    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To reauthorize the Missing Children’s Assistance Act, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section identifier="/us/sComp/118/65/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t34/s10101">34 U.S.C. 10101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">  This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Missing Children’s Assistance Reauthorization Act of 2023</shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/118/65/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">MISSING CHILDREN’S ASSISTANCE ACT AMENDMENTS. </heading>
            <subsection identifier="/us/sComp/118/65/s2/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">Section 403 of the Missing Children’s Assistance Act (34 U.S.C. 11292) is amended—</chapeau>
                <paragraph identifier="/us/sComp/118/65/s2/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in paragraph (3), by striking “<quotedText style="-uslm-dtd:quote">and</quotedText>” at the end;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/65/s2/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">in paragraph (4), by striking the period at the end and inserting “<quotedText style="-uslm-dtd:quote">; and</quotedText>”, and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/65/s2/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">by adding at the end the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="5">“(5) </num><content style="-uslm-dtd:text">the term ‘<quotedText style="-uslm-dtd:quote">child sexual abuse material</quotedText>’ has the meaning given the term ‘<quotedText style="-uslm-dtd:quote">child pornography</quotedText>’ in section 2256 of title 18, United States Code;”</content>
                    </paragraph></quotedContent>.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/118/65/s2/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Duties and Functions of the Administrator.—</heading><chapeau style="-uslm-dtd:text">Section 404 of the Missing Children’s Assistance Act (34 U.S.C. 11293) is amended—</chapeau>
                <paragraph identifier="/us/sComp/118/65/s2/b/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in subsection (a)(6)(E), by striking “<quotedText style="-uslm-dtd:quote">the tipline established</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">the CyberTipline established</quotedText>”; and</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/65/s2/b/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">in subsection (b)(1)—</chapeau>
                    <subparagraph identifier="/us/sComp/118/65/s2/b/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><chapeau style="-uslm-dtd:text">in subparagraph (A)—</chapeau>
                        <clause identifier="/us/sComp/118/65/s2/b/2/A/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><chapeau style="-uslm-dtd:text">in clause (i)—</chapeau>
                            <subclause identifier="/us/sComp/118/65/s2/b/2/A/i/I" style="-uslm-dtd:subclause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">hotline by which</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">call center to which</quotedText>”; and</content>
                            </subclause>
                            <subclause identifier="/us/sComp/118/65/s2/b/2/A/i/II" style="-uslm-dtd:subclause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">individuals may report</quotedText>” and all that follows and inserting<quotedContent class="inline" style="-uslm-dtd:quoted-block"><chapeau style="-uslm-dtd:text">“individuals may—</chapeau>
                                <subclause style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">“(I) </num><content style="-uslm-dtd:text">report child sexual exploitation and the location of any missing child; and</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">“(II) </num><content style="-uslm-dtd:text">request information pertaining to procedures necessary to reunite such child with such child’s parent;”</content>
                                </subclause></quotedContent>;</content>
                            </subclause>
                        </clause>
                        <clause identifier="/us/sComp/118/65/s2/b/2/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">by redesignating clause (ii) as clause (iii); and</content>
                        </clause>
                        <clause identifier="/us/sComp/118/65/s2/b/2/A/iii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">by inserting after clause (i) the following:<quotedContent style="-uslm-dtd:quoted-block">
                            <subsection style="-uslm-dtd:subsection" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">“(ii) </num><content style="-uslm-dtd:text">manage the AMBER Alert Secondary Distribution Program; and”</content>
                            </subsection></quotedContent>;</content>
