                <heading style="-uslm-dtd:header">SHORT TITLE </heading>
                <num style="-uslm-dtd:enum" value="201">Sec. 201. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s1861">42 U.S.C. 1861 note</ref><b>]</b> </editorialNote><content style="-uslm-dtd:text">This title may be cited as the “<shortTitle style="-uslm-dtd:quote"><inline style="-uslm-dtd:short-title">Academic Research Facilities Modernization Act of 1988</inline></shortTitle>”.</content><footnote id="IDFF48BDA296A3411895CC8A682D97489C" style="-uslm-dtd:footnote"><sup style="-uslm-dtd:superscript">1</sup><p style="-uslm-dtd:para; margin-left:1em">This title was enacted as title II of the National Science Foundation Authorization Act of 1988 (Public Law 100–570).</p></footnote>

                <heading style="-uslm-dtd:header">findings and purpose </heading>
                <num style="-uslm-dtd:enum" value="202">Sec. 202. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s1862a">42 U.S.C. 1862a</ref><b>]</b> </editorialNote><subsection class="inline" identifier="/us/sComp/100/570/tII/s202/a" style="-uslm-dtd:subsection" styleType="OLC"><num style="-uslm-dtd:enum" value="a">(a) </num><chapeau style="-uslm-dtd:text">The Congress finds that—</chapeau>
                <paragraph identifier="/us/sComp/100/570/tII/s202/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the fundamental research and related education program supported by the Federal Government and conducted by the Nation's universities and colleges are essential to our national security, and to our health, economic welfare, and general well- being;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/100/570/tII/s202/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">many national research and related education programs conducted by universities and colleges are now hindered by obsolete research buildings and equipment, and many institutions lack sufficient resources to repair, renovate, or replace their laboratories;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/100/570/tII/s202/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the Nation's capacity to conduct high quality research and education programs and to maintain its competitive position at the forefront of modern science, engineering, and technology is threatened by this research capital deficit, which poses serious and adverse consequences to our future national security, health, welfare, and ability to compete in the international marketplace;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/100/570/tII/s202/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">a national effort to spur reinvestment in research facilities is needed, and national, State, and local policies and cooperative programs are required that will yield maximum return on the investment of scarce national resources and sustain a commitment to excellence in research and education; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/100/570/tII/s202/a/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">the Foundation, as part of its responsibility for maintaining the vitality of the Nation's academic research, and in partnership with the States, industry, and universities and colleges, must assist in enhancing the historic linkages between Federal investment in academic research and training and investment in the research capital base by reinvesting in the capital facilities which modern research and education programs require.</content>
                </paragraph></subsection>
                <subsection identifier="/us/sComp/100/570/tII/s202/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">It is the purpose of this title to assist in modernizing and revitalizing the Nation's research facilities at institutions of higher education, independent non-profit research institutions and research museums, and consortia thereof, through capital investment.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/100/570/tII/s203" style="-uslm-dtd:section" styleType="traditional">
                <heading style="-uslm-dtd:header">establishment of program </heading>
                <num style="-uslm-dtd:enum" value="203">Sec. 203. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s1862b">42 U.S.C. 1862b</ref><b>]</b> </editorialNote><subsection class="inline" identifier="/us/sComp/100/570/tII/s203/a" style="-uslm-dtd:subsection" styleType="OLC"><num style="-uslm-dtd:enum" value="a">(a)</num><paragraph class="inline" identifier="/us/sComp/100/570/tII/s203/a/1" style="-uslm-dtd:paragraph" styleType="OLC"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">To carry out this title, the Director shall establish and carry out a new Academic Research Facilities Modernization Program (hereafter in this title referred to as the “<quotedText style="-uslm-dtd:quote">Program</quotedText>”), under which awards are made to institutions of higher education, independent nonprofit research institutions, and research museums, and consortia thereof, for the repair, renovation, or, in exceptional cases, replacement of obsolete science and engineering facilities primarily devoted to research.</content></paragraph>
                <paragraph class="leftIndentDecrease1" identifier="/us/sComp/100/570/tII/s203/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">Such awards shall, consistent with the functions of the Foundation set forth in section 3 of the National Science Foundation Act of 1950 (42 U.S.C. 1862) and through established Foundation selection procedures, serve to—</chapeau>
                    <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/100/570/tII/s203/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">promote the modernization of graduate academic science and engineering research laboratories and related facilities so as to facilitate and support research in the scientific and engineering disciplines;</content>
                    </subparagraph>
