    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To reduce the hazards of earthquakes, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

        <section identifier="/us/sComp/95/124/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s7701">42 U.S.C. 7701 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">That this Act may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Earthquake Hazards Reduction Act of 1977</inline></shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/95/124/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">FINDINGS. </heading>
            <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">The Congress finds and declares the following:</chapeau>
                <paragraph identifier="/us/sComp/95/124/s2/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">All 50 States, and the Commonwealth of Puerto Rico,<ref class="footnoteRef" idref="IDD1EDE5C660474E79B595C202A92A0BD8" style="-uslm-dtd:footnote-ref">1</ref> are vulnerable to the hazards of earthquakes, and at least 39 of them are subject to major or moderate seismic risk, including Alaska, California, Hawaii, Illinois, Massachusetts, Missouri, Montana, Nevada, New Jersey, New York, Oregon, South Carolina Tennessee,,<ref class="footnoteRef" idref="ID2EFF61579E1E4E3B8599330FC55FB4B3" style="-uslm-dtd:footnote-ref">2</ref> Utah, and Washington. A large portion of the population of the United States lives in areas vulnerable to earthquake hazards.</content><footnote id="IDD1EDE5C660474E79B595C202A92A0BD8" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">Section 2(a)(1)(A) in Public Law 115-307 amends paragraph (1) by inserting “<quotedText style="-uslm-dtd:quote">, and the Commonwealth of Puerto Rico,</quotedText>” after “<quotedText style="-uslm-dtd:quote">States</quotedText>”. Such amendment did not specify the occurrence of the word “<quotedText style="-uslm-dtd:quote">States</quotedText>”; however, such amendment was carried out to the first occurrence to reflect the probable intent of Congress.   </p></footnote><footnote id="ID2EFF61579E1E4E3B8599330FC55FB4B3" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">2</sup><p style="-uslm-dtd:para; margin-left:1em">Double commas are so in law. See the amendment made by section 2(a)(1)(C) in Public Law 115-307.</p></footnote>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s2/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Earthquakes have caused, and can cause in the future, enormous loss of life, injury, destruction of property, and economic and social disruption. With respect to future earthquakes, such loss, destruction, and disruption can be substantially reduced through the development and implementation of earthquake hazards reduction measures, including (A) improved design and construction methods and practices, (B) land-use controls and redevelopment, (C)  early-warning systems, (D) coordinated emergency preparedness plans, and (E) public education and involvement programs.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s2/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">An expertly staffed and adequately financed earthquake hazards reduction program, based on Federal, State, local, and private research, planning, decisionmaking, and contributions would reduce the risk of such loss, destruction, and disruption in seismic areas by an amount far greater than the cost of such program.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s2/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">A well-funded seismological research program could provide the scientific understanding needed to fully implement an effective earthquake early warning system.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s2/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">The geological study of active faults and features can reveal how recently and how frequently major earthquakes have occurred on those faults and how much risk they pose. Such long-term seismic risk assessments are needed in virtually every aspect of earthquake hazards management, whether emergency planning, public regulation, detailed building design, insurance rating, or investment decision.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s2/6" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">The vulnerability of buildings, lifeline infrastructure, public works, and industrial and emergency facilities can be reduced through proper earthquake resistant design and construction practices. The economy and efficacy of such procedures can be substantially increased through research and development.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s2/7" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">Programs and practices of departments and agencies of the United States are important to the communities they serve; some functions, such as emergency communications and national defense, and lifeline infrastructure, such as dams, bridges, and public works, must remain in service during and after an earthquake. Federally owned, operated, and influenced structures and lifeline infrastructure should serve as models for how to reduce and minimize hazards to the community.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s2/8" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">The implementation of earthquake hazards reduction measures would, as an added benefit, also reduce the risk of loss, destruction, and disruption from other natural hazards and man-made hazards, including hurricanes, tornadoes, accidents, explosions, landslides, building and structural cave-ins, and fires.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s2/9" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="9">(9) </num><content style="-uslm-dtd:text">Reduction of loss, destruction, and disruption from earthquakes will depend on the actions of individuals, and organizations in the private sector and governmental units at Federal, State, and local levels. The current capability to transfer knowledge and information to these sectors is insufficient. Improved mechanisms are needed to translate existing information and research findings into reasonable and usable specifications, criteria, and practices so that individuals, organizations, and governmental units may make informed decisions and take appropriate actions.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s2/10" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="10">(10) </num><content style="-uslm-dtd:text">Severe earthquakes are a worldwide problem. Since damaging earthquakes occur infrequently in any one nation, international cooperation is desirable for mutual learning from limited experiences.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s2/11" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="11">(11) </num><content style="-uslm-dtd:text">An effective Federal program in earthquake hazard reduction will require input from and review by persons outside the Federal Government expert in the sciences of earthquake hazards reduction and in the practical application of earthquake hazards reduction measures.</content>
                </paragraph>
            </subsection>
            <paragraph identifier="/us/sComp/95/124/s2/12" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="12">(12) </num><content style="-uslm-dtd:text">The built environment has generally been constructed and maintained to meet the needs of the users under normal conditions. When earthquakes occur, the built environment is generally designed to prevent severe injuries or loss of human life and is not expected to remain operational or able to recover under any specified schedule.</content>
            </paragraph>
            <paragraph identifier="/us/sComp/95/124/s2/13" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="13">(13) </num><content style="-uslm-dtd:text">The National Research Council published a study on reducing hazards and risks associated with earthquakes based on the goals and objectives for achieving national earthquake resilience described in the strategic plan entitled “<quotedText style="-uslm-dtd:quote">Strategic Plan for the National Earthquake Hazards Reduction Program</quotedText>”. The study and an accompanying report called for work in 18 tasks focused on research, preparedness, and mitigation and annual funding of approximately $300,000,000 per year for 20 years.</content>
            </paragraph><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s7701">42 U.S.C. 7701</ref><b>]</b> </editorialNote>
        </section>
        <section identifier="/us/sComp/95/124/s3" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">PURPOSE. </heading>
