    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To improve performance and accountability in the Federal Government, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section identifier="/us/sComp/118/190/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t31/s1101">31 U.S.C. 1101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Federal Agency Performance Act of 2024</shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/118/190/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">ESTABLISHMENT OF STRATEGIC REVIEWS AND REPORTING. </heading>
            <subsection identifier="/us/sComp/118/190/s2/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Strategic Reviews.—</heading>
                <paragraph identifier="/us/sComp/118/190/s2/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">Section 1121 of title 31, United States Code, is amended—</chapeau>
                    <subparagraph identifier="/us/sComp/118/190/s2/a/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">by striking the section heading and inserting “<quotedText style="-uslm-dtd:quote">Progress reviews and use of performance information</quotedText>”; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/190/s2/a/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                        <subsection style="-uslm-dtd:subsection" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="c">“(c) </num><heading style="-uslm-dtd:header">Agency Reviews of Progress Towards Strategic Goals and Objectives.—</heading>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="1">“(1) </num><heading style="-uslm-dtd:header">Covered goal defined.—</heading><content style="-uslm-dtd:text">In this subsection, the term ‘<quotedText style="-uslm-dtd:quote">covered goal</quotedText>’ means a goal or objective established in the strategic plan of the agency under section 306(a) of title 5.</content>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="2">“(2) </num><heading style="-uslm-dtd:header">Review. —</heading><chapeau style="-uslm-dtd:text">Not less frequently than annually and consistent with guidance issued by the Director of the Office of Management and Budget, the head and Chief Operating Officer of each agency, shall—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">“(A) </num><chapeau style="-uslm-dtd:text">for each covered goal, review with the appropriate agency official responsible for the covered goal—</chapeau>
                                    <clause style="-uslm-dtd:clause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="i">“(i) </num><chapeau style="-uslm-dtd:text">the progress achieved toward the covered goal—</chapeau>
                                        <subclause style="-uslm-dtd:subclause" styleType="OLC">
                                            <num style="-uslm-dtd:enum" value="I">“(I) </num><content style="-uslm-dtd:text">during the most recent fiscal year; or</content>
                                        </subclause>
                                        <subclause style="-uslm-dtd:subclause" styleType="OLC">
                                            <num style="-uslm-dtd:enum" value="II">“(II) </num><content style="-uslm-dtd:text">from recent sources of evidence available at the time of the review; and</content>
                                        </subclause>
                                    </clause>
                                    <clause style="-uslm-dtd:clause" styleType="OLC">
                                        <num style="-uslm-dtd:enum" value="ii">“(ii) </num><content style="-uslm-dtd:text">the likelihood that the agency will achieve the covered goal;</content>
                                    </clause>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">coordinate with relevant personnel within and outside the agency who contribute to the accomplishment of each covered goal;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="C">“(C) </num><content style="-uslm-dtd:text">assess progress toward each covered goal by reviewing performance information and other types of evidence relating to each covered goal, such as program evaluations and statistical data;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="D">“(D) </num><content style="-uslm-dtd:text">identify whether additional evidence is necessary to better assess progress toward each covered goal, and 
prioritize the development of the evidence described in subparagraph (C), such as through the plans required under section 312 of title 5, if applicable;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="E">“(E) </num><content style="-uslm-dtd:text">assess whether relevant organizations, program activities, regulations, policies, and other activities contribute as planned to each covered goal;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="F">“(F) </num><content style="-uslm-dtd:text">as appropriate, leverage the assessment performed under subparagraph (E) as part of the portfolio reviews required under section 503(c)(1)(G);</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="G">“(G) </num><content style="-uslm-dtd:text">identify any risks or impediments that would reduce or otherwise decrease the likelihood that the agency will achieve the covered goal; and</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="H">“(H) </num><content style="-uslm-dtd:text">for each covered goal at greatest risk of not being achieved, identify prospects and strategies for performance improvement, including any necessary changes to program activities, regulations, policies, or other activities of the agency.</content>
                                </subparagraph>
                            </paragraph>
                            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="3">“(3) </num><heading style="-uslm-dtd:header">Support.—</heading><chapeau style="-uslm-dtd:text">In fulfilling the requirements of paragraph (2), the head and Chief Operating Officer of each agency shall be supported by—</chapeau>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">the Performance Improvement Officer of the agency;</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">as appropriate, the Chief Data Officer, Evaluation Officer, Program Management Improvement Officer, and Statistical Official of the agency; and</content>
                                </subparagraph>
                                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="C">“(C) </num><content style="-uslm-dtd:text">any other senior agency official designated by the head of the agency, the sustained involvement of whom may help the agency increase the likelihood of achieving 1 or more covered goals.”</content>
                                </subparagraph>
                            </paragraph>
