    <main style="-uslm-dtd:legis-body"><longTitle><docTitle style="-uslm-dtd:legis-type">AN ACT</docTitle><officialTitle style="-uslm-dtd:official-title">To extend the authority to provide employees of the United States Secret Service with overtime pay beyond other statutory limitations, and for other purposes.</officialTitle></longTitle><enactingFormula style="-uslm-dtd:enacting-clause">Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,</enactingFormula>
        <section identifier="/us/sComp/118/38/s1" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="1">SECTION 1. </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t5/s101">5 U.S.C. 101 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">SHORT TITLE. </heading>
            <content class="block" style="-uslm-dtd:text">This Act may be cited as the “<shortTitle style="-uslm-dtd:quote">Overtime Pay for Protective Services Act of 2023</shortTitle>”.</content>
        </section>
        <section identifier="/us/sComp/118/38/s2" style="-uslm-dtd:section" styleType="OLC">
            <num style="-uslm-dtd:enum" value="2">SEC. 2. </num><heading style="-uslm-dtd:header">EXTENSION OF OVERTIME PAY EXCEPTION THROUGH 2028 FOR PROTECTIVE SERVICES. </heading>
            <subsection identifier="/us/sComp/118/38/s2/a" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="a">(a) </num><heading style="-uslm-dtd:header">Amendments.—</heading><chapeau style="-uslm-dtd:text">Section 2 of the Overtime Pay for Protective Services Act of 2016 (5 U.S.C. 5547 note) is amended—</chapeau>
                <paragraph identifier="/us/sComp/118/38/s2/a/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><content style="-uslm-dtd:text">in the section heading, by striking “<quotedText style="-uslm-dtd:quote">2023</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">2028</quotedText>”;</content>
                </paragraph>
                <paragraph identifier="/us/sComp/118/38/s2/a/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><chapeau style="-uslm-dtd:text">in subsection (a)—</chapeau>
                    <subparagraph identifier="/us/sComp/118/38/s2/a/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">in the subsection heading, by striking “<quotedText style="-uslm-dtd:quote">Definition</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">Definitions</quotedText>”;</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/38/s2/a/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">In this section, the term</quotedText>” and inserting the following:<quotedContent class="inline" style="-uslm-dtd:quoted-block"><chapeau style="-uslm-dtd:text">“In this section—</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="1">“(1) </num><content style="-uslm-dtd:text">the term”</content>
                        </paragraph></quotedContent>; and</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/38/s2/a/2/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><content style="-uslm-dtd:text">by striking “<quotedText style="-uslm-dtd:quote">2023.</quotedText>” and inserting the following:<quotedContent class="inline" style="-uslm-dtd:quoted-block"><chapeau style="-uslm-dtd:text">“2028; and</chapeau>
                        <paragraph style="-uslm-dtd:paragraph" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="2">“(2) </num><content style="-uslm-dtd:text">the term ‘<quotedText style="-uslm-dtd:quote">protective services</quotedText>’ does not include routine administrative or technical work that supports the daily operations of the United States Secret Service.”</content>
                        </paragraph></quotedContent>; and</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/118/38/s2/a/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><content style="-uslm-dtd:text">in subsection (b)(1), by striking “<quotedText style="-uslm-dtd:quote">during each of calendar years 2016 through 2023</quotedText>” and inserting “<quotedText style="-uslm-dtd:quote">for protective services during each of calendar years 2016 through 2028</quotedText>”.</content>
                </paragraph>
            </subsection>
            <subsection identifier="/us/sComp/118/38/s2/b" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="b">(b) </num><editorialNote role="uscRef" style="-uslm-dtd:usc-reference"><b>[</b><ref href="/us/usc/t5/s5547">5 U.S.C. 5547 note</ref><b>]</b> </editorialNote><heading style="-uslm-dtd:header">Retroactive Effective Date.—</heading><content style="-uslm-dtd:text">If this Act is enacted after December 31, 2023, the amendments made by subsection (a) shall take effect as if enacted on December 31, 2023.</content>
            </subsection>
            <subsection identifier="/us/sComp/118/38/s2/c" style="-uslm-dtd:subsection" styleType="OLC">
                <num style="-uslm-dtd:enum" value="c">(c) </num><heading style="-uslm-dtd:header">Reports.—</heading>
                <paragraph identifier="/us/sComp/118/38/s2/c/1" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="1">(1) </num><heading style="-uslm-dtd:header">Definitions.—</heading><chapeau style="-uslm-dtd:text">In this subsection:</chapeau>