            <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">It is the purpose of the Congress in this Act to reduce the risks of life and property from future earthquakes and increase the resilience of communities in the United States through the establishment and maintenance of an effective earthquake hazards reduction program. The objectives of such program shall include—</chapeau>
                <paragraph identifier="/us/sComp/95/124/s3/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the education of the public, including State and local officials, as to earthquake phenomena, the identification of locations and structures which are especially susceptible to earthquake damage, ways to reduce the adverse consequences of an earthquake to individuals and the communities, and related matters;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s3/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the development of technologically and economically feasible design and construction methods and procedures to make new and existing structures, in areas of seismic risk, earthquake resistant, giving priority to the development of such methods and procedures for power generating plants, dams, hospitals, schools, public utilities and other lifeline infrastructure, public safety structures, high occupancy buildings, and other structures which are especially needed to facilitate community-wide post-earthquake recovery and in times of disaster;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s3/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the implementation to the greatest extent practicable, in all areas of high or moderate seismic risk, of a system (including personnel, technology, and procedures)  for identifying, evaluating, and accurately characterizing seismic hazards;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s3/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">the development, publication, and promotion, in conjunction with State and local officials and professional organizations, of model building and planning codes and other means to encourage consideration of information about seismic risk in making decisions about land-use policy and construction activity;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s3/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">the development, in areas of seismic risk, of improved understanding of, and capability with respect to, earthquake-related issues, including methods of mitigating the risks from earthquakes, planning to prevent such risks, disseminating warnings of earthquakes, organization emergency services, and planning for re-occupancy, recovery, reconstruction, and redevelopment after an earthquake;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s3/6" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">the development of ways to increase the use of existing scientific and engineering knowledge to mitigate earthquake hazards; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s3/7" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">the development of ways to assure the availability of affordable earthquake insurance.</content>
                </paragraph>
            </subsection><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s7702">42 U.S.C. 7702</ref><b>]</b> </editorialNote>
        </section>
        <section identifier="/us/sComp/95/124/s4" role="definitions" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><heading style="-uslm-dtd:header">DEFINITIONS. </heading>
            <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">As used in this Act, unless the context otherwise requires:</chapeau>
                <paragraph identifier="/us/sComp/95/124/s4/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">includes</term>” and variants thereof should be read as if the phrase “<term style="-uslm-dtd:quote">but is not limited to</term>” were also set forth.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s4/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Program</term>” means the National Earthquake Hazards Reduction Program established under section 5.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s4/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">seismic</term>” and variants thereof mean having to do with, or caused by earthquakes.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s4/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">State</term>” means each of the States of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa, the commonwealth of the Mariana Islands, and any other territory or possession of th United States.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s4/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">United States</term>” means, when used in geographical sense, all of the States as defined in section 4(4).</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s4/6" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">lifeline infrastructure</term>” means public works and utilities, including transportation facilities and infrastructure, oil and gas pipelines, electrical power and communication facilities and infrastructure, and water supply and sewage treatment facilities.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s4/7" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Program agencies</term>” means the Federal Emergency Management Agency, the United States Geological Survey, the National Science Foundation, and the National Institute of Standards and Technology.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s4/8" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Interagency Coordinating Committee</term>” means the Interagency Coordinating Committee on Earthquake Hazards Reduction established under section 5(a).</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s4/9" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="9">(9) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">Advisory Committee</term>” means the Advisory Committee established under section 5(a)(5).</content>
                </paragraph>
            </subsection>
            <paragraph identifier="/us/sComp/95/124/s4/10" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="10">(10) </num><content style="-uslm-dtd:text">The term “<term style="-uslm-dtd:term">community resilience</term>” means the ability of a community to prepare and plan for, absorb, recover from, and more successfully adapt to adverse seismic events.</content>
            </paragraph><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s7703">42 U.S.C. 7703</ref><b>]</b> </editorialNote>
        </section>
        <section identifier="/us/sComp/95/124/s5" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><heading style="-uslm-dtd:header">NATIONAL EARTHQUAKE HAZARDS REDUCTION PROGRAM. </heading>
            <subsection identifier="/us/sComp/95/124/s5/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Establishment.—</heading>
                <paragraph identifier="/us/sComp/95/124/s5/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">There is established the National Earthquake Hazards Reduction Program.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s5/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Program activities.—</heading><chapeau style="-uslm-dtd:text">The activities of the Program shall be designed to—</chapeau>
                    <subparagraph identifier="/us/sComp/95/124/s5/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">develop effective measures for earthquake hazards reduction;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">promote the adoption of earthquake hazards reduction measures by Federal, State, and local governments, national standards and model code organizations, architects and engineers, building owners, and others with a role in planning and constructing buildings, structures, and lifeline infrastructure through—</chapeau>
                        <clause identifier="/us/sComp/95/124/s5/a/2/B/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">grants, contracts, cooperative agreements, and technical assistance;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/a/2/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">development of standards, guidelines, and voluntary consensus codes for earthquake hazards reduction for buildings, structures, and lifeline infrastructure;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/a/2/B/iii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">development and maintenance of a repository of information, including technical data, on seismic risk, community resilience, and hazards reduction; and</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/a/2/B/iv" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">publishing a systematic set of maps of active faults and folds, liquefaction susceptibility, susceptibility for earthquake induced landslides, and other seismically induced hazards; and</content>
