    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To amend titles 11 and 28, United States Code, to modify the compensation payable to trustees serving in cases under chapter 7 of title 11, United States Code, to extend the term of certain temporary offices of bankruptcy judges, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section identifier="/us/sComp/119/76/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t28/s1">28 U.S.C. 1 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Bankruptcy Administration Improvement Act of 2025</shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/119/76/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">FINDINGS. </heading>
            <chapeau class="block" style="-uslm-dtd:text">Congress finds the following:</chapeau>
            <paragraph identifier="/us/sComp/119/76/s2/1" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">Congress has amended the laws governing bankruptcy fees as necessary to ensure that the bankruptcy system remains self-supporting, while also fairly allocating the costs of the system among those who use the system.</content>
            </paragraph>
            <paragraph identifier="/us/sComp/119/76/s2/2" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Because of the importance for the bankruptcy system to be self-funded, at no cost to taxpayers, Congress has closely monitored the funding needs of the bankruptcy system, including by requiring periodic reporting by the Attorney General regarding the United States Trustee System Fund.</content>
            </paragraph>
            <paragraph identifier="/us/sComp/119/76/s2/3" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">Because the system governing bankruptcies of various types is interconnected, Congress has established fees, including filing fees, quarterly fees in chapter 11 cases, and other fees, that together fund the courts, judges, United States trustees, and trustees serving in bankruptcy cases under chapter 7 of title 11, United States Code.</content>
            </paragraph>
            <paragraph identifier="/us/sComp/119/76/s2/4" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">Trustees serving in bankruptcy cases under chapter 7 of title 11, United States Code, are vital to the functioning of the bankruptcy system, as they provide services at the front lines of the bankruptcy process, administering thousands of cases.</content>
            </paragraph>
            <paragraph identifier="/us/sComp/119/76/s2/5" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">Chapter 7 bankruptcy trustees provide valuable returns of assets to government creditors, including the Internal Revenue Service, the Department of Agriculture, the Small Business Administration, and other Federal, State, and municipal governments.</content>
            </paragraph>
            <paragraph identifier="/us/sComp/119/76/s2/6" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="6">(6) </num><content style="-uslm-dtd:text">Due to the work of the chapter 7 bankruptcy trustees, millions of dollars are also disbursed annually to private creditors of all types, including medical providers, unsecured creditors, small businesses, and micro-enterprises such as domestic support providers.</content>
            </paragraph>
            <paragraph identifier="/us/sComp/119/76/s2/7" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="7">(7) </num><content style="-uslm-dtd:text">Despite the essential role of chapter 7 bankruptcy trustees, since 1994 the amount of compensation paid to these trustees has not been increased. As in 1994, bankruptcy trustees receive only $60 per case (composed of $45 from subsection 330(b)(1), and $15 from subsection 330(b)(2), of title 11, United States Code) in nearly 90 percent of chapter 7 cases, and bankruptcy trustees receive no compensation at all for cases in which the filing fee is waived by the bankruptcy court.</content>
            </paragraph>
            <paragraph identifier="/us/sComp/119/76/s2/8" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="8">(8) </num><content style="-uslm-dtd:text">Since 1994, there have been significant increases in salaries, attorney fees, budget appropriations, filing fees, and court-related fees associated with chapter 7 bankruptcies. In contrast, the $60 paid to chapter 7 trustees has remained the same and has not even been increased for inflation. In 2021, Congress attempted to implement a mechanism that would give chapter 7 trustees a raise, but the trustees only received increased compensation for 1 fiscal year. Based on Consumer Price Index estimates, the $60 paid to trustees in 1994 would be the equivalent of over $125 today.</content>
            </paragraph>
            <paragraph identifier="/us/sComp/119/76/s2/9" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="9">(9) </num><chapeau style="-uslm-dtd:text">This Act and the amendments made by this Act—</chapeau>
                <subparagraph identifier="/us/sComp/119/76/s2/9/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">increase the compensation of chapter 7 bankruptcy trustees to the level that is appropriate, overdue, and proportionate with the level that was intended in 1994, by increasing the total compensation of trustees to $120 per case;</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/119/76/s2/9/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">ensure adequate funding of the United States trustee system through the increase of certain fees, which will also apply to districts that are not part of a United States trustee region as required by existing law; and</content>
                </subparagraph>