                        </subsection></quotedContent>.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/118/190/s2/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Conforming amendment.—</heading><content style="-uslm-dtd:text">The table of sections for Chapter 11 of title 31, United States Code, is amended by striking the item relating to section 1121 and inserting the following:<quotedContent style="-uslm-dtd:quoted-block"><content style="-uslm-dtd:text">“1121. Progress reviews and use of performance information..”</content></quotedContent>.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/118/190/s2/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Summary Required.—</heading><chapeau style="-uslm-dtd:text">Section 1116 of title 31, United States Code, is amended—</chapeau>
                <paragraph identifier="/us/sComp/118/190/s2/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">in subsection (c)—</chapeau>
                    <subparagraph identifier="/us/sComp/118/190/s2/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">in paragraph (6)(E), by striking “<quotedText style="-uslm-dtd:quote">and</quotedText>” at the end;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/190/s2/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">in paragraph (7), by striking the period at the end and inserting “<quotedText style="-uslm-dtd:quote">; and</quotedText>”; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/190/s2/b/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="8">“(8) </num><content style="-uslm-dtd:text">include a summary of the findings of the review of the agency under section 1121(c).”</content>
                        </paragraph></quotedContent>; and</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/118/190/s2/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">by striking subsections (f) through (i).</content>
                </paragraph>
            </subsection>
        </section>
        <section identifier="/us/sComp/118/190/s3" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="3">SEC. 3. </num><heading style="-uslm-dtd:header">REVISIONS TO THE FEDERAL PERFORMANCE WEBSITE. </heading>
            <chapeau class="block" style="-uslm-dtd:text">Section 1122 of title 31, United States Code, is amended—</chapeau>
            <paragraph identifier="/us/sComp/118/190/s3/1" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">in subsection (a)—</chapeau>
                <subparagraph identifier="/us/sComp/118/190/s3/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">in paragraph (2)—</chapeau>
                    <clause identifier="/us/sComp/118/190/s3/1/A/i" style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="i">(i) </num><chapeau style="-uslm-dtd:text">in subparagraph (C)—</chapeau>
                        <subclause identifier="/us/sComp/118/190/s3/1/A/i/I" style="-uslm-dtd:subclause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">by inserting “<quotedText style="-uslm-dtd:quote">required to be included on the single website under subparagraph (A) and the information</quotedText>”; before “<quotedText style="-uslm-dtd:quote">in the program inventory</quotedText>”; and</content>
                        </subclause>
                        <subclause identifier="/us/sComp/118/190/s3/1/A/i/II" style="-uslm-dtd:subclause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">and</quotedText>” at the end;</content>
                        </subclause>
                    </clause>
                    <clause identifier="/us/sComp/118/190/s3/1/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">in subparagraph (D), by striking the period at the end and inserting “<quotedText style="-uslm-dtd:quote">; and</quotedText>”; and</content>
                    </clause>
                    <clause identifier="/us/sComp/118/190/s3/1/A/iii" style="-uslm-dtd:clause" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                        <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="E">“(E) </num><content style="-uslm-dtd:text">ensure that the website described in subparagraph (A) conforms with the requirements for websites under section 3(a) of the 21st Century Integrated Digital Experience Act (44 U.S.C. 3501 note).”</content>
                        </subparagraph></quotedContent>; and</content>
                    </clause>
                </subparagraph>
                <subparagraph identifier="/us/sComp/118/190/s3/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">in paragraph (4), by striking subparagraph (A) and inserting the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">“(A) </num><chapeau style="-uslm-dtd:text">archive and preserve—</chapeau>
                        <clause style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">“(i) </num><content style="-uslm-dtd:text">the information included in the program inventory required under paragraph (2)(B), including the information described in paragraph (3), after the end of the period during which that information is made available; and</content>
                        </clause>
                        <clause style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">“(ii) </num><content style="-uslm-dtd:text">the information included in the single website under paragraph (2)(A) in accordance with subsections (b) and (c) after the end of the period during which such information is made available on the website; and”</content>
                        </clause>
                    </subparagraph></quotedContent>;</content>
                </subparagraph>
            </paragraph>
            <paragraph identifier="/us/sComp/118/190/s3/2" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in subsection (b), by striking paragraph (6) and inserting the following:<quotedContent style="-uslm-dtd:quoted-block">
                <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="6">“(6) </num><chapeau style="-uslm-dtd:text">the results achieved toward the agency priority goals established under section 1120(b)—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">during the most recent quarter and overall trend data for each quarter compared to the planned level of performance; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">at the end of the 2-year agency priority goal period compared to the overall planned level of performance;”</content>
                    </subparagraph>
                </paragraph></quotedContent>; and</content>
            </paragraph>
            <paragraph identifier="/us/sComp/118/190/s3/3" style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">in subsection (c), by striking paragraph (5) and inserting the following:<quotedContent style="-uslm-dtd:quoted-block">
                <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">“(5) </num><chapeau style="-uslm-dtd:text">the results achieved toward the priority goals developed under section 1120(a)(1)—</chapeau>
