our diverse heritage;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s272/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">to encourage leadership, innovation, and applications of the most current technologies and practices to enhance museum services through international, national, regional, State, and local networks and partnerships;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s272/4" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">to assist, encourage, and support museums in carrying out their stewardship responsibilities to achieve the highest standards in conservation and care of the diverse cultural, historic, natural, and scientific heritage of the United States to benefit future generations;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s272/5" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">to assist, encourage, and support museums in achieving the highest standards of management and service to the public, and to ease the financial burden borne by museums as they serve their communities in new and different ways;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s272/6" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">to support resource sharing and partnerships among museums, libraries, schools, and other community organizations;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s272/7" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">to encourage and support museums as a part of economic development and revitalization in communities;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s272/8" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">to ensure museums of various types and sizes in diverse geograic regions of the United States are afforded attention and support; </content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s272/9" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="9">(9) </num><content style="-uslm-dtd:text">to support efforts at the State and regional levels to leverage museum resources and maximize museum services; and</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s272/10" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="10">(10) </num><content style="-uslm-dtd:text">to assist museums in their civic engagement efforts to ensure that every person in the United States has access to high-quality museum services.</content>

                    <num style="-uslm-dtd:enum" value="273">SEC. 273. </num><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
                    <subsection style="-uslm-dtd:subsection" styleType="OLC" role="undesignated-level"><chapeau style="-uslm-dtd:text">As used in this subtitle:</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s273/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Museum.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">museum</term>” means a public, tribal,<ref style="-uslm-dtd:footnote-ref" idref="IDF2EE53B4AFF04DDA877E0E2FD6405E92" class="footnoteRef">1</ref> or private nonprofit agency or institution organized on a permanent basis for essentially educational, cultural heritage, or aesthetic purposes, that utilizes a professional staff, owns or utilizes tangible objects, cares for the tangible objects, and exhibits the tangible objects to the public on a regular basis. Such term includes museums that have tangible and digital collections and includes aquariums, arboretums, botanical gardens, art museums, children's museums, general museums, historic houses and sites, history museums, nature centers, natural history and anthropology museums, planetariums, science and technology centers, specialized museums, and zoological parks.</content><footnote id="IDF2EE53B4AFF04DDA877E0E2FD6405E92" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">Section 17(1) of Public Law 115–410 amends paragraph (1) by inserting “<term style="-uslm-dtd:quote">, tribal,</term>” after “<term style="-uslm-dtd:quote">public</term>”.                             <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">State.—</heading><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">State</term>” means each of the 50 States of the United States, the District of Columbia, the Commomwealth of Puerto Rico, the United States Virgin Islands, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, the Republic of the Marshall Islands, the Federated States of Micronesia, and the Republic of Palau.</content>
                        </paragraph>

                    <num style="-uslm-dtd:enum" value="274">SEC. 274. </num><heading style="-uslm-dtd:header">MUSEUM SERVICES ACTIVITIES. </heading>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stC/s274/a" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">The Director, subject to the policy advice of the Museum and Library Services Board, may enter into arrangements, including grants, contracts, cooperative agreements, and other forms of assistance, with museums, States, local governments, and other entities as the Director considers appropriate, to pay the Federal share of the cost of—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s274/a/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">supporting museums in providing learning and access to collections, information, and educational resources in a variety of formats (including exhibitions, programs, publications, and websites) for individuals of all ages;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s274/a/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">supporting museums in building learning partnerships with the Nation’s schools, including tribal schools, and developing museum resources, capabilities, and programs in support of State and local efforts to offer a well-rounded educational experience to all students;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s274/a/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><chapeau style="-uslm-dtd:text">supporting the conservation and preservation of museum collections, including efforts to—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stC/s274/a/3/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">provide optimal conditions for storage, exhibition, and use;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stC/s274/a/3/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">prepare for and respond to disasters and emergency situations;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stC/s274/a/3/C" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">establish endowments for conservation; </content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stC/s274/a/3/D" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">curate, stabilize, and organize object-related information; and</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stC/s274/a/3/E" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">train museum staff in collections care;</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s274/a/4" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">supporting efforts at the State level to