                    <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/100/570/tII/s203/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">assist those academic institutions that historically have received relatively little Federal research and development funds to improve their academic science and engineering infrastructures and broaden and strengthen the Nation's science and engineering base; and</content>
                    </subparagraph>
                    <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/100/570/tII/s203/a/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">promote the modernization of undergraduate academic science and engineering research laboratories and related facilities so as to facilitate and support research in the scientific and engineering disciplines.</content>
                    </subparagraph>
                </paragraph></subsection>
                <subsection identifier="/us/sComp/100/570/tII/s203/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b)</num><paragraph class="inline" identifier="/us/sComp/100/570/tII/s203/b/1" style="-uslm-dtd:paragraph" styleType="OLC"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The Program shall be carried out through projects which involve the repair, renovation, or, in exceptional cases, replacement of specific science and engineering facilities devoted primarily to research at eligible institutions, or consortia thereof, and for which funds are awarded in response to specific proposals submitted by such eligible institutions or consortia in accordance with procedures prescribed by the Director pursuant to section 204 of this Act.</content></paragraph>
                    <paragraph class="leftIndentDecrease1" identifier="/us/sComp/100/570/tII/s203/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Awards made under the Program shall not exceed $7,000,000 to any institution or consortium over any period of 5 years for the repair, renovation, or, in exceptional cases, replacement of academic research facilities.</content>
                    </paragraph>
                    <paragraph class="leftIndentDecrease1" identifier="/us/sComp/100/570/tII/s203/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">The Director shall, in making awards under the Program, consider the extent to which that institution or consortium has received funds for the repair, renovation, construction, or replacement of academic facilities from any other Federal funding source within the 5-year period immediately preceding the application. The Director shall give priority to institutions or consortia that have not received such funds in the preceding 5 years.</content>
                    </paragraph>
                    <paragraph class="leftIndentDecrease1" identifier="/us/sComp/100/570/tII/s203/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">The Director shall, in awarding funds under this title, consider the distribution of funds among institutions of different sizes and geographical locations.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/100/570/tII/s203/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><chapeau style="-uslm-dtd:text">Criteria for the award of funds to any institution for a project under the Program shall include—</chapeau>
                    <paragraph identifier="/us/sComp/100/570/tII/s203/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the quality of the research and training to be carried out in the facility or facilities involved;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/100/570/tII/s203/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">the need for the proposed repair, renovation, or, in exceptional cases, replacement based on an analysis of the age and condition of existing research facilities and equipment;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/100/570/tII/s203/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">the congruence of the institution's research and training activities with the future research needs of the Nation and the research mission of the Foundation;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/100/570/tII/s203/c/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">the contribution that the project will make toward meeting national, regional, and institutional research and related training needs;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/100/570/tII/s203/c/5" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">in the case of an institution that historically has received relatively little Federal research and development funding, the contribution the proposed project will make to improving the institution's academic scientific and engineering infrastructure and broadening the Nation's science and engineering base; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/100/570/tII/s203/c/6" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">the impact of the award on the overall geographic distribution of awards made under the Program, with the objective of avoiding undue concentration of awards.</content>
                    </paragraph>
                </subsection>
            </section>
            <section identifier="/us/sComp/100/570/tII/s204" style="-uslm-dtd:section" styleType="traditional">
                <heading style="-uslm-dtd:header">procedures, guidelines, and planning activities </heading>
                <num style="-uslm-dtd:enum" value="204">Sec. 204. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s1862c">42 U.S.C. 1862c</ref><b>]</b> </editorialNote><subsection class="inline" identifier="/us/sComp/100/570/tII/s204/a" style="-uslm-dtd:subsection" styleType="OLC"><num style="-uslm-dtd:enum" value="a">(a)</num><paragraph class="inline" identifier="/us/sComp/100/570/tII/s204/a/1" style="-uslm-dtd:paragraph" styleType="OLC"><num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">The Director shall, consistent with the objectives of the Program and the criteria set forth in section 203(c) of this Act, set forth procedures for the Program.</content></paragraph>