                    <subparagraph identifier="/us/sComp/118/38/s2/c/1/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">Appropriate committees of congress.—</heading><chapeau style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">appropriate committees of Congress</quotedText>” means—</chapeau>
                        <clause identifier="/us/sComp/118/38/s2/c/1/A/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">the Committee on Appropriations of the Senate;</content>
                        </clause>
                        <clause identifier="/us/sComp/118/38/s2/c/1/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><content style="-uslm-dtd:text">the Committee on Homeland Security and Governmental Affairs of the Senate;</content>
                        </clause>
                        <clause identifier="/us/sComp/118/38/s2/c/1/A/iii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iii">(iii) </num><content style="-uslm-dtd:text">the Committee on the Judiciary of the Senate;</content>
                        </clause>
                        <clause identifier="/us/sComp/118/38/s2/c/1/A/iv" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="iv">(iv) </num><content style="-uslm-dtd:text">the Committee on Appropriations of the House of Representatives;</content>
                        </clause>
                        <clause identifier="/us/sComp/118/38/s2/c/1/A/v" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="v">(v) </num><content style="-uslm-dtd:text">the Committee on Homeland Security of the House of Representatives;</content>
                        </clause>
                        <clause identifier="/us/sComp/118/38/s2/c/1/A/vi" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="vi">(vi) </num><content style="-uslm-dtd:text">the Committee on Oversight and Accountability of the House of Representatives; and</content>
                        </clause>
                        <clause identifier="/us/sComp/118/38/s2/c/1/A/vii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="vii">(vii) </num><content style="-uslm-dtd:text">the Committee on the Judiciary of the House of Representatives.</content>
                        </clause>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/38/s2/c/1/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Director.—</heading><content style="-uslm-dtd:text">The term “<quotedText style="-uslm-dtd:quote">Director</quotedText>” means the Director of the United States Secret Service.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/118/38/s2/c/2" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="2">(2) </num><heading style="-uslm-dtd:header">Report on plans to reduce overtime usage.—</heading>
                    <subparagraph identifier="/us/sComp/118/38/s2/c/2/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading><content style="-uslm-dtd:text">Not later than 180 days after the date of enactment of this Act, the Director shall submit to the appropriate committees of Congress a report describing the steps that the United States Secret Service is taking to address the increased protective service demands placed upon United States Secret Service personnel.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/38/s2/c/2/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Elements.—</heading><chapeau style="-uslm-dtd:text">The report required under subparagraph (A) shall include the following:</chapeau>
                        <clause identifier="/us/sComp/118/38/s2/c/2/B/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><content style="-uslm-dtd:text">An analysis of the current (as of the date on which the report is submitted) operational demands and staffing levels with respect to the United States Secret Service.</content>
                        </clause>
                        <clause identifier="/us/sComp/118/38/s2/c/2/B/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><chapeau style="-uslm-dtd:text">Recommended strategies for reducing overtime requirements for United States Secret Service personnel, including—</chapeau>
                            <subclause identifier="/us/sComp/118/38/s2/c/2/B/ii/I" style="-uslm-dtd:subclause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">the appointment of additional personnel;</content>
                            </subclause>
                            <subclause identifier="/us/sComp/118/38/s2/c/2/B/ii/II" style="-uslm-dtd:subclause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">solutions such that sufficient resources are available throughout each year without the need for exceptions to, or waivers of, premium pay limitations;</content>
                            </subclause>
                            <subclause identifier="/us/sComp/118/38/s2/c/2/B/ii/III" style="-uslm-dtd:subclause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="III">(III) </num><content style="-uslm-dtd:text">the redistribution of workload among United States Secret Service personnel; and</content>
                            </subclause>
                            <subclause identifier="/us/sComp/118/38/s2/c/2/B/ii/IV" style="-uslm-dtd:subclause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="IV">(IV) </num><content style="-uslm-dtd:text">other improvements in operational efficiency with respect to the United States Secret Service.</content>