leverage museum resources, including statewide assessments of museum services and needs and development of State plans to improve and maximize museum services through the State;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s274/a/5" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">creating shared technology tools and data resources, and developing museum staff training plans to improve and maximize museum services through organizations such as museum associations, professional networks, community-based organizations, and foundations, and through other collaborative mechanisms;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s274/a/6" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="6">(6) </num><chapeau style="-uslm-dtd:text">stimulating greater collaboration, in order to share resources and strengthen communities, among museums and—</chapeau>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stC/s274/a/6/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">libraries;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stC/s274/a/6/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">schools;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stC/s274/a/6/C" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">institutions of higher education;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stC/s274/a/6/D" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">international, Federal, State, regional, tribal, and local agencies or organizations;</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stC/s274/a/6/E" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">nongovernmental organizations; </content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stC/s274/a/6/F" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">other community organizations; and</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stC/s274/a/6/G" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">other relevant research and policy organizations;</content>
                            </subparagraph>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s274/a/7" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">encouraging the use of new and emergingtechnologies and media, including new ways to disseminate information, engage varied audiences in experiential learning, and support teachers and students to enhance access to and engagement withmuseum collections, programs, and services;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s274/a/8" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">supporting museums in developing, carrying out, and providing programs and services that meet the needs of communities throughout the Nation, including people of diverse geographic, cultural, and socioeconomic backgrounds, individuals with disabilities, residents of rural and urban areas, Native Americans, military families, veterans, and caregivers, and for State institutions;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s274/a/9" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="9">(9) </num><content style="-uslm-dtd:text">supporting professional development and technical assistance programs to enhance museum operations, and the skills of museum staff, at all levels, and to support the development of the next generation of museum leaders and professionals, in order to ensure the highest standards in all aspects of museum operations;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s274/a/10" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="10">(10) </num><content style="-uslm-dtd:text">supporting museums in research, program evaluation, and the collection and dissemination of information to museum professionals and the public; </content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s274/a/11" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="11">(11) </num><content style="-uslm-dtd:text">encouraging, supporting, and disseminating model programs of museum and library collaboration;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s274/a/12" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="12">(12) </num><content style="-uslm-dtd:text">enabling museums to serve as anchor institutions to support community revitalization and the creation of opportunities for advancement; and</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s274/a/13" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="13">(13) </num><content style="-uslm-dtd:text">developing public and private partnerships with other agencies and community-based organizations to expand and enhance museum services.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stC/s274/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Federal Share.—</heading>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s274/b/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">50 percent.—</heading><content style="-uslm-dtd:text">Except as provided in paragraph (2), the Federal share described in subsection (a) shall be not more than 50 percent.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s274/b/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Greater than 50 percent.—</heading><content style="-uslm-dtd:text">The Director may use not more than 20 percent of the funds made available under this subtitle for a fiscal year to enter into arrangements under subsection (a) for which the Federal share may be greater than 50 percent.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s274/b/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Operational expenses.—</heading><content style="-uslm-dtd:text">No funds for operational expenses may be provided under this section to any entity that is not a museum.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stC/s274/c" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Review and Evaluation.—</heading>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s274/c/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Director shall establish procedures for reviewing and evaluating arrangements described in subsection (a) entered into under this subtitle.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s274/c/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Grant distribution.—</heading><content style="-uslm-dtd:text">In awarding grants, the Director shall take into consideration the equitable distribution of grants to museums of various types and sizes and to different geographic areas of the United States.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s274/c/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Applications for technical assistance.—</heading>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stC/s274/c/3/A" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Director may use not more than 10 percent of the funds appropriated to carry out this subtitle for technical assistance.</content>
                            </subparagraph>