                        </clause>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/a/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">improve the understanding of earthquakes and their effects on communities, buildings, structures, and lifeline infrastructure, through interdisciplinary research that involves engineering, natural sciences, and social, economic, and decisions sciences; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/a/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">continue the development of the Advanced National Seismic System, including earthquake early warning capabilities and the Global Seismographic Network.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s5/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Interagency coordinating committee on earthquake hazards reduction.—</heading>
                    <subparagraph identifier="/us/sComp/95/124/s5/a/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">There is established an Interagency Coordinating Committee on Earthquake Hazards Reduction chaired by the Director of the National Institute of Standards and Technology (referred to in this subsection as the “<quotedText style="-uslm-dtd:quote">Director</quotedText>”).</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/a/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Membership.—</heading><chapeau style="-uslm-dtd:text">In addition to the Director, the committee shall be composed of—</chapeau>
                        <clause identifier="/us/sComp/95/124/s5/a/3/B/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the Administrator of the Federal Emergency Management Agency;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/a/3/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the Director of the United States Geological Survey;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/a/3/B/iii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">the Director of the National Science Foundation;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/a/3/B/iv" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">the Director of the Office of Science and Technology Policy; and</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/a/3/B/v" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">the Director of the Office of Management and Budget.</content>
                        </clause>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/a/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Meetings.—</heading><content style="-uslm-dtd:text">The Committee shall meet not less frequently than once each year at the call of the Director.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/a/3/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">Duties.—</heading>
                        <clause identifier="/us/sComp/95/124/s5/a/3/D/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">General duty.—</heading><content style="-uslm-dtd:text">The Interagency Coordinating Committee shall oversee the planning, management, and coordination of
 the Program.</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/a/3/D/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">Specific duties.—</heading><chapeau style="-uslm-dtd:text">The duties of the Interagency Coordinating Committee include the following:</chapeau>
                            <subclause identifier="/us/sComp/95/124/s5/a/3/D/ii/I" style="-uslm-dtd:subclause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="I">(I) </num><chapeau style="-uslm-dtd:text">Developing, not later than 6 months after the date of the enactment of the National Earthquake
 Hazards Reduction Program Reauthorization Act of 2004 and updating
 periodically—</chapeau>
                                <item identifier="/us/sComp/95/124/s5/a/3/D/ii/I/aa" style="-uslm-dtd:item" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="aa">(aa) </num><content style="-uslm-dtd:text">a strategic plan that establishes goals and priorities for the Program activities described under
 subsection (a)(2); and</content>
                                </item>
                                <item identifier="/us/sComp/95/124/s5/a/3/D/ii/I/bb" style="-uslm-dtd:item" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="bb">(bb) </num><content style="-uslm-dtd:text">a detailed management plan to implement such strategic plan.</content>
                                </item>
                            </subclause>
                            <subclause identifier="/us/sComp/95/124/s5/a/3/D/ii/II" style="-uslm-dtd:subclause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">Developing a coordinated interagency budget for the Program that will ensure appropriate balance
 among the Program activities described under subsection (a)(2), and, in
 accordance with the plans developed under subclause (I), submitting such
 budget to the Director of the Office of Management and Budget at the time
 designated by the Director for agencies to submit biennial budgets.</content>
                            </subclause>
                            <subclause identifier="/us/sComp/95/124/s5/a/3/D/ii/III" style="-uslm-dtd:subclause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="III">(III) </num><content style="-uslm-dtd:text">Developing interagency memorandums of understanding with any relevant Federal agencies on data
 sharing and resource commitment in the event of an earthquake disaster.</content>
                            </subclause>
                            <subclause identifier="/us/sComp/95/124/s5/a/3/D/ii/IV" style="-uslm-dtd:subclause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="IV">(IV) </num><content style="-uslm-dtd:text">Coordinating with the Interagency Coordinating Committee on Windstorm Impact Reduction and other
 natural hazards coordination committees as the Director determines
 appropriate to share data and best practices.</content>
                            </subclause>
                            <subclause identifier="/us/sComp/95/124/s5/a/3/D/ii/V" style="-uslm-dtd:subclause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="V">(V) </num><content style="-uslm-dtd:text">Coordinating with the Administrator of the National Aeronautics and Space Administration and the
 Administrator of the National Oceanic and Atmospheric Administration on
 data sharing and resource allocation to ensure judicious use of Government
 resources and the free-flowing exchange of information related to
 earthquakes.</content>
                            </subclause>
                            <subclause identifier="/us/sComp/95/124/s5/a/3/D/ii/VI" style="-uslm-dtd:subclause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="VI">(VI) </num><content style="-uslm-dtd:text">Coordinating with the Secretary of Agriculture and the Secretary of the Interior on the use of
 public lands for earthquake monitoring and research stations, and related
 data collection.</content>
                            </subclause>
                            <subclause identifier="/us/sComp/95/124/s5/a/3/D/ii/VII" style="-uslm-dtd:subclause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="VII">(VII) </num><content style="-uslm-dtd:text">Coordinating with the Secretary of Transportation and the Secretary of Housing and Urban
 Development on the effects of earthquakes on transportation and housing
 stocks.</content>
                            </subclause>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/a/3/D/iii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><heading style="-uslm-dtd:header">Assistance from secretary of agriculture and secretary of the interior.—</heading><content style="-uslm-dtd:text">To the extent practicable, the Secretary of Agriculture and the Secretary of the Interior shall
 expedite any request for a permit to use public land under clause
 (ii)(VI).</content>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s5/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Biennial report.—</heading>
                    <subparagraph identifier="/us/sComp/95/124/s5/a/4/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">Not less frequently than once every two years, the Interagency Coordinating Committee shall submit
			 to the Committee on Commerce, Science, and Transportation, the Committee
			 on Energy and Natural Resources, and the Committee on Homeland Security
			 and Governmental Affairs of the Senate and the Committee on Science,
			 Space, and Technology, the Committee on Energy and Commerce, the Committee
