    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To amend the Save Our Seas 2.0 Act to improve the administration of the Marine Debris Foundation, to amend the Marine Debris Act to improve the administration of the Marine Debris Program of the National Oceanic and Atmospheric Administration, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section identifier="/us/sComp/119/65/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s1951">33 U.S.C. 1951 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Save Our Seas 2.0 Amendments Act</shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/119/65/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">MODIFICATIONS TO THE MARINE DEBRIS PROGRAM OF THE NATIONAL OCEANIC AND ATMOSPHERIC ADMINISTRATION. </heading>
            <subsection identifier="/us/sComp/119/65/s2/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><chapeau style="-uslm-dtd:text">The Marine Debris Act (Public Law 109-449) is amended—</chapeau>
                <paragraph identifier="/us/sComp/119/65/s2/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">by inserting before section 3 the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <subtitle style="-uslm-dtd:subtitle">
                        <num style="-uslm-dtd:enum" value="A">“Subtitle A—</num><heading style="-uslm-dtd:header">NOAA And Coast Guard Programs”</heading>
                    </subtitle></quotedContent>; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/119/65/s2/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s1952-1955">33 U.S.C. 1952-1955</ref><b>]</b> </editorialNote><content style="-uslm-dtd:text">by redesignating sections 3 through 6 as sections 101 through 104, respectively.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/119/65/s2/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Grants, Cooperative Agreements, Contracts, and Other Agreements.—</heading><chapeau style="-uslm-dtd:text">Section 101(d) of the Marine Debris Act (33 U.S.C. 1952(d)), as redesignated by this Act, is amended—</chapeau>
                <paragraph identifier="/us/sComp/119/65/s2/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in the subsection heading by striking “<quotedText style="-uslm-dtd:quote">AND CONTRACTS</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">CONTRACTS, AND OTHER AGREEMENTS</quotedText>”;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/119/65/s2/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in paragraph (1) by striking “<quotedText style="-uslm-dtd:quote">and contracts</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">, contracts, and other agreements</quotedText>”;</content>

                        <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">in subparagraph (B)—</chapeau>
                        <clause identifier="/us/sComp/119/65/s2/b/3/A/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">part of the</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">part of a</quotedText>”; and</content>
                        </clause>

                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">by inserting “<quotedText style="-uslm-dtd:quote">or (C)</quotedText>” after “<quotedText style="-uslm-dtd:quote">subparagraph (A)</quotedText>”; and</content>
                        </clause>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/119/65/s2/b/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">in subparagraph (C) in the matter preceding clause (i) by inserting “<quotedText style="-uslm-dtd:quote">and except as provided in subparagraph (B)</quotedText>” after “<quotedText style="-uslm-dtd:quote">subparagraph (A)</quotedText>”; and</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/119/65/s2/b/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><content style="-uslm-dtd:text">by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">

                        <num style="-uslm-dtd:enum" value="7">“(7) </num><heading style="-uslm-dtd:header">In-kind contributions.—</heading><content style="-uslm-dtd:text">With respect to any project carried out pursuant to a contract or other agreement entered into under paragraph (1) that is not a cooperative agreement 
or an agreement to provide financial assistance in the form of a grant, the Under Secretary may contribute on an in-kind basis the portion of the costs of the project that the Under Secretary determines represents the amount of benefit the National Oceanic and Atmospheric Administration derives from the project.”</content>

            </subsection>
        </section>
        <section identifier="/us/sComp/119/65/s3" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">MODIFICATIONS TO THE MARINE DEBRIS FOUNDATION. </heading>
            <subsection identifier="/us/sComp/119/65/s3/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s1961-1969">33 U.S.C. 1961-1969</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Subtitle B of title I of the Save Our Seas 2.0 Act (Public Law 116-224) is transferred to appear after section 104 of the Marine Debris Act (Public Law 109-449), as redesignated by this Act.</content>
            </subsection>
            <subsection identifier="/us/sComp/119/65/s3/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s1961">33 U.S.C. 1961</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Status of Foundation.—</heading><content style="-uslm-dtd:text">Section 111(a) of the Marine Debris Act (Public Law 109-449), as transferred by this Act, is amended, in the second sentence, by striking “<quotedText style="-uslm-dtd:quote">organization</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">corporation</quotedText>”.</content>
            </subsection>
            <subsection identifier="/us/sComp/119/65/s3/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Purposes.—</heading><chapeau style="-uslm-dtd:text">Section 111(b) of the Marine Debris Act (Public Law 109-449), as transferred and redesignated by this Act, is amended—</chapeau>
                <paragraph identifier="/us/sComp/119/65/s3/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in paragraph (3) by inserting “<quotedText style="-uslm-dtd:quote">Indian Tribes,</quotedText>” after “<quotedText style="-uslm-dtd:quote">Tribal governments,</quotedText>”; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/119/65/s3/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in paragraph (4) by striking “<quotedText style="-uslm-dtd:quote">title II</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">subtitle C</quotedText>”.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/119/65/s3/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Board of Directors.—</heading>
                <paragraph identifier="/us/sComp/119/65/s3/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s1962">33 U.S.C. 1962</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Appointment, vacancies, and removal.—</heading><chapeau style="-uslm-dtd:text">Section 112(b) of the Marine Debris Act (Public Law 109-449), as transferred by this Act, is amended—</chapeau>
                    <subparagraph identifier="/us/sComp/119/65/s3/d/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">by redesignating paragraphs (1) through (5) as paragraphs (2) through (6) respectively;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/119/65/s3/d/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">by inserting before paragraph (2), as redesignated, the following:<quotedContent style="-uslm-dtd:quoted-block">
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">“(1) </num><heading style="-uslm-dtd:header">Recommendations of board regarding appointments.—</heading><content style="-uslm-dtd:text">For appointments made under paragraph (2), the Board shall submit to the Under Secretary recommendations on candidates for appointment.”</content>
                        </paragraph></quotedContent>;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/119/65/s3/d/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><chapeau style="-uslm-dtd:text">in paragraph (2), as redesignated, in the matter preceding subparagraph (A)—</chapeau>