                <paragraph class="leftIndentDecrease1" identifier="/us/sComp/100/570/tII/s204/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">The procedures so prescribed shall contain such terms, conditions, and guidelines as may be necessary in the light of Program objectives, but shall in any event provide that—</chapeau>
                    <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/100/570/tII/s204/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">funds to carry out the Program will be awarded only on the basis of merit after a comprehensive review using established Foundation procedures;</content>
                    </subparagraph>
                    <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/100/570/tII/s204/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the membership of merit review panels that assess proposals will be broadly representative of eligible institutions, including research universities and predominantly undergraduate and minority institutions;</content>
                    </subparagraph>
                    <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/100/570/tII/s204/a/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the institution receiving an award shall provide at least 50 percent of the cost, in cash or in kind, fairly evaluated, of the repair, renovation, or replacement involved and shall provide this contribution from private or non-Federal public sources, except that the Director may accept a match of less than 50 percent, but at least 30 percent, for institutions which are not ranked among the top 100 of the institutions receiving Federal research and development funding, as documented in the latest annual report of the Foundation entitled “<quotedText style="-uslm-dtd:quote">Federal Support to Universities, Colleges, and Selected Nonprofit Institutions</quotedText>”; and</content>
                    </subparagraph>
                    <subparagraph class="leftIndentDecrease1" identifier="/us/sComp/100/570/tII/s204/a/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">to the extent practicable, eligible institutions of a given type will compete against similar institutions for Program awards.</content>
                    </subparagraph>
                </paragraph></subsection>
                <subsection identifier="/us/sComp/100/570/tII/s204/b" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">The Director shall conduct comprehensive planning activities, including surveys of research facility needs and other information-gathering activities, necessary to implement the Program and to develop the procedures called for under subsection (a) of this section.</content>
                </subsection>
                <subsection identifier="/us/sComp/100/570/tII/s204/c" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="c">(c) </num><chapeau style="-uslm-dtd:text">Prior to the issuance of the comprehensive plan required by subsection (d) of this section, and consistent with the Program criteria set forth in section 203(c) of this Act, the Director shall publish in the Federal Register proposed Program guidelines for public review for a comment period of 30 days. Such guidelines shall provide detailed information on eligibility, criteria, terms, and conditions and shall include, but not be limited to—</chapeau>
                    <paragraph identifier="/us/sComp/100/570/tII/s204/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">definitions for the terms “<term style="-uslm-dtd:term">institutions of higher education</term>”, “<quotedText style="-uslm-dtd:quote">private non-profit research organizations</quotedText>”, “<quotedText style="-uslm-dtd:quote">research museums</quotedText>”, “<quotedText style="-uslm-dtd:quote">consortia</quotedText>”, “<quotedText style="-uslm-dtd:quote">facilities</quotedText>”, “<quotedText style="-uslm-dtd:quote">facilities primarily devoted to research</quotedText>”, “<quotedText style="-uslm-dtd:quote">instrumentation</quotedText>”, “<quotedText style="-uslm-dtd:quote">equipment</quotedText>”, “<quotedText style="-uslm-dtd:quote">repair</quotedText>”, “<quotedText style="-uslm-dtd:quote">renovation</quotedText>”, and “<quotedText style="-uslm-dtd:quote">replacement</quotedText>”;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/100/570/tII/s204/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">selection criteria to be used by the Foundation in evaluating proposals from institutions and consortia thereof, including criteria for evaluating scientific merit and for evaluating the age and condition of existing research facilities; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/100/570/tII/s204/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">requirements for matching a Program award with contributions from non-Federal sources.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/100/570/tII/s204/d" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="d">(d) </num><chapeau style="-uslm-dtd:text">The Director, after gathering appropriate information and after considering comments on the proposed Program guidelines published in the Federal Register pursuant to subsection (c) of this section, shall develop a comprehensive plan for the Program that—</chapeau>
                    <paragraph identifier="/us/sComp/100/570/tII/s204/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">defines the appropriate roles and responsibilities of the Federal Government, institutions of higher education, State governments, private foundations, and other appropriate organizations;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/100/570/tII/s204/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">states what procedures will be used to ensure that predominantly undergraduate institutions and colleges and universities that historically have received little Federal research and development funding will receive substantial percentages of the funds awarded under this title;</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/100/570/tII/s204/d/3" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">states the estimated percentage of Program funds available for each category of eligible institutions, including predominantly undergraduate institutions and colleges and universities that historically have received little Federal research and development funding as well as research universities; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/100/570/tII/s204/d/4" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="4">(4) </num><chapeau style="-uslm-dtd:text">evaluates and addresses, to the maximum extent possible, a variety of factors which include—</chapeau>