			 on Natural Resources, and the Committee on Homeland Security of the House
			 of Representatives a report on the Program. Such report shall include—</chapeau>
                        <clause identifier="/us/sComp/95/124/s5/a/4/A/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the Program budget for the current fiscal year for each agency that participates in the Program, and for each major goal established for the Program activities under paragraph
(3)(D)(i)(I)<ref class="footnoteRef" idref="IDB3ABF3912A25409EA1883C63BD2F7D6A" style="-uslm-dtd:footnote-ref">3</ref>;</content><footnote id="IDB3ABF3912A25409EA1883C63BD2F7D6A" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">3</sup><p style="-uslm-dtd:para; margin-left:1em">Clause (i) of paragraph (3)(D), as amended by section 3(b)(3) of Public Law 115–307, does not contain subclauses.</p></footnote>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/a/4/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the proposed Program budget for the next fiscal year for each agency that participates in the Program, and for each major goal established for the Program activities under paragraph
(3)(D)(i)(I)<ref class="footnoteRef" style="-uslm-dtd:dangling-footnote-ref">3</ref>;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/a/4/A/iii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">a description of the activities and results of the Program during the previous year, including an assessment of the effectiveness of the Program in furthering the goals established in the strategic plan under paragraph (3)(D)(i)(I)<ref class="footnoteRef" style="-uslm-dtd:dangling-footnote-ref">3</ref>;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/a/4/A/iv" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">a description of the extent to which the Program has incorporated the recommendations of the Advisory Committee;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/a/4/A/v" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">a description of activities, including budgets for the current fiscal year and proposed budgets for the next fiscal year, that are carried out by Program agencies and contribute to the Program, but are not included in the Program;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/a/4/A/vi" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="vi">(vi) </num><content style="-uslm-dtd:text">a description of the activities, including budgets for the current fiscal year and proposed budgets for the following fiscal year, related to the grant program carried out under subsection (b)(2)(A)(i); and</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/a/4/A/vii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="vii">(vii) </num><content style="-uslm-dtd:text">a statement regarding whether the Administrator of the Federal Emergency Management Agency has lowered or waived the cost share requirement for assistance provided under subsection (b)(2)(A)(i).</content>
                        </clause>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/a/4/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Support for preparation of report.—</heading><content style="-uslm-dtd:text">Each head of a Program agency shall submit to the Director of the National Institute of Standards
 and Technology such information as the Director may request for the
 preparation of a report under subparagraph (A) not later than 90 days
 after the date on which the Director requests such information.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s5/a/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Advisory committee.—</heading>
                    <subparagraph identifier="/us/sComp/95/124/s5/a/5/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Director shall establish an Advisory Committee on Earthquake Hazards Reduction of at least 11 members, none of whom may be an employee (as defined in subparagraphs (A) through (F) of section 7342(a)(1) of title 5, United States Code, including representatives of research and academic institutions, industry standards development organizations, State and local government, and financial communities who are qualified to provide advice on earthquake hazards reduction and represent all related scientific, architectural, and engineering disciplines. The recommendations of the Advisory Committee shall be considered by Federal agencies in implementing the Program.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/a/5/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Assessment.—</heading><chapeau style="-uslm-dtd:text">The Advisory Committee shall assess—</chapeau>
                        <clause identifier="/us/sComp/95/124/s5/a/5/B/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">trends and developments in the science and engineering of earthquake hazards reduction;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/a/5/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">effectiveness of the Program in carrying out the activities under (a)(2);</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/a/5/B/iii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">the need to revise the Program; and</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/a/5/B/iv" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">the management, coordination, implementation, and activities of the Program.</content>
                        </clause>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/a/5/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Report.—</heading><content style="-uslm-dtd:text">Not later than 1 year after the date of enactment of the National Earthquake Hazards Reduction Program Reauthorization Act of 2004 and at least once every 2 years thereafter, the Advisory Committee shall report to the Director on its findings of the assessment carried out under subparagraph (B) and its recommendations for ways to improve the Program. In developing recommendations, the Committee shall consider the recommendations of the United States Geological Survey Scientific Earthquake Studies Advisory Committee.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/a/5/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><heading style="-uslm-dtd:header">Application of chapter 10 of title 5, united states code.—</heading><content style="-uslm-dtd:text">Section 1013 of title 5, United States Code, shall not apply to the Advisory Committee.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/95/124/s5/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Responsibilities of Program Agencies.—</heading>
                <paragraph identifier="/us/sComp/95/124/s5/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Lead agency.—</heading><chapeau style="-uslm-dtd:text">The National Institute of Standards and Technology shall have the primary responsibility for planning and coordinating the Program. In carrying out this paragraph, the Director of the Institute shall—</chapeau>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">ensure that the Program includes the necessary steps to promote the implementation of earthquake hazard reduction measures by Federal, State, and local governments, national standards and model building code organizations, architects and engineers, and others with a role in planning and constructing<ref class="footnoteRef" idref="ID2FE4D7AA0E884A279800AA77A448A6C0" style="-uslm-dtd:footnote-ref">4</ref> buildings and lifeline infrastructure;</content><footnote id="ID2FE4D7AA0E884A279800AA77A448A6C0" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">4</sup><p style="-uslm-dtd:para; margin-left:1em">Section 3(c)(1)(A) of Public Law 115-307 amends section 5(b)(1)(A) by striking “<quotedText style="-uslm-dtd:quote">and constructing[,]</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">constructing, evaluating, and retrofitting</quotedText>”. The amendment could not be carried out due to the inclusion of a comma following “<quotedText style="-uslm-dtd:quote">constructing</quotedText>” in the stricken matter. </p></footnote>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">support the development of performance-based seismic engineering tools, and work with appropriate groups to promote the commercial application of such tools, through earthquake-related building codes, standards, and construction practices;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">request the assistance of Federal agencies other than the Program agencies, as necessary to assist in carrying out this Act; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/1/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">work with the Federal Emergency Management Agency, the National Science Foundation<ref class="footnoteRef" idref="IDB6F6646E4B9147229B41659FE2C6496A" style="-uslm-dtd:footnote-ref">5</ref>, and the United States Geological Survey, to develop a comprehensive plan for earthquake engineering research to provide new and effectively use existing testing facilities and laboratories (existing at the time of the development of the plan), upgrade facilities and equipment as needed, and integrate new, innovative testing approaches to the research infrastructure in a systematic manner.