                            <subparagraph style="-uslm-dtd:subparagraph" identifier="/us/sComp/94/462/tII/stC/s274/c/3/B" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Individual museums.—</heading><content style="-uslm-dtd:text">Individual museums may receive not more than 3 technical assistance awards under subparagraph (A). Subsequent awards for technical assistance shall be subject to review outside the Institute.</content>
                            </subparagraph>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stC/s274/d" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Services for Native Americans.—</heading><content style="-uslm-dtd:text">From amounts appropriated under section 276, the Director shall reserve 2.25 percent to award grants to, or enter into contracts or cooperative agreements with, Indian tribes and organizations that primarily serve and represent Native Hawaiians (as defined in section 6207 of the Native Hawaiian Education Act), to enable such tribes and organizations to carry out the activities described in subsection (a).</content>

                    <num style="-uslm-dtd:enum" value="275">SEC. 275. </num><heading style="-uslm-dtd:header">21ST CENTURY MUSEUM PROFESSIONAL PROGRAM. </heading>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stC/s275/a" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Purpose.—</heading><chapeau style="-uslm-dtd:text">It is the purpose of this section to develop and enhance the diverse workforce of museum
 professionals in order
 to best anticipate and serve the needs of their local communities and
 the public by—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s275/a/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">recruiting and educating future museum professionals from diverse and underrepresented backgrounds,
 including through encouraging
 middle or high school students and postsecondary students to pursue
 careers and build skills in museum services;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s275/a/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">developing museum leaders from diverse and underrepresented backgrounds, including by increasing
 the capacity of institutions that offer early career and mid-career
 professional development, specialized training, and leadership programs
 that directly relate to museum studies and management; and</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s275/a/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">supporting the professional development of current museum professionals and the museum workforce to
 enable them to meet identified needs of their communities.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stC/s275/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Activities.—</heading><chapeau style="-uslm-dtd:text">From the amounts provided under section 276, the Director may enter into
 arrangements,
 including grants, contracts, cooperative agreements, and other forms of
 assistance, with museums, museum consortia and associations, institutions
 of higher education (as defined in section 264(b)), and other entities
 that the Director determines
 appropriate, for projects that further the purpose of this section, such
 as projects that—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s275/b/1" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">increase the number of students from diverse and underrepresented backgrounds enrolled in graduate
 and undergraduate museum-related programs as well as
 other relevant programs offered through other education-focused entities,
 such as State
 and local governments, associations, and nonprofit organizations, in order
 to
 effectively prepare the students for, and retain the students in, careers
 in museum services;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s275/b/2" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">recruit future museum professionals from diverse and underrepresented backgrounds, including
 efforts to attract promising middle school, high school, or
 postsecondary students to consider careers in museum services such as
 through offering paid internships, mentoring, and fellowship
 opportunities;</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s275/b/3" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">develop new or enhance current professional development and retention programs for museum
 professionals and the museum workforce, including through mid-career
 skill-building, mentoring, and fellowships, and by supporting the
 development of
 local and regional networks for those who may not have easy access to such
 opportunities; and</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" identifier="/us/sComp/94/462/tII/stC/s275/b/4" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">support and conduct research, needs assessments, pilot programs, and evaluation of
 education and
 professional development programs to explore successful approaches that
 can successfully recruit, prepare, educate, and retain the next generation
 of
 museum professionals.</content>
                        </paragraph>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stC/s275/c" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Evaluation.—</heading><content style="-uslm-dtd:text">The Director shall establish procedures for reviewing and evaluating arrangements supported under
 this
 section.</content>

                <section style="-uslm-dtd:section" identifier="/us/sComp/94/462/tII/stC/s276" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="276">SEC. 276. </num><heading style="-uslm-dtd:header">AUTHORIZATION OF APPROPRIATIONS. </heading>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stC/s276/a" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Grants.—</heading><content style="-uslm-dtd:text">For the purpose of carrying out this subtitle, there are authorized to be appropriated to the Director $38,600,000 for each of the fiscal years 2020 through 2025.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stC/s276/b" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Sums Remaining Available.—</heading><content style="-uslm-dtd:text">Sums appropriated pursuant to subsection (a) for any fiscal year shall remain available for obligation until expended.</content>
                    </subsection>
                    <subsection style="-uslm-dtd:subsection" identifier="/us/sComp/94/462/tII/stC/s276/c" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Funding Rules.—</heading><content style="-uslm-dtd:text">Notwithstanding any other provision of this subtitle, if the amount appropriated under subsection (a) for a fiscal year is greater than the amount appropriated under such subsection for fiscal year 2020 by more than $10,000,000, then an amount of not less than 30 percent but not more than 50 percent of the increase in appropriated funds shall be available, from the funds appropriated under such subsection for the fiscal year, to enter into arrangements under section 274 to carry out the State assessments described in section 274(a)(4) and to assist States in the implementation of such plans.</content>
