    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To require transparency in notices of funding opportunity, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section identifier="/us/sComp/118/140/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t31/s6101">31 U.S.C. 6101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Grant Transparency Act of 2023</shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/118/140/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">NOTICES OF FUNDING OPPORTUNITY TRANSPARENCY. </heading>
            <subsection identifier="/us/sComp/118/140/s2/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">In this section:</chapeau>
                <paragraph identifier="/us/sComp/118/140/s2/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Agency.—</heading><chapeau style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">agency</quotedText>”—</chapeau>
                    <subparagraph identifier="/us/sComp/118/140/s2/a/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">has the meaning given the term “<quotedText style="-uslm-dtd:quote">Executive agency</quotedText>” in section 105 of title 5, United States Code; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/140/s2/a/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">does not include the Government Accountability Office.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/118/140/s2/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Competitive grant.—</heading><chapeau style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">competitive grant</quotedText>” means a discretionary award (as defined in section 200.1 of title 2, Code of Federal Regulations) awarded by an agency—</chapeau>
                    <subparagraph identifier="/us/sComp/118/140/s2/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">through a grant agreement or cooperative agreement under which the agency makes payment in cash or in kind to a recipient to carry out a public purpose authorized by law; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/140/s2/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the recipient of which is selected from a pool of applicants through the use of merit-based selection procedures for the purpose of allocating funds authorized under a grant program of the agency.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/118/140/s2/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Evaluation or selection criteria.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">evaluation or selection criteria</quotedText>” means standards or principles for judging, evaluating, or selecting an application for a competitive grant.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/140/s2/a/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Notice of funding opportunity.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">notice of funding opportunity</quotedText>” has the meaning given the term in section 200.1 of title 2, Code of Federal Regulations.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/140/s2/a/5" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="5">(5) </num><heading style="-uslm-dtd:header">Rating system.—</heading><chapeau style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">rating system</quotedText>”—</chapeau>
                    <subparagraph identifier="/us/sComp/118/140/s2/a/5/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">means a system of evaluation of competitive grant applications to determine how such applications advance through the selection process; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/140/s2/a/5/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><chapeau style="-uslm-dtd:text">includes—</chapeau>
                        <clause identifier="/us/sComp/118/140/s2/a/5/B/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">a merit criteria rating rubric;</content>
                        </clause>
                        <clause identifier="/us/sComp/118/140/s2/a/5/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">an evaluation of merit criteria;</content>
                        </clause>
                        <clause identifier="/us/sComp/118/140/s2/a/5/B/iii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">a methodology to evaluate and rate based on a point scale; and</content>
                        </clause>
                        <clause identifier="/us/sComp/118/140/s2/a/5/B/iv" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">an evaluation to determine whether a competitive grant application meets evaluation or selection criteria.</content>
                        </clause>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/118/140/s2/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Transparency Requirements.—</heading><chapeau style="-uslm-dtd:text">Each notice of funding opportunity issued by an agency for a competitive grant shall include—</chapeau>
                <paragraph identifier="/us/sComp/118/140/s2/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">a description of any rating system and evaluation and selection criteria the agency uses to assess applications for the competitive grant;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/140/s2/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">a statement of whether the agency uses a weighted scoring method and a description of any weighted scoring method the agency uses for the competitive grant, including the amount by which the agency weights each criterion; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/140/s2/b/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">any other qualitative or quantitative merit-based approach the agency uses to evaluate an application for the competitive grant.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/118/140/s2/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Applications; Data Elements.—</heading>
                <paragraph identifier="/us/sComp/118/140/s2/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">The Director of the Office of Management and Budget, in coordination with the Executive department designated under section 6402(a)(1) of title 31, United States Code, shall develop data elements relating to grant applications to ensure common reporting by each agency with respect to applications received in response to each notice of funding opportunity of the agency.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/140/s2/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Contents.—</heading><chapeau style="-uslm-dtd:text">The data elements developed under paragraph (1) shall include—</chapeau>
                    <subparagraph identifier="/us/sComp/118/140/s2/c/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">the number of applications received; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/140/s2/c/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">the city and State of each organization that submitted an application.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/118/140/s2/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Rule of Construction.—</heading><content style="-uslm-dtd:text">With respect to a particular competitive grant, nothing in this Act shall be construed to supersede any requirement with respect to a notice of funding opportunity for the competitive grant in a law that authorizes the competitive grant.</content>
            </subsection>
            <subsection identifier="/us/sComp/118/140/s2/e" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">No Additional Funds.—</heading><content style="-uslm-dtd:text">No additional funds are authorized to be appropriated for the purpose of carrying out this Act.</content>
            </subsection>
            <subsection identifier="/us/sComp/118/140/s2/f" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="f">(f) </num><heading style="-uslm-dtd:header">Effective Date.—</heading>
                <paragraph identifier="/us/sComp/118/140/s2/f/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">This Act shall take effect on the date that is 120 days after the date of enactment of this Act.</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/140/s2/f/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">No retroactive effect.—</heading><content style="-uslm-dtd:text">This Act shall not apply to a notice of funding opportunity issued before the date of enactment of this Act.</content>
                </paragraph>
            </subsection>
        </section>