                        </clause>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/65/s2/b/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">in subparagraph (D), by striking “<quotedText style="-uslm-dtd:quote">with their families</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">with their parents</quotedText>”;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/65/s2/b/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">in subparagraph (F), by striking “<quotedText style="-uslm-dtd:quote">to families</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">to parents</quotedText>”;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/65/s2/b/2/D" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="D">(D) </num><content style="-uslm-dtd:text">by striking subparagraph (G) and inserting the following:<quotedContent style="-uslm-dtd:quoted-block">
                        <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="G">“(G) </num><chapeau style="-uslm-dtd:text">provide technical assistance and case-related resources, including—</chapeau>
                            <clause style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">“(i) </num><chapeau style="-uslm-dtd:text">referrals to—</chapeau>
                                <subclause style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">“(I) </num><content style="-uslm-dtd:text">child-serving professionals involved in helping to recover missing and exploited children; and</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">“(II) </num><content style="-uslm-dtd:text">law enforcement officers in their efforts to identify, locate, and recover missing and exploited children; and</content>
                                </subclause>
                            </clause>
                            <clause style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">“(ii) </num><chapeau style="-uslm-dtd:text">searching public records databases and publicly accessible open source data to—</chapeau>
                                <subclause style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">“(I) </num><content style="-uslm-dtd:text">locate and identify potential abductors and offenders involved in attempted or actual abductions; and</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">“(II) </num><content style="-uslm-dtd:text">identify, locate, and recover abducted children;”</content>
                                </subclause>
                            </clause>
                        </subparagraph></quotedContent>;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/65/s2/b/2/E" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="E">(E) </num><content style="-uslm-dtd:text">in subparagraph (H), by inserting “<quotedText style="-uslm-dtd:quote">on long-term missing child cases</quotedText>” after  “<quotedText style="-uslm-dtd:quote">techniques to assist</quotedText>”;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/65/s2/b/2/F" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="F">(F) </num><content style="-uslm-dtd:text">by striking subparagraph (I) and inserting the following:<quotedContent style="-uslm-dtd:quoted-block">
                        <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="I">“(I) </num><chapeau style="-uslm-dtd:text">provide education, technical assistance, and information to—</chapeau>
                            <clause style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">“(i) </num><content style="-uslm-dtd:text">nongovernmental organizations with respect to procedures and resources to conduct background checks on individuals working with children; and</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">“(ii) </num><content style="-uslm-dtd:text">law enforcement agencies with respect to identifying and locating noncompliant sex offenders;”</content>
                            </clause>
                        </subparagraph></quotedContent>;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/65/s2/b/2/G" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="G">(G) </num><content style="-uslm-dtd:text">in subparagraph (J), by striking “<quotedText style="-uslm-dtd:quote">with their families</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">with their parents</quotedText>”;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/65/s2/b/2/H" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="H">(H) </num><chapeau style="-uslm-dtd:text">in subparagraph (K)—</chapeau>
                        <clause identifier="/us/sComp/118/65/s2/b/2/H/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><chapeau style="-uslm-dtd:text">in clause (i)—</chapeau>
                            <subclause identifier="/us/sComp/118/65/s2/b/2/H/i/I" style="-uslm-dtd:subclause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">in the matter preceding subclause (I), by striking “<quotedText style="-uslm-dtd:quote">tipline</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">CyberTipline</quotedText>”;</content>
                            </subclause>