                <subparagraph identifier="/us/sComp/119/76/s2/9/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">support the preservation of existing bankruptcy judgeships that are urgently needed to handle existing and anticipated increases in business and consumer caseloads.</content>
                </subparagraph>
            </paragraph>
            <paragraph identifier="/us/sComp/119/76/s2/10" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="10">(10) </num><content style="-uslm-dtd:text">This Act will not alter the filing fee under chapter 7 of title 11, United States Code, and will not modify, impair, or supersede the current authority of the district courts of the United States, or of bankruptcy courts, to waive the payment of filing fees by indigent individuals.</content>
            </paragraph>
        </section>
        <section identifier="/us/sComp/119/76/s3" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">TRUSTEE COMPENSATION. </heading>
            <subsection identifier="/us/sComp/119/76/s3/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Compensation of Officers.—</heading><chapeau style="-uslm-dtd:text">Section 330 of title 11, United States Code, is amended—</chapeau>
                <paragraph identifier="/us/sComp/119/76/s3/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in subsection (b)(1) by striking “<quotedText style="-uslm-dtd:quote">$45</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">$105</quotedText>”; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/119/76/s3/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">by striking subsection (e).</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/119/76/s3/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t28/s1930">28 U.S.C. 1930 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Remainder of Fees.—</heading><chapeau style="-uslm-dtd:text">Notwithstanding any other provision of law, the remainder of fees collected under section 1930(a)(1)(A) of title 28, United States Code, after compensating trustees under section 330(b)(1) of title 11, United States Code, shall be deposited as follows:</chapeau>
                <paragraph identifier="/us/sComp/119/76/s3/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">$63.51 in the special fund of the Treasury established under section 1931 of title 28, United States Code.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/119/76/s3/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">$25.00 in the special fund established in accordance with section 10101(b) of the Deficit Reduction Act of 2005 (28 U.S.C. 1931 note).</content>
                </paragraph>
                <paragraph identifier="/us/sComp/119/76/s3/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">$51.49 in the United States Trustee System Fund established under section 589a of title 28, United States Code.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/119/76/s3/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">United States Trustee System Fund.—</heading><chapeau style="-uslm-dtd:text">Section 589a of title 28, United States Code, is amended—</chapeau>
                <paragraph identifier="/us/sComp/119/76/s3/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in subsection (b)(1)(A), by striking “<quotedText style="-uslm-dtd:quote">40.46 percent of the fees collected</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">$51.49 of the fees collected in each case</quotedText>”; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/119/76/s3/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">in subsection (f)(1)—</chapeau>
                    <subparagraph identifier="/us/sComp/119/76/s3/c/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">in subparagraph (D) by striking “<quotedText style="-uslm-dtd:quote">Fourth</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">Second</quotedText>”;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/119/76/s3/c/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">by striking subparagraphs (B) and (C); and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/119/76/s3/c/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">by redesignating subparagraph (D) as subparagraph (B).</content>
                    </subparagraph>
                </paragraph>
            </subsection>
        </section>
        <section identifier="/us/sComp/119/76/s4" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><heading style="-uslm-dtd:header">BANKRUPTCY FEES. </heading>
            <subsection identifier="/us/sComp/119/76/s4/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Quarterly Fees.—</heading><chapeau style="-uslm-dtd:text">Section 1930(a)(6)(B) of title 28, United States Code, is amended—</chapeau>
                <paragraph identifier="/us/sComp/119/76/s4/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in clause (i), by striking “<quotedText style="-uslm-dtd:quote">5-year</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">10-year</quotedText>”; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/119/76/s4/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">in clause (ii)—</chapeau>
                    <subparagraph identifier="/us/sComp/119/76/s4/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">in subclause (I)—</chapeau>
                        <clause identifier="/us/sComp/119/76/s4/a/2/A/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">by inserting “<quotedText style="-uslm-dtd:quote">the greater of</quotedText>” before “<quotedText style="-uslm-dtd:quote">0.4</quotedText>”; and</content>
                        </clause>