                            </subclause>
                        </clause>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/118/38/s2/c/3" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="3">(3) </num><heading style="-uslm-dtd:header">Annual projections.—</heading>
                    <subparagraph identifier="/us/sComp/118/38/s2/c/3/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><heading style="-uslm-dtd:header">In general.—</heading>
                        <clause identifier="/us/sComp/118/38/s2/c/3/A/i" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="i">(i) </num><heading style="-uslm-dtd:header">Requirement.—</heading><content style="-uslm-dtd:text">In accordance with the schedule described in clause (ii), the Director shall submit to the appropriate committees of Congress a report that contains projections for the information described in paragraphs (1) through (7) of section 2(c) of the Secret Service Recruitment and Retention Act of 2018 (Public Law 115-160; 132 Stat. 1246), which shall be divided by calendar quarter.</content>
                        </clause>
                        <clause identifier="/us/sComp/118/38/s2/c/3/A/ii" style="-uslm-dtd:clause" styleType="OLC">
                            <num style="-uslm-dtd:enum" value="ii">(ii) </num><heading style="-uslm-dtd:header">Schedule described.—</heading><chapeau style="-uslm-dtd:text">The schedule described in this clause is as follows:</chapeau>
                            <subclause identifier="/us/sComp/118/38/s2/c/3/A/ii/I" style="-uslm-dtd:subclause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="I">(I) </num><content style="-uslm-dtd:text">Not later than 30 days after the date of enactment of this Act, a report with respect to calendar year 2024.</content>
                            </subclause>
                            <subclause identifier="/us/sComp/118/38/s2/c/3/A/ii/II" style="-uslm-dtd:subclause" styleType="OLC">
                                <num style="-uslm-dtd:enum" value="II">(II) </num><content style="-uslm-dtd:text">Not later than December 31 of each of calendar years 2024 through 2027, a report with respect to the calendar year following the calendar year in which the report is submitted.</content>
                            </subclause>
                        </clause>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/38/s2/c/3/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><heading style="-uslm-dtd:header">Quarterly updates.—</heading><content style="-uslm-dtd:text">With respect to each annual report required under subparagraph (A), the Director shall, on the last day of each calendar quarter of the calendar year that is covered by the report, submit to the appropriate committees of Congress an updated version of that report 
that contains projections for the information described in that subparagraph for the remainder of that calendar year, which shall be divided by calendar quarter.</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/38/s2/c/3/C" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="C">(C) </num><heading style="-uslm-dtd:header">Deeming of period.—</heading><content style="-uslm-dtd:text">Solely for the purposes of a report required under this paragraph, a reference in any of paragraphs (1) through (7) of section 2(c) of the Secret Service Recruitment and Retention Act of 2018 (Public Law 115-160; 132 Stat. 1246) to a numerical value for a previous calendar year shall be deemed to be a projection of that numerical value for an upcoming calendar year or for the remainder of a calendar year, as applicable.</content>
                    </subparagraph>
                </paragraph>
                <paragraph identifier="/us/sComp/118/38/s2/c/4" style="-uslm-dtd:paragraph" styleType="OLC">
                    <num style="-uslm-dtd:enum" value="4">(4) </num><heading style="-uslm-dtd:header">Effect of amendments.—</heading><chapeau style="-uslm-dtd:text">Not later than January 30 of each of calendar years 2025 through 2029, the Director shall submit to the appropriate committees of Congress a report on the effects of the amendments made by subsection (a), which shall include, with respect to the calendar year preceding the calendar year in which the report is submitted, the following:</chapeau>
                    <subparagraph identifier="/us/sComp/118/38/s2/c/4/A" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="A">(A) </num><content style="-uslm-dtd:text">The information described in paragraphs (1) through (7) of section 2(c) of the Secret Service Recruitment and Retention Act of 2018 (Public Law 115-160; 132 Stat. 1246).</content>
                    </subparagraph>
                    <subparagraph identifier="/us/sComp/118/38/s2/c/4/B" style="-uslm-dtd:subparagraph" styleType="OLC">
                        <num style="-uslm-dtd:enum" value="B">(B) </num><content style="-uslm-dtd:text">A comparison between the final data reported under subparagraph (A) and the annual projections reported for that calendar year under paragraph (3)(A), including an explanation for any substantial variance between that final data and those annual projections.</content>
                    </subparagraph>
                </paragraph>
            </subsection>