</content><footnote id="IDB6F6646E4B9147229B41659FE2C6496A" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">5</sup><p style="-uslm-dtd:para; margin-left:1em">The amendment made by section 103(2)(A)(v) of Public Law 108–360 (118 Stat. 1671) to strike “<quotedText style="-uslm-dtd:quote">National Science Foundation, the National Institute[s] of Standards and Technology</quotedText>” and insert “<quotedText style="-uslm-dtd:quote">Federal Emergency Management Agency, the National Science Foundation</quotedText>”, was executed by striking “<quotedText style="-uslm-dtd:quote">National Science Foundation, the National Institute of Standards and Technology</quotedText>” in the matter to be struck to reflect the probable intent of Congress.</p></footnote>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s5/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Department of homeland security; federal emergency management agency.—</heading>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Program responsibilities.—</heading><chapeau style="-uslm-dtd:text">The Administrator of the Federal Emergency Management Agency—</chapeau>
                        <clause identifier="/us/sComp/95/124/s5/b/2/A/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">shall operate a program of grants and assistance to enable States to develop mitigation,
 preparedness, and response plans, purchase necessary instrumentation,
 prepare inventories and conduct seismic safety inspections of critical
 structures and lifeline infrastructure, update building, land use
 planning, and zoning codes and ordinances to enhance seismic safety,
 increase earthquake awareness and education, and provide assistance to
 multi-State groups for such purposes;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/b/2/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">shall support the implementation of a comprehensive earthquake education, outreach, and public
 awareness program, including development of materials and their wide
 dissemination to all appropriate audiences and support public access to
 locality-specific information that may assist the public in preparing for,
 mitigating against, responding to and recovering from earthquakes and
 related disasters;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/b/2/A/iii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">shall, in conjunction with the Director of the National Institute of Standards and Technology,
 other Federal agencies, and private sector groups, use research results to
 support the preparation, maintenance, and wide dissemination of seismic
 resistant design guidance and related information on building codes,
 standards, and practices for new and existing buildings, structures, and
 lifeline infrastructure, aid in the development of performance-based
 design guidelines and methodologies, and support model codes that are cost
 effective and affordable in order to promote better practices within the
 design and construction industry and reduce losses from earthquakes;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/b/2/A/iv" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">shall enter into cooperative agreements or contracts with States and local jurisdictions and other
 Federal agencies to establish demonstration projects on earthquake hazard
 mitigation, to link earthquake research and mitigation efforts with
 emergency management programs, or to prepare educational materials for
 national distribution; and</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/b/2/A/v" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">shall support the Director of the National Institute of Standards and Technology in the completion
 of programmatic goals.</content>
                        </clause>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">State assistance program criteria.—</heading><chapeau style="-uslm-dtd:text">In order to qualify for assistance under subparagraph (A)(i), a State must—</chapeau>
                        <clause identifier="/us/sComp/95/124/s5/b/2/B/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">demonstrate that the assistance will result in enhanced seismic safety in the State;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/b/2/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">provide 25 percent of the costs of the activities for which assistance is being given, except that
 the Administrator may lower or waive the cost-share requirement for these
 activities for a small impoverished community, as defined in section 203
 of the Disaster Relief Act of 1974 (42 U.S.C. 5133(a)); and</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/b/2/B/iii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">meet such other requirements as the Administrator shall prescribe.</content>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s5/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">United states geological survey.—</heading><chapeau style="-uslm-dtd:text">The United States Geological Survey shall report on significant domestic and international earthquakes and conduct research and other activities necessary to characterize and identify earthquake hazards, assess earthquake risks, monitor seismic activity, and improve earthquake forecasts. In carrying out this paragraph, the Director of the United States Geological Survey shall—</chapeau>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">conduct a systematic assessment of the seismic risks in each region of the Nation prone to earthquakes, including, where appropriate, the establishment and operation of intensive monitoring projects on hazardous faults, seismic microzonation studies in urban and other developed areas where earthquake risk is determined to be significant, and engineering seismology studies;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">work with officials of State and local governments to ensure that they are knowledgeable about the specific seismic risks in their areas;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">develop standard procedures, in consultation with the Administrator of the Federal Emergency Management Agency and the Director of the National Institute of Standards and Technology, for issuing earthquake alerts and early warnings;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/3/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">issue when necessary and feasible, and notify the Administrator of the Federal Emergency Management Agency, the Director of the National Institute of Standards and Technology, and State and local officials, an alert and an earthquake warning;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/3/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><chapeau style="-uslm-dtd:text">operate, including the National Earthquake Information Center, a forum for the international exchange of earthquake information which shall—</chapeau>
                        <clause identifier="/us/sComp/95/124/s5/b/3/E/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">promote the exchange of information on earthquake research and earthquake preparedness between the United States and other nations;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/b/3/E/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">maintain a library containing selected reports, research papers, and data produced through the Program;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/b/3/E/iii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">answer requests from other nations for information on United States earthquake research and earthquake preparedness programs; and</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/b/3/E/iv" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">direct foreign requests to the agency involved in the Program which is best able to respond to the request;</content>
