    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To require Facility Security Committees to respond to security recommendations issued by the Federal Protective Service relating to facility security, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section identifier="/us/sComp/118/157/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t40/s1315">40 U.S.C. 1315 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Improving Federal Building Security Act of 2024</shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/118/157/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">RESPONDING TO SECURITY RECOMMENDATIONS. </heading>
            <subsection identifier="/us/sComp/118/157/s2/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">In this section:</chapeau>
                <paragraph identifier="/us/sComp/118/157/s2/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Agency.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">agency</quotedText>” has the meaning given the term in section 551 of title 5, United States Code.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/157/s2/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Facility security committee.—</heading><chapeau style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">Facility Security Committee</quotedText>” means a committee that—</chapeau>
                    <subparagraph identifier="/us/sComp/118/157/s2/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">consists of representatives of—</chapeau>
                        <clause identifier="/us/sComp/118/157/s2/a/2/A/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">all Federal tenants in a specific non-military facility;</content>
                        </clause>
                        <clause identifier="/us/sComp/118/157/s2/a/2/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the security organization for the facility; and</content>
                        </clause>
                        <clause identifier="/us/sComp/118/157/s2/a/2/A/iii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">the owning or leasing Federal tenant; and</content>
                        </clause>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/157/s2/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">is responsible for addressing facility-specific security issues and approving the implementation of security measures and practices in the facility.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/118/157/s2/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Secretary.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">Secretary</quotedText>” means the Secretary of Homeland Security.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/118/157/s2/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Response.—</heading>
                <paragraph identifier="/us/sComp/118/157/s2/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">Not later than 90 days after the date on which the Federal Protective Service issues a security recommendation to a Facility Security Committee to improve facility security, the head of the Facility Security Committee, or a designee thereof, shall—</chapeau>
                    <subparagraph identifier="/us/sComp/118/157/s2/b/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">respond to the Secretary—</chapeau>
                        <clause identifier="/us/sComp/118/157/s2/b/1/A/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">indicating if the Facility Security Committee intends to adopt or reject the recommendation; and</content>
                        </clause>
                        <clause identifier="/us/sComp/118/157/s2/b/1/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">describing the financial implications of adopting or rejecting the recommendation, including if the benefits outweigh the costs; and</content>
                        </clause>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/157/s2/b/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">if the Facility Security Committee intends to reject the recommendation, provide the Secretary a justification for accepting the risk posed by rejecting the recommendation.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/118/157/s2/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Method.—</heading><chapeau style="-uslm-dtd:text">The Secretary shall—</chapeau>
                    <subparagraph identifier="/us/sComp/118/157/s2/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">develop a method to monitor the recommendations and responses described in paragraph (1); and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/157/s2/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">take reasonable action to ensure Facility Security Committee responsiveness under paragraph (1).</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/118/157/s2/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Annual Report.—</heading>
                <paragraph identifier="/us/sComp/118/157/s2/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><chapeau style="-uslm-dtd:text">Not later than 270 days after the date of enactment of this Act, and annually thereafter, the Secretary shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security and the Committee on Transportation and Infrastructure of the House of Representatives a report that, for the fiscal year preceding the report, includes—</chapeau>
                    <subparagraph identifier="/us/sComp/118/157/s2/c/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">a summary of the security recommendations issued by the Federal Protective Service to Facility Security Committees to improve facility security;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/157/s2/c/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the percentage of recommendations described in subparagraph (A) that were accepted and the percentage of such recommendations that were rejected;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/157/s2/c/1/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">the percentage of Facility Security Committees that failed to respond to a recommendation described in subparagraph (A) in a timely manner;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/157/s2/c/1/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">a summary of justifications provided by Facility Security Committees if a Facility Security Committee rejected a recommendation described in subparagraph (A);</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/157/s2/c/1/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">a summary of the financial implications of Facility Security Committee responses to recommendations described in subparagraph (A), including if the benefits outweigh the costs;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/157/s2/c/1/F" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">an analysis of steps taken by Facility Security Committees to mitigate the risk posed by rejecting a recommendation described in subparagraph (A); and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/157/s2/c/1/G" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">an analysis of any trends found among the findings in the report.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/118/157/s2/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Form.—</heading><content style="-uslm-dtd:text">Each report required under paragraph (1) shall be submitted in unclassified form, but may include a classified annex.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/157/s2/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Briefing.—</heading><content style="-uslm-dtd:text">The Secretary shall brief the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security and the Committee on Transportation and Infrastructure of the House of Representatives on an annual basis on the findings of the most recently submitted report under paragraph (1).</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/118/157/s2/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Report on Surveillance Technology.—</heading><chapeau style="-uslm-dtd:text">Not later than 180 days after the date of enactment of this Act, the Secretary shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security and the Committee on Transportation and Infrastructure of the House of Representatives an unredacted report on—</chapeau>
                <paragraph identifier="/us/sComp/118/157/s2/d/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">all surveillance technology recommended by the Federal Protective Service; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/157/s2/d/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">any intended use of the technology described in paragraph (1).</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/118/157/s2/e" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">No Additional Funds.—</heading><content style="-uslm-dtd:text">No additional funds are authorized to be appropriated for the purpose of carrying out this Act.</content>
            </subsection>
            <subsection identifier="/us/sComp/118/157/s2/f" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Sunset and Report.—</heading>
                <paragraph identifier="/us/sComp/118/157/s2/f/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Sunset.—</heading><content style="-uslm-dtd:text">This Act shall cease to be effective on the date that is 5 years after the date of enactment of this Act.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/157/s2/f/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">GAO report.—</heading><content style="-uslm-dtd:text">Not later than 5 years after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on the effectiveness of this Act.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/118/157/s2/g" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="g">(g) </num><heading style="-uslm-dtd:header">Application.—</heading><chapeau style="-uslm-dtd:text">This Act shall only apply to—</chapeau>
                <paragraph identifier="/us/sComp/118/157/s2/g/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">General Services Administration facilities under protection of the Federal Protective Service; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/157/s2/g/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">non-General Services Administration facilities that pay fees to the Federal Protective Service for protection.</content>
                </paragraph>
            </subsection>