                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="3">“(3) </num><heading style="-uslm-dtd:header">Terms.—</heading><content style="-uslm-dtd:text">Any Director appointed under paragraph (2) shall be appointed for a term of 6 years.”</content>
                        </paragraph></quotedContent>;</content>
                    </subparagraph>

                    <subparagraph identifier="/us/sComp/119/65/s3/d/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">in paragraph (1)(A) by striking “<quotedText style="-uslm-dtd:quote">officers and employees</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">the initial officers and employees</quotedText>”; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/119/65/s3/d/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">

                    <subsection style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="h">“(h) </num><heading style="-uslm-dtd:header">Chief Executive Officer.—</heading>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">“(1) </num><heading style="-uslm-dtd:header">Appointment; removal; review.—</heading><content style="-uslm-dtd:text">The Board shall appoint and review the performance of, and may remove, the chief executive officer of the Foundation.</content>
                        </paragraph>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">“(2) </num><heading style="-uslm-dtd:header">Powers.—</heading><content style="-uslm-dtd:text">The chief executive officer of the Foundation may appoint, remove, and review the performance of any officer or employee of the Foundation.”</content>
                        </paragraph>
                    </subsection></quotedContent>.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/119/65/s3/e" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s1963">33 U.S.C. 1963</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Powers of Foundation.—</heading><chapeau style="-uslm-dtd:text">Section 113(c)(1) of the Marine Debris Act (Public Law 109-449), as transferred by this Act, is amended in the matter preceding subparagraph (A)—</chapeau>
                <paragraph identifier="/us/sComp/119/65/s3/e/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">by inserting “<quotedText style="-uslm-dtd:quote">nonprofit</quotedText>” before “<quotedText style="-uslm-dtd:quote">corporation</quotedText>”; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/119/65/s3/e/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">acting as a trustee</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">formed</quotedText>”.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/119/65/s3/f" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Principal Office.—</heading><content style="-uslm-dtd:text">Section 113 of the Marine Debris Act (Public Law 109-449), as transferred by this Act, is amended by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                <subsection style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="g">“(g) </num><heading style="-uslm-dtd:header">Principal Office.—</heading><content style="-uslm-dtd:text">The Board shall locate the principal office of the Foundation in the National Capital Region, as such term is defined in section 2674(f)(2) of title 10, United States Code, or a coastal shoreline community.”</content>

                <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Best Practices; Rule of Construction.—</heading><content style="-uslm-dtd:text">Section 113 of the Marine Debris Act (Public Law 109-449), as transferred by this Act and amended by subsection (e), is further amended by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                <subsection style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="h">“(h) </num><heading style="-uslm-dtd:header">Best Practices.—</heading>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">“(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Foundation shall develop and implement best practices for conducting outreach to Indian Tribes and Tribal Governments.</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">“(2) </num><heading style="-uslm-dtd:header">Requirements.—</heading><chapeau style="-uslm-dtd:text">The best practices developed under paragraph (1) shall—</chapeau>
                        <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">include a process to support technical assistance and capacity building to improve outcomes; and</content>
                        </subparagraph>
                        <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">promote an awareness of programs and grants available under this Act.</content>
                        </subparagraph>
                    </paragraph>
                </subsection>
                <subsection style="-uslm-dtd:subsection" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="i">“(i) </num><heading style="-uslm-dtd:header">Rule of Construction.—</heading><chapeau style="-uslm-dtd:text">Nothing in this Act may be construed—</chapeau>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">to satisfy any requirement for government-to-government consultation with Tribal Governments; or</content>
                    </paragraph>
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">to affect or modify any treaty or other right of any Tribal Government.”</content>
                    </paragraph>

            </subsection>

                <num style="-uslm-dtd:enum" value="h">(h) </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t33/s1968">33 U.S.C. 1968</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading><chapeau style="-uslm-dtd:text">Section 118(a) of the Marine Debris Act (Public Law 109-449), as transferred by this Act, is amended—</chapeau>

                        <num style="-uslm-dtd:enum" value="3">“(3) </num><heading style="-uslm-dtd:header">EPA administrator.—</heading><content style="-uslm-dtd:text">The term ‘<term style="-uslm-dtd:quote">EPA Administrator</term>’ has the meaning given such term in section 2 of the Save Our Seas 2.0 Act (Public Law 116-224).</content>