                        </clause>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/3/F" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">operate a National Seismic System;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/3/G" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">support regional seismic networks, which shall complement the National Seismic Network; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/3/H" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="H">(H) </num><content style="-uslm-dtd:text">work with the National Science Foundation, the Federal Emergency Management Agency, and the National Institute of Standards and Technology to develop a comprehensive plan for earthquake engineering research to effectively use existing testing facilities and laboratories (in existence at the time of the development of the plan), upgrade facilities and equipment as needed, and integrate new, innovative testing approaches to the research infrastructure in a systematic manner.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/3/I" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">work with other Program agencies to coordinate Program activities with similar earthquake hazards reduction efforts in other countries, to ensure that the Program benefits from relevant information and advances in those countries;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/3/J" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="J">(J) </num><content style="-uslm-dtd:text">maintain suitable seismic hazard maps and data in support of building codes for structures and lifeline infrastructure, including additional maps needed for performance-based design approaches; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/3/K" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="K">(K) </num><content style="-uslm-dtd:text">support the Director of the National Institute of Standards and Technology in the completion of programmatic goals.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s5/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">National science foundation.—</heading>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/4/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">The National Science Foundation
 shall be responsible for funding research on earth sciences to improve the understanding of the causes and behavior of earthquakes, on earthquake engineering, and on human response to earthquakes. In carrying out this paragraph, the Director of the National Science Foundation shall—</chapeau>
                        <clause identifier="/us/sComp/95/124/s5/b/4/A/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">encourage prompt dissemination of significant findings, sharing of data, samples, physical collections, and other supporting materials, and development of intellectual property so research results can be used by appropriate organizations to mitigate earthquake damage;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/b/4/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">in addition to supporting individual investigators, support university research consortia, State agencies, State geological surveys, and centers for research in geosciences and in earthquake engineering;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/b/4/A/iii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">work closely with the United States Geological Survey to support applied science in the production of a systematic series of earthquake-related geologic hazard maps, and to identify geographic regions of national concern that should be the focus of targeted solicitations for earthquake-related research proposals;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/b/4/A/iv" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">support research that improves the safety and performance of buildings, structures, and lifeline systems using experimental and computational facilities;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/b/4/A/v" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">emphasize, in earthquake engineering research, development of economically feasible methods to retrofit existing buildings and to protect lifeline infrastructure to mitigate earthquake damage;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/b/4/A/vi" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="vi">(vi) </num><content style="-uslm-dtd:text">support research that studies the political, economic, and social factors that influence the implementation of hazard reduction measures;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/b/4/A/vii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="vii">(vii) </num><content style="-uslm-dtd:text">include to the maximum extent practicable diverse institutions, including Historically Black Colleges and Universities and those serving large proportions of Hispanics, Native Americans, Asian-Pacific Americans, and other underrepresented populations;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/b/4/A/viii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="viii">(viii) </num><content style="-uslm-dtd:text">develop, in conjunction with the Federal Emergency Management Agency, the National Institute of Standards and Technology, and the United States Geological Survey, a comprehensive plan for earthquake engineering research to effectively use existing testing facilities and laboratories (in existence at the time of the development of the plan), upgrade facilities and equipment as needed, and integrate new, innovative testing approaches to the research infrastructure in a systematic manner; and</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/b/4/A/ix" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ix">(ix) </num><content style="-uslm-dtd:text">support the Director of the National Institute of Standards and Technology in the completion of programmatic goals.</content>
                        </clause>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/4/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Identification of funding.—</heading><chapeau style="-uslm-dtd:text">The National Science Foundation shall—</chapeau>
                        <clause identifier="/us/sComp/95/124/s5/b/4/B/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">to the extent practicable, note in any notice of Program funding or other funding possibilities
 under the Program that the funds are part of the Program;</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/b/4/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">to the extent practicable, track the awarding of Federal funds through the Program; and</content>
                        </clause>
                        <clause identifier="/us/sComp/95/124/s5/b/4/B/iii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">not less frequently than once every 2 years, submit to the director of the Program a report
 specifying the amount of Federal funds awarded to conduct research that
 enhances the understanding of earthquake science.</content>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s5/b/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">National institute of standards and technology.—</heading><chapeau style="-uslm-dtd:text">In addition to the lead agency responsibilities described under paragraph (1), the National Institute of Standards and Technology shall be responsible for carrying out research and development to improve community resilience through building codes and standards and practices for structures and lifeline infrastructure. In carrying out this paragraph, the Director of the National Institute of Standards and Technology shall—</chapeau>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/5/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">work closely with national standards and model building code organizations, in conjunction with the Agency, to promote the implementation of research results;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/5/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">promote better building practices among architects and engineers;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/5/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">work closely with national standards organizations to develop seismic safety standards and practices for new and existing lifeline infrastructure;</content>
                    </subparagraph>
