AN ACTTo extend authorizations for the May 10, 2024[H.R. 8289]airport improvement program, to extend the funding and expenditure authority of the Airport and Airway Trust Fund, and for other purposes.Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. [26 U.S.C. 1 note] SHORT TITLE.   This Act may be cited as the “Airport and Airway Extension Act of 2024, Part II”.
SEC. 2. TABLE OF CONTENTS.   The table of contents for this Act is as follows: TITLE I— TITLE II—
<num style="-uslm-dtd:enum" value="I">TITLE I—</num><heading style="-uslm-dtd:header">FEDERAL AVIATION PROGRAMS </heading> <section identifier="/us/sComp/118/60/tI/s101" style="-uslm-dtd:section" styleType="OLC"> <num style="-uslm-dtd:enum" value="101">SEC. 101. </num><heading style="-uslm-dtd:header">EXTENSION OF AIRPORT IMPROVEMENT PROGRAM; DISCRETIONARY FUND. </heading> <subsection identifier="/us/sComp/118/60/tI/s101/a" style="-uslm-dtd:subsection" styleType="OLC"> <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Authorization of Appropriations.—</heading><content style="-uslm-dtd:text">Section 48103(a)(7) of title 49, United States Code, shall be applied by substituting “$2,105,191,256 for the period beginning October 1, 2023, and ending on May 17, 2024.” for “$2,041,120,218 for the period beginning October 1, 2023, and ending on May 10, 2024.”.</content> </subsection> <subsection identifier="/us/sComp/118/60/tI/s101/b" style="-uslm-dtd:subsection" styleType="OLC"> <num style="-uslm-dtd:enum" value="b">(b) </num><heading style="-uslm-dtd:header">Obligation Authority.—</heading><content style="-uslm-dtd:text">Subject to limitations specified in advance in appropriations Acts, sums made available pursuant to subsection (a) may be obligated at any time through September 30, 2024, and shall remain available until expended.</content> </subsection> <subsection identifier="/us/sComp/118/60/tI/s101/c" style="-uslm-dtd:subsection" styleType="OLC"> <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Project Grant Authority.—</heading><content style="-uslm-dtd:text">Section 47104(c) of title 49, United States Code, shall be applied by substituting “May 17, 2024” for “May 10, 2024”.</content> </subsection> <subsection identifier="/us/sComp/118/60/tI/s101/d" style="-uslm-dtd:subsection" styleType="OLC"> <num style="-uslm-dtd:enum" value="d">(d) </num><heading style="-uslm-dtd:header">Special Rule for Apportionments.—</heading><content style="-uslm-dtd:text">Section 47114(c)(1)(J) of title 49, United States Code, shall be applied by substituting “May 17, 2024” for “May 10, 2024”.</content> </subsection> <subsection identifier="/us/sComp/118/60/tI/s101/e" style="-uslm-dtd:subsection" styleType="OLC"> <num style="-uslm-dtd:enum" value="e">(e) </num><heading style="-uslm-dtd:header">Supplemental Discretionary Funds.—</heading><content style="-uslm-dtd:text">Section 47115(j)(4)(A) of title 49, United States Code, shall be applied by substituting “$334,563,279 for the period beginning on October 1, 2023, and ending on May 17, 2024.” for “$340,321,762 for the period beginning on October 1, 2023, and ending on May 10, 2024.”.</content> </subsection> </section> <section identifier="/us/sComp/118/60/tI/s102" style="-uslm-dtd:section" styleType="OLC"> <num style="-uslm-dtd:enum" value="102">SEC. 102. </num><heading style="-uslm-dtd:header">EXTENSION OF EXPIRING AUTHORITIES; MISCELLANEOUS AUTHORIZATIONS. </heading> <subsection identifier="/us/sComp/118/60/tI/s102/a" style="-uslm-dtd:subsection" styleType="OLC"> <num style="-uslm-dtd:enum" value="a">(a) </num><chapeau style="-uslm-dtd:text">The following provisions of law shall be applied by substituting “May 17, 2024” for “May 10, 2024”:</chapeau> <paragraph identifier="/us/sComp/118/60/tI/s102/a/1" style="-uslm-dtd:paragraph" styleType="OLC"> <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Section 44803(h) of title 49, United States Code.