                        <clause identifier="/us/sComp/119/76/s4/a/2/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">and</quotedText>” at the end and inserting “<quotedText style="-uslm-dtd:quote">or</quotedText>”; and</content>
                        </clause>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/119/76/s4/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">in subclause (II), by striking “<quotedText style="-uslm-dtd:quote">0.8</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">0.9</quotedText>”.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/119/76/s4/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Period for Deposits.—</heading><content style="-uslm-dtd:text">Section 589a(f) of title 28, United States Code, as amended by section 3(c)(2), is amended by striking “<quotedText style="-uslm-dtd:quote">2026</quotedText>” each place it appears and inserting “<quotedText style="-uslm-dtd:quote">2031</quotedText>”.</content>
            </subsection>
            <subsection identifier="/us/sComp/119/76/s4/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t28/s589a">28 U.S.C. 589a note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Deposits of Certain Fees for Fiscal Years 2026 Through 2031.—</heading><chapeau style="-uslm-dtd:text">Notwithstanding section 589a(b) of title 28, United States Code, for each of fiscal years 2026 through 2031—</chapeau>
                <paragraph identifier="/us/sComp/119/76/s4/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">the fees collected under section 1930(a)(6) of title 28, United States Code, less the amount specified in subparagraph (2) of this subsection, shall be deposited as specified in section 589a(f) of title 28, United States Code, as amended by this Act; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/119/76/s4/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">$5,400,000 of the fees collected under section 1930(a)(6) of title 28, United States Code, shall be deposited in the general fund of the Treasury.</content>
                </paragraph>
            </subsection>
        </section>
        <section identifier="/us/sComp/119/76/s5" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><heading style="-uslm-dtd:header">EXTENSION OF TERM OF CERTAIN TEMPORARY OFFICES OF BANKRUPTCY JUDGE. </heading>
            <subsection identifier="/us/sComp/119/76/s5/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Bankruptcy Administration Improvement Act of 2020.—</heading><chapeau style="-uslm-dtd:text">Section 4 of the Bankruptcy Administration Improvement Act of 2020 (28 U.S.C. 152 note) is amended—</chapeau>
                <paragraph identifier="/us/sComp/119/76/s5/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">in subsection (a)(2)—</chapeau>
                    <subparagraph identifier="/us/sComp/119/76/s5/a/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">in subparagraph (A)(i), by striking “<quotedText style="-uslm-dtd:quote">5 years</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">10 years</quotedText>”; and</content>
                    </subparagraph>

            </subsection>
        </section>
        <section identifier="/us/sComp/119/76/s6" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="6">SEC. 6. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t11/s330">11 U.S.C. 330 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">EFFECTIVE DATE; APPLICATION OF AMENDMENTS. </heading>
            <subsection identifier="/us/sComp/119/76/s6/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Except as provided in subsection (b), the amendments made by this Act shall take effect on the first day of the calendar quarter that first occurs on or after the date of enactment of this Act.</content>
            </subsection>
            <subsection identifier="/us/sComp/119/76/s6/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Exceptions.—</heading>
                <paragraph identifier="/us/sComp/119/76/s6/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Compensation of officers.—</heading><chapeau style="-uslm-dtd:text">Section 3 and the amendments made by section 3 shall apply to any case under title 11, United States Code, commenced on or after October 1 that first occurs after the date of enactment of this Act—</chapeau>
                    <subparagraph identifier="/us/sComp/119/76/s6/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">under chapter 7 of title 11, United States Code; or</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/119/76/s6/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">under chapter 11, 12, or 13 of title 11, United States Code, that is converted to a case under chapter 7 of title 11, United States Code.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/119/76/s6/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Bankruptcy fees.—</heading><chapeau style="-uslm-dtd:text">Section 4 and the amendments made by section 4 shall apply to—</chapeau>
                    <subparagraph identifier="/us/sComp/119/76/s6/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">any case commenced or pending under chapter 11 of title 11, United States Code, on or after the first day of the calendar quarter that first occurs on or after the date of enactment of this Act; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/119/76/s6/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">quarterly fees payable under section 1930(a)(6) of title 28, United States Code, as amended by section 4,  
for disbursements made in any calendar quarter that begins on or after the date of enactment of this Act.</content>
                    </subparagraph>