                    <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/95/124/s5/b/5/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D)<ref class="footnoteRef" idref="ID47700758E49548DC85B07BB8524DDC13" style="-uslm-dtd:footnote-ref">6</ref> </num><content style="-uslm-dtd:text">support the development and commercial application of cost effective and affordable performance-based seismic engineering by providing technical support for seismic engineering practices and related building code, standards, and practices development; and</content><footnote id="ID47700758E49548DC85B07BB8524DDC13" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">6</sup><p style="-uslm-dtd:para; margin-left:1em">Margin so in law.</p></footnote>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/b/5/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">work with the National Science Foundation, the Federal Emergency Management Agency, and the United States Geological Survey to develop a comprehensive plan for earthquake engineering research to effectively use existing testing facilities and laboratories (in existence at the time of the development of the plan), upgrade facilities and equipment as needed, and integrate new, innovative testing approaches to the research infrastructure in a systematic manner.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/95/124/s5/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Budget Coordination.—</heading>
                <paragraph identifier="/us/sComp/95/124/s5/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Guidance.—</heading><content style="-uslm-dtd:text">The Interagency Coordinating Committee shall each year provide guidance to the other Program agencies concerning the preparation of requests for appropriations for activities related to the Program, and shall prepare, in conjunction with the other Program agencies, an annual Program budget to be submitted to the Office of Management and Budget.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s5/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Reports.—</heading><chapeau style="-uslm-dtd:text">Each Program agency shall include with its annual request for appropriations submitted to the Office of Management and Budget a report that—</chapeau>
                    <subparagraph identifier="/us/sComp/95/124/s5/c/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">identifies each element of the proposed Program activities of the agency;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/c/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">specifies how each of these activities contributes to the Program; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/95/124/s5/c/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">states the portion of its request for appropriations allocated to each element of the Program.</content>
                    </subparagraph>
                </paragraph>

            <num style="-uslm-dtd:enum" value="8">SEC. 8. </num><heading style="-uslm-dtd:header">SEISMIC STANDARDS. </heading>
            <subsection identifier="/us/sComp/95/124/s8/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Assessment and Recommendations.—</heading><content style="-uslm-dtd:text">Not later than December 1, 2019, the Director of the National Institute of Standards and Technology
 and the Administrator of the Federal Emergency Management Agency shall
 jointly convene a committee of experts from Federal agencies,
 nongovernmental organizations, private sector entities, disaster
 management professional associations, engineering professional
 associations, and professional construction and homebuilding industry
 associations, to assess and recommend options for improving the built
 environment and critical infrastructure to reflect performance goals
 stated in terms of post-earthquake reoccupancy and functional recovery
 time.</content>
            </subsection>
            <subsection identifier="/us/sComp/95/124/s8/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Report to Congress.—</heading><content style="-uslm-dtd:text">Not later than June 30, 2020, the committee convened under paragraph (1) shall submit to the
 Committee on Commerce, Science, and Transportation, the Committee on
 Energy and Natural Resources, and the Committee on Homeland Security and
 Governmental Affairs of the Senate and the Committee on Science, Space,
 and Technology, the Committee on Natural Resources, and the Committee on
 Homeland Security of the House of Representatives a report on recommended
 options for improving the built environment and critical infrastructure to
 reflect performance goals stated in terms of post-earthquake reoccupancy
 and functional recovery time.</content>

            <num style="-uslm-dtd:enum" value="9">SEC. 9. </num><heading style="-uslm-dtd:header">ACCEPTANCE OF GIFTS. </heading>
            <subsection identifier="/us/sComp/95/124/s9/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Authority.—</heading><content style="-uslm-dtd:text">In furtherance of the purposes of this Act, the Administrator of the Federal Emergency Management Agency may accept and use bequests, gifts, or donations of services, money, or property, notwithstanding section 3679 of the Revised Statutes (31 U.S.C. 1342).</content>
            </subsection>
            <subsection identifier="/us/sComp/95/124/s9/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Criteria.—</heading><content style="-uslm-dtd:text">The Administrator of the Federal Emergency Management Agency shall establish by regulation criteria for determining whether to accept bequests, gifts, or donations of services, money, or property. Such criteria shall take into consideration whether the acceptance of the bequest, gift, or donation would reflect unfavorably on the Director's ability to carry out his responsibilities in a fair and objective manner, or would compromise the integrity of, or the appearance of the integrity of, the Program or any official involved in administering the Program.</content>
            </subsection><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s7705c">42 U.S.C. 7705c</ref><b>]</b> </editorialNote>
        </section><editorialNote style="-uslm-dtd:legis-comment"><b>[</b>Sec. 10. Repealed by section 203 of P.L. 106–503 (114 Stat. 2305).<b>]</b> </editorialNote>
        <section identifier="/us/sComp/95/124/s11" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="11">SEC. 11. </num><heading style="-uslm-dtd:header">POST-EARTHQUAKE INVESTIGATIONS PROGRAM. </heading>
            <subsection role="undesignated-level" style="-uslm-dtd:subsection" styleType="OLC"><chapeau style="-uslm-dtd:text">There is established within the United States Geological Survey a post-earthquake investigations program, the purpose of which is to investigate major earthquakes, so as to learn lessons which can be applied to reduce the loss of lives and property in future earthquakes. The United States Geological Survey, in consultation with each Program agency, shall organize investigations to study the implications of the earthquake in the areas of responsibility of each Program agency. The investigations shall begin as rapidly as possible and may be conducted by grantees and contractors. The Program agencies shall ensure that the results of investigations are disseminated widely. The Director of the Survey is authorized to utilize earthquake expertise from the Agency, the National Science Foundation, the National Institute of Standards and Technology, other Federal agencies, and private contractors, on a reimbursable basis, in the conduct of such earthquake investigations. At a minimum, investigations under this section shall include—</chapeau>
                <paragraph identifier="/us/sComp/95/124/s11/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">analysis by the National Science Foundation and the United States Geological Survey of the causes of the earthquake and the nature of the resulting ground motion;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s11/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">analysis by the National Science Foundation and the National Institute of Standards and Technology of the behavior of structures and lifeline infrastructure, both those that were damaged and those that were undamaged; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/95/124/s11/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">analysis by each of the Program agencies of the effectiveness of the earthquake hazards mitigation programs and actions relating to its area of responsibility under the Program, and how those programs and actions could be strengthened.</content>
                </paragraph>
            </subsection><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s7705e">42 U.S.C. 7705e</ref><b>]</b> </editorialNote>
        </section>
        <section identifier="/us/sComp/95/124/s12" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="12">SEC. 12. </num><heading style="-uslm-dtd:header">AUTHORIZATION OF APPROPRIATIONS. </heading>