                                </item>

                                    <num style="-uslm-dtd:enum" value="bb">(bb) </num><content style="-uslm-dtd:text">in item (dd) by striking “<quotedText style="-uslm-dtd:quote">sex tourism involving children</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">extraterritorial child sexual abuse and exploitation</quotedText>”; and</content>
                                </item>
                                <item identifier="/us/sComp/118/65/s2/b/2/H/i/II/cc" style="-uslm-dtd:item" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="cc">(cc) </num><content style="-uslm-dtd:text">in item (ee), by striking “<quotedText style="-uslm-dtd:quote">extra-familial</quotedText>”; and</content>
                                </item>
                            </subclause>

                            </subclause>
                            <subclause identifier="/us/sComp/118/65/s2/b/2/H/ii/III" style="-uslm-dtd:subclause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="III">(III) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">; and</quotedText>” at the end and inserting “<quotedText style="-uslm-dtd:quote">, including by providing information on legal remedies available to such victims;</quotedText>”; and</content>
                            </subclause>
                        </clause>
                        <clause identifier="/us/sComp/118/65/s2/b/2/H/iii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">by striking clause (iii);</content>

                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/65/s2/b/2/I" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">by redesignating subparagraphs (L) through (O) as subparagraphs (M) through (P), respectively;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/65/s2/b/2/J" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="J">(J) </num><content style="-uslm-dtd:text">by inserting after subparagraph (K) the following:<quotedContent style="-uslm-dtd:quoted-block">
                        <subparagraph style="-uslm-dtd:subparagraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="L">“(L) </num><chapeau style="-uslm-dtd:text">provide support services, consultation, and assistance to missing and sexually exploited children, parents, their families, and child-serving professionals on—</chapeau>
                            <clause style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="i">“(i) </num><content style="-uslm-dtd:text">recovery support, including counseling recommendations and community support;</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="ii">“(ii) </num><content style="-uslm-dtd:text">family and peer support;</content>
                            </clause>
                            <clause style="-uslm-dtd:clause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="iii">“(iii) </num><chapeau style="-uslm-dtd:text">requesting the removal of child sexual abuse material and sexually exploitive content depicting children from the internet, including by assisting with requests to providers (as defined in section 2258E of title 18, United States Code) to remove visual depictions of victims that—</chapeau>
                                <subclause style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="I">“(I) </num><content style="-uslm-dtd:text">constitute or are associated with child sexual abuse material; or</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="II">“(II) </num><content style="-uslm-dtd:text">do not constitute child sexual abuse material but are sexually suggestive;”</content>
                                </subclause>
                            </clause>
                        </subparagraph></quotedContent>;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/65/s2/b/2/K" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="K">(K) </num><chapeau style="-uslm-dtd:text">in subparagraph (M), as so redesignated—</chapeau>
                        <clause identifier="/us/sComp/118/65/s2/b/2/K/i" style="-uslm-dtd:clause" styleType="OLC">

                                </subclause>
                                <subclause style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="IV">“(IV) </num><content style="-uslm-dtd:text">sextortion; and</content>
                                </subclause>
                                <subclause style="-uslm-dtd:subclause" styleType="OLC">
                                    <num style="-uslm-dtd:enum" value="V">“(V) </num><content style="-uslm-dtd:text">online enticement;”</content>
                                </subclause>

                    </subparagraph>

                                <num style="-uslm-dtd:enum" value="ii">“(ii) </num><content style="-uslm-dtd:text">responding to foster children missing from a State or Tribal child welfare system; and”</content>

                        </subparagraph></quotedContent>; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/65/s2/b/2/N" style="-uslm-dtd:subparagraph" styleType="OLC">

            </subsection>
            <subsection identifier="/us/sComp/118/65/s2/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Reporting.—</heading><chapeau style="-uslm-dtd:text">Section 407 of the Missing Children’s Assistance Act (34 U.S.C. 11295a) is amended—</chapeau>
                <paragraph identifier="/us/sComp/118/65/s2/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><chapeau style="-uslm-dtd:text">in subsection (a)—</chapeau>
                    <subparagraph identifier="/us/sComp/118/65/s2/c/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">in paragraph (3) by striking “<quotedText style="-uslm-dtd:quote">and</quotedText>” at the end;</content>
                    </subparagraph>

                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="7">“(7) </num><content style="-uslm-dtd:text">the number of children nationwide who are reported to the grantee as missing from State-sponsored care and are likely victims of child sex trafficking.”</content>
                        </paragraph></quotedContent>, and</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/118/65/s2/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">by adding at end the following:<quotedContent style="-uslm-dtd:quoted-block">
                    <subsection style="-uslm-dtd:subsection" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="c">“(c) </num><heading style="-uslm-dtd:header">Criteria for Forensic Partnerships.—</heading><content style="-uslm-dtd:text">As a condition of receiving funds under section 404(b), the grant recipient shall annually provide to the Administrator and make available to the general public, as appropriate, the criteria and processes the grantee uses to establish forensic partnerships and recommend forensic resources to law enforcement and shall annually review these forensic partnerships and forensic referrals against the criteria and review new advancements in technology.”</content>

            <subsection identifier="/us/sComp/118/65/s2/d" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading><content style="-uslm-dtd:text">Section 409(a) of the Missing Children’s Assistance Act (34 U.S.C. 11297(a)) is amended by striking “<quotedText style="-uslm-dtd:quote">$40,000,000 for each of the fiscal years 2014 through 2023, up to $32,200,000</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">$49,300,000 for each of fiscal years 2024 through 2028, up to $41,500,000</quotedText>”.</content>
