    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To amend the Fair Credit Reporting Act to prevent consumer reporting agencies from furnishing consumer reports under certain circumstances, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section identifier="/us/sComp/119/36/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t15/s1601">15 U.S.C. 1601 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Homebuyers Privacy Protection Act</shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/119/36/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">TREATMENT OF PRESCREENING REPORT REQUESTS. </heading>
            <subsection identifier="/us/sComp/119/36/s2/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Section 604(c) of the Fair Credit Reporting Act (15 U.S.C. 1681b(c)) is amended by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">“(4) </num><heading style="-uslm-dtd:header">Treatment of prescreening report requests.—</heading>
                    <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">“(A) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">In this paragraph:</chapeau>
                        <clause style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">“(i) </num><heading style="-uslm-dtd:header">Credit union.—</heading><content style="-uslm-dtd:text">The term ‘<quotedText style="-uslm-dtd:quote">credit union</quotedText>’ means a Federal credit union or a State credit union, as those terms are defined, respectively, in section 101 of the Federal Credit Union Act (12 U.S.C. 1752).</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">“(ii) </num><heading style="-uslm-dtd:header">Insured depository institution.—</heading><content style="-uslm-dtd:text">The term ‘<quotedText style="-uslm-dtd:quote">insured depository institution</quotedText>’ has the meaning given the term in section 3 of the Federal Deposit Insurance Act (12 U.S.C. 1813(c)).</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">“(iii) </num><heading style="-uslm-dtd:header">Residential mortgage loan.—</heading><content style="-uslm-dtd:text">The term ‘<quotedText style="-uslm-dtd:quote">residential mortgage loan</quotedText>’ has the meaning given the term in section 1503 of the S.A.F.E. Mortgage Licensing Act of 2008 (12 U.S.C. 5102).</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iv">“(iv) </num><heading style="-uslm-dtd:header">Servicer.—</heading><content style="-uslm-dtd:text">The term ‘<quotedText style="-uslm-dtd:quote">servicer</quotedText>’ has the meaning given the term in section 6(i) of the Real Estate Settlement Procedures Act of 1974 (12 U.S.C. 2605(i)).</content>
                        </clause>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">“(B) </num><heading style="-uslm-dtd:header">Limitation.—</heading><chapeau style="-uslm-dtd:text">If a person requests a consumer report from a consumer reporting agency in connection with a credit transaction involving a residential mortgage loan, that agency may not, based in whole or in part on that request, furnish a consumer report to another person under this subsection unless—</chapeau>
                        <clause style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">“(i) </num><content style="-uslm-dtd:text">the transaction consists of a firm offer of credit or insurance; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">“(ii) </num><chapeau style="-uslm-dtd:text">that other person—</chapeau>
                            <subclause style="-uslm-dtd:subclause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="I">“(I) </num><content style="-uslm-dtd:text">has submitted documentation to that agency certifying that such other person has, pursuant to paragraph (1)(A), the authorization 
of the consumer to whom the consumer report relates; or</content>
                            </subclause>
                            <subclause style="-uslm-dtd:subclause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="II">“(II)</num><item class="inline" style="-uslm-dtd:item" styleType="OLC"><num style="-uslm-dtd:enum" value="aa">(aa) </num><content style="-uslm-dtd:text">has originated a current residential mortgage loan of the consumer to whom the consumer report relates;</content></item>
                                <item style="-uslm-dtd:item" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="bb">“(bb) </num><content style="-uslm-dtd:text">is the servicer of a current residential mortgage loan of the consumer to whom the consumer report relates; or</content>
                                </item>
                                <item style="-uslm-dtd:item" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="cc">“(cc)</num><subitem class="inline" style="-uslm-dtd:subitem" styleType="OLC"><num style="-uslm-dtd:enum" value="AA">(AA) </num><content style="-uslm-dtd:text">is an insured depository institution or credit union; and</content></subitem>
                                    <subitem style="-uslm-dtd:subitem" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="BB">“(BB) </num><content style="-uslm-dtd:text">holds a current account for the consumer to whom the consumer report relates.”</content>
                                    </subitem>
                                </item>
                            </subclause>
                        </clause>
                    </subparagraph>
                </paragraph></quotedContent>.</content>
            </subsection>
        </section>
        <section identifier="/us/sComp/119/36/s3" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t15/s1681b">15 U.S.C. 1681b note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">EFFECTIVE DATE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act, and the amendments made by this Act, shall take effect on the date that is 180 days after the date of enactment of this Act.</content>
        </section>
        <section identifier="/us/sComp/119/36/s4" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><heading style="-uslm-dtd:header">GAO STUDY. </heading>
            <subsection identifier="/us/sComp/119/36/s4/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">The Comptroller General of the United States shall carry out a study on the value of trigger leads received by text message that includes input from State regulatory agencies, mortgage lenders, depository institutions (as defined in section 3 of the Federal Deposit Insurance Act (12 U.S.C. 1813)), consumer reporting agencies (as defined in section 603 of the Fair Credit Reporting Act (15 U.S.C. 1681a)), and consumers.</content>
            </subsection>
            <subsection identifier="/us/sComp/119/36/s4/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Report.—</heading><content style="-uslm-dtd:text">Not later than the end of the 12-month period beginning on the date of enactment of this Act, the Comptroller General shall submit to Congress a report containing any findings and determinations made in the study required by subsection (a).</content>
            </subsection>