</content> </paragraph> <paragraph identifier="/us/sComp/118/60/tI/s102/a/3" style="-uslm-dtd:paragraph" styleType="OLC"> <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">Section 44807(d) of title 49, United States Code.</content> </paragraph> identifier="/us/sComp/118/60/tI/s102/b/2" style="-uslm-dtd:paragraph" styleType="OLC"> <num style="-uslm-dtd:enum" value="2">(2) </num><content style="-uslm-dtd:text">Section 47143(c) of title 49, United States Code.</content> </paragraph> <paragraph identifier="/us/sComp/118/60/tI/s102/b/3" style="-uslm-dtd:paragraph" styleType="OLC"> <num style="-uslm-dtd:enum" value="3">(3) </num><content identifier="/us/sComp/118/60/tI/s102/b/5" style="-uslm-dtd:paragraph" styleType="OLC"> <num style="-uslm-dtd:enum" value="5">(5) </num><content style="-uslm-dtd:text">Section 2306(b) of the FAA Extension, Safety, and Security Act of 2016 (Public Law 114-190; 130 Stat. 641).</content> </paragraph> </subsection> <subsection identifier="/us/sComp/118/60/tI/s102/c" style="-uslm-dtd:subsection" styleType="OLC"> <num style="-uslm-dtd:enum" value="c">(c) </num><content style="-uslm-dtd:text">Section 48105 of title 49, United States Code, shall be applied by substituting “$24,508,197 for the period beginning on October 1, 2023, and ending on May 17, 2024.” for “$23,762,295 for the period beginning on October 1, 2023, and ending on May 10, 2024.”.</content> </subsection> </section> <num style="-uslm-dtd:enum" value="II">TITLE II—</num><heading style="-uslm-dtd:header">AIRPORT REVENUE PROVISIONS </heading> <section identifier="/us/sComp/118/60/tII/s201" style="-uslm-dtd:section" styleType="OLC"> <num style="-uslm-dtd:enum" value="201">SEC. 201. </num><heading style="-uslm-dtd:header">EXPENDITURE AUTHORITY FROM AIRPORT AND AIRWAY TRUST FUND. </heading> <subsection identifier="/us/sComp/118/60/tII/s201/a" style="-uslm-dtd:subsection" styleType="OLC"> <num style="-uslm-dtd:enum" value="a">(a) </num><content style="-uslm-dtd:text">Sections 9502(d)(1) and 9502(e)(2) of the Internal Revenue Code of 1986 shall be applied by substituting “May 18, 2024” for “May 11, 2024”.</content> </subsection> <subsection identifier="/us/sComp/118/60/tII/s201/b" style="-uslm-dtd:subsection" styleType="OLC"> <num style="-uslm-dtd:enum" value="b">(b) </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t26/s9502">26 U.S.C. 9502</ref><b>]</b> </editorialNote><content style="-uslm-dtd:text">Section 9502(d)(1)(A) of the Internal Revenue Code of 1986 is amended by striking the semicolon at the end and inserting “<quotedText style="-uslm-dtd:quote">or the Airport and Airway Extension Act of 2024, Part II;</quotedText>”.</content> </subsection> </section> <section identifier="/us/sComp/118/60/tII/s202" style="-uslm-dtd:section" styleType="OLC"> <num style="-uslm-dtd:enum" value="202">SEC. 202. </num><heading style="-uslm-dtd:header">EXTENSION OF TAXES FUNDING AIRPORT AND AIRWAY TRUST FUND. </heading> <subsection identifier="/us/sComp/118/60/tII/s202/a" style="-uslm-dtd:subsection" styleType="OLC"> <num style="-uslm-dtd:enum" value="a">(a) </num><content style="-uslm-dtd:text">Sections 4043(d), 4081(d)(2)(B), 4261(j), 4261(k)(1)(A)(ii), and 4271(d)(1)(A)(ii) of the Internal Revenue Code of 1986 shall be applied by substituting “May 17, 2024” for “May 10, 2024”.</content> </subsection> <subsection identifier="/us/sComp/118/60/tII/s202/b" style="-uslm-dtd:subsection" styleType="OLC"> <num style="-uslm-dtd:enum" value="b">(b) </num><content style="-uslm-dtd:text">Section 4083(b) of such Code shall be applied by substituting “May 18, 2024” for “May 11, 2024”.</content> </subsection> </section>