                        <subparagraph identifier="/us/sComp/100/570/tII/s204/d/4/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the unique circumstances and research facilities needs of research universities, undergraduate institutions, and other institutions whose enrollment includes substantial percentages of minorities underrepresented in science and engineering research;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/100/570/tII/s204/d/4/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">innovative approaches in the management of the Program that address both short-term and long-term aspects of the renovation, repair, and replacement of academic research facilities;</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/100/570/tII/s204/d/4/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">programmatic approaches that recognize and support excellence, strengthen scientific and engineering research potential and, to the maximum extent possible and consistent with the purposes of this Act, assure an equitable distribution of resources with respect to institutions and geographical areas; and</content>
                        </subparagraph>
                        <subparagraph identifier="/us/sComp/100/570/tII/s204/d/4/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">any recommendations necessary to improve the Program and further meet the purposes of this title.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/100/570/tII/s204/e" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Biennial Report.—</heading><chapeau style="-uslm-dtd:text">Every 2 years, the Committee shall prepare and submit to the Director a report on its activities
 during the previous 2 years and proposed activities for the next 2 years.
 The Director shall submit to Congress the report, unaltered, together with
 such comments as the Director considers appropriate, including—</chapeau>
                    <paragraph identifier="/us/sComp/100/570/tII/s204/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">review data on the participation in Foundation activities of institutions serving populations that
 are
 underrepresented in STEM disciplines, including poor, rural, and tribal
 populations; and</content>
                    </paragraph>
                    <paragraph identifier="/us/sComp/100/570/tII/s204/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">recommendations regarding how the Foundation could improve outreach and
 inclusion of these populations in Foundation activities.</content>
                    </paragraph>
                </subsection>
                <subsection identifier="/us/sComp/100/570/tII/s204/f" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="f">(f) </num><content style="-uslm-dtd:text">Final guidelines shall be published in the Federal Register not later than 45 days after the submission of the report required under subsection (e).</content>
                </subsection>
                <subsection identifier="/us/sComp/100/570/tII/s204/g" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="g">(g) </num><content style="-uslm-dtd:text">The Director shall, from amounts available to the Foundation under section 101(b) of this Act for fiscal year 1989, make available an amount, not to exceed $1,000,000, to carry out the provisions of this section. None of the funds authorized to be appropriated in section 101 of this Act may be used for grant or contract awards under the Program prior to completion and submission to Congress of the comprehensive plan required by subsection (d) of this section.</content>
                </subsection>
                <subsection identifier="/us/sComp/100/570/tII/s204/h" style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="h">(h) </num><content style="-uslm-dtd:text">In conducting the activities under the Program, the Director shall consult with the Secretary of Education and the heads of other related agencies.</content>
                </subsection>
            </section>
            <section identifier="/us/sComp/100/570/tII/s205" style="-uslm-dtd:section" styleType="traditional">
                <heading style="-uslm-dtd:header">set-aside for certain institutions </heading>
                <num style="-uslm-dtd:enum" value="205">Sec. 205. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t42/s1862d">42 U.S.C. 1862d</ref><b>]</b> </editorialNote><content style="-uslm-dtd:text">Of the amounts appropriated to the Foundation for the Program, as authorized under section 101 of this Act, in each fiscal year, at least 12 percent shall be reserved for historically Black colleges or universities defined as “<quotedText style="-uslm-dtd:quote">part B institutions</quotedText>” by section 322(2) of the Higher Education Act of 1965 (20 U.S.C. 1061(2)) and other institutions of higher education whose enrollment includes a substantial percentage of students who are Black Americans, Hispanic Americans, or Native Americans.</content>
            </section>
            <section identifier="/us/sComp/100/570/tII/s206" style="-uslm-dtd:section" styleType="traditional">
                <heading style="-uslm-dtd:header">conforming amendment </heading>
                <num style="-uslm-dtd:enum" value="206">Sec. 206. </num><content style="-uslm-dtd:text">Subtitle E of title IV (sections 6401–6403) of the Omnibus Trade and Competitiveness Act of 1988 is repealed.</content>