            <subsection identifier="/us/sComp/95/124/s12/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a)</num><paragraph class="inline" identifier="/us/sComp/95/124/s12/a/1" style="-uslm-dtd:paragraph" styleType="OLC"><num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">General.—</heading><content style="-uslm-dtd:text">There are authorized to be appropriated to the President to carry out the provisions of section 5 and 6 of this Act (in addition to any authorizations for similar purposes included in other Acts and the authorizations set forth in subsections (b) and (c) of this section), not to exceed $1,000,000 for the fiscal year ending September 30, 1978, not to exceed $2,000,000 for the fiscal year ending September 30, 1979, and not to exceed $2,000,000 for the fiscal year ending September 30, 1980.</content></paragraph>
                <paragraph class="leftIndentDecrease1" identifier="/us/sComp/95/124/s12/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">There are authorized to be appropriated to the Director to carry out the provisions of sections 5 and 6 of this Act for the fiscal year ending September 30, 1981—</chapeau>
                    <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/95/124/s12/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">$1,000,000 for continuation of the Interagency Committee on Seismic Safety in Construction and the Building Seismic Safety Council programs,</content>
                    </subparagraph>
                    <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/95/124/s12/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">$1,500,000 for plans and preparedness for earthquake disasters,</content>
                    </subparagraph>
                    <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/95/124/s12/a/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">$500,000 for prediction response planning,</content>
                    </subparagraph>
                    <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/95/124/s12/a/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">$600,000 for architectural and engineering planning and practice programs,</content>
                    </subparagraph>
                    <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/95/124/s12/a/2/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">$1,000,000 for development and application of a public education program,</content>
                    </subparagraph>
                    <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/95/124/s12/a/2/F" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">$3,000,000 for use by the National Science Foundation in addition to the amount authorized to be appropriated under subsection (c), which amount includes $2,400,000 for earthquake policy research and $600,000 for the strong ground motion element of the siting program, and</content>
                    </subparagraph>
                    <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/95/124/s12/a/2/G" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">$1,000,000 for use by the Center for Building Technology, National Bureau of Standards in addition to the amount authorized to be appropriated under subsection (d) for earthquake activities in the Center.</content>
                    </subparagraph>
                </paragraph>
                <paragraph class="leftIndentDecrease1" identifier="/us/sComp/95/124/s12/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">There are authorized to be appropriated to the Director for the fiscal year ending September 30, 1982, $2,000,000 to carry out the provisions of section 5 and 6 of this Act.</content>
                </paragraph>
                <paragraph class="leftIndentDecrease1" identifier="/us/sComp/95/124/s12/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">There are authorized to be appropriated to the Director, to carry out the provisions of section 5 and 6 of this Act, $1,281,000 for the fiscal year ending September 30, 1983.</content>
                </paragraph>
                <paragraph class="leftIndentDecrease1" identifier="/us/sComp/95/124/s12/a/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">There are authorized to be appropriated to the Director, to carry out the provisions of section 5 and 6 of this Act, for the fiscal year ending September 30, 1984, $3,705,000 and for the fiscal year ending September 30, 1985, $6,096,000.</content>
                </paragraph>
                <paragraph class="leftIndentDecrease1" identifier="/us/sComp/95/124/s12/a/6" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">There are authorized to be appropriated to the Director, to carry out the provisions of section 5 and 6 of this Act, for the fiscal year ending September 30, 1986, $5,596,000, and for the fiscal year ending September 30, 1987, $5,848,000.</content>

There are authorized to be appropriated to the Secretary of the Interior for purposes of carrying out, through the Director of the United States Geological Survey, the responsibilities that may be assigned to the Director under this Act $48,360,000 for fiscal year 2001, of which $3,500,000 is for the Global Seismic Network and $100,000 is for the Scientific Earthquake Studies Advisory Committee established under section 210 of the Earthquake Hazards Reduction Authorization Act of 2000; $50,415,000 for fiscal year 2002, of which $3,600,000 is for the Global Seismic Network and $100,000 is for the Scientific Earthquake Studies Advisory Committee; and $52,558,000 for fiscal year 2003, of which $3,700,000 is for the Global Seismic Network and $100,000 is for the Scientific Earthquake Studies Advisory Committee.                     </subparagraph>

            <num style="-uslm-dtd:enum" value="13">SEC. 13. </num><heading style="-uslm-dtd:header">ADVANCED NATIONAL SEISMIC SYSTEM. </heading>
            <subsection identifier="/us/sComp/95/124/s13/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Establishment.—</heading><content style="-uslm-dtd:text">The Director of the United States Geological Survey shall establish and operate an Advanced National Seismic System. The purpose of such system shall be to organize, modernize, standardize, and stabilize the national, regional, and urban seismic monitoring systems in the United States, including sensors, recorders, and data analysis centers, into a coordinated system that will measure and record the full range of frequencies and amplitudes exhibited by seismic waves, in order to enhance earthquake research and warning capabilities.</content>
            </subsection>
            <subsection identifier="/us/sComp/95/124/s13/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Management Plan.—</heading><content style="-uslm-dtd:text">Not later than 90 days after the date of the enactment of the Earthquake Hazards Reduction Authorization Act of 2000, the Director of the United States Geological Survey shall transmit to the Congress a 5-year management plan for establishing and operating the Advanced National Seismic System. The plan shall include annual cost estimates for both modernization and operation, milestones, standards, and performance goals, as well as plans for securing the participation of all existing networks in the Advanced National Seismic System and for establishing new, or enhancing existing, partnerships to leverage resources.</content>
            </subsection><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s7707">42 U.S.C. 7707</ref><b>]</b> </editorialNote>
        </section>
        <section identifier="/us/sComp/95/124/s14" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="14">SEC. 14. </num><heading style="-uslm-dtd:header">NETWORK FOR EARTHQUAKE ENGINEERING SIMULATION. </heading>
            <subsection identifier="/us/sComp/95/124/s14/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Establishment.—</heading><content style="-uslm-dtd:text">The Director of the National Science Foundation shall establish the George E. Brown, Jr. Network for Earthquake Engineering Simulation that will upgrade, link, and integrate a system of geographically distributed experimental facilities for earthquake engineering testing of full-sized structures and their components and partial-scale physical models. The system shall be integrated through networking software so that integrated models and databases can be used to create model-based simulation, and the components of the system shall be interconnected with a computer network and allow for remote access, information sharing, and collaborative research.</content>
            </subsection>
            <subsection identifier="/us/sComp/95/124/s14/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading><chapeau style="-uslm-dtd:text">In addition to amounts appropriated under section 12(c), there are authorized to be appropriated to the National Science Foundation for the George E. Brown, Jr. Network for Earthquake Engineering Simulation—</chapeau>