                    <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">during the most recent quarter and overall trend data for each quarter compared to the planned level of performance; and</content>
                    </subparagraph>
                    <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">at the end of the 4-year Federal Government priority goal period compared to the overall planned level of performance;”</content>
                    </subparagraph>
                </paragraph></quotedContent>.</content>
            </paragraph>
        </section>
        <section identifier="/us/sComp/118/190/s4" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="4">SEC. 4. </num><heading style="-uslm-dtd:header">FEDERAL GOVERNMENT PRIORITY GOALS. </heading>
            <content class="block" style="-uslm-dtd:text">Section 1120(a)(2) of title 31, United States Code, is amended by striking the second sentence and inserting<quotedContent class="inline" style="-uslm-dtd:quoted-block"><chapeau style="-uslm-dtd:text">“Such goals shall—</chapeau>
            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">be updated and revised not less frequently than during the first year of each Presidential term;</content>
            </subparagraph>
            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="B">“(B) </num><content style="-uslm-dtd:text">be made publicly available not less frequently than concurrently with the submission of the budget of the United States Government under section 1105(a) made during the first full fiscal year following any year during which a term of the President commences under section 101 of title 3;</content>
            </subparagraph>
            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="C">“(C) </num><content style="-uslm-dtd:text">include plans for the successful achievement of each goal within each single Presidential term; and</content>
            </subparagraph>
            <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="D">“(D) </num><content style="-uslm-dtd:text">explicitly cite to any specific contents of the budget described in subparagraph (B) that support the achievement of each goal.”</content>
            </subparagraph></quotedContent>.</content>
        </section>
        <section identifier="/us/sComp/118/190/s5" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="5">SEC. 5. </num><heading style="-uslm-dtd:header">FEDERAL GOVERNMENT PRIORITY GOAL CO-LEADERS. </heading>
            <content class="block" style="-uslm-dtd:text">Section 1115(a) of title 31, United States Code, is amended by striking paragraph (3) and inserting the following:<quotedContent style="-uslm-dtd:quoted-block">
            <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                <num style="-uslm-dtd:enum" value="3">“(3) </num><chapeau style="-uslm-dtd:text">for each Federal Government performance goal, identify, as appropriate, not fewer than 2 lead Government officials who shall jointly be responsible for coordinating the efforts to achieve the goal, of whom—</chapeau>
                <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="A">“(A) </num><content style="-uslm-dtd:text">not less than 1 shall be from the Executive Office of the President; and</content>

            <num style="-uslm-dtd:enum" value="6">SEC. 6. </num><heading style="-uslm-dtd:header">REPEAL OF OUTDATED PILOT PROJECTS. </heading>
            <subsection identifier="/us/sComp/118/190/s6/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">In General.—</heading><content style="-uslm-dtd:text">Chapter 11 of title 31, United States Code, is amended by striking sections 1118 and 1119.</content>
            </subsection>
            <subsection identifier="/us/sComp/118/190/s6/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Conforming Amendment.—</heading><chapeau style="-uslm-dtd:text">Section 9704 of title 31, United States Code, is amended—</chapeau>
                <paragraph identifier="/us/sComp/118/190/s6/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">by striking subsection (c); and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/190/s6/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">by redesignating subsection (d) as subsection (c).</content>
                </paragraph>

            <subsection identifier="/us/sComp/118/190/s6/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Clerical Amendment.—</heading><content style="-uslm-dtd:text">The table of sections for chapter 11 of title 31, United States Code, is amended by striking the items relating to sections 1118 and 1119.</content>
            </subsection>

            <num style="-uslm-dtd:enum" value="7">SEC. 7. </num><heading style="-uslm-dtd:header">CLARIFYING AMENDMENTS. </heading>
            <subsection identifier="/us/sComp/118/190/s7/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Clarification of Requirement To Cite to Evidence-Building Activities in Strategic Plans.—</heading><chapeau style="-uslm-dtd:text">Section 306(a) of title 5, United States Code, is amended—</chapeau>
                <paragraph identifier="/us/sComp/118/190/s7/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in paragraph (8) by inserting “<quotedText style="-uslm-dtd:quote">, as applicable</quotedText>” after “<quotedText style="-uslm-dtd:quote">section 312</quotedText>”; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/190/s7/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in paragraph (9), in the matter preceding subparagraph (A), by inserting “<quotedText style="-uslm-dtd:quote">with respect to the head of an agency required to develop a plan described in subsection (a) or (b) of section 312,</quotedText>” before “<quotedText style="-uslm-dtd:quote">an assessment</quotedText>”.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/118/190/s7/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Clarification of Timing of Agency Performance Report.—</heading><content style="-uslm-dtd:text">Section 1116(b)(1) of title 31, United States Code, is amended by striking “<quotedText style="-uslm-dtd:quote">shall occur no less than 150 days after</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">shall occur not later than 150 days after</quotedText>”.</content>
            </subsection>
        </section>
        <section identifier="/us/sComp/118/190/s8" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="8">SEC. 8. </num><heading style="-uslm-dtd:header">GAO REPORT. </heading>
            <content class="block" style="-uslm-dtd:text">Not later than 18 months after the date of enactment of this Act, the Comptroller General of the United States shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Accountability 
 of the House of Representatives a report on the effectiveness of this Act and the amendments made by this Act.</